The Regular Meeting of the City Council of the City of Hackensack was
held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday,
December 3, 2019 at 8:23 p.m.
Mayor Labrosse called the meeting to order and the City Clerk Deborah
Karlsson announced that the meeting was being held in accordance with the
Sunshine Law, notice having been published according to law, with a copy on
file in the City Clerk’s office, and a copy posted on the bulletin board in City
Hall.
Attendance
Ms. Karlsson called the roll: Mayor Labrosse, Deputy Mayor Canestrino,
Deputy Mayor Sims, Councilman Battaglia and Councilwoman Von
Rudenborg were present. City Manager Ted Ehrenburg was present. City
Attorney Steven Kleinman was present. Deputy City Clerk Allison Saabye
was present.

Approval of Minutes
A motion to approve the C.O.W. and Regular Meeting Minutes from October 29,
2019 was offered by Deputy Mayor Sims, seconded by Councilman Battaglia and
approved by Mayor Labrosse, Deputy Mayor Canestrino, Deputy Mayor Sims,
Councilman Battaglia, and Councilwoman Von Rudenborg.
City Manager’s Report
The City of Hackensack’s annual tree lighting has been rescheduled for
Monday, December 9, at 5:30 PM. The recreation department children’s
holiday party is scheduled for Saturday, December 14, from 10AM to 12PM at
the HACPAC. The city will be hosting a food drive for Fairleigh Dickinson
University from December 9 – 20 th. Please bring non-perishable items to the
City Hall lobby. Flyer is available on the website for more details. Be sure to
check the Hackensack newsletter which was recently mailed to your home
with details about the 2020 digital calendar and the sanitation recycling pick
up schedule. Don’t miss the HACPAC Christmas play “The Christmas Caper.”
Tickets are on sale now on the HACPAC website. The City is proud to
announce we have been awarded $271,704 from the NJ DOT for road
resurfacing for Beech Street from Summit Avenue to First Street. Building
Department update: 63 notices, 110 inspections, 6 summonses issues, 13
CCOs, and 14 OPRAs were fulfilled. The next Council meeting is December
17. We wish everyone a safe holiday. The City will hood the meters on Main
Street for the two weeks prior to Christmas to appreciate our residents and
visitors and assist with the small businesses to encourage people to come
shop in the city as well as enjoy the improvements to the city such as the
HACPAC and all the redevelopment that is occurring. We will do Anderson
Street this year too.

FINAL ADOPTION OF ORDINANCE NO. 53-2019, BOND
ORDINANCE PROVIDING FOR IMPROVEMENTS TO THE
VOORHIS LANE SANITARY SEWER PUMP STATION BY AND
IN THE CITY OF HACKENSACK, COUNTY OF BERGEN,
STATE OF NEW JERSEY; APPROPRIATING $1,200,000

A public hearing was held on November 12, 2019. No one wished to
speak.
A motion to table the adoption of Ordinance 53-2019 until December 3,
2019 was offered by Councilman Battaglia and seconded by Deputy Mayor
Sims. On December 3, 1029 a motion to remove the ordinance from the
table was offered by Deputy Mayor Canestrino and seconded by Deputy
Mayor Sims.
BE IT RESOLVED by the City Council of the City of Hackensack,
County of Bergen and State of New Jersey, that Ordinance No. 53-2019 has
passed its second and final reading and is hereby adopted.

ORDINANCE NO. 53-2019
BOND ORDINANCE PROVIDING FOR IMPROVEMENTS TO THE VOORHIS
LANE SANITARY SEWER PUMP STATION BY AND IN THE CITY OF
HACKENSACK, IN THE COUNTY OF BERGEN, STATE OF NEW
JERSEY; APPROPRIATING $1,200,000 THEREFOR AND AUTHORIZING
THE ISSUANCE OF $375,000 BONDS OR NOTES OF THE CITY TO
FINANCE PART OF THE COST THEREOF
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY
OF HACKENSACK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY (not less
than two-thirds of all the members thereof affirmatively concurring), AS FOLLOWS:
SECTION 000000000. The improvements described in Section 3 of this
bond ordinance are hereby authorized as general improvements or purposes to be
undertaken by the City of Hackensack, in the County of Bergen, State of New Jersey (the
"City"). For the said improvements or purposes stated in Section 3, there is hereby
appropriated the aggregate sum of $1,200,000, said sum being inclusive of $825,000 as
the amount of aggregate amount of down payment for said improvements or purposes as
required by the Local Bond Law, N.J.S.A. 40A:2-1 et seq. (the “Local Bond Law”). The
down payment is now available by virtue of money actually held by the City and previously
contributed for such purposes by a developer.

SECTION 0. For the financing of said improvements or purposes described
in Section 3 hereof, and to meet the part of said $1,200,000 appropriation not provided for
by application hereunder of said down payment, negotiable bonds of the City are hereby
authorized to be issued in the principal amount of $375,000 pursuant to the Local Bond
Law. In anticipation of the issuance of said bonds and to temporarily finance said
improvements or purposes, negotiable notes of the City in a principal amount not
exceeding $375,000 are hereby authorized to be issued pursuant to and within the
limitations prescribed by said Local Bond Law.
SECTION 0. The improvements and purposes hereby authorized and
purposes for the financing of which said debt obligations are to be issued is for
improvements to the Voorhis Lane Sanitary Sewer Pump Station, including but not
limited to, station improvements and replacement of existing equipment and gravity
sewer main(s) necessary to increase the capacity of sanitary sewer conveyance,
including all engineering and design work, surveying, construction planning, preparation
of plans and specifications, permits, bid documents, construction inspection and
contract administration, and all work, materials, equipment, labor and appurtenances
necessary therefor or incidental thereto.
(b) The estimated maximum amount of bonds or notes to be issued for said
purpose is $375,000.
(c) The estimated cost of said purpose is $1,200,000.
SECTION 0. In the event the United States of America, the State of New
Jersey and/or the County of Bergen make a contribution or grant in aid to the City for the
improvements and purposes authorized hereby and the same shall be received by the City
prior to the issuance of the bonds or notes authorized in Section 2 hereof, then the amount
of such bonds or notes to be issued shall be reduced by the amount so received from the
United States of America, the State of New Jersey and/or the County of Bergen. In the
event, however, that any amount so contributed or granted by the United States of
America, the State of New Jersey and/or the County of Bergen shall be received by the
City after the issuance of the bonds or notes authorized in Section 2 hereof, then such
funds shall be applied to the payment of the bonds or notes so issued and shall be used
for no other purpose. This Section 4 shall not apply, however, with respect to any

contribution or grant in aid received by the City as a result of using funds from this bond
ordinance as “matching local funds” to receive such contribution or grant in aid.
SECTION 0. All bond anticipation notes issued hereunder shall mature at
such times as may be determined by the Chief Financial Officer of the City, provided that
no note shall mature later than one (1) year from its date. The notes shall bear interest at
such rate or rates and be in such form as may be determined by the Chief Financial
Officer of the City. The Chief Financial Officer of the City shall determine all matters in
connection with the notes issued pursuant to this bond ordinance, and the signature of the
Chief Financial Officer of the City upon the notes shall be conclusive evidence as to all
such determinations. All notes issued hereunder may be renewed from time to time in
accordance with the provisions of N.J.S.A. 40A:2-8.1. The Chief Financial Officer of the
City is hereby authorized to sell part or all of the notes from time to time at public or private
sale and to deliver them to the purchaser thereof upon receipt of payment of the purchase
price and accrued interest thereon from their dates to the date of delivery thereof. The
Chief Financial Officer of the City is directed to report in writing to the governing body at
the meeting next succeeding the date when any sale or delivery of the notes pursuant to
this bond ordinance is made. Such report must include the principal amount, the
description, the interest rate, and the maturity schedule of the notes so sold, the price
obtained and the name of the purchaser.
SECTION 0. The capital budget of the City is hereby amended to conform
with the provisions of this bond ordinance and to the extent of any inconsistency herewith,
a resolution in the form promulgated by the Local Finance Board showing full detail of the
amended capital budget and capital programs as approved by the Director of the Division
of Local Government Services will be on file in the office of the Clerk and will be available
for public inspection.
SECTION 0. The following additional matters are hereby determined,
declared, recited and stated:
(0) The purposes described in Section 3 of this bond ordinance are not a
current expense and are improvements which the City may lawfully undertake as general
improvements, and no part of the cost thereof has been or shall be specially assessed on
property specially benefited thereby.

(0) The period of usefulness of said purposes within the limitations of said
Local Bond Law, according to the reasonable life thereof computed from the date of the
said bonds authorized by this bond ordinance, is 20 years.
(0) The supplemental debt statement required by the Local Bond Law has
been duly made and filed in the Office of the Clerk of the City and a complete executed
duplicate thereof has been filed in the Office of the Director of the Division of Local
Government Services in the Department of Community Affairs of the State of New Jersey,
and such statement shows that the gross debt of the City as defined in the Local Bond
Law is increased by the authorization of the bonds or notes provided for in this bond
ordinance by $375,000, and the said obligations authorized by this bond ordinance will be
within all debt limitations prescribed by said Local Bond Law.
(0) An aggregate amount not exceeding $350,000 for items of expense
listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated
herein for the purposes or improvements herein before described.
SECTION 0.0 The full faith and credit of the City are hereby pledged to the
punctual payment of the principal of and the interest on the obligations authorized by this
bond ordinance. The obligations shall be direct, unlimited obligations of the City, and the
City shall be obligated to levy ad valorem takes upon all the taxable property within the
City for the payment of the obligations and the interest thereon without limitation as to rate
or amount.
SECTION 9. The City reasonably expects to reimburse any expenditures
toward the costs of the improvements or purposes described in Section 3 hereof and paid
prior to the issuance of any bonds or notes authorized by this bond ordinance with the
proceeds of such bonds or notes. This Section 9 is intended to be and hereby is a
declaration of the City's official intent to reimburse any expenditures toward the costs of
the improvements or purposes described in Section 3 hereof to be incurred and paid prior
to the issuance of bonds or notes authorized herein in accordance with Treasury
Regulations §150-2. No reimbursement allocation will employ an "abusive arbitrage
device" under Treasury Regulations §1.148-10 to avoid the arbitrage restrictions or to
avoid the restrictions under Sections 142 through 147, inclusive, of the Internal Revenue

Code of 1986, as amended (the “Code”). The proceeds of any bonds or notes authorized
by this bond ordinance used to reimburse the City for costs of the improvements or
purposes described in Section 3 hereof, or funds corresponding to such amounts, will not
be used in a manner that results in the creation of "replacement proceeds", including
"sinking funds", "pledged funds" or funds subject to a "negative pledge" (as such terms are
defined in Treasury Regulations §1.148-1), of any bonds or notes authorized by this bond
ordinance or another issue of debt obligations of the City, other than amounts deposited
into a "bona fide debt service fund" (as defined in Treasury Regulations §1.148-1). The
bonds or notes authorized herein to reimburse the City for any expenditures toward the
costs of the improvements or purposes described in Section 3 hereof will be issued in an
amount not to exceed $375,000. The costs to be reimbursed with the proceeds of the
bonds or notes authorized herein will be "capital expenditures" in accordance with the
meaning of Section 150 of the Code. All reimbursement allocations will occur not later
than 18 months after the later of (i) the date the expenditure from a source other than any
bonds or notes authorized by this bond ordinance is paid, or (ii) the date the improvements
or purposes described in Section 3 hereof "placed in service" (within the meaning of
Treasury Regulations §1.150-2) or abandoned, but in no event more than three years after
the expenditure is paid.
SECTION 10. The City covenants to maintain the exclusion from gross
income under section 103(a) of the Code of the interest on all bonds and notes issued
under this bond ordinance.
SECTION 11. This bond ordinance shall take effect twenty (20) days after
the first publication thereof after final adoption, as provided by the Local Bond Law.

ORDINANCE NO. 54-2019
AN ORDINANCE TO AMEND CHAPTER 117 OF THE CODE OF
THE CITY OF HACKENSACK, “PARKS,” TO ESTABLISH
RULES FOR THE USE OF SYNTHETIC PLAYING FIELDS.
WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make,
amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws
of this state or of the United States, as it may deem necessary and proper for the good of government,
order and protection of person and property, and for the preservation of the public health, safety and
welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers
and duties conferred and imposed by this subtitle, or by any law; and,
WHEREAS, pursuant to N.J.S.A. 40:61-1, the City Council of the City of Hackensack
(“Council”) is further authorized to adopt ordinances for the government, use and policing of all public
parks under its jurisdiction; and,
WHEREAS, pursuant to the foregoing statutory authority, the Council has promulgated rules for
the use and enjoyment of City parks, which are codified at Chapter 117 of the Code of the City of
Hackensack (“Code”); and,
WHEREAS, the Council has installed a synthetic playing surface at Johnson Park and may do so
at other park facilities within the City; and,
WHEREAS, the Council has been advised by its professionals that certain rules are necessary to
ensure such synthetic playing surfaces remain in optimal condition for the residents of Hackensack to
enjoy, and wishes to promulgate said rules via this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HACKENSACK, as follows:
Section 1:
Chapter 117, Section 6 of the Code of the City of Hackensack is hereby amended to establish a new
subsection Q. Subsections A through P shall remain unchanged [additions by underline].
§117-6. Miscellaneous prohibited activities.
In public parks and public areas, no person shall:
Q. On any synthetic turf field in any City park (1) drink any beverage other than water; (2) eat
food of any kind; (3) chew gum; (4) bring any animals onto the field, except for "guide dogs"
and "service dogs" as defined at N.J.S.A. 10:5-5, which are performing the task or service
that the dog has been trained to do; (5) wear metal cleats; (6) bring onto the field any sharp
objects with the capability of penetrating the synthetic surface; (7) allow or operate any
unauthorized vehicles.

Section 2:
All other provisions of Chapter 117 of the Code shall remain unchanged.
Section 3:
Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this
Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being
the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same
being conflict or inconsistent with any provision of this Ordinance shall remain in effect.
Section 4:
Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection,
sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of
competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections,
sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent
this Ordinance shall stand notwithstanding the invalidity of any part.
Section 5:
Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified
and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the
official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change
any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the
codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code,
and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be
repealed.
Section 6:
This Ordinance shall take effect upon passage, adoption, and publication in the manner prescribed by law.

by application hereunder of said down payment, negotiable bonds of the City are hereby
authorized to be issued in the principal amount of $3,809,000 pursuant to the Local Bond
Law. In anticipation of the issuance of said bonds and to temporarily finance said
improvements or purposes, negotiable notes of the City in a principal amount not
exceeding $3,809,000 are hereby authorized to be issued pursuant to and within the
limitations prescribed by said Local Bond Law.

City is hereby authorized to sell part or all of the notes from time to time at public or private
sale and to deliver them to the purchaser thereof upon receipt of payment of the purchase
price and accrued interest thereon from their dates to the date of delivery thereof. The
Chief Financial Officer of the City is directed to report in writing to the governing body at
the meeting next succeeding the date when any sale or delivery of the notes pursuant to
this bond ordinance is made. Such report must include the principal amount, the
description, the interest rate, and the maturity schedule of the notes so sold, the price
obtained and the name of the purchaser.
SECTION 0. The capital budget of the City is hereby amended to conform
with the provisions of this bond ordinance and to the extent of any inconsistency herewith,
a resolution in the form promulgated by the Local Finance Board showing full detail of the
amended capital budget and capital programs as approved by the Director of the Division
of Local Government Services will be on file in the office of the Clerk and will be available
for public inspection.

SECTION 0. The following additional matters are hereby determined,
declared, recited and stated:
(0) The purposes described in Section 3 of this bond ordinance are not a
current expense and are improvements which the City may lawfully undertake as general
improvements, and no part of the cost thereof has been or shall be specially assessed on
property specially benefited thereby.
(0) The period of usefulness of said purposes within the limitations of said
Local Bond Law, according to the reasonable life thereof computed from the date of the
said bonds authorized by this bond ordinance, is 10.31 years.
(0) The supplemental debt statement required by the Local Bond Law has
been duly made and filed in the Office of the Clerk of the City and a complete executed
duplicate thereof has been filed in the Office of the Director of the Division of Local
Government Services in the Department of Community Affairs of the State of New Jersey,
and such statement shows that the gross debt of the City as defined in the Local Bond
Law is increased by the authorization of the bonds or notes provided for in this bond
ordinance by $3,809,000, and the said obligations authorized by this bond ordinance will
be within all debt limitations prescribed by said Local Bond Law.
(0) An aggregate amount not exceeding $200,000 for items of expense
listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated
herein for the purposes or improvements herein before described.
SECTION 0.0 The full faith and credit of the City are hereby pledged to the
punctual payment of the principal of and the interest on the obligations authorized by this
bond ordinance. The obligations shall be direct, unlimited obligations of the City, and the
City shall be obligated to levy ad valorem takes upon all the taxable property within the
City for the payment of the obligations and the interest thereon without limitation as to rate
or amount.
SECTION 9. The City reasonably expects to reimburse any expenditures
toward the costs of the improvements or purposes described in Section 3 hereof and paid
prior to the issuance of any bonds or notes authorized by this bond ordinance with the
proceeds of such bonds or notes. This Section 9 is intended to be and hereby is a
declaration of the City's official intent to reimburse any expenditures toward the costs of
the improvements or purposes described in Section 3 hereof to be incurred and paid prior

to the issuance of bonds or notes authorized herein in accordance with Treasury
Regulations §150-2. No reimbursement allocation will employ an "abusive arbitrage
device" under Treasury Regulations §1.148-10 to avoid the arbitrage restrictions or to
avoid the restrictions under Sections 142 through 147, inclusive, of the Internal Revenue
Code of 1986, as amended (the “Code”). The proceeds of any bonds or notes authorized
by this bond ordinance used to reimburse the City for costs of the improvements or
purposes described in Section 3 hereof, or funds corresponding to such amounts, will not
be used in a manner that results in the creation of "replacement proceeds", including
"sinking funds", "pledged funds" or funds subject to a "negative pledge" (as such terms are
defined in Treasury Regulations §1.148-1), of any bonds or notes authorized by this bond
ordinance or another issue of debt obligations of the City, other than amounts deposited
into a "bona fide debt service fund" (as defined in Treasury Regulations §1.148-1). The
bonds or notes authorized herein to reimburse the City for any expenditures toward the
costs of the improvements or purposes described in Section 3 hereof will be issued in an
amount not to exceed $3,809,000. The costs to be reimbursed with the proceeds of the
bonds or notes authorized herein will be "capital expenditures" in accordance with the
meaning of Section 150 of the Code. All reimbursement allocations will occur not later
than 18 months after the later of (i) the date the expenditure from a source other than any
bonds or notes authorized by this bond ordinance is paid, or (ii) the date the improvements
or purposes described in Section 3 hereof "placed in service" (within the meaning of
Treasury Regulations §1.150-2) or abandoned, but in no event more than three years after
the expenditure is paid.
SECTION 10. The City covenants to maintain the exclusion from gross
income under section 103(a) of the Code of the interest on all bonds and notes issued
under this bond ordinance.
SECTION 11. The Chief Financial Officer is hereby authorized and directed
to perform all acts and things, to do all that is necessary and proper and to execute and
deliver all agreements and certificates required to comply with the provisions of Rule 15c2-
12, as amended and supplemented, promulgated by the Securities and Exchange
Commission, relating to secondary market disclosure.
SECTION 12. This bond ordinance shall take effect twenty (20) days after
the first publication thereof after final adoption, as provided by the Local Bond Law.

WHEREAS, the City of Hackensack, in the County of Bergen, State of New Jersey
(“the City”) is authorized pursuant to N.J.S.A. 40A:12A-14 to determine that a delineated
area in the City is an area in need of rehabilitation; and
WHEREAS, in order to make that determination, the governing body must first
authorize the City’s Planning Board to undertake a preliminary investigation to determine

whether a proposed area is a rehabilitation area according to the criteria set forth in
N.J.S.A. 40A:12A-3 and -14; and
WHEREAS, pursuant to Resolution No. 325-18, on August 21, 2018, the governing body
authorized and requested that the Planning Board undertake a preliminary investigation (“the
Investigation”) to determine whether Blocks 223, 225, 226.01, 226.02, 227, 228, 229, 230, 232, 233,
235, 236, and 237 (“the Area of Investigation”) constituted an “area in need of rehabilitation” as set
forth in N.J.S.A. 40A:12A-3 and -14; and
WHEREAS, the governing body also authorized its planning consultant, DMR
Architects (“DMR”), to assist the Planning Board in the Investigation, and the Planning
Board appointed DMR to conduct the necessary redevelopment investigation; and
WHEREAS, consistent with the requirements set forth in N.J.S.A. 40:12A-3 and -14,
notice was given that on September 12, 2018, a hearing would be held for the purpose of
hearing all persons who were interested in or would be affected by a determination that
the properties in the Area of Investigation are a rehabilitation area as that term is defined
in Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (“LRHL”); and
WHEREAS, DMR prepared an Investigation Report that was publicly presented after
adequate notice before the Planning Board on September 12, 2018; and
WHEREAS, the Investigation Report determined that the Area of Investigation evidenced
conditions and characteristics that qualified the Area of Investigation as an “area in need of
rehabilitation” satisfying the criteria under N.J.S.A. 40A:12A-14; and
WHEREAS, on September 12, 2018, the Planning Board held a public hearing
concerning the Area of Investigation during which Joseph Mecca, Esq. represented the
Planning Board of the City; and
WHEREAS, on September 12, 2018, the Planning Board received the testimony of
Francis Reiner, L.L.A., P.P. of DMR, and Mr. Reiner provided an eye witness account of the
conditions that he observed at the Area of Investigation which confirmed the description of
conditions found in the Investigation Report; and
WHEREAS, the Planning Board hearing on September 12, 2018 was open to the
public for the purpose of hearing all persons who were interested in or would be affected
by a determination that the Area of Investigation is a rehabilitation area; and
WHEREAS, after completing its hearing and investigation of this matter, on
September 12, 2018, the Planning Board adopted a resolution recommending that the

Mayor and City Council designate the Area of Investigation as a rehabilitation area because
the Investigation Report and testimony of Mr. Reiner provide substantial evidence that the
Area of Investigation meets the statutory criteria; and
WHEREAS, pursuant to Resolution No. 376-18 adopted on September 25, 2018, the
governing body concurred with the Planning Board’s findings and determined to designate
the Area of Investigation as an “area in need of rehabilitation” pursuant to the LRHL; and
WHEREAS, at the direction of the governing body, DMR has prepared a
Redevelopment Plan entitled “Prospect – Railroad – Essex – Beech Redevelopment Plan for
an Area in Need of Rehabilitation” dated October 2019; and
WHEREAS, the governing body wishes to adopt the Prospect – Railroad – Essex – Beech
Redevelopment Plan for a portion of the Area of Investigation designated in need of rehabilitation,
consisting of Block 223, Lots 1 to 7 and 11 to 24; Block 226.01, Lots 1.01 to 1.04 and 3; Block
226.02, Lots 1 to 15 and 19 to 27; Block 227, Lots 1 to 32; Block 228, Lots 1 to 3, 6, 9 to 30, and 40
to 49; Block 229, Lots 1, 11 to 14, 28 to 43, 46; Block 230, Lots 1, 3.01 to 7, 12 to 19, 21 to 30; Block

WHEREAS, the Governor’s Council on Alcoholism and Drug Abuse
established the Municipal Alliances for the Prevention of Alcoholism and Drug
Abuse in 1989 to educate and engage residents, local government and law
enforcement officials, schools, nonprofit organizations, the faith community,
parents, youth and other allies in efforts to prevent alcoholism and drug
abuse in communities throughout New Jersey.
WHEREAS, The City Council of the City of Hackensack, County of Bergen,
State of New Jersey recognizes that the abuse of alcohol and drugs is a serious
problem in our society amongst persons of all ages; and therefore has an
established Municipal Alliance Committee; and,
WHEREAS, the City Council further recognizes that it is incumbent upon not
only public officials but upon the entire community to take action to prevent such
abuses in our community; and,
WHEREAS, the City Council has applied for funding to the Governor’s Council
on Alcoholism and Drug Abuse through the County of Bergen.
NOW, THEREFORE, BE IT RESOLVED by the City of Hackensack, County of

the design of the Voorhis Sanitary Sewer Lift Station Improvement Project;

engineering services for said project; and

Suburban Consulting Engineers is the most advantageous to the City based
on cost, expertise in this field and vast experience and specific prior
knowledge of this particular project, including the necessary sewer
separation components.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of
the City of Hackensack, County of Bergen, as follows:
1. Suburban Consulting Engineers of 96 U.S. Highway 206, Flanders, NJ
07836 is hereby awarded a contract in an amount not to exceed
$148,700 for the engineering design of the Voorhis Sanitary Sewer Lift
Station Improvement Project, in accordance with the proposal
attached thereof.
2. A Certification of Funds has been prepared and authorized by the
Chief Financial Officer for the said contract assuring that there is a
sufficient appropriation to fund the purchases authorized in this
resolution as an express and mandatory condition of the award of this
contract.
3. The budget account to be charged is C-04-19-053-000-100.
4. The Mayor and City Clerk are hereby authorized to sign the contract
documents necessary to effectuate the award of this contract. The

WHEREAS, the New Jersey Department of Transportation (“NJDOT”) has
advised the City that NJDOT will be undertaking the design and construction of a
pavement reconstruction project (“Project”) that will include a portion of Route 80
that passes through Hackensack; and,
WHEREAS, the Project may require the City to construct new facilities for its
existing water and sewer systems, or require the City to protect, relocate or adjust
existing facilities for these systems; and,
WHEREAS, NJDOT has recognized that the City is not obligated by state law
or agreement to pay for certain costs the City may incur as a result of the Project;
and,
WHEREAS, the NJDOT has prepared a Utility Engineering and Construction
Agreement (“UECA”) establishing the respective rights and responsibilities of the
parties with respect to the Project, which sets forth understandings for the
verification, design, protection and/or relocation of City water and sewer facilities in
connection with the design and construction of the Project.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City
of Hackensack that the Mayor and City Clerk are authorized to enter into the UECA
as set forth above; and,
BE IT FURTHER RESOLVED that the Mayor, City Clerk, City Manager and
City Attorney are authorized to take any additional steps necessary in furtherance
of the intent and purpose of this Resolution; and,
BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to

WHEREAS, various Year 2019 bills have been presented for payment this
year, which bills were not covered by Year 2019 Budget Appropriations; and
WHEREAS, N.J.S.A. 40A:4-58 provides that amounts in excess of
appropriations over and above the amounts deemed to be necessary to fulfill the

WHEREAS, Bergen County Community Development Grants have been
proposed by the following organizations located in the municipality of Hackensack,
New Jersey; and
WHEREAS, pursuant to the State Inter-local Services Act, Community
Development funds may not be spent in a municipality without authorization by the
Mayor and City Council; and

REQUEST PARTICIPATION IN THE “1033 PROGRAM”
WHEREAS, The U.S. Department of Defense (“DoD”) 1033 Program permits
the Secretary of Defense to transfer excess DoD supplies and equipment to state
and local law enforcement agencies for use in their law enforcement duties; and
WHEREAS, this property is procured at no cost to the agency with the
exception of any shipping or transportation costs, and includes tactical and riot
gear, vehicles, watercraft, weapons, and night vision; and
WHEREAS, in order to participate in the 1033 Program, agencies must
request permission to do so from the State Coordinator appointed by the Governor
of the State of New Jersey; and
WHEREAS, the State Coordinator then facilitates the agency’s application
process with the Federal Law Enforcement Support Office.
NOW, THEREFORE, LET IT BE RESOLVED, by the Council of the City of
Hackensack that the Director of the Hackensack Police Department, or the
designated representative thereof, is hereby authorized to solicit the State

AGREEMENT TO CLEARY, GIACOBBE, ALFIERI, JACOBS, LLC
AS CITY ATTORNEY
WHEREAS, it has become necessary for the City of Hackensack
(“City”) to engage the services of a City Attorney; and
WHEREAS, N.J.S.A. 40A:11-1 et seq. exempts professional service
services from certain requirements of public bidding provided a notice of the
appointment be printed in a newspaper of general circulation within the
municipality; and
WHEREAS, the City did undertake a competitive process to select a
City Attorney and solicited Requests for Qualifications on July 12, 2019; and

WHEREAS, the City has determined that Cleary, Giacobbe, Alfieri,
Jacobs, LLC will be the most advantageous to the City, all relevant factors
considered; and
WHEREAS, the City has qualified Cleary, Giacobbe, Alfieri, Jacobs,
LLC as City Attorney for the year 2019/2020; and
WHEREAS, the City has received a Business Registration Certificate
and Stockholder Disclosure from the firm prior to entering into a contract;
and
WHEREAS, the Chief Financial Officer has certified the availability of
funds in budget account 9-01-20-155-155-201 as an express condition of
this contract.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of
the City of Hackensack that said City Attorney be and is hereby appointed
for the year 2019/2020; and
BE IT FURTHER RESOLVED, that compensation for said City
Attorney for the year 2019/2020 shall be claimed, approved and paid in the
manner set forth in N.J.S.A. 40A:5-16 and pursuant to a professional service
agreement to be entered between the parties; and
BE IT FURTHER RESOLVED, that the maximum dollar amount of this
contract is reasonably estimated to be $180,000 over the contract term plus
litigation; however, the local unit is not obligated to spend this amount
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are
hereby authorized to sign the agreement on behalf of the City, which shall be
available for public inspection in the office of the City Clerk; and
BE IT FURTHER RESOLVED, that the City Clerk shall cause a notice

RESOLUTION APPROVING THE INSTALLATION OF NEW
WATER MAIN, THE REPLACEMENT OF EXISTING WATER
MAIN AND THE INSTALLATION OF THREE (3) NEW PUBLIC
FIRE HYDRANTS IN CONNECTION WITH THE
DEVELOPMENT AT 66-70 ZABRISKIE STREET
WHEREAS, Hackensack Jefferson LLC is the redeveloper of property within
the City of Hackensack at 66-70 Zabriskie Street, at the corner of Kinderkamack
Road; and,
WHEREAS, in connection with this project, the City’s water service provider,
Suez Water New Jersey, Inc. (“Suez”), has advised that Hackensack Jefferson LLC
has submitted to Suez an application for extension to its distribution system that
includes the installation or replacement of water main and the installation of three
new public fire hydrants; and,
WHEREAS, this project is necessary to supply domestic and fire water
service to the premises being redeveloped at 66-70 Zabriskie Street; and,
WHEREAS, Suez has advised that it requires the approval of the City Council
in order to proceed with the aforementioned work.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City
of Hackensack as follows:
1. The City approves a replacement and extension to the distribution
system of Suez to provide for the installation of 800’ of new 8” main in
Jefferson Street between Johnson Avenue and Kinderkamack Road; and
the replacement of 550’ of 6” main with 12” main in Jefferson Street
between Main Street and Johnson Avenue.
2. The City approves the installation of three (3) new public fire hydrants
along the east side of Kinderkamack Road between Zabriskie Street
and Madison Street, to be used for fire purposes only, in accordance
with Suez’s rules and regulations, and its rates as set forth in its
Schedule of Rates filed with the New Jersey Board of Public Utilities in
Newark, New Jersey.
3. All work shall be performed in accordance with the applicable
provisions of the Hackensack City Code and any applicable regulations
relating thereto, including, but not limited to, Chapter 148 of the City
Code relating to excavations and openings so as to ensure public
safety and the restoration of any street or right-of-way surface to the
City’s satisfaction.
4. The Mayor, City Clerk, City Manager and City Attorney are authorized
to take any additional steps necessary in furtherance of the intent and
purpose of this Resolution;
5. A copy of this Resolution shall be forwarded by the City Clerk to the
appropriate representatives of Suez.
Public Comment
A motion to open the meeting to the public was offered by Councilwoman
Von Rudenborg and seconded by Deputy Mayor Canestrino.
Dora Mae Davis – Hackensack – Do you ever do robo calls to the community
in reference to community events such as last night’s Christmas tree
lighting? I only found out through the internet and I would like to know if
there are any community awareness calls.
Mayor Labrosse responded – I asked the City Manager’s office yesterday
morning to do a reverse 911 call throughout the city for the event so one
should have gone out.
Kathleen Salvo – Hackensack – Closing schools for elections would be good
because it is very dangerous. I want to thank Captain Foley and Natale but it
is still not safe by ECDC. We talked about jaywalking and there is no way for
people to cross Broadway because there is no crosswalk but next week, they
will remove the handicapped spot that is not used and install a crosswalk.
There is a shortage of crossing guards. I asked them why and it is because
we don’t pay them enough. They get under $13 dollars to start. Paramus
gives them $22. We are shooing ourselves in the foot. For $12, I wouldn’t
want to get wet so when it rains, they call out sick and we have to put an
officer in their place and they might be needed elsewhere. We should think
about giving them more so we can get more crossing guards. I saw the 25-
mph speed thing on Spring Valley but it doesn’t matter because no one is
there to give you a ticket. We should give some tickets out too.
Rich Cerbo – Hackensack – What was that all about on Spring Valley Avenue?
It was a flashing sign. It was there a while and you go there now and they
are going 100 mph. What does it do? Why do you do it? Just to show that
you are doing something? Maybe we can do a review or some kind of
discussion about how we are progressing with redevelopment. It seems like
it is all over the place. It is a city in chaos rather than functioning or moving
ahead. Let’s discuss the plan. Does it take anything to include the public in

what is going on? When you spend you are driving inflation on every level of
government. Every increase that happens, this group and that group, that
drives inflation up because there is no check on it. It is automatic. The Main
Street thing, where is that going? One block at a time? Is there a target
date on Main Street improvements, the two way?
City Manager responded – Each one of these sections are being done by
different contractors or different engineering firms. We have the best
intentions and estimates to do this and then we dig into the street and find
things we did not anticipate. I can’t sit here and say we will be ready by
October of 2020 for the street conversion because the truth is the minute I
say that publicly, we will have people in the audience say you said on this
date that this was going to be done. We will have monthly meetings will the
engineers to focus our attention to get this done. The mission is to make the
two-way conversion and separation done because it is a mandate by the DEP
and it is necessary for a city of this size to make sure it resolves flooding
conditions, improve property values. If we tore up all of Main Street at once
we would have mass chaos. Who is going to come to Hackensack if the
streets are all closed?
Mayor Labrosse responded – Studies show that traffic trailers are very
effective in slowing down speeders and educating people. It does work. The
redevelopment is not all over. The rehabilitation zone is 163 acres
downtown. Look at that as one project with a bunch of small projects that
are part of it. The other projects we have are Zabriskie Street, the train
station, Lot C, and the Record property.
City Manager responded – We have a goal setting meeting, we have year-
end reports where we identify this progress. Going back to the street signs,
there are three parts of traffic – enforcement, engineering, and education.
As a retired chief of police, I used to leave those trailers out for two weeks,
that gave the public notice that we are going to start enforcement and ticket
writing. When they come to complain to the Mayor and Council, they had
notice, we told them we would enforce it, and then we enforced it.
No one else wished to speak. A motion to close the meeting to the public was
offered by Deputy Mayor Canestrino and seconded by Deputy Mayor Sims.
Council Comments
Councilwoman Von Rudenborg – We have some events coming up. The City
Manager mentioned the food drive, the Christmas Caper at the HACPAC, the
police are doing a toy drive, Johnson Public Library is doing a create an
ornament event, the tree lighting is December 9. Hackensack Junior
Wrestling started tonight and they will be having two matches at the M&M
Center. It is nice for them to have the new space. We are excited to show
off the M&M. Thank you to Deputy Mayor Sims for giving out turkeys. Thank
you to Lt. Lupo for his presentation to veterans. Anything we can do for our
veterans is great, especially with the political climate, we owe everything,
our freedom, democracy, all those things to our veterans who are protecting
our freedom. Thank you to the Environmental Commission for coming out
tonight. I think the plan for Staib Park is wonderful but there are some
logistics we have to figure out before we make a decision. Congratulations
to the Deputy Mayor for her award. She does so much and knows her stuff
and is a great role model. I am still nervous up here and I have her to say be
confident, you will learn. She deserves it. Thank you.
Deputy Mayor Canestrino – A couple important things on the docket tonight,
there is some bond work tonight to support the sewers, paving, parks, police
and fire communications system, DPW new equipment, plus some repairs at
city hall. A lot of that was on the docket and thanks to Jim for managing it so
well to be able to afford these things. I was at the last FAA meeting. I want
to thank the residents for reporting. I asked for your support and we had

250 different individuals reporting and 365 complaints filed this year to date.
The big number is the 250 individuals because the FAA looks at both of those
numbers. It is not just the same people calling all the time. Thank you for
the support and continue to do it. The FAA is still targeting March 26, 2020
for the alternate flight path over Route 17. They will be having public
meetings for feedback and the target date for that is January 8. I will keep
everyone informed so we will have a good showing. There have been 16,828
events over Hackensack. An event is either an aircraft entering to arrive or
taking off from Teterboro to fly over the city. That is a lot of events that
were between 79 and 82 decibels of sound. That is an unacceptable amount
of sound to be exposed to with that frequency. We have to continue to
report those issues. All in all, I think it was a productive meeting. Hope
everyone had a happy thanksgiving. See you all at the tree lighting next
week.
Councilman Sims – Congratulations to the Art Club. Woman of the Year in the
State of New Jersey, what an honor. This Council with many others were
down at the league to express our support and thank you for your hard work.
I want to thank the Environmental Committee for their presentation today.
We will look into and come up with a solution. Free parking on Main Street
for two weeks before Christmas is amazing. You will see the bags over the
meters. The last day for leaf pick up is Saturday December 14. Be mindful.
Last night we got a little glimmer of what the snow will be like and I saw a lot
of cars parked where it says no parking so the plows couldn’t plow those
streets. Please move your car if it is snowing more than 4 inches. Great job
to the DPW for the winter. The newsletter will be going out this weekend.
Before Thanksgiving, junior basketball gave out 415 turkeys to those in
need. I want to salute all of the volunteers and sponsors who fed a lot of

Councilman Battaglia – Congratulations to Kathy for a well-deserved award.
She takes care of her mother who is 101 years old and Emil has been sick for
the past three weeks. I attended a meeting with the PSE&G people and they
promised that they are going to improve the lighting. One reason that
people don’t pay attention to traffic signals, the red hand says stop don’t go
and they continue to walk and the cars have to stop. You need to pay
attention. At night, they need to wear reflective clothes. The DPW did a

The paving program continues and we are making a list for the next few

Mayor Labrosse – I ask those in TV land to come take a look at the tree
downstairs. I am all in favor of Election Day school closures. I always
thought having the schools open on Election Day was a bad mix especially
now with all the school shootings. Next Monday is our tree lighting. It will be
the second lighting of our new tree. Let’s make it a banner year for the
police toy drive this year so the kids can reap the benefits. Becoming a
veteran friendly city was mentioned earlier. There are three components to
that, 5% of our employees would be veterans, we would give up a few
parking spots to designate them to veterans, and 6% off set to fund veteran
programs and contracts. Staib Park and the Environmental Commission, it is
a great idea but it does have some challenges. We have to come up with a
solution for snow storage. I want to bring up that Borg’s Woods is a 20-acre
track of forest in downtown Hackensack, it is owned by Bergen County and
anyone at any time can enjoy that park. It is underutilized. It is gorgeous
and it is right in the middle of Hackensack. Congrats to Hackensack Art Club
on 80 years. They are still going strong. I hope everyone had a wonderful
