The Special Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey , on Monday , July 10 , 2000, at 6:00 P.M. Mayor Zisa called the meeting to order and asked the City Clerk to call the roll. Present - Councilmen Roger B. Mattei and Jesus R. Galvis, I Councilwoman Juanita Trammell, Deputy Mayor Mark A. Stein, Mayor John F. Zisa, City Manag er James S. Lacava, City Clerk Doris L. Dukes and City Attorney Richard E. Salkin Beth Calderone, Certified Court Stenog rapher was present and recorded the entire proceeding s. Mrs. Dukes: "In accordance with the Open Public Meeting s Act, Chapter 231, Laws of 1975 adequate notice of this meeting was provided by sending a notice to the Record and by posting a copy on the bulletin board in Hackensack". \ Mayor Zisa announced that the purpose of this meeting is to hold a hearing on an appeal filed on a decision from the Board of Adjustment. He then turned the meeting over to the City Attorney. City Attorney Salkin stated, by Resolution of the Zoning Board dated April 13, 2000, approval was g iven to an application for development of (an expansion of a non-conforming use) 164 Green Street, #61-99 - Joseph Janiero. On April 20th, �000, an appeal was filed by L. Nix. The City Clerk provided you with a copy of the transcript. As of now, it is as if there was no approval g ranted I by the Board. The Attorney explained the procedures Council must follow and their options. Mr. Salkin stated Mr. Takvorian, Attorney for Mr. Janerio is here with his client. L. Nix, is also present. He asked Mr. Takvorian if he wished to make a statement. S. Theodore Takvorian, Attorney for Joseph Janerio, said he believes the evidence submitted was sufficient. Detail questions had been asked about the use at the hearing before the Zoning Board. The City Attorney then asked Mr. Nix for his statement. L. Nix, had some photos he had taken which he tried to discuss, but was advised that he could not use any additional evidence, photos or oral. He must only refer to the information contained in the transcript. Mr. Nix continually tried to introduce new information throughout the hearing and was told it would not be accepted. I Councilman Mattei offered a motion Board's decision with the condition that the property be properly maintained. to uphold the Zoning The City Attorney advised that pursuant to the City Clerk, the ag reement between Mr. Janiero and the City specifies that the property must be maintained. This will be so indicated. The City Attorney will prepare a resolution for Council's action. Motion offered by Galvis, seconded by Trammell, that the public hearing be closed.
