The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday January 23, 2018 at 8:07 p.m. Mayor John Labrosse called the meeting to order and the Deputy City Clerk Allison Saabye announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall. Attendance Ms. Saabye called the roll: Mayor Labrosse, Deputy Mayor Canestrino, Councilman Battaglia and Councilwoman Von Rudenborg were present. Deputy Mayor Sims was absent. City Manager Ted Ehrenburg was present. City Attorney Steve Kleinman was present. Flag Salute Proclamations and Presentations – None Approval of Minutes – None City Manager’s Report Black History Month luncheon will be scheduled late February. HPAC should be back on schedule for this Friday. Events that were rescheduled will remain rescheduled. For those who didn’t know, we had a pipe burst in HPAC which caused some flooding and damage to the infrastructure as far as the equipment and the flooring and ceiling tiles. We are prepared to start having our events on Friday. The Teterboro Airport meeting is scheduled for tomorrow at 7PM at 90 Moonachie Avenue. It is open to the public. Main Street parking meters will be monitored as of Saturday January 27 from 9AM to 6PM. The parking enforcement enhancement and fees are slowing getting addressed in 2018 and we will be stepping up the administrative and enforcement parts of pour parking meters. As the city progresses this becomes a critical area. This Wednesday January 25 is the last day for Christmas tree pick up. State Street conversion has been completed and I’ve had a lot of positive feedback. There are still a few bugs that have to be worked out but the conversion will serve the city well. We will start to pre- plan for Main Street conversion. PUBLIC HEARING – Kathleen Salvo – Lodi Street – Hackensack – Will this be on a trial basis? Can we change if need be if we find out we moved a bus stop too far? Mayor Labrosse replied bus stops can be changed any time. They have been amended often. This is a big move for both the city and NJ Transit and we can always adjust it. CITY OF HACKENSACK ORDINANCE NO. 01-2018 AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, “VEHICLES AND TRAFFIC,” TO ADD AND REMOVE CERTAIN BUS STOPS WITHIN THE CITY OF HACKENSACK WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, 01/23/2018 3  WHEREAS, pursuant to N.J.S.A. 39:4-8(e), the governing body of a municipality may, without the approval of the Commissioner of Transportation, and consistent with the current standards prescribed by the Manual on Uniform Traffic Control Devices for Streets and Highways, by ordinance designate stops, stations, or stands for omnibuses on any street under its jurisdiction, subject to guidelines issued by the Commissioner of Transportation; WHEREAS, pursuant to the above-noted authority, the City Council of the City of Hackensack has established locations for bus stops on certain streets within the City, as enumerated in Section 170-62 of the Code of the City of Hackensack; and, WHEREAS, the City Council has determined that for safety and the expedition of traffic on the streets within the City, certain bus stops should be added and others removed, as set forth herein. CITY OF HACKENSACK ORDINANCE NO. 02-2018 AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, “VEHICLES AND TRAFFIC,” TO ESTABLISH THE SOUTH SIDE OF ATLANTIC STREET BETWEEN STATE STREET AND MAIN STREET AS A NO PARKING AREA. WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, WHEREAS, presently, Atlantic Street between State Street and Main Street is designated as a Parking Meter Zone as set forth in Section 170-70 of the Code of the City of Hackensack (“Code”); and, WHEREAS, the Traffic Bureau of the Hackensack Police Department has analyzed traffic conditions in the area, and has recommended that parking meters be removed so as to provide for the free flow of traffic on the entirety of the south side of Atlantic Street; and, WHEREAS, the City Council concurs with the analysis and conclusions reached by the Hackensack Police Department and desires to establish the south side of Atlantic Street between State Street and Main Street as a “no parking area” as established by Section 170-50 of the Code; and, WHEREAS, the City Council further wants to clarify an existing ambiguity in the Code that lists the north side of Atlantic Street between State Street and Main Street as both a Parking Meter Zone and a “no parking area” to make clear that it is strictly a “no parking area.” NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 170, Section 50 of the Code of the City of Hackensack is hereby amended to add the south side of Atlantic Street from Main Street to State Street as a No Parking area as follows [additions by underline, deletions by strikethrough]: §170-50. In exchange for the above services, the CONSULTANT shall be compensated in the following manner: a) The CONSULTANT shall be paid by the GOVERNING BODY a fee as compensation for the services rendered, an amount equal to six percent (6%) of the GOVERNING BODY’s annual assessment as promulgated by the FUNDs. Said fee shall be paid to the CONSULTANT within thirty (30) days of payment of the GOVERNING BODY’s assessment. b) For any insurance coverages authorized by the GOEVERNING BODY to be placed outside the FUND, the CONSULTANT shall receive as compensation the normal brokerage commissions paid by the insurance company. Public Comment A motion to open the meeting to the public was offered by Deputy Mayor Canestrino and seconded by Councilman Battaglia. Joe Decarlo – Summit Avenue – Hackensack – Is there any update on what the city plans to do about Airbnb? There is a four bedroom house across the street from me and they rent out two or three of the rooms and there is suspicious activity. I don’t mind as long as it is in residential areas and is regulated. City Attorney responded – I have done research and different towns take different approaches, some encourage it and regulate it. A lot of municipalities do nothing at all, some ban it all together, and some encourage it and try to obtain revenue from it. There is some legislation introduced in Trenton that would adopt a regulatory scheme though it is not clear whether the state will take any action on it. If there are legitimate issues I would encourage you to speak with the city manager. There are other parts of the city code that deal with boarding and rooming houses which may be applicable. City Manager responded – One of the major concerns for me personally is the homeland security issue. Back around September 11 th, people stayed in this city and then climbed on that plane and we can prove they were in this city. I hate to raise the concern but I think it is our responsibility to have checks and balances. I understand this is a supporting funding source to people to support their family but there seems to be no controls and nothing that documents the comings and goings. Paul Incalcaterra – Hackensack – I know the city gives vehicles out to the employees to use and the rec center has a white minivan and we already have parking issues in the area and they park this van there and leave it there for a few days. If they could park it on Holt Street, Broadway is tough 01/23/2018 22 to park on especially during the day. They park it there and leave it there especially over the holidays and it doesn’t move for two or three days. As a courtesy to the neighbors they should move it, the deli needs parking for customers too. It would be nice if you could open up that lot under construction especially when it snows. Rich Cerbo – Spring Valley Avenue – Hackensack – Your efforts have been successful because there is no one here and there is no more opposition. We have 3 minutes and then you can go home. John Lindsey the former mayor of New York City said the power to tax is the power to live. That is the case here. I saw postings that you are now going to sit and question the tax revenue coming in by the medical center. They are everywhere here. I want to make sure you are not just trying to get this over with and go easy on them. They owe this city much more than I think you will ask for. All this untaxed property that the county has, why not negotiate with our county executive to lower our tax rate? There are so many untaxed properties here. I think it is a good request to make of the county government. You should have ongoing discussions with out county. Taxes are too high. Kathy Salvo – Lodi Street – Hackensack – We do have zoning laws that say three or more people who are not related to you can’t live within the same house. We have designated rooming house areas. This bed and breakfast or whatever they want to call themselves is illegal. They cannot operate in a residential area. We have three laws in our code. The rooming houses are monitored; they have to have fire escapes. We have rules for this. We should negotiate with the county to put our salt shed next to theirs on Kansas. It is valuable property they were supposed to sell and put back on the tax rolls when they moved the homeless shelter. I will go with you to the county and we will negotiate together. You quoted the Planning Board as saying we need to bathrooms in front of the M&M Building, that was the first meeting we had as a courtesy. It was sort of a closed meeting because you can do what you want and they can only make suggestions. At the second meeting which was open to everyone, we all told you we didn’t want it and that we didn’t need the senior citizens center. The Planning Board then recommended that you don’t put it there. You took away all the open space. The BOE should be upset because the state says that you have to have 30 minutes of outdoor activity for pre-k. Those old garbage trucks are embarrassing. No one else wished to speak. Friday night there is a improv comedy night with Ryan Huban at the Arts Center. Saturday night is a PAC the House series with Hackensack’s own Matthew Whittacker who will be the opening act for Alyson Williams with the Nat Adderly Trio. There are still tickets available. On February 3, John Waite will be preforming and those tickets are selling out quickly. This Friday the Ice House is having a get together to wish well to the Olympians who have been practicing there. We have been working really hard to get the salt shed moved. Our plans are to get the salt away from Green Street. As for Airbnb, you want to know who your neighbors are especially in residential areas. Deputy Mayor Sims – Absent Councilman Battaglia – My condolences to John and his wife Debbie for the loss of his mother in law. People need to understand about taxes that four our of four up here right now pay taxes for our properties. No one wants to pay an extra few hundred a year. At least we can see the light at the end of the tunnel when before we weren’t getting any revenue and we were trying to get the taxes flat. We are working on it and it will happen. We are trying to do something and if you have better ideas then we will talk. I am trying to work with Ted to try to control the traffic and improve problems we have with speeding, parking, and distracted driving. Now we are looking into getting some kind of signs that mention the speed you are doing and light up red if you are speeding. We have to do whatever we can to keep everyone safe. People have to be more alert. Ted will have to talk to Two Brothers construction to see if we can open the parking lot to provide some relief to the school. Thank you for coming. He is amazing to watch. He’s won the night at the Apollo. John Waite on February 3 will be a great show. Ruth’s art show ends on Thursday and I want to thank her because her art really enhanced the building especially during the opening. There was chatter about the dog park this week online because Hackensack was noted in the New York Times as a great diverse city and it talks about all the stuff going on. Someone online came up with an idea to put a dog park in Memorial Park and I saw it and I politely said that won’t happen. Firemen and their wives said it was a terrible idea. The dog park belongs in Staib Park and we will work on it and get it done. I want to welcome the new board members. I am excited about the environmental board coming back on. I believe we are done with the pilings at 150-170 Main Street. 240 Main Street is two or three stories up. I have been to the Ice House’s send off for the Olympians before; it is an exciting thing to see. Most of these people are from other countries but anyone who gets to that level deserves our respect.
