Roll Call: Ayes – Melfi, Sasso, Meneses, McAuliffe, Townes NO. 445 OFFERED BY: McAULIFFE SECONDED BY: MELFI _________________________________________________________________  WHEREAS, the City of Hackensack recognizes the severe plight of senior citizens with restricted incomes in meeting the monetary demands caused by ever increasing real property taxes, cost of living increases and the freeze of state aid to both municipalities and the Hackensack Board of Education; and WHEREAS, the New Jersey State Legislature has enacted at N.J.S.A. 54:4-8.67 to 54:4-8.75 the New Jersey Senior Property Tax Freeze Protection Act (“SPTFPA”) with the purpose to keep senior citizens on fixed incomes from being forced from their homes by unbearable real property tax increases; and WHEREAS, the SPTFPA took effect in 1998; and WHEREAS, eligible state resident homeowners received “Homestead Property Tax Reimbursement”, defined as the difference between real property taxes paid on a residence and the amount of the property taxes paid in the base year when the applicant enrolled in the program if the amount in the base year is the lower amount; and WHEREAS, the SPTFPA effectively freezes applicants’ real property taxes at an affordable level; and WHEREAS, the SPTFPA is available for homeowners (1) at least 65 years of age or disabled who paid real property taxes on a principal residence in New Jersey; (2) who have paid property tax or rent for at least ten consecutive years, (3) including at least three years ownership of the homestead with respect to which the tax reimbursement is sought; and WHEREAS, the amount payable to an eligible claimant in a given tax year is equal to the amount by which the person’s property tax liability for tax year 1997 (or such later tax year as the person qualifies for reimbursement under the program); and who meet certain income limits, which income eligibility limits increase annually by the amount of maximum Social Security benefit cost of living increase for that year for single and married persons respectively; and WHEREAS, the City of Hackensack strongly believes that such income limitations are insufficient to alleviate the plight of senior citizens in the City of Hackensack given the cost of living in not only Hackensack but also in many municipalities in other counties throughout throughout New Jersey, based on information available from, in part, the 2000 Consensus, the Somerset County Office on Aging and the 2004 Council on Affordable Housing Regional Income Limits; and WHEREAS, the City of Hackensack is of the opinion that such income eligibility limitations for senior citizens should be increased by the New Jersey State Legislature to enable seniors to remain in the communities they have established as their home, despite the tremendous rise in property taxes and the cost of living increases realized within many counties; NOW, THEREFORE, BE IT RESOLVED, that the City of Hackensack, in the County of Bergen, State of New Jersey, by adoption of this resolution strongly urges the New Jersey State Legislature to proceed in a diligent and expeditious fashion to enact legislation that would amend the SPTFPA N.J.S.A. 54:4-8.67 to 8.75 effectively to increase, for the calendar year 2005 and forward, the income eligibility limitations to the median regional income limits as established by the Council on Affordable Housing. BE IT FURTHER RESOLVED, that the Clerk of the City of Hackensack, is directed to forward copies of this resolution to each and every State Assemblyperson, State Senator and the Legislature will seriously and diligently consider this request for amended legislation to alleviate the struggle with the increasing burdens of real property taxes. BE IT FURTHER RESOLVED, that the Clerk of the City of Hackensack is directed to forward copies of this resolution to the New Jersey League of Municipalities, to the clerks of each municipality in Bergen County, and to the State and Local Office of AARP, to ask for their assistance in support of this legislative request. Roll Call: Ayes – Melfi, Sasso, Meneses, McAuliffe, Townes NO. 446 OFFERED BY: MENESES SECONDED BY: SASSO _________________________________________________________________ WHEREAS, the Indian Point Energy Center located in Buchanan, New York, contains two active nuclear reactors; and WHEREAS, these nuclear reactors pose an immediate significant threat to Bergen County residents living within twenty miles of the plant; WHEREAS, every Bergen County resident lives within fifty miles of Indian Point; and WHEREAS, it has been reported that the hijacked jetliners flew over Indian Point on route to the World Trade Center on September 11, 2001; and WHEREAS, the US Nuclear Regulatory Commission states that a nuclear plan meltdown could contaminate areas and cause fatal cancer in residents as far as five hundred miles from the plants; and WHEREAS, New York Governor George Pataki commissioned a report in August, 2002, to be prepared by James Witt, former head of the Federal Emergency Management Agency, to study the official regional evacuation plans; and WHEREAS, the report clearly states the plans are unrealistic and seem designed to meet specific regulatory requirements, rather than effectively protect a population; and WHEREAS, Bergen County Executive, Dennis McNerney has placed the safety and protection of Bergen County residents as his highest priority; and WHEREAS, the City Council of the City of Hackensack join County Executive McNerney in his concern for the safe operation of the Indian Point Energy Center; and WHEREAS, the Bergen County Management Team has been ordered to evaluate the dangers Bergen County residents face as a result of their proximity to Indian Point and Bergen County’s preparedness in the event of an emergency at the plant. NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of Hackensack, Bergen County, New Jersey does hereby urge the United States Nuclear Regulatory Commission and New York Governor Pataki to temporarily shutdown the Indian Point Energy Center nuclear reactors until all contingency plans outlined in the Witt Report are met; and BE IT FURTHER RESOLVED, that a copy of this resolution be sent to all seventy municipalities of Bergen County for their adoption, copies of which are to be forwarded to the office of the Governor of the State of New York, Senator Loretta Weinberg, Assemblyman Gordon Johnson, and Assemblywoman Valerie Huttle, U.S. Senator Jon Corzine, U.S. Senator Frank Lautenberg, County Executive McNerney, and the county governments of Westchester, Puttnam and Orange Counties, New York Roll Call: Ayes – Melfi, Sasso, Meneses, McAuliffe, Townes NO. 447 OFFERED BY: SASSO SECONDED BY: MENESES _________________________________________________________________ WHEREAS, the Enhanced 9-1-1 Grant provides opportunities for the City of Hackensack to upgrade, replace and purchase new equipment to efficiently process 9-1-1 calls; and WHEREAS, the City of Hackensack’s existing service is obsolete and soon to be inoperable; and WHEREAS, the City of Hackensack has identified a project for 9-1-1 system replacement; and WHEREAS, the City of Hackensack wishes to request funding under the New Jersey Office of Emergency Telecommunications Services Enhanced 9-1-1 Grant Program for the project.
