A Special ·Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, March 22, 1999, at 7:00 P. M. Deputy Mayor Galvis called the meeting to order and asked the City Clerk to call the roll. Present - Councilman Roger B. Mattei, Deputy Mayor Jesus R. Galvis, Councilman Mark A. Stein, City Manager James S. Lacava, I City Clerk Doris L. Dukes and City Attorney Richard E. Salkin Absent - Councilwoman Juanita Tr ammell and Mayor John F. Zisa Mrs. Dukes: "In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975 adequate notice of this meeting was provided by sending a notice to The Record and by posting a copy on the Bulletin Board in City Hall". Deputy Mayor Galvis called for a motion to hold the public hearing on the 1999 Municipal Budget. Motion offered by Stein, seconded by Mattei that the public hearing be held. Carried. Deputy Mayor Galvis asked if anyone wished to speak on the budget. There was no response. Motion offered by Stein, seconded by Mattei that the public hearing be closed. Carried. Resolution #128 OFFERED BY: Stein SECONDED BY: Mattei WHEREAS, the Planning Board of the City of Hackensack requires the services of a licensed professional Planner in connection with I the review of several land use applications presently pending before the Board; and WHEREAS, such professional services will be rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law pursuant to N.J.S.A.40A:ll-5(l)(a)(i) of the Local Public Contracts Law; and WHEREAS, it is the desire of the City Council, upon the recommendation of the Planning Board, to engage the services of Peter G. Steck, P.P., P.O. Box 306, Maplewood, N. J., 07040, to perform these services for an amount not to exceed $5,500.00; and WHEREAS, a certificate establishing that funds are available from Account #9-10-344-212 of the Current Fund, P.O. #110235 in the amount $5,500.00, has been issued by the Chief Financial Officer; and WHEREAS, the Local Public Contracts Law requires that the resolution authorizing the award of contracts for professional services without competitive bidding and the contract must be available for public inspection; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that: I (1) The Mayor and City Clerk be and they are hereby authorized and directed to execute the letter proposal dated February 1999, with Peter G. Stick, P.E., to provide said services. 25, (2) This contract is awarded without competitive bidding as a professional service in accordance with NJSA 40A:ll-5(l))a) {i) of the Local Public Contracts Law because said services are to be rendered or performed by a person authorized by law to practice a recognized profession and whose profession is regulated by law; and BE IT FURTHER RESOLVED that the City Clerk be and is hereby directed to retain a copy of the contract, upon execution, for public inspection and to publish a notice of this action once in the Record. Roll Call: Ayes - Mattei, Stein, Galvis Absent � Trammell, Zisa Resolution #129 OFFERED BY: Mattei SECONDED BY: Stein WHEREAS, N.J.S.40A-8 as amended, provides that the budget be passed by title only at the time of the public hearing if a resolution is passed by not less than a majority of the full I governing body, providing that at least one week prior to the date of hearing a complete copy of the approved budget as advertised has been posted in City Hall and copies have been made available by the City Clerk to person requiring them; and WHEREAS, these two conditions have been met; NOW, THEREFORE, BE IT RESOLVED that the budget shall be read by title only. Roll Call: Ayes - Mattei, Stein, Galvis Absent - Trammell, Zisa Mrs. Dukes advised the Deputy Mayor that the Docket was completed. Deputy Mayor Galvis called for a motion to adjourn the meeting.
