BE IT RESOLVED by the City Council of the City of
Hackensack, County of Bergen and State of New Jersey, that
Ordinance NO. 33-2006 entitled: “AN ORDINANCE PROVIDING FOR
INDEMNIFICATION FOR CITY OFFICIALS WITH REFERENCE TO DEFENSE

WHEREAS, the Mayor and Council of the City of Hackensack
(the “Mayor and Council”) are in receipt of a Resolution dated
September 12, 2006 of the Planning Board of the City of
Hackensack setting forth the reasons per its investigation as to
whether certain properties should be delineated as areas in need
of redevelopment; and
WHEREAS, the Mayor and Council have authorized and directed
the Planning Board of the City of Hackensack (the “Board”) to
conduct a preliminary investigation of the Study Area pursuant to
Resolution No. 266 dated July 11, 2006 and in accordance with
N.J.S.A. 40A:12A-1 et seq.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of
the City of Hackensack hereby adopts the findings of the Planning
Board of the City of Hackensack as set forth in their Resolution
dated September 12, 2006 and hereby delineates the properties
incorporated in same as areas in need of redevelopment.

BE IT RESOLVED by the City Council of the City of
Hackensack that Plenary Retail Consumption License No. 0223-33-
059-007 heretofore issued to Araque Campo E, 252 Main Street,
Hackensack, NJ, be transferred to Mi Tierrita Restaurant
Corporation, 252 Main Street, Hackensack, NJ, effective October
3, 2006; and
BE IT FURTHER RESOLVED that the applicant has complied with
Sub-Chapter 7 of the New Jersey Administrative Code.

WHEREAS, pursuant to N.J.S.A. 54:5-114.2(a) the City of
Hackensack, through its Tax Collector held a public sale to the
highest bidder for Tax Sale Certificate numbers 96.65, 96.66 and
96.67; and
WHEREAS, said public sale took place on Thursday, September
28, 2006 at 2:00 p.m.; and
WHEREAS, US Bank Col. Agt./Sass Muni IV DTR was the
successful bidder at said public tax sale having bid the sum of
$2,043,417.52 for said tax sale certificate; and
WHEREAS, the successful bidder has delivered to the Tax
Collector of the City of Hackensack full payment of any and all
monies required under this bid;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The City of Hackensack hereby confirms the sale of Tax
Sale Certificate numbers 96.65, 96.66 and 96.67 to US Bank Col.
Agt./Sass Muni IV DTR. .
2. The Tax Collector of the City of Hackensack shall
prepare and forward an assignment of said tax sale certificates
to the successful bidder.
BE IT FURTHER RESOLVED that a copy of this Resolution be
forwarded to the Tax Collector.

WHEREAS, the governing body of the City of Hackensack has
been advised that an emergency affecting the safety and welfare
of the citizens of the City of Hackensack and the general public
when three catch basins collapsed at Atlantic Street and
Railroad, Moore and Alley Way and Williams and Blauvelt Place
were rendered inoperable; and
WHEREAS, the Project Manager notified the City Manager
setting forth the circumstances regarding the emergency; and
WHEREAS, the governing body is satisfied that an emergency
did exist and that immediate action was necessary to restore the
aforementioned catch basins to full operation; and
WHEREAS, the cost of the repairs was $10,200.00 which was a
fair and reasonable quotation; and
WHEREAS, the Chief Financial Officer has certified that
funds are available in account 6-01-44-903-901-28G, Purchase
Order #152013;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Hackensack that pursuant to N.J.S.A. 40A:11-6 which
authorizes the governing body to award contracts without benefit
of public bidding in emergency situations and the vendor Kaycon
Construction, 75A Voorhis Lane, Hackensack, New Jersey 07601, be
paid therefore.

April 4, 2006 as a pocket license is approved for a place to

WHEREAS, the City of Hackensack requires the installation
of special type light poles to be installed in Parking Lot D;
and,
WHEREAS, Public Service Electric and Gas Company is the sole
producer of this type of light pole for Parking Lot D; and
WHEREAS, it is the desire of the Mayor and Council to
purchase this type of light pole for Parking Lot D; and
WHEREAS, a certificate establishing that funds are available
from Account No. C-05-60-X20-000-001 of the Capital Budget,
Purchase Order #152028 in the amount of $24,816.00 has been
issued by the Chief Financial Officer;
NOW THEREFORE BE IT RESOLVED that the purchase of nine light
poles be awarded to Public Service Electric and Gas at the quoted
price of $24,816.00.

WHEREAS, pursuant to an advertisement in The Record, bids
were received on September 26, 2006 for the Removal of Brushes,
Wood Chips and Tree Logs; and
WHEREAS, bids were received from Grinnell Recycling, Inc.
and Nature’s Choice Corporation; and
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Hackensack that the contract for the Removal of Brushes, Wood
Chips and Tree Logs for the City of Hackensack be awarded to
Grinnell Recycling Inc., 428 Houses Corner Road, Sparta, New
Jersey 07871 at the contract price of $515.00 per 30 yard
container.

WHEREAS, bids were received on July 6, 2006 for elevator
maintenance for the City of Hackensack from July 1, 2006 through
July 31, 2009; and
WHEREAS, bids were received from New York Elevator Inc. and
Atlantic Elevator Co., Inc.; and
WHEREAS, Resolution #269 awarded this bid to Atlantic
Elevator Co. Inc. at the contract price; and
WHEREAS, the City of Hackensack was notified that Slade
Elevator Industries, Inc. has purchased Atlantic Elevator and has
notified the City of Hackensack that the contract price received
will remain in effect through the term of the contract;
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Hackensack that the name of the vendor of elevator maintenance
be changed from Atlantic Elevator Co. Inc. to Slade Elevator
Industries, Inc.

WHEREAS, there exists in the City of Hackensack a need for
the services of a licensed New Jersey Attorney for the purpose of
special counsel for handling litigation, and
WHEREAS, such professional services will be rendered or
performed by a person authorized by law to practice a recognized
profession and whose practice is regulated by law pursuant to
N.J.S.A.40A11-5(1)(a)(i) of the Local Public Contracts Law; and
WHEREAS, pursuant to the Fair and Open Process Rule,
N.J.S.A. 19:44A-20.4 et. seq., advertisements for proposals were
published on the City of Hackensack’s Web Site and The Bergen
Record Newspaper, and proposals were received and reviewed for
the aforementioned professional services for the Year 2006 which
anticipated cost will be over $17,500 per year.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of
the City of Hackensack that:
(l) The Mayor and City Clerk be and they are hereby
authorized and directed to execute a contract with Richard
Malagiere, Esq., 407 Sette Drive, Paramus, New Jersey 07652 to
perform the aforesaid services.
(2) This contract is awarded pursuant to a fair and open
process.
BE IT FURTHER RESOLVED that the City Clerk be and is hereby
directed to retain a copy of the contract for public inspection
and to publish a notice of this action once in the Record.

WHEREAS, it is in the best interests of the City of Hackensack to appoint members to
the “Hackensack Alliance to Prevent Alcoholism and Drug Abuse,” which appointments will
benefit the residents of City of Hackensack and,
WHEREAS, it has come to the attention of the Mayor and the City Council that members
currently serving on the “Hackensack Alliance to Prevent Alcoholism and Drug Abuse” have not
been re-appointed and are therefor serving without the benefit of a set term and,
WHEREAS, it is in the best interest of the City to appoint these members to set terms.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and the Council of the City
of Hackensack hereby make the following appointments to the “Hackensack Alliance to Prevent

WHEREAS, a Bergen Community Development grant of $529,703.85
has been proposed by the Mayor and City Council for the Roadway
Resurfacing 2007 in the municipality of Hackensack; and,
WHEREAS, pursuant to the State Interlocal Services Act,
Community Development funds may not be spent in a municipality
without authorization by the Governing Body; and
WHEREAS, the aforesaid project is in the best interest of
the people of the City of Hackensack; and
WHEREAS, this resolution does not obligate the financial
resources of the municipality and is intended solely to expedite
expenditure of the aforesaid CD funds.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and the
Council of the City of Hackensack hereby confirms endorsement of
the aforesaid project; and
BE IT FURTHER RESOLVED, that a copy of this resolution shall
be sent to the Director of the Bergen County Community
Development Program so that implementation of the aforesaid
project may be expedited.
