The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, April 18, 2016 at 8:05 p.m. Mayor John Labrosse Jr. called the meeting to order and the City Clerk Deborah Karlsson announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall. Attendance Ms. Karlsson called the roll: Mayor John P. Labrosse Jr., Deputy Mayor Kathy Canestrino, Councilman Leonardo Battaglia, Councilman David Sims and Councilwoman Deborah Keeling-Geddis were present. City Manager David Troast and CFO James Mangin were in attendance. Judge Carver and Attorney Kate Walsh were in attendance. A motion to approve the Regular Meeting Minutes from November 25, 2013 was offered by Deputy Mayor Canestrino, seconded by Councilman Battaglia and approved by Mayor Labrosse, Deputy Mayor Canestrino, Councilman Battaglia, and Councilman Sims. Councilwoman Keeling-Geddis abstained. City Manager’s Report The City of Hackensack has been given an award by the South Bergen JIF for achieving a score of +65 points in the 2015 Safety Incentive Program. It’s a rating system based on training, lost days, etc. We did get a check for $750. Last weekend the brewery had their grand opening. I encourage you to visit it. Congratulations to the fire department on their promotions. We had many qualified candidates. Congratulations to the basketball team for a great win and a great season. On April 29, 2016 along with Arbor Day, at the M&M Building you can pick up some seedlings that have been supplied by the forest service to plant in your yard. Last, I have asked Greg Liosi to speak – he is our Clean Communities Coordinator and Earth Day is coming up. 04/18/2016 1 Greg Liosi – We have two events per year. We have two clean up days, one in the spring and one in the fall. As part of the Clean Communities Coordinator, I have implemented a new program which is hopefully going to bring awareness to an issue. We are kicking off a program – Hackensack Working to Be Plastic Free. Part of this program, which we are funding through the Clean Communities Grant, is educational material to residents who wish to participate. We have packets at the Cultural Arts Center and in there is items that will encourage people to be aware of the amount of plastic that we use. Recycling is very important but unfortunately there is so much plastic now. We are going to encourage people to use reusable tote bags for groceries. When we clean we find that most of the litter is plastic. We are going to be working with Riverkeeper for a lot of programs. We really have to double our efforts because of our proximity to the river. Also in the package are some brown bags, some notepads, pens which are made mostly of biodegradable material, and a stainless streel water bottle. We are going to start this program on April 25, 2016. We are offering these packages one per household. We will also be encouraging all city employees to be using these reusable items and participate. City Manager continued – We had the privilege of going to the Fire Department Valor Awards. Hackensack took a lot of awards for bravery and saves and being there to help people. 2016 Budget Hearing Motion to open to the public for the hearing on the budget offered by Deputy Mayor Canestrino and seconded by Councilman Sims. Kathleen Salvo – Hudson Street – Hackensack - A lot of money is being spent and that is what I am worried about. Does anyone do any numbers for what it will cost to maintain the two big projects we are working on through the years? Mayor – This is just for the items pertaining to this budget and that would not be part of it although we do have answers for your question. CFO – Those two projects are not part of this. We had said the financing of them was going to be with no tax increase in the existing debt service budget. We won’t pay off the debt until the projects are finished. It is premature to figure out the operating expenses at this point. Rich Cerbo – Spring Valley Avenue – Hackensack – On the topic of spending, this culture has conditioned us to make a purchase, to buy, to spend. Why not a tax cut instead of frivolous spending? If you cut taxes it will snow ball. Cut taxes and let people spend their money. We don’t need more projects to praise people who built the projects. Councilman Sims – Do we keep putting it off? We have not put any money into the M&M Building in 40 years. CFO – The goal has always been long term tax stabilization. This budget is a turning point because we have the worst part of the tax appeals behind us. To contemplate a tax cut while we are still facing the tax appeal problem is reckless. You have to get the tax appeal issue behind us before you can consider any kind of tax cut. Chris Coli – Summit Avenue – Hackensack – Question about the M&M Building… 04/18/2016 2 Mayor – The money for that is not being spent for another few years. We are talking just about the document which was presented and it has no mention of the projects. Those bonds don’t exist as of yet. City Manager – Just to summarize the budget, I believe $1.5 million of the increase is directly related to the tax appeal issue and payment. The percentage of actual tax increase to operate the city is at $103.00. If there were no tax appeals, the budget would be increasing by $21.00 to the average household. CITY OF HACKENSACK ORDINANCE NO. 16-2016 ORDINANCE ADOPTING 76 MAIN STREET (BLOCK 206.01, LOT 11) REDEVELOPMENT PLAN WHEREAS, the City of Hackensack, in the County of Bergen, State of New Jersey (“the City”) is authorized pursuant to N.J.S.A. 40A:12A-5 to determine that a delineated area in the City is an area in need of redevelopment; and WHEREAS, pursuant to Resolution No. 88-08, on March 4, 2008, the governing body determined that 76 Main Street identified on the official tax map as Block 206.01, Lot 11 (“the Area of Investigation”) constitutes an “area in need of redevelopment” for condemnation purposes according to the criteria set forth in N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and WHEREAS, at the direction of the governing body and the Planning Board, DMR has prepared a Redevelopment Plan entitled the “76 Main Street Redevelopment Plan” dated April 2016; and WHEREAS, the governing body wishes to adopt the 76 Main Street Redevelopment Plan for the area designated in need of redevelopment consisting of Block 206.01, Lot 11; and 04/18/2016 5 WHEREAS, N.J.S.A. 40A:12A-7 requires the adoption of redevelopment plans by ordinance with the Planning Board reviewing the plan for consistency with the Master Plan of the City of Hackensack prior to final adoption, which referral has taken place, and a report being returned from the Planning Board as to such consistency with the Master Plan. CITY OF HACKENSACK ORDINANCE NO. 19-2016 ORDINANCE AUTHORIZING A FIVE (5) YEAR TAX EXEMPTION PURSUANT TO N.J.S.A. 40A:21-1 ET SEQ. AND § 153-6 ET SEQ. OF THE CODE OF THE CITY OF HACKENSACK FOR THE PROPERTY DESIGNATED AS BLOCK 303, LOT 7 ON THE CITY’S OFFICIAL TAX MAP, MORE COMMONLY KNOWN AS 161-163 MAIN STREET WHEREAS, the City of Hackensack (“the City”) has designated its downtown district as an area in need of rehabilitation and is authorized to adopt an ordinance to utilize tax exemptions pursuant to N.J.S.A. 40A:21-1 et seq., the five (5) year tax exemption and abatement law; and WHEREAS, pursuant Article VIII, Section I, paragraph VI of the New Jersey State Constitution and N.J.S.A. 40A:21-1 et seq., the City adopted Ordinance No. 3-2014 (codified at § 153-6 et seq. of the City Code), to allow for five (5) year tax exemptions that permit the Tax Assessor to regard the full and true value, or a portion thereof of certain improvements as not increasing the full and true value of certain property for a period of five (5) years, provided the owner’s application is approved by the Tax Assessor and the City’s governing body; and WHEREAS, pursuant to N.J.S.A. 40A:21-10c and § 153-12B(3) of the City Code, a five (5) year tax exemption for improvements made to convert a vacant office building into multi- family residential dwelling units over retail in the City’s Rehabilitation Area is permitted; and WHEREAS, the Applicant is the owner of certain property located at 161-163 Main Street in the City designated as Block 303, Lot 17 on the Official Tax Map of the City, which is located in the City’s Rehabilitation Area; and 04/18/2016 10  WHEREAS, on January 13, 2016, the Applicant received final site plan approval from the City’s Planning Board that conducted a duly noticed public hearing on December 9, 2015; and WHEREAS, on February 3, 2016, the Applicant filed an application seeking a short term tax exemption on the improvements associated with the conversion of a pre-existing three story office building into two retail units on the first floor and eight apartments on the second and third floors along with associated parking improvements on site (“the Improvements”) pursuant to N.J.S.A. 40A:21-1 et seq. and § 153-6 et seq. of the City Code (Ordinance No. 3-2014); and WHEREAS, the Improvements being made by the Applicant are estimated to cost in total approximately $1.1 million to complete; and WHEREAS, the City has reviewed the application, which was timely filed, and approved the construction of the proposed Improvements. NOW, THEREFORE, BE IT ORDAINED by the governing body of the City of Hackensack in the County of Bergen, State of New Jersey that: 1. The application filed by Main Street Hackensack LLC for a five (5) year tax exemption for its approved Improvements at 161-163 Main Street designated as Block 303, Lot 17 on the Official Tax Map is hereby approved pursuant to N.J.S.A. 40A:21-10c and § 153-12B(3) of the City Code. 2. The Mayor or City Manager are hereby authorized and directed to execute the Financial Agreement attached hereto and made part hereof as Exhibit A pursuant to the terms and conditions contained therein. 3. The City Clerk shall transmit a copy of the fully executed Financial Agreement and this Ordinance to the Director of the Division of Local Government Services in the Department of Community Affairs within thirty (30) days of execution pursuant to N.J.S.A. 40A:21-11d. Public Comment A motion to open the meeting to the public was offered by Deputy Mayor Canestrino and seconded by Councilman Sims. Loretta Hand Onyeani - 463 North Arlington Avenue- East Orange- I own property at 388 First Street. It has been in our family since 1944. I want to discuss the codes and regulations problems I am having with the building next door, the cleaners and laundry at 394 First Street. I have made it known to the owners of the laundromat that the dumpster in front of the building is an eye sore. I have also spoken to the Building Department and Constable. The Hackensack code E36:11 states that receptacles need to be covered by a fence or evergreen planting. This has not occurred. My second concern is storm water management. This has caused excessive water collecting on my driveway and backyard. The third item is a shared driveway. Cars bypass the traffic light by entering the driveway on both sides which causes two-way traffic on this small driveway. I would like to have some response to this concern. The Mayor responded that we will make sure this gets looked into. We will have to research the issues. Rich Cerbo – Spring Valley Avenue – Hackensack – I want to start with a Longfellow poem called “A Psalm of Life.” It celebrates life. It says that the goal is not the grave but the psalm of life is for everyone. Saying that, I want to get to your oath of office tonight, which says it is given by the authority of the people and I don’t think there is any authority of the people here. I want 04/18/2016 29 to bring up the settlement that was made with Mr. Rottino recently. You gave him a quarter of a million dollars and just shut him up and say you did nothing wrong. You don’t just give money for doing nothing wrong. You are allowed to say that you did nothing wrong, but we should know something since we are paying out that money. Even if it is covered by insurance, we still pay into that. This recent awful accident we had. I have been complaining about police speeding vehicles for years. We had a speeding police vehicle kill someone. Before today’s meeting, you should have had a moment of silence for that person. You need to do something about it and it is not just the police, it is firetrucks. Firetrucks are going 100mph swaying into other lanes. Judge Carver – Many cases do not specifically contain any admission of liability – they are settlements and the language is usually fairly standard. Some settlements are confidential. Mayor – The Mayor’s office has no jurisdiction over how police and fire drive. I do have to say this, if my house is on fire or someone is in my house trying to kill me, I sure hope they have their lights and sirens on. Regina DiPasqua- Parker Avenue- Hackensack- For the Rottino settlement, I saw no resolution on it, I saw an article on it, I saw an amount but the city says it is only paying $250,000. I think the residents have a right to know the full amount. The Mayor stated there was a resolution on it last meeting. The Judge confirmed the city’s portion of it was $250,000 even though the settlement total was $525,000. The city can’t legislate how much comes from other parties involved. Nobody tried to keep it a secret from anybody. Mr. Williams – Hackensack – Is Hackensack financially secure now? I see a lot of money being spent. Where is it all coming from? I don’t understand. We are building the sports dome and the splashpark; we are building more buildings and then will need to hire more firemen. I don’t understand how we can do it. I see what happened in Ramapo, NY when they built the minor league baseball field and now they have problems. I am waiting to see something happen, I know it’s going to happen. Someone is going to make a mistake somewhere and the taxpayers will have to pay. The Mayor commented this has been explained at several of the meetings. The CFO explained we are not Ramapo, NY. The stadium was a public referendum for a bond ordinance that was turned down by the public. The administration used general fund money which you can’t do. Our projects will be done through a bond ordinance which had a public hearing. The financing of it, for the most part we are borrowing the money, and the payback on the money will come from our debt service budget and we won’t increase that budget. That means we won’t have to increase taxes. Kathleen Salvo – Hudson Street – Hackensack – I can’t say enough good stuff about our fire department. Great job to the basketball team! As far as dumpsters, I can give you lots of locations that are not covered at this moment. That is not enforced. Nobody does anything about it. We still have a dysfunctional building department. It has been two weeks since the wall fell. If it fell on somebody would you do something differently? Do we have to wait for someone to die? It fell twice. He is a liability. He is two feet on to our property. The city will be responsible. The City Manager is fudging the rules and using his own code book. It is not secure. You are hiding behind art. You are bending the rules. Another thing, they should not get redevelopment money or special perks. There is fire money here, insurance money. We still 04/18/2016 30 didn’t get the lights back. It’s a disaster and you just sit there and do nothing. City Manager – I have had the construction official go out and it meets all the standards of the code. 150-170 Main Street scaffolding- They have the fences on city property. They have NJ barriers on the road. Lenny Nix – Elm Street – Hackensack – I have a lot of issues. I don’t like the way the water park is going. Boswell won’t return my phone calls. I want to buy city property and no one returns my phone calls. The wall is a disaster. The construction department is non-existent. If something happens one of these days it is not going to be a shock. When you do construction you have to make sure nothing can happen. It sounds like you are doing a lot of great things. We have a lot of ambition and dreams but it is going to take ten years before this town starts to take a turn. You need to get thousands of people in to this town to make money. You have to use both railroads. The stuff we are doing now should have been done twenty years ago. We have to start building. Fort Lee has a 50-story building. Machione, Hackensack Auto body, Polifly… these places I have been talking about for years. Machione, they ran somebody over. They are an accident waiting to happen. There is some sort of sleazy deals going on down there. I am fed up with them. Chris Coli – Prospect Avenue – Hackensack – #164-16 which was pulled, it appeared to me that you were trying to get rid of the sanitation department? The Mayor answered no. Mr. Coli continued – The building on 50 Passaic Street, I think it is owned by the county, why are we giving them money back? CFO – I do not know who owns the building at 50 Passaic Street but the escrow account was opened by the gentlemen on the resolution. An escrow account was opened, the building department certified the project was done, and now the funds get returned. Mr. Coli continued – Many people and places in town do not have a recycling bin. My son says his building doesn’t even have a place to put it so he just throws it all in the trash. That would come under sanitation. Also, the basketball courts we are building and the soccer dome… we are building no bleachers so we are going to have big games there but there will be nowhere for people to sit or stand. Maybe if we didn’t increase our debt, maybe if we don’t spend this money, then we won’t have any debt next year. Then maybe we can lower our taxes instead. CFO – On the solid waste resolution which was pulled, that is for the disposal, not the collection. The difference between how we finance using debt and the federal government * they do deficit spending, we can’t. In NJ, you are required to have a balanced budget. You incur the debt; you have to pay it off. The federal government incurs debt; they can do deficit spending which means they don’t have to balance their budget. Mr. Incalcatera – Hackensack - Do we have any sort of recycling inspector? City Manager responded saying we have something like that and we are stepping up that program. Mr. Incalcatera continued - I think we definitely need to do more with recycling. I think maybe we can get signs or bins. It’s more about teaching people to do it and in the schools. The other thing on a positive note, they 04/18/2016 31 repaved my area down on Broadway and they did a great job. I see different parts of Hackensack that are getting it done. The only bad thing about having a nice new street is people speed on them. We should be giving out more speeding tickets and use that money to do something positive. There has to be something done about speeding. Also, over by the library, the parking is so bad there. You can park two blocks away which can be difficult for some people. Maybe on the side of Moore Street you can put some signs that say five or ten minute parking. Why? If you want to return your DVD or your books, you have to put money in the meter just to return it. They don’t let you return DVDs in the outside bin. Next month the Cultural Arts Center is having some sort of cabaret. I would like to know how the progress is on the new building. The City Manager replied it should be going out to bid by the end of the month. No one else wished to speak. Council Comments Councilman Battaglia- Thank you, Mayor, for recognizing the problem going on in Ecuador; Many people lost their lives, are injured, or lost their homes. St. Anthony’s Church is having a mass for the people in Ecuador at 7PM on Wednesday. Sometimes it is true when you want to go to the library, there is no parking available. My suggestion is the people that work there should park a few blocks away so then the people who want to use the library have spots. As far as speeding, I feel in some parts of the city we should use speed bumps. There are also many lights at night in the city that are out. Sometimes the street is so dark you can’t see someone crossing the street. As for the sports facilities by building them and doing what we are doing you save money in the long run and keep the kids off the streets. Deputy Mayor Canestrino- It is so nice to see our basketball team doing well. We are very blessed to have a great fire department. I was also at the fire department valor awards and I think we had 34 of our men which were honored. We had our planning board meeting already this month. We had a site plan approval for 18 East Camden which is the old Oratani Field Club. They came with wonderful plans, with about 250 units and a parking garage. In a step towards moving forward with Record site development, we had subdivisions on the site. 163 Main Street is looking at retail on the first floor with eight apartments above. Alementary had their grand opening and is the second brewery in Bergen County. We wish them a wonderful future here. There was a lot of talk about recycling tonight and thanks to Greg Liosi for working on everything with Clean Communities. We know as a city we can do better and maybe we can look for ways of encouraging recycling. Thanks to CFO and City Manager and Finance Committee on the budget once again. Remember tomorrow is the Board of Ed election which is very important. Exercise your right to vote. Councilman Sims- None Councilwoman Keeling-Geddis- We had our second Cultural Arts Board meeting this month. It is on the second Monday every month and everyone is welcome to come. We are working on a summer schedule for the Atlantic Street Park including a mini concert and movies. At this time the entire board has unanimously voted down the interior design samples which were presented to us. We are waiting to see some more samples. Don’t forget to vote tomorrow and for those who observe, Happy Passover. 04/18/2016 32 Mayor Labrosse – I was at the Alementary opening on Saturday and they must have had 500 people there in those few hours. The Valor awards were worth the trip to see the 35 guys get their awards. Kudos to the basketball team and the coaches. Arbor Day come down to the Cultural Arts Center where we will be planting a tree. Redevelopment is moving along very well. A lot of projects are still coming in. A lot of people don’t want to see things change but to be honest I would rather be put aside for trying to do something than criticized for doing nothing. We are trying to do something here and no one has done anything for these kids in 30 something years. Everything is the same as when I moved here. We are doing it in a way that will not increase taxes. And yes, we can lower taxes easy but then we won’t pave the roads, we can lay people off, we can not put up stop signs, not fix anything… and then what? Then your homes will go down, your property values will decrease if we do not rebuild the city. Great job on the budget again. Tomorrow is election day- if you don’t vote, don’t complain.
