The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday, October 2, 2012, at 8:10 p.m. Mayor Melfi called the meeting to order and City Clerk, Debra Heck, stated: “In accordance with the Open Public Meetings Act, Chapter 231, Laws of 1975, adequate notice of this meeting was provided by sending a notice to The Record and the County Seat and by posting a copy on the Bulletin Board in City Hall”. Mrs. Heck called the roll: Present – Mayor Michael R. Melfi, Deputy Mayor Marlin G. Townes, Councilwoman Karen K. Sasso , Councilman John P. Labrosse, Councilman Jorge E. Meneses, City Attorney Joseph C. Zisa and City Manager Stephen Lo Iacono. The approval of minutes was held for the next meeting. City Manager’s Report – Mr. Lo Iacono spoke about the Upper Main Alliance Street Fair which is being held on Saturday, October 6, 2012 and also a resolution which is on the docket tonight that will formalize our arrangement with the County of Bergen regarding reverse 911. A motion was made by Councilman Meneses and seconded by Councilwoman Sasso to remove resolutions 336-12, 337-12 and 338-12, which contain Ordinances 21- 2012, 22-2012 and 23-2012 from the docket. The annual fees for licenses issued pursuant to this chapter shall be as provided in Chapter 107, Licenses and Permits. B. Duration. All licenses issued under this chapter shall expire on July 1 of each year. C. Usage. At least 60% of taxi licenses held by the same person must be active for a minimum of six months or the unused portion of the taxi licenses will not be eligible for renewal and will thus expire. Section II It is the express intent of this Ordinance to require that 60% of taxi owner’s licenses held by one person be active for a minimum of six months or the licenses will not be eligible for renewal and thus will expire. Furthermore, this amendment is to be effective as to all previously issued taxi licenses issued in the City of Hackensack. Section III If any part of this Ordinance is held to be invalid, such adjudication shall not affect the validity of the remaining portions of this Ordinance. Section IV This article shall become effective immediately upon its final passage and publication as required by law. This Ordinance shall take effect after publication of a Notice of Final Adoption as required by law. BE IT ORDAINED, by the City Council of the City of Hackensack, in the County of Bergen and State of New Jersey, as follows: Section I Chapter 155-8 “Requirements for issuance” is amended as follows: A. Taxi owner’s license. a. Taxi owners’ licenses shall be issued upon the payment of the appropriate fee. b. No taxi owner’s license shall be issued until the vehicle proposed to be licensed shall have been inspected and approved in writing by the Chief of Police. c. No taxi owner’s license shall be issued for any vehicle with less than three doors, at least two of which doors shall be for the exclusive use of passengers. d. The correct name, business address and taxi license number issued by the Chief of Police shall be displayed on both sides of the taxicab in letters no smaller than three inches nor more than six inches in height. B. Taxi driver’s license a. Taxi drivers’ licenses shall be issued upon the payment of the appropriate fee. b. (2) i. Be at least 18 years of age. ii. Be of sounds physique with good eyesight and not subject to epilepsy, vertigo, heart trouble or any other infirmity of the body or mind which might render him unfit for the operation of a taxicab. iii. Be able to read and write the English language. iv. Furnish satisfactory evidence that he has been the holder for at least one year immediately prior to the date of application of a valid New Jersey automobile driver’s license. v. Be clean in dress and person and not addicted to the use of intoxicating liquors or drugs. vi. Be of good character. vii. Be a citizen of the United States. viii. Have been a resident of the State of New Jersey for at least one year. ix. Affirm that he or she has never been convicted in any state of a high misdemeanor or a violation of this chapter or any prior ordinance of the city relating to taxicabs. C. Limit on the number of taxi licenses held by one person. No one person shall be authorized to hold more than twenty-five (25) taxi licenses at one time. Section II It is the express intent of this Ordinance to require that no more than twenty-five taxi licenses be held by one person at one time. Furthermore, this amendment is to be effective as to all previously issued taxi licenses issued in the City of Hackensack. Section III If any part of this Ordinance is held to be invalid, such adjudication shall not affect the validity of the remaining portions of this Ordinance. Section IV This article shall become effective immediately upon its final passage and publication as required by law. Roll Call: Ayes – ORDINANCE 23-2012 AN ORDINANCE AMENDING CITY ORDINANCE 2-82 CHAPTER 155-3, SCHEDULE A, “LICENSES REQUIRED” TO INCREASE THE NUMBER OF TAXI OWNER’S LICENSES THAT MAY BE ISSUED AT ANY TIME FROM 25 TO 50 AND TO AUTHORIZE THE CITY TO HOLD A PUBLIC AUCTION TO ISSUE TAXI OWNER’S LICENSES. BE IT ORDAINED, by the City Council of the City of Hackensack, in the County of Bergen and State of New Jersey, as follows: Section I Chapter 155-3 “Licenses required” is amended as follows: A. Taxi owner’s license. a. No person shall transport any passenger for hire in any public taxicab, cab, hack, automobile, or other motor vehicle unless said vehicle is licensed in accordance with the provisions of this chapter and Chapter 107, Licenses and Permits. The license required by this subsection shall be known as a “taxi owner’s license.” b. The total number of taxi owner’s licenses that may be issued and outstanding at any time pursuant to and in conformity with this chapter is hereby fixed at 50. Unless and until the number of existing taxi owner’s licenses is reduced to less than 50, no new taxi owner’s licenses shall be issued. c. Method for issuing new taxi licenses. Newly created and newly available taxi licenses shall be issued pursuant to the authority granted to the municipality under N.J.S.A. 48:16-2.1 and N.J.S.A. 48:16-2.3. When the municipality determines by ordinance the number of taxi licenses available for issuance, it shall follow the procedures specified herein: 10/2/12  i. Notice. 1. Publish a notice, in a newspaper circulating generally within the municipality, stating the number of new or additional licenses to be authorized and the application period for the new or additional licenses. 2. The notice shall specify a time and date after which no further applications will be accepted. 3. The notice shall be published at least 30 days prior to the time and date specified in the notice as the time and date when no further applications will be accepted. ii. Procedure. 1. Public auction. Whenever the municipality determines by ordinance to issue one or more taxi licenses, it may authorize such license(s) to be issued to the highest qualified bidder at a sale by public auction which is conducted by or supervised by the municipal clerk. a. Minimum bid. The minimum bid for a taxi owner’s license shall be $100.00. b. The municipality reserves the right to reject all bids where the highest bid is not accepted. 2. Reimbursement for public notice. The recipient(s) of a taxi license issued pursuant to this section shall reimburse the municipality for any costs incurred by the municipality in complying with the public notice requirements established pursuant to section (A)(3)(i). The cost of the public notice shall be set at $25.00 per taxi license issued. B. Taxi driver’s license. No person shall transport any passenger for hire in any taxicab, cab, hack, automobile or other motor vehicle or drive or operate any such vehicle designed for the transportation of passengers for hire unless such person shall have secured a license for said purpose pursuant to the provisions of this chapter and of Chapter 107, Licenses and Permits. The license required by this subsection shall be known as a “taxi driver’s license.” Section II It is the express intent of this Ordinance to increase the number of taxi owner’s licenses that may be issued at any time from 25 to 50 and to authorize the city to hold a public auction to issue taxi owner’s licenses. Furthermore, this amendment is to be effective as to all previously issued taxi licenses issued in the City of Hackensack. Section III If any part of this Ordinance is held to be invalid, such adjudication shall not affect the validity of the remaining portions of this Ordinance. Section IV This article shall become effective immediately upon its final passage and publication as required by law. This Ordinance shall take effect after publication of a Notice of Final Adoption as required by law. Fee- $10 Section II It is the express intent of this Ordinance to: modify the fees charged by the Department of Vital Statistics for a correction, other than an administrative error correction, of a birth certificate, marriage record, civil union, or domestic partnership; to modify the fees charged by the Health Department for administration of non-Medicare reimbursed vaccines; and to set the fee charged for the administration of state or federally supplied vaccines to non-Hackensack resident adults. Roll Call: Ayes – Labrosse, Townes, Sasso, Meneses, Melfi ORDINANCE NO. 27-2012 AN ORDINANCE TO AMEND AND SUPPLEMENT SECTION I OF CHAPTER 32 OF “THE CODE OF THE CITY OF HACKENSACK, NEW JERSEY,” ENTITLED “POLICE DEPARTMENT…ESTABLISHMENT OF THE POLICE DEPARTMENT” BE IT ORDAINED by the Mayor and Council of the City of Hackensack that Section 1 of Chapter 32 of “The Code of the City of Hackensack, New Jersey,” be repealed in its entirety, and the following be substituted therefor: POLICE DEPARTMENT – CHAPTER 32 32-1 Establishment of the Police Department There is hereby created in and for the City of Hackensack, a Police Department, as follows: 1. Sworn Officers. One (1) Chief of Police, One (1) Deputy Chief, Five (5) Captains, Nine (9) Lieutenants, Eighteen (18) Sergeants, and a maximum of Eighty (80) Police Officers, to be appointed to these positions by the City Manager with the budgetary approval of the City Council, as public need may require. 2. Civilian. A. Communication operators, mechanics, parking meter repairers, parking meter collectors and repairers, school traffic guards, office-clerical personnel and such other titles as may be established. B. Director of Police. (i) Establishment. At any time when (a) by operation of law there exists a vacancy in the position of Chief of Police; or (b) the City Manager reasonably anticipates that the Chief of Police will be unable to perform his statutory duties for a period exceeding ninety (90) days, the City Manager may appoint a person to be designated as the ‘Director of Police’, to serve at the pleasure of the City Manager, as herein provided. (ii) Said Director of Police, if appointed, shall assume and be vested with all powers and duties allowable under this ordinance and under N.J.S.A. 40A:14-118 to a Chief of Police. (iii) The compensation of said ‘Director of Police’ shall be set by a duly executed Contract by and between said person and the City of Hackensack, the duration of which shall not exceed one (1) year, or by adoption of a salary ordinance. 10/2/12  (iv) The position of the Director of Police may be terminated by the City Manager on thirty (30) days notice. 3. Special Law Enforcement Officers. The City of Hackensack hereby establishes Special Law Enforcement Officers pursuant to and in compliance with the Special Law Enforcement Officers Act (N.J.S.A. 40A:14-146.8 et seq.) A. Special Law Enforcement Officers shall not be utilized to supplant regular Police Officers on City assigned extra-duty assignments. B. Special Law Enforcement Officers are subject to the personnel policies of the City of Hackensack. C. Special Law Enforcement Officers are subject to the City of Hackensack Police Department’s Rules and Regulations, and Written Directive System, where applicable. This Ordinance shall take effect after publication of a Notice of Final Adoption, required by law. Roll Call: Ayes – Labrosse, Townes, Sasso, Meneses, Melfi NO.369-12 OFFERED BY: LABROSSE SECONDED BY: SASSO WHEREAS, the governing body of the City of Hackensack has been advised that an emergency affecting the safety and welfare of the citizens of the City of Hackensack and the general public existed when emergency repairs were needed for the Sewer Department’s Vac-All #276; and WHEREAS, the Director of Sanitation notified the City Manager setting forth the circumstances regarding the emergency; and WHEREAS, the governing body is satisfied that an emergency did exist and that immediate action was necessary to restore the aforementioned; and WHEREAS, the total cost of the repair was $16,278.95, which was a fair and reasonable quotation; and WHEREAS, the Chief Financial Officer has certified that funds are available in Current account 2-01-26-311-311-273. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Hackensack that pursuant to N.J.S.A. 40A:11-6 which authorizes the governing body to award contracts without benefit of public bidding in emergency situations that the vendors, Pierce Eagle Equipment Company, 3388 Route 22 West, Branchburg, NJ, 08876, be paid therefore. Koteen Associates, Inc., performed such audit on behalf of the City of Hackensack and obtained a credit in the amount of $59,990.38 and the consulting service fee is $29,995.19; and WHEREAS, the fee for the Utility Rate Consulting Service for the PSE&G holiday lights for the City of Hackensack is hereby recognized as extraordinary in 5:3014C promulgated by the Local Finance Board, Division of Local Government Services, Inc .; and NOW THEREFORE BE IT RESOLVED that the invoice submitted by George A. Koteen Associates, Inc., Utility Rate Consultants, 290 Queen Anne Road, Teaneck, NJ, 07666, be accepted and awarded in the amount of $29,995.19. 10/2/12  BE IT FURTHER RESOLVED that the Chief Financial Officer has certified that funds are available in the current account 2-01-31-435-435-246 which is also where the credit will be recorded. Roll Call: Ayes – Labrosse, Townes, Sasso, Meneses, Melfi NO.371-12 OFFERED BY: LABROSSE SECONDED BY: SASSO ____________________________________________________________________________________ BE IT RESOLVED, by the City Council of the City of Hackensack that the proper officers be and are hereby authorized to make the following refunds for the reasons stated: AMOUNT BLOCK LOT NAME YEAR REASON $1,739.06 82.01 4.02 Wells Fargo Home Mtg 2012 Over Pymt For Nelson Lee 1 Home Campus MAC X2302-04D DesMoines, IA 50328 Roll Call – Ayes: Labrosse, Townes, Sasso, Meneses, Melfi NO. 372-12 OFFERED BY: LABROSSE SECONDED BY: SASSO ________________________________________________________________ WHEREAS, there exists a need for the County of Bergen, Office of Emergency Management, Department of Public Safety to provide an automated telephone alerting system service (hereinafter called “system”) to be available 24 hours a day, seven (7) days a week, and all days per year to the seventy (70) Municipalities comprising the County of Bergen; and WHEREAS, the Bergen County Board of Chosen Freeholders adopted Resolution No. 250-12 on March 07, 2012, authorizing the County to award a purchase contract to Swiftreach Networks, 14 Industrial Avenue, Suite 4, Mahwah, New Jersey 07430 (hereinafter known as the “service provider”) to provide the above-referenced system to those municipalities so desiring; and WHEREAS, the City of Hackensack wishes to utilize such a system for the benefit of its citizens; and WHEREAS, an agreement is necessary to delineate the respective responsibilities of the parties in connection therewith; and WHEREAS, the County shall pay 100% of the cost of initial installation, testing of the system, 100% of the cost of the annual maintenance, testing and training of the system, 100% of the call fees for emergency calls using the Emergency Services Listing and non-emergency calls using municipally-provided lists. 10/2/12  NOW, THEREFORE, BE IT RESOLVED, that the City of Hackensack be and is hereby authorized to enter into an Agreement with the County of Bergen to utilize an automated telephone alerting system services at any time during the County’s contract period with the service provider (April 07, 2012 through April 06, 2013) with an option for one (1) additional year; and BE IT FURTHER RESOLVED, that the Mayor of the City of Hackensack be and is hereby authorized to execute said agreement in a form to be approved by the City of Hackensack’s attorney. Roll Call - Ayes: Labrosse, Townes, Sasso, Meneses, Melfi NO. 373-12 OFFERED BY: LABROSSE SECONDED BY: SASSO ________________________________________________________________ BE IT FURTHER RESOLVED, that the Mayor and Council of the City of Hackensack reviewed the CY 2012/SFY 2013 Best Practice Checklist at the public Committee of the Whole meeting held on October 2, 2012 Roll Call - Ayes: Labrosse, Townes, Sasso, Meneses, Melfi A motion was made by Councilman Meneses and seconded by Councilwoman Sasso to open the meeting to the public. Regina DiPasqua, Parker Avenue, spoke about the creation of the taxi license ordinances and said that the City should get a refund on legal fees for same. Ms. DiPasqua also asked whether or not Councilwoman Sasso had left the room during the closed session when Ms. DiPasqua’s case was discussed and she was told yes. With reference to the Atlantic Street park, Ms. DiPasqua said that she hoped that the Council would continue to work with business owners and not call them “obstructionists”. Kathleen Salvo, 184 Hudson Street, said that building the new park is an obsession with the Council and also spoke about the Police depot which she said never has a light on in it. She asked if the City is paying for the whole building and said that a camera is needed in the area. Ms. Salvo also said that HUMC should not be sending any bills for ambulances. Mr. Lo Iacono said that everything Ms. Salvo had said is her opinion. Emil Canestrino, 37 Brook Street, spoke about the police director ordinance and asked for the criteria for choosing this person. Mayra, 21 Frederick Street, asked if there had been a final decision on the taxi licenses. Perry Jackson, Park Street, said that the Riverkeeper is a very good concept and also that City revitalization is important. He also thanked everyone for doing an excellent job. Joseph Steiner, Maywood, spoke about the recent court case involving Chief Zisa. Steve Gelber, 304 Clinton Place, said that he agrees with Mr. Steiner’s comments but knows that the Council had been told many times about the situation. As no one else wished to be heard, a motion was made by Councilman Meneses and seconded by Councilwoman Sasso to close the public portion of the meeting at 8:40 p.m. and also to return to closed session in order to finish the meeting. 10/2/12  _____________________________ Mayor Michael R.
