City Council

The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday, February 21, 2012, at 8:00 p.m. Mayor Meneses called the meeting to order and City Clerk, Debra Heck, stated: “In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and the County Seat and by posting a copy on the Bulletin Board in City Hall”. Mrs. Heck called the roll: Present – Mayor Jorge E. Meneses, Deputy Mayor Michael R. Melfi, Councilwoman Karen K. Sasso, Councilman John P. Labrosse, Councilman Marlin G. Townes, City Attorney Joseph C. Zisa and City Manager Stephen Lo Iacono. Mayor Meneses asked everyone to stand for the flag salute. A motion was made by Councilwoman Sasso and seconded by Councilman Townes to approve the minutes of the January 3, 2012, January 9, 2012, February 6, 2012 and February 7, 2012 meetings. A motion was made by Councilman Townes and seconded by Councilman Labrosse to approve the minutes of the January 17, 2012 meeting. Councilwoman Sasso abstained. City Manager’s Report – Mr. Lo Iacono spoke briefly about the disaster relief employment program which had afforded the City six employees and the tasks that were assigned to same. He said that the program will come to an end this month. Mr. Lo Iacono advised that there is a resolution on the docket this evening pertaining to a program that the State chose the Health Department to participate in. The grant will provide the City with equipment to do blood tests on children for lead poisoning. Much of the credit goes to John Christ, as he is regarded as one of the premier health officers of the State. Mr. Lo Iacono gave an update on the Main Street Rehabilitation Program and said that the fourth and fifth elements are close to being presented to the Council within the week. He also said that the committee has a schedule that is pretty aggressive. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack, County of Bergen and State of New Jersey, that Ordinance No. 4-2012 has passed its second and final reading and is hereby adopted. Roll Call – Ayes: Labrosse, Townes, Sasso, Melfi, Meneses 2/21/12  ORDINANCE 4-2012 AN ORDINANCE AMENDING CHAPTER 175 OF THE CODE OF THE CITY OF HACKENSACK, ENTITLED “ZONING ORDINANCE AND MAP” WHEREAS, in order to effectuate portions of the City’s Master Plan, the City may from time to time re-zone certain lots / blocks provided that the ordinance is enacted to advance the general welfare and is consistent with the planning objectives of the City’s Master Plan and / or Re-Examination Report; and WHEREAS, as of the date hereof, Block 531.01 Lot 1; Block 527 Lot 5.02, and Block 532.02 Lot 1, as designated on the official tax map of the City of Hackensack (hereinafter “the Property’), is currently used by the County of Bergen as a County Police Headquarters and County DPW Facility; and WHEREAS, the City’s Master Plan Re-Examination Report, dated July 8, 2009, identifies the subject property of potentially becoming available as a “redevelopment opportunity area” and, thus, furthering the objectives of the City’s 2001 Master Plan, that being to assist in the rehabilitation of areas in need of improvement and upgrading (See p. 4 of the City’s Master Plan Re-Examination Report, dated July 8, 2009); and WHEREAS, the said Re-Examination Report specifically identifies the redevelopment potential of the Property as being a goal and objective for the City’s current Master Plan (See p. 16 of the City’s of the City’s Master Plan Re-Examination Report, dated July 8, 2009); and WHEREAS, as currently developed, the Property is prone to flooding, has been developed overtime in a inefficient utilization of the Property and its structures can no longer support the uses contained therein and, thus, the rezoning of the Property to facilitate its redevelopment would promote the general welfare. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Hackensack, in the County of Bergen and State of New Jersey, that Chapter 175 of the Code of the City of Hackensack, entitled “Zoning Ordinance and Map” is hereby amended, supplemented and revised as follows: Article III. Establishment of Districts; Zoning Map. Section 175-3.4 is hereby added to read as follows: 175.3.4 REZONING OF CERTAIN LOTS / BLOCKS A. In order to effectuate portions of the City’s Master Plan, the City may from time to time re-zone certain lots / blocks provided that the ordinance is enacted to advance the general welfare and is consistent with the planning objectives of the City’s Master Plan and / or Re-Examination Report. 1. Block 531.01 Lot 1; Block 527 Lot 5.02 and Block 532.02 Lot 1, Said Property shall be re-zoned and designated as being within the B-2 Zoning District and the Principal Permitted Uses, Accessory Uses, Conditional Uses, bulk requirements and other requirements / restrictions shall be as set forth in the “Schedule of District Regulations – B-2 District” as set forth elsewhere in Chapter 175. If any part or parts of this Ordinance for any reason is held to be invalid, such adjudication shall not affect the validity of the remaining portions of this Ordinance. All Ordinances or parts of Ordinances, which are inconsistent herewith are repealed, but only to the extent of such inconsistency. The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the City is increased by the authorization of the Refunding Bonds provided in this refunding bond ordinance by $550,000, and that an amount representing the principal amount of the Refunded Bonds equal to $485,000 will be deductible from gross debt. Roll Call – Ayes: Labrosse, Townes, Sasso, Melfi, Meneses 2/21/12  A motion was made by Deputy Mayor Melfi and seconded by Councilman Townes to open the meeting to the public. Doreen Davis, 192 Stanley Place, spoke about metered parking on Main Street and said that there should be more time on the meters. She also asked why only quarters are permitted and if the sign on the corner of First and Stanley Place was pushed back. Kathy Canestrino, 37 Brook Street, asked for an update on the televising of council meetings. She also spoke about towns in Bergen County moving their Board of Education elections to November. Mrs. Canestrino asked if the resolution regarding excess funds means that the City is closing out its 2011 books. Mr. Lo Iacono said that there is only one more month that transfers can be done. Mayor Meneses said that televising of council meetings was discussed at the COW meeting and that there is one more option that needs to be researched. Mr. Zisa reminded everyone that if the cost of doing so is in excess of $17,500 then the service would need to be put out for bid. Mayor Meneses said that the rescheduling of elections has not been discussed lately and that he hasn’t spoken to the Board of Education. The Mayor did say however that last time there had been no interest in moving the municipal election to November. Regina DiPasqua, Parker Avenue, asked what the purpose of the employment agreement (Resolution 77-12) with the City Manager is. Mr. Zisa said that this had never been done and that the Council thought there should be an employment agreement with him. Ms. DiPasqua asked if it is a public document and Mr. Zisa said that he is pretty sure that it is. Ms. DiPasqua also spoke about Mrs. Sasso’s billboard and said that it is not legal. Emil Canestrino, 37 Brook Street, said that the County has a state of the art facility for a communications center and asked if the Council has any interest in this. Mr. Lo Iacono said that he has had a discussion with the County about it but that the City was not approached. Mr. Canestrino asked if the City’s proposed communications center will have these same capabilities. Mr. Lo Iacono advised that the command center will have a communications center but that there are no plans to use it other than for an emergency response center. A motion was made by Councilwoman Sasso and seconded by Councilman Townes to close the public portion of the meeting. Councilman Labrosse said that he wanted to acknowledge the passing of Mary Ann Lamber this week. He also asked with reference to Mr. Canestrino’s question if the City could upgrade its communication equipment and bring in other towns. Councilman Townes advised that he had attended the Blue and Gold dinner for Pack 5 this weekend and said that it was a really nice function.
