The Reorganization Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Saturday July 1, 2017 at 1:10 p.m. City Clerk Deborah Karlsson called the meeting to order and announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall. A motion to close the meeting for nominations for the four year term of the Office of Mayor was offered by Councilwoman Canestrino and seconded by Councilman Sims. A motion to elect Councilman John Labrosse as Mayor was offered by Councilwoman Canestrino, seconded by Councilman Sims, and approved by Councilman Battaglia, Councilwoman Canestrino, Councilman Labrosse, Councilman Sims, and Councilwoman Von Rudenborg. CITY OF HACKENSACK ORDINANCE NO. 20-2017 ORDINANCE ADOPTING MAIN AND ANDERSON STREET REDEVELOPMENT PLAN (COMMONLY KNOWN AS THE HOLMAN SITE) CONSISTING OF BLOCK 410, LOTS 1, 2.01 AND 22 WHEREAS, the City of Hackensack, in the County of Bergen, State of New Jersey (“the City”) is authorized pursuant to N.J.S.A. 40A:12A-5 to determine that a delineated area in the City is an area in need of redevelopment; and WHEREAS, in order to make that determination, the City’s governing body must first authorize the City’s Planning Board to undertake a preliminary investigation to determine whether the delineated area is a redevelopment area according to the criteria set forth in N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and WHEREAS, pursuant to Resolution No. 88-17, on March 28, 2017, the Mayor and Council authorized and requested that the Planning Board to undertake a preliminary investigation (“the Investigation”) to determine whether Block 410, Lots 1, 2.01, and 22 (commonly known as the Holman Site) (“the Area of Investigation”) constitutes an “area in need of redevelopment” for non-condemnation purposes according to the criteria set forth in N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and WHEREAS, the Mayor and Council also authorized its planning consultant, DMR Architects (“DMR”) to assist the Planning Board in the Investigation and the Planning Board appointed DMR to conduct the necessary redevelopment investigation; and WHEREAS, consistent with the requirements set forth in N.J.S.A. 40:12A-6, the Planning Board specified and gave notice that on May 10, 2017 a hearing would be held for the purpose of hearing all persons who are interested in or would be affected by a determination that the properties in the Area of Investigation are a redevelopment area as that term is defined in Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (“LRHL”); and WHEREAS, DMR prepared a “Report of Preliminary Investigation for Determination of an Area in Need of Redevelopment for the Area of Investigation” (the “Investigation Report”) that was publicly presented after adequate notice before the Planning Board on May 10, 2017; and WHEREAS, the Investigation Report determined that the Area of Investigation evidences conditions and characteristics that qualify the Area of Investigation as an “area in need of redevelopment” because it collectively satisfies the “a,” “d,” and “e” criteria of the LRHL under N.J.S.A. 40A:12A-5; and 07/01/2017 5  WHEREAS, on May 10, 2017, the Planning Board held a public hearing concerning the Area of Investigation during which Joseph Mecca, Esq. represented the Planning Board of the City; and WHEREAS, on May 10, 2017, the Planning Board received the uncontested testimony of Francis Reiner, L.L.A., P.P. of DMR, and Mr. Reiner provided an eye witness account of the conditions that he observed at the Area of Investigation which confirmed the description of conditions found in the Investigation Report, and Mr. Reiner also gave testimony concerning the relationship of the observed conditions to the redevelopment criteria and the decadent effect that these conditions were having on the surrounding properties; and WHEREAS, the Planning Board hearing on May 10, 2017 was open to the public for the purpose of hearing all persons who are interested in or would be affected by a determination that the Area of Investigation is a redevelopment area; and WHEREAS, after completing its hearing and investigation of this matter on May 10, 2017, the Planning Board determined to recommend that the Mayor and City Council designate the Area of Investigation as a redevelopment area because the Investigation Report and testimony of Mr. Reiner provide substantial evidence that the Area of Investigation meets the criteria enumerated in the Investigation Report and that the Area of Investigation is having a decadent effect on surrounding properties; and WHEREAS, pursuant to Resolution 188-17, on May 30, 2017, the Mayor and City Council adopted a resolution concurring with the Planning Board’s findings and has determined to designate the Area of Investigation as an “area in need of redevelopment” pursuant to the LRHL; and WHEREAS, at the direction of the Mayor, City Council and the Planning Board, DMR has prepared a Redevelopment Plan entitled “Main and Anderson Street Redevelopment Plan” dated June 2017; and WHEREAS, the Mayor and City Council wishes to adopt the 4 Main and Anderson Street Redevelopment Plan for the area designated in need of redevelopment consisting of Block 410, Lots 1, 2.01, and 22; and WHEREAS, N.J.S.A. 40A:12A-7 requires the adoption of redevelopment plans by ordinance with the Planning Board reviewing the plan for consistency with the Master Plan of the City of Hackensack prior to final adoption, which referral has taken place, and a report being returned from the Planning Board as to such consistency with the Master Plan. NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Hackensack in the County of Bergen, State of New Jersey, as follows: 07/01/2017 6  SECTION 1. Main and Anderson Street Redevelopment Plan. The Main and Anderson Street Redevelopment Plan prepared by DMR and attached hereto as Exhibit A and by the reference made a part hereof is hereby approved and adopted pursuant to N.J.S.A. 40A:12A-1 et seq.. SECTION 2. Severability. If any section, subsection or paragraph of this ordinance be declared unconstitutional, invalid or inoperative, in whole or in part, by a court of competent jurisdiction, such chapter, section subchapter or paragraph shall to the extent that is not held unconstitutional, invalid or inoperative remain in full force and effect and shall not affect the remainder of this ordinance. SECTION 3. Repealer. All ordinances and resolutions, and parts of ordinances and resolutions which are inconsistent with provisions of this ordinance shall be, and are hereby, repealed to the extent of any such inconsistency. SECTION 4. Effective Date. This ordinance shall take effect after final adoption and approval pursuant to law. CRUSIUS, ESQ., TO SERVE AS THE CITY’S MUNICIPAL PROSECUTOR WHEREAS, it is necessary for the City of Hackensack (“City”) to engage the services of a Municipal Prosecutor; and, WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. exempts professional service contracts from certain requirements of public bidding provided that a notice of the appointment is printed in a newspaper of general circulation within the municipality; and, WHEREAS, the City has utilized a competitive process to select a Municipal Prosecutor, in compliance with the “fair and open process” established by N.J.S.A. 19:44A-20.4 et seq., by soliciting Requests for Qualifications; and, WHEREAS, responses to the Requests for Qualifications were received by the City Clerk and were publicly opened on June 28, 2017; and, 07/01/2017 7  WHEREAS, after due consideration, the City Council determined that the proposal submitted by Elsbeth J. Crusius, Esq. is the most advantageous to the City, all relevant factors considered; and, WHEREAS, the City Council desires to appoint Elsbeth J. Crusius, Esq. as Municipal Prosecutor effective July 1, 2017, and to serve for a one (1) year term; and, WHEREAS, the Chief Financial Officer has prepared and attached a certification of available funds to this resolution. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Hackensack that Elsbeth Crusius, Esq. be and is hereby appointed Municipal Prosecutor for the period July 1, 2017 through June 30, 2018; and, BE IT FURTHER RESOLVED, that compensation for the Municipal Prosecutor shall be claimed, approved and paid in the manner set forth in N.J.S.A. 40A:5-18 and pursuant to a professional service agreement to be entered into between the parties; and, BE IT FURTHER RESOLVED, the compensation for the tasks associated with this position will be $700.00 per court session, but shall not exceed $70,000 in total without the further written authorization of the City Council. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Hackensack that Steven W. Kleinman, Esq., of Cleary, Giacobbe, Alfieri & Jacobs LLC be and is hereby appointed City Attorney for the period July 1, 2017 through June 30, 2018; and, BE IT FURTHER RESOLVED, that compensation for the City Attorney shall be claimed, approved and paid in the manner set forth in N.J.S.A. 40A:5-18 and pursuant to a professional service agreement to be entered into between the parties; and, BE IT FURTHER RESOLVED, the compensation for the tasks associated with this position will be a flat fee of $15,000.00 per month, and for matters outside the scope of the flat monthly fee, such as litigation, $150.00 per hour for all attorneys, including partners, counsel, and associates, and $100.00 per hour for paralegals. The Chief Financial Officer is directed to use this cash management plan as the guide in depositing and investing the City of Hackensack’s funds. In accordance with N.J.S.A. 40A;5-15.1, the following instruments are authorized as suitable investments for the City of Hackensack:  Interest-bearing bank accounts in banks as authorized above for deposit of local unit funds (GUDPA approved);  Certificates of Deposit in GUDPA approved banking institutions;  Bonds or other obligations of the United States of America or obligations guaranteed by the United States of America. This includes instruments such as Treasury Bills, Notes, and Bonds;  Government money market mutual funds that comply with the requirements of N.J.S.A. 40A:5-15.1(e);  Any federal agency or instrumentality obligation authorized by Congress that matures within 397 days from the date of purchase, and has a fixed rate of interest not dependent on any index or external factors;  Bonds or other obligations of the local unit or school district of which the City is a part;  Local government investment pools, including municipal note issuances, which comply with N.J.S.A. 40A:5-15.1(e) and conditions as set by the Division of Local Government Services;  New Jersey Cash Management Fund;  Repurchase agreements of fully collateralized securities which comply with N.J.S.A. 40A:5-15.1(e);  New Jersey Asset and Rebate Management Program. There are no approved security broker/dealers. In the event that a security broker/dealer shall be approved during the year, the registered principle of said brokerage firm so approved shall be provided with and sign an acknowledgement that have seen and reviewed this cash management plan. Each month the Chief Financial Officer shall prepare a report for the City Manager that consists of the following: 07/01/2017 10   A summary of all investments made or redeemed for the month.  A listing of any and all financial institutions holding local unit funds.  The class or type of securities purchased or funds deposited.  Income earned on deposits and investments.  Market value of investments and disclosure as to how the value was determined, if applicable.  A listing of accounts or deposits that do not earn interest. This document shall constitute the cash management policy of the City of Hackensack. Any official involved with the selection of depositories, investments, broker/dealers, shall disclose any material business or personal relationship to the City Manager and to the Local Finance Board or Local Ethics Board as applicable. Any official who, in the course of his or her duties, deposits or invests in accordance with this plan shall be relieved of any liability for loss. Council Intr Secon Abstai Absen Recuse Member o d Yes No n t d Von Rudenborg X Deputy Mayor Canestrino X Deputy Mayor Sims X X Battaglia X X Mayor Labrosse X CITY OF HACKENSACK RESOLUTION NO. 235-17 RESOLUTION AUTHORIZING THE APPROVAL OF A PETTY CASH FUND WHEREAS, N.J.S.A. 40A:5-21 authorizes a local unit to establish a petty cash fund upon approval from the Director of the Division of Local Government Services; and WHEREAS, such approval was granted on December 8, 2015; and WHEREAS, in order to establish a uniform method of accounting for petty cash funds, which purpose is to pay for small incidental costs not associated with the normal processes for the acquisition of materials and services; and WHEREAS, petty cash funds are not provided for the purpose of circumventing the regular acquisition process; and WHEREAS, purchase order procedures can be utilized with most vendors when making frequent purchases. NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the City of Hackensack, County of Bergen a petty cash fund in the amount of $600 is approved for year 2017; and 07/01/2017 11  BE IT FURTHER RESOLVED, that no single payment from the petty cash find shall exceed $50.00. Lara Rodriguez – Hackensack – I want to wish all the newly elected council people congratulations on this occasion. As a member of the school board, I am thrilled to see a Hackensack High School alumnus, a practicing attorney, be selected as prosecutor for the city. As a member of the school board I am looking forward to our collaborations in the next four years but your first official appointment of Ms. Crusius as the prosecutor speaks to your sincerity in our continued cooperation between the BOE and the city. Congratulations. Roosevelt Sills – Hackensack - I commend Hackensack for the great leader you have chosen to lead this great city and I congratulate all those who have taken an oath today. When I graduated from high school, I moved here out of all places and I found my wife here. I often joke with Deputy Mayor Sims about, is a leader born or is a leader made? Leadership comes from the heart because serving comes from the heart. I would like to commend you for leading this great city and continue to keep Hackensack safe. Stefan Neustadter – Hackensack – I want to congratulate all the council members. It is wonderful that you spent the last administration putting the money in place to have Hackensack realize its possible greatness. You have got the means to do it, the vision to do it and let’s grow together. Paul Nickels – Hackensack – Congratulations, you will hear from me every other week about housing and such and I look forward to it. Chief Freeman – Hackensack Fire Department – On behalf of the Fire Department, I want to congratulate you on the election. I want to thank you for the past support you have shown the department and I look forward to the continued support and the great work we do together moving the city forward. A special thank you to outgoing Councilwoman Keeling-Geddis for her support and I also want to thank you for the hiring of this great City Manager, he is a great asset to the city. Councilwoman Dr. October Hudley – Irvington – I would like to give a special congratulations to Deputy Mayor Sims and your colleagues. I know you will serve the community well. Bergen County Executive Jim Tedesco – Congratulations on being sworn in for a four year term to run the city of Hackensack. As co-partners of government here in Hackensack, it is my honor to congratulate you from the one million people that call Bergen County their home. We have worked together and that will continue with the people of Hackensack as this is the center and the county seat. We will continue to work together to make not only the city of Hackensack, but the county as great as it can be. Bergen County Clerk John Hogan – Today we come together not only for congratulations for those who prevailed in the election but also to celebrate our democracy, the continuity of government, peaceful, orderly elections. I served as Mayor of my little town of Northvale when I was 30 years old and I served again when I was 50. There is no place in elected office where you’re closer to the people than when you are a mayor or member of the governing body and it’s the best training ground for higher office. 07/01/2017 15 Congratulations, you have some challenges here in Hackensack. Chris Tully on behalf of Congressman Gottheimer – The congressman expresses regrets that he could not be here today, however, he asked me to read a statement: I am pleased to offer my congratulations to Mayor John Labrosse, Deputy Mayor Kathleen Canestrino, Deputy Mayor David Sims, Councilman Leonardo Battaglia, and Councilwoman Stephanie Von Rudenborg on the recent election victory. The council embodies strong commitment to the City of Hackensack and community service helping Hackensack grow and flourish. The oath of office is a special occasion to celebrate but it is also an appropriate time to reflect on responsibilities and ways we can all work together to serve this community. During my past six months in office I’ve been working to cut taxes, cut unnecessary regulation, support our veterans and first responders, fix our roads and bridges, and fight terrorism at home and abroad. I look forward to working with all of you to move across the aisle and fight for a better return on investment for tax dollars already sent to Washington DC and apply for grants for our roads, our cops, and our economic development across north Jersey. Wimberly – Congratulations Mayor and Council, I come in two-fold. I am a part time Hackensack-er because I am a football coach here and spend most of my nights and afternoons on First and Beech Street and even more importantly my two sons attended Hackensack High School. One just graduated and the other just graduated college. I enjoy eating here and shopping here and know that you have a friend in me in the New Jersey General Assembly. No one else wished to speak. Council Comments Councilwoman Von Rudenborg – I want to thank the citizens of Hackensack for believing in me enough and you have my word, that I will continue to keep this wonderful city moving in the right direction. I would also like to thank my fellow council members for their support, dedication, and hard work over the past four years. I am proud to be part of such a passionate team. Thank you for all the employees and volunteers here at the city. Their hard work and diligence is evident in all of the day-to-day operations as well as the big events you see around the city. Thank you to my fellow Planning Board members who I have had the pleasure of serving with for the past year and a half. A huge thank you to my family and friends for their encouragement and support and to my husband Eric for always believing in me and picking up the slack while campaigning and to Evan, Benjamin, and GiGi thank you for all the encouragement and memories we made while hitting the pavement during campaigning. At a young age you have learned the importance of citizenship, community service, and why it is important to always do the right thing. Although during the next few years there will be more time spent away from you, in the end I am doing this for you and the future of the city. I hope by serving to keep the city moving in the right direction, your generation will buy your first homes in this city and be just as proud as we are today to call Hackensack our home. Deputy Mayor Canestrino – It is an indescribable honor to stand before you this afternoon as I am sworn in for another four years as your Deputy Mayor. I want to thank my running mates, my campaign staff, and all of our 07/01/2017 16 volunteers who worked for us day after day throughout the campaign carrying our message to the voters. We could not have succeeded without your tireless efforts. I also want to thank my husband Emil and my family who were supportive of me during this campaign. On May 9 th, 2017 the people of Hackensack spoke loud and clear that they continue to believe in our vision for the City of Hackensack and are proud of the progress that we have made in the past four years. Our continued promise for the next four years is to stabilize taxes through controlled spending and increased revenue, to continue our redevelopment plan targeted to bring one billion dollars in investment into the city, to continue our long overdue infrastructure improvements to our parks, cultural, and recreational facilities, and our streets especially paving and sewer improvements and most important, to keep an open and honest dialogue with our residents in order to make good decisions together. I know that promises by politicians are often easily forgotten or overlooked but this council has proven that we are committed to our promises and that we will continue to pursue the goals that we laid for this city. We truly and honestly want to give you a better city and return Hackensack to its place of prominence. Thank you for all your kind wishes and your hard work. I look forward to working with you for another four years. Deputy Mayor Sims – Ms. Rodriguez made the remarks about Hackensack alumni, I believe in blue and gold as much as anybody and Ms. Crusius may be a great individual but I cannot vote yes or no to a person who I have never met. I’m sorry but I just can’t do that. The prosecutor is a demanding responsibility in this city and that is the reason why I chose to abstain. I would like to express sincere thanks to my family and friends and this community for having faith and trust in re-electing me for a second term. To the elected officials, clergy, city workers, and all who have participated in this reorganization meeting, thank you. To my mom and my daughter, thank you for all your help. Tiffany, the first lady, you already know how much you mean to me. To my cousin/sister Andrea, we are winning. It was wonderful that you got voted in on Tuesday as the new district assistant superintendent of Hackensack schools and to my brother Fred who keeps a check on me from South Carolina all the time. To Assemblyman Benji Wimberly, who swore me in today, you have been a great mentor. When we first met, I bet you never thought we would be here today. God is good. To my large and diverse Hackensack junior basketball family, I love you. I am so proud and honored to be standing here in front of you today not only as a re-elected official of the City Council but as Hackensack’s fourth African American Deputy Mayor. This is an achievement that I could never have envisioned when I was a young man growing up. Hackensack is moving in the right direction with our team, led by our Mayor John Labrosse. There are so many great things happening here in our city from redevelopment and transforming our downtown to the new businesses that are moving in. It is an exciting time here in Hackensack. Most near and dear to my heart we are making major investments in our children and in our future. We are building new parks and recreation facilities and upgrading the ones we have. As a youth sports coach for many years, I know the value that these investments will bring to our community and I am so excited to be able to see kids take advantage of them. Once again I would like to thank everyone who supported our team in this election and all the residents of Hackensack, you are the reason why we work hard for our community and I am excited to continue serving you. I am humbled and grateful for four more years. Lastly to my pops who passed away last year, he sits up here in the council chambers in spirit with me. Thank you. Councilman Battaglia – I want to thank especially my wife, my sons Giovanni and Leonardo, my grandson and granddaughter, my sister, her fiancé, my niece, her daughter. I want to thank the department heads and Ted, Jim, Jesse, and everybody else doing a wonderful job. There is no question that with these guys there is nothing we can’t accomplish. The last four years we accomplished a lot and our goal is to continue to do the same. When you 07/01/2017 17 see me around I am thinking potholes and removal of the snow and anything that makes you guys happy. Our goal is to try to keep the residents happy. That is what we will continue doing. I want to thank the residents because they trusted and supported us and that is the reason we got elected. I want to thank God because he keeps me here. Any day I open my eyes is one more day. I want to welcome Stephanie to the team and I want to thank Debbie for her service to the city. The people who pass around these seats know that it is not easy to be here. You have to have thick skin to support all the comments and all the complaints from the people. Sometimes people come to me and say Leo, I don’t know how you do it. Somebody has to do it. It is difficult sometimes when we are looking for people to participate in the city council and people don’t always want to step to the plate. Thank you everybody for coming. Mayor Labrosse – On behalf of my fellow city council members and our entire team, thank you for joining us here today on this very important occasion in our great city’s history and I want to thank and congratulate all of our council members. This is a committed group. Our newest member, I have never seen commitment like from this young lady. Cold weather and rain and she was out there pushing a baby carriage and two other kids up and down the streets going door to door to get herself elected. We are so glad to have her on board. I want to thank my family, my friends, in particular my wife Deb for putting up with all the tough times and always being there for me, always giving me her complete support, letting me know when I am wrong or whether I am right. I couldn’t have done it without you. To the voters of our great city, thank you from the bottom of my heart for once again giving me your trust and confidence for my third term of office on the City Council and thank you to my fellow city council members for again choosing me to serve as mayor; I can only pledge to continue to work hard and work together in our city’s best interest and do my very best to lead Hackensack to an even brighter future. We have come to far together and have an exciting journey ahead. There was a time not so long ago when Hackensack was the center of everything in Bergen County. Everyone came to Main Street and our city thrived. Then our economic conditions changed, large shopping malls replaced many local business districts all over the region and like many others, our Main Street declined and in a way, so did our city. Now things are changing for the better and our city’s future is very bright. Today thanks to the vision and leadership of some very dedicated people working together as partners in government and business, we are in the early stages of a tremendous redevelopment that will once again make Hackensack the cultural and economic center of Bergen County with new business, new housing, new offices, new shopping, new restaurants, and over 1 billion dollars in new redevelopment, no city has a brighter future than ours. This exciting future will benefit every city resident with over 1,000 new jobs created, a new Performing Arts Center opening soon, and an outstanding new recreation facility, and so much more. I am so proud to be your Mayor at this remarkable turning point in our city’s great history. I love the city, our home, our friends, our neighbors, our diversity, and everything that makes Hackensack the wonderful place that it is. I thank you all again for your confidence and support, let’s keep working together to make Hackensack the best small city that we can possibly be. Thank you.
