WHEREAS, Michael J. Mordaga, Police Inspector, is requesting
an additional twelve (12) month leave of absence, without pay, to
serve as Chief of Detectives for the Bergen County Prosecutor’s
office; and
WHEREAS, Peter J. Capone, City Manager, has determined that
this employee be granted a twelve month Leave of Absence, as
requested, effective August 1, 2005 and terminating July 31,
2006.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of
the City of Hackensack, that Michael J. Mordaga, Police
Inspector, be granted a twelve (12) month leave of absence,
without pay, as requested; and
BE IT FURTHER RESOLVED that a certified copy of this
Resolution be forwarded to the employee’s pension system by the
Chief Financial Officer.

WHEREAS, the City of Hackensack, County of Bergen, State of
New Jersey desires to apply to the New Jersey Department of
Transportation (NJDOT) for grant funding under the Transportation
Enhancement Program; and
WHEREAS, the funds are provided under the Transportation
Equity Act for the 21st Century commonly referred to as TEA-21;
and
WHEREAS, the Hackensack Streetscape project meets all the
criteria necessary to receive funding under the Transportation
Enhancement Program; and
WHEREAS, the Hackensack Streetscape project will encourage
alternative modes of transportation, enhance the travel
experience, improve open space and smart growth, and improve the
quality of life for the residents of The City of Hackensack; and
WHEREAS, the City of Hackensack agrees to assume a
commitment for maintenance of the project after construction is
completed; and
NOW, THEREFORE, BE IT RESOLVED, that the Governing Body of
the City of Hackensack, County of Bergen, State of New Jersey
authorizes Muller Bohlin Associates to submit a grant application
to the NJDOT for funding under the Transportation Enhancement
Program for the Hackensack Streetscape.

WHEREAS, such professional services will be rendered or
performed by a person authorized by law to practice a recognized
profession and whose practice is regulated by law pursuant to
N.J.S.A. 40A:11-5(1)(a)(i) of the Local Public Contracts Law; and
WHEREAS, the Local Public Contracts Law requires that the
resolution authorizing the award of contracts for professional
services without competitive bids, and the contract itself, must
be available for public inspection; and
WHEREAS, it is the desire of the Mayor and Council of the
City of Hackensack to retain the services of James P. Patuto,
Esq., 55 State Street, Hackensack, New Jersey, to serve as
Special Counsel; and
WHEREAS, a certificate establishing that funds are available
for this contract from a designated appropriation from the 2005
budget at a rate of $80.00 per hour and shall be provided in
subsequent budgets has been issued by the Chief Financial Officer
in accordance with N.J.A.C. 5:30-14.5 of the Rules and
Regulations of the New Jersey Department of Community Affairs,
Local Finance Board;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Hackensack as follows:
1) That the Mayor and City Clerk be and they are hereby
authorized and directed to execute a contract with
James P. Patuto, Esq., 55 State Street, Hackensack, New
Jersey, to serve as Special Counsel.
2) That this contract is awarded without competitive
bidding as a professional service in accordance with
N.J.S.A. 40A:11-5(1)(a)(i) of the Local Public
Contracts Law because said services are to be rendered
or performed by a person authorized by law to practice
a recognized profession and whose profession is
regulated by law, in accordance with the provisions of
said Statute.
BE IT FURTHER RESOLVED that the City Clerk be and is hereby
directed to retain a copy of the contract for public
inspection and to publish notice of this action in The
Record.

WHEREAS, the Community Resource Council, 387 Main Street,
Hackensack, New Jersey 07601, has submitted an application to
expand its emergency helpline for $25,000.00 from un-programmed
community development block grant funds; and
WHEREAS, pursuant to the State Interlocal Services Act, and
the practices of the Bergen County Division of Community
Development, such funds may not be spent in a municipality nor
are such grant applications processed absent authorization by the
governing body of the municipality; and
WHEREAS, the applicant perceives that the project is in the
best interest of the people of Bergen County; and
WHEREAS, this Resolution does not obligate the financial
resources of the City of Hackensack and is intended solely to
expedite the processing of the application;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The City Council hereby confirms the endorsement of the
processing of the aforedescribed grant application;
2. This endorsement is not intended, nor shall it be
interpreted to express endorsement or support of any
future land use applications that the applicant may make
in connection with the proposed project.
3. This endorsement shall not be interpreted as an opinion
or belief of the legal propriety of the project, as
described in the application provided by the applicant to
the City of Hackensack.
