AMENDING AND SUPPLEMENTING ORDINANCE 27-74, CHAPTER 170-7 OF
THE CODE OF THE CITY OF HACKENSACK, NEW JERSEY, ENTITLED

WHEREAS, the State of New Jersey intends to construct its Train
Preemption for Traffic Signals North II project within the City of Hackensack; and
WHEREAS, the project proposed by the State of New Jersey Department
of Transportation may require the limited use of municipal police as Traffic
Directors for work zone safety operations supplementing the traffic control plan
established under the contract for construction of the project; and
WHEREAS, the State of New Jersey Department of Transportation has
requested that the City of Hackensack enter into a Police Agreement for use of
City officers as traffic directors,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Hackensack, in the County of Bergen in the State of New Jersey, that the City
Manager, Stephen Lo Iacono, is hereby authorized to execute an agreement
between the State of New Jersey Department of Transportation and the City of
Hackensack to provide police officers as traffic directors.
The costs incurred by the City of Hackensack for use of its officers in
connection with the State construction project shall be paid directly to the City of
Hackensack by the State of New Jersey Department of Transportation pursuant
to the agreement attached hereto.
In addition, the City of Hackensack, authorizes the Chief Financial Officer,
Ross Bobal, to submit and execute State Payment Vouchers, PV-C, on behalf of
agreement signatory.

WHEREAS, statute N.J.S.A. 54:4-8 allows a permanently and totally
disabled Veteran to be 100% tax exempt; and
WHEREAS, an application must be in writing by the claimant and
submitted on Form PTD to the Tax Assessor’s office supported with documents to
substantiate all necessary qualifications; and
WHEREAS, Stanley Sinowitz, residing at 245 Prospect Avenue, Unit 19B,
Hackensack, New Jersey, having satisfied the above, determined to be a 100%
disabled veteran, is entitled to tax exemption at 100% to be prorated as of
September 23, 2008 and is entitled to receive the following refund:
2008 tax exemption prorated 9/23/08 $2,195.55
2009 tax exemption (amount paid) 3,870.00
Total refund due $6,065.55
NOW, THEREFORE, BE IT RESOLVED that the Tax Collector is directed
to cancel property taxes for Block 343 Lot 12.A assessed to Stanley and Joan
Sinowitz prorated as of September 23, 2008 in the amount of $2,195.55 and
cancel taxes for the full year of 2009 in the amount of $8,191.37 accordingly, to
reflect the disabled veteran exemption and issue a refund in the amount of
$6,065.55 to Stanley Sinowitz.

WHEREAS, the Recreation Department received a payment of $140.00
for the registration of two children in the junior track program; and
WHEREAS, the children were not able to attend this program.
NOW, THEREFORE, BE IT RESOLVED that a refund in the amount of
$140.00 be issued to Mrs. Latesha Everett, 495 Washington Avenue,
Hackensack, NJ, 07601 for the previously paid registration fee.

WHEREAS, there presently exists a road within the City of Hackensack
commonly known as McKinley Street, and
WHEREAS, Patricia Fuoco was involved in an accident on February 14,
2009 on McKinley Street in Hackensack; and
WHEREAS, Mrs. Fuoco alleges that her vehicle struck a raised sewer
grate which she alleges the City of Hackensack failed to maintain in a safe
manner; and
WHEREAS, Mrs. Fuoco’s vehicle sustained property damage; and
WHEREAS, a claim was made against the City of Hackensack for
payment of said damage; and
WHEREAS, it is in the best interests of the City of Hackensack to
amicably resolve this matter with Patricia Fuoco, and
WHEREAS, the City does not admit any liability on behalf of the City of
Hackensack.
NOW, THEREFORE, BE IT RESOLVED that the City of Hackensack is
authorized to pay Patricia Fuoco the amount of $2000.00 in full settlement of this
claim.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to
retain a copy of this resolution for public inspection.

WHEREAS, an emergency has arisen with respect to the emergency
repair of the failure in infrastructure within the City of Hackensack in the area of
Euclid Avenue, Summit Avenue and Anderson Street, and, no adequate provision
was made in the 2009 budget for the aforesaid purpose, and
WHEREAS, NJS 40A:4-46 provides for the creation of an emergency
appropriation for the purpose mentioned above, and
WHEREAS, the total amount of the emergency appropriations created,
including the appropriation to be created by this resolution is $ 630,000.00 and
three (3) percent of the total operating appropriations in the budget for 2008 is
$ 1,010,862.38 and
WHEREAS, the foregoing appropriation together with prior appropriations
does not exceed three (3) percent of the total operating appropriations (including
utility operation appropriations) in the budget for 2008.
NOW, THEREFORE, BE IT RESOLVED, that in accordance with NJS
40A:4-48:
1. An emergency appropriation is hereby made for Emergency Repair of
Infrastructure within the City of Hackensack in the amount of $ 450,000.00
2. That said emergency appropriation shall be provided for in full in the
2010 budget, and is requested to be excluded from CAPS, pursuant to
NJS 40A:4-53.3c(1).
3. That two (2) certified copies of this resolution be
filed with the Director of the Division of Local Government
Services

INTRODUCTION OF ORDINANCE NO. 25-2009, AN ORDINANCE
FIXING AND DETERMINING MUNICIPAL CLASS POSITION TITLES AND
SALARY RANGES FOR CERTAIN NON-CONTRACTUAL OFFICERS AND
EMPLOYEES OF THE CITY OF HACKENSACK.
BE IT RESOLVED that the above ordinance, being Ordinance 25-2009 as
introduced, does now pass on first reading and that said Ordinance shall be
considered for final passage at a meeting to be held on September 15, 2009 at
7:00 p.m. or as soon thereafter as the matter can be reached at the regular
meeting place of the City Council and at such time and place all persons
interested be given an opportunity to be heard concerning said Ordinance and
that the City Clerk be and she is hereby authorized and directed to publish said
ordinance according to law with a notice of its introduction and passage on first
reading and of the time and place when and where said ordinance will be further
considered for final passage.
