The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday, September 1, 2015 at 8:00 p.m. Mayor John Labrosse Jr. called the meeting to order and the City Clerk Deborah Karlsson announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall. Attendance Ms. Karlsson called the roll: Mayor John P. Labrosse Jr., Deputy Mayor Kathy Canestrino, Councilman Leonardo Battaglia, Councilman Jason Some and Councilman David Sims were present. City Manager’s Report The City received a grant from F.E.M.A. for $21,546. The City will have a 10% match to that. Building Department Updates: 106 notices, 96 inspections, 40 property compliance, 8 C.C.O., 9 sidewalk inspections, and 9 summonses written. More people are attending the Open Swim Night at the high school. We would like to see the attendance rise. School is starting. We’d like to remind you, especially from the Police Department, to be aware of traffic, school buses and pedestrians. Do not park in fire zones or in front of fire hydrants, do not double park, do not drop children off on the opposite side of the road or let them run across the street. Concerts will be held at the Atlantic Street Park during lunch time on Fridays in September. Local restaurants have agreed to deliver preordered lunches to the park. 9/1/2015 1  The Council is looking to enter into two redevelopment agreements regarding 210-214 Main Street and 150-170 Main Street at the next Council Meeting. Brian Nelson should be here. The Annual Fill the Boot Drive is being hosted by the Fire Department on September 5, 2015. It is for Muscular Dystrophy. Located at 450 Hackensack Avenue, from 9am to 2pm. September is National Hunger Month. Shoprite is hosting a Help Bag Hunger on September 16th. You can buy a bag of groceries and leave it. Shoprite of Hackensack has been a City sponsor for many years. Double garbage pick-up ends on September 1 st, however, we will continue to maintain the routes we have designated previously. I will be reporting the possibilities and restraints of this to the Council. It shall be unlawful for any person engaged in the business of selling or offering to sell ice cream, ice cream products, water ices or such frozen confectionary products to park any vehicle within the lines of any public street, road or other public place for the purpose of engaging in such business for a period longer than 15 minutes. No such vehicle used for conducting the business aforesaid shall be parked within 500 feet of any public or private school 1 hour before the opening of school or 1 hour after the closing of school, nor shall any such vehicle be parked within 500 feet of any public or private event where food or refreshments are sold during the time the event occurs. CITY OF HACKENSACK ORDINANCE NO. 45-2015 AN ORDINANCE AMENDING PART I, ENTITLED “ADMINISTRATIVE LEGISLATION” OF THE CITY OF HACKENSACK MUNICIPAL CODE, TO ADD CHAPTER 7, ENTITLED “ACCESS TO ALL ADVISORY BOARD.” WHEREAS, pursuant to N.J.S.A. 40:81-10, a municipal council may create and determine and define the powers and duties of such executive and administrative departments, boards, and offices, that it deems necessary for the proper and efficient conduct of the affairs of the municipality; and WHEREAS, the City of Hackensack (“City”) is committed to meeting the needs of residents and other individuals within the City who have disabilities; and WHEREAS, the City has determined that the interests of the City will be served by creating an Access to All Advisory Board that will keep the City Council informed of developments regarding people with disabilities; advise, recommend, and arrange ceremonies honoring people with disabilities; and respond to any ordinances introduced by the City Council that may have an impact upon people with disabilities; and WHEREAS, the City of Hackensack (“City”) wishes to amend Part II of The City of Hackensack Municipal Code entitled “General Legislation,” to add Chapter 7 entitled, “Access to All Advisory Board”; and NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: SECTION 1. Part I, entitled “Administrative Legislation,” is amended to add Chapter 7, entitled “Access to All Advisory Board,” such that The City of Hackensack Municipal Code, Part I entitled “Administrative Legislation,” states: Chapter 7: ACCESS TO ALL ADVISORY BOARD §7-1 Establishment There is hereby established, within the City of Hackensack, an Access to All Advisory Board. §7-2 Purpose 9/1/2015 10 The purpose of the Board shall be to advise the Mayor and Council of the City of Hackensack with regard to the needs of residents and other individuals within the City who have disabilities and to advise the Mayor and Council with regard to compliance with laws and regulations concerning individuals with disabilities. Without limiting the powers and purposes of the Board, the Board shall: A. Undertake such efforts as are necessary to improve community awareness as to the needs of residents with disabilities. B. Propose measures that will promote a physically accessible environment within the City. C. Communicate the City's willingness to attract persons with disabilities and promote public outreach programs designed to foster such communication. D. Develop ways to integrate residents with disabilities into all aspects of community life within the City. E. Encourage cooperation and coordination with other organizations within the City in an effort to achieve the goals and objectives of the Board. §7-3 Membership; terms; compensation The membership of the Board shall consist of five persons who are residents of the City. At least two of the members shall be either persons with disabilities, parents of children with disabilities, or a resident family member who is a caregiver of a person with a disability. The members of the Board shall be appointed the City Manager with the advice and consent of the Mayor and Council. The Board members first appointed shall be appointed for the following terms: two members for three years, two members for two years and one member for one year. Following the initial appointments, all appointments shall be for three years, and vacancies shall be filled for the unexpired term only. The members shall receive no compensation for their services. With the exception of the Board members first appointed, the terms of office of each appointee shall commence on the first day of January and shall expire on the 31st day of December of the appropriate years. The Board members first appointed shall also serve from the date of their respective appointments through and including December 31, 2015, at which time the term of years of their full appointments shall commence. §44-3 Organization With the exception of the Chairperson, who shall be designated annually by the City Manager, the Board shall choose its own officers, make its own rules and regulations for the discharge of its duties and for the proper exercise of the powers conferred upon it by the Mayor and Council, and keep a record of its proceedings. The Chairperson shall serve as a liaison between the Board and the City Council. The Board shall meet at least quarterly, but as frequently as may be required in its rules and regulations and as circumstances may require. §44-5 Attendance; removal In the event that any member of the Board shall miss three consecutive meetings, the Board shall report said absences to the Mayor and Council. If the Mayor and Council, after due inquiry, are satisfied that the absences where not occasioned by reasonable cause, the Board Member may be removed by resolution of the Mayor and Council. Attorney Visconi responds no official action. Regina Dipasqua- Parker Avenue- The garbage is a mess. I called the City Manager’s office and I asked is twice a week pick up city wide. I was told yes it was and then I was transferred to the DPW. Melanie was out and Denise called me back and said no they must have been confused by the address you gave them and I said I didn’t give an address. The Elks are getting it picked up twice a week. Is it fair to the residents that we don’t get twice a week garbage pickup? This has been happening for a month now that only certain parts of the City are getting twice a week. Mayor comments on garbage pickup. So our money isn’t as good but you want it quicker than you did before. Mayor comments on garbage pickup situation. Mr. Troast just said it is being discussed to continue it as it is because of redevelopment. Mayor comments it is just being discussed. It is not your neighbored or mine it is not residential, those are mix used areas. Our money is not equal and redevelopment is more important. City Manager comments. Kathleen Salvo- Hudson Street- We are being discriminated against. We thought you meant first ward Hudson Street. It doesn’t take any more effort it should be twice a week, you did it for Maywood. We have a contract to we pay taxes. Everyone in the City should get twice a week pickup. Why can’t you guys buy a garbage truck? That truck is pathetic and nothing lasts for 25 years. To give our men these trucks to fix it’s pathetic. Just buy us one good truck why can’t you buy us one truck. They look like they should be junked. It isn’t fair and you haven’t fixed it in two years and my neighborhood is gross. Come in the neighborhood Mr. Troast and see the volume of garbage. Getting back to Atlantic Street Park, I counted thirty lights there the other night, we are paying public service for these lights for no reason at all. They should be on sets so we can put them as needed. Mayor comments on lights. There are way too many trees and way too much for our men to handle. The front of that building is dangerous, it’s a right of way and we should have not satisfied the handicapped parking spaces by putting them in front of that building. It needs to go back to a left turn lane only. City Manager comments on parking spaces. Richard Cerbo- Spring Valley Avenue- Paving the streets Is physical, teaching picking up garbage is physical, teaching school is physical, all these things are physical so it’s good, we need to act and get things done we can do better though I think. Have you made any progress by persuading our county communities to contribute to our service City. I thought that was something you were interested in Mr. Mayor. It’s our service to all of Bergen County maybe they could contribute. I wanted to ask about the County and the hospital, about giving more to Hackensack. Would it be better to contribute to us, the hospital is a great institution and they have done great things there. I turn the news off because it’s awful but it’s mostly about immigrants. It’s an awful discussion about it. Don’t forget Mexico was once a part of this country. I think it’s time to lay off the Mexicans in the news. Thank you very much. Victor Sasson- Euclid Avenue- I never understood the twice a week garbage collection. We do a lot of recycling in my house, we started composting this year ourselves. It just seems like a waste of municipal funds people can conserve and recycle more. A couple of months ago I appeared here to talk about my concerns with the Board of Education but since then nothing has changed. One of the most disturbing things was the 29 Ipads and chrome books that were stolen from the Hackensack Public Schools in 2014 and only two were recovered and those two were traced back to a teacher’s house. That teacher still hasn’t been charged. I have yet to hear anything about the schools from them. One of them, the president of the Board of Education will be running for council, what record does he have on the board of Education that has the nerve to run for council, what has he done for the City I have yet to hear anything about it. Thank you. Joe Borretto- Poplar Avenue- Mr. Sasson if you have any issues with the Board of Education you should come to the meetings, we just had one earlier this evening. If there are any complaints please come and bring your complaints to us. I thank you council. A motion to close the meeting to the public was offered by Councilman Battaglia and seconded by Councilman Some. Council Comments Councilman Battaglia- The problem in DPW is getting better. The trucks are running and we got the second shift working. I suggest we do the second pick up city-wide until the end of November and then do a second pick up for the areas with more garbage. The issue with PSE&G is going to be a few more months, but the benefit is going to be great. I was in a meeting where we discussed the coordination of when they are going to pave which streets according to the list of streets the City wants to work on further. Thank you. Deputy Mayor Canestrino- I have to agree. A fine and efficient job has been done to the streets that have been fixed. Thank you for saying something positive Ms. Davis. The garbage was a suggestion brought forward to the Council and it was just a discussion. I don’t even remember twice-a-week garbage. I am hoping we can look at a time frame that makes sense. We have close to ten trucks running now and are no longer picking up Maywood’s garbage. If we do it, we should do it for the entire City. Thursday night is our last movie night. Come out and see it. School is starting and the kids will be on the streets. Please be extra careful. Ms. Davis, thank you so much for the comments about the paving. The Deputy Mayor discussed the garbage issue. Last year we were able to do twice a week pick up and manage Maywood’s garbage, except this year we were down on some truck and personnel and had some glitches. The summer concert series went well. It is campaigning season. Try to keep the campaigning outside this room. Not saying you cannot beat us up or say what you want to say. I am looking forward to the new building being up and running so the Hackensack Theater Group won’t have to deal with any more noise complaints. Buying a new garbage truck is not out of the question. The men haven’t maintained the trucks properly. The last thing we want to do is buy a new truck and have it end up like the other ones in two years. The twice-a-week pick up is more for the smell of garbage than the volume of garbage. Large volumes of garbage at four family apartment buildings might be a zoning issue if there is overcrowding. That is a problem to look into. Ms. DiPasqua, earlier in the night you mention someone dying on Jackson Ave. I was not aware of that. That is not the reason why making Franklin Ave. a one-way street was brought to me. It was because of the trucks turning. Enjoy the three-day weekend. Get home safe and thanks for coming.
