The Regular Meeting of the City Council of the City of Hackensack was conducted as an Electronic Public Meeting in lieu of its in-person regular Public Meeting previously advertised for 7:00 P.M. at the Council Chambers at Hackensack City Hall. This Electronic Public Meeting is being held in lieu of an in- person public meeting due to the state of emergency arising from the current situation involving the COVID-19 Virus and to ensure the health, safety and welfare of the public. The meeting was held on Tuesday, October 12, 2021 at 8:00 P.M. Members of the public were able to participate in the meeting by using the “Zoom” online meeting platform. Mayor Labrosse called the meeting to order and the City Clerk Deborah Karlsson announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall. Ms. Karlsson: Pursuant to the Open Public Meetings Act and recent regulations issued by the State of New Jersey, the following procedures will be in effect for public comment during this remote public meeting of the City Council. The public shall have an opportunity for comment during the designated public portion of this meeting. The time period for public comment is limited to three minutes for each speaker and no person may address the Council more than once, except for speaking during an advertised public hearing for an ordinance. At the time designated for public comment, the Mayor or other presiding officer of the Council will recognize one speaker at a time. That speaker must identify himself or herself by full name and whether or not he or she resides in Hackensack. No other member of the public is permitted to speak unless recognized by the presiding officer, and other remote attendees may be muted during that time if necessary, to eliminate background noise. Meeting attendees shall exhibit appropriate demeanor during this meeting, as required by Section 37-15 of the City Code. In the event any member of the public becomes disruptive at any time, that individual may be muted by the presiding officer and will receive a warning that continued disruption may result in being prevented from speaking or removed from the meeting entirely. The Zoom meeting platform has a texting function, however, this is to be used only for the purpose of advising the City’s IT staff of any technical concerns or issues. The public may also submit written public comments to be audibly read into the record by the City Clerk during the public portion of any remote public meeting of the City Council. Comments can be submitted by regular mail or by e-mail to asaabye@hackensack.org. Comments received less than five hours before the start of a meeting may be carried to the next meeting. Any person who actually speaks during the public comment portion of a remote public meeting may not also have a comment read into the record. The City Clerk will stop reading a written comment into the public record once it reaches the three (3) minute limit. Duplicate written comments may be summarized and noted for the record in a consistent manner. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 170, Section 50 of the Code of the City of Hackensack is hereby amended as follows [additions by underline, deletions by strikethrough]: §170-50 Schedule I: No Parking. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed. CITY OF HACKENSACK ORDINANCE NO. 52-2021 AN ORDINANCE TO AMEND CHAPTER 170, SECTION 71 OF THE CODE OF THE CITY OF HACKENSACK, “RESIDENTS ONLY ON- STREET PARKING,” TO REQUIRE VEHICLES TO BE REGISTERED 10/12/2021 5  IN THE STATE OF NEW JERSEY TO RECEIVE A RESIDENTS ONLY ON-STREET PARKING PERMIT WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, WHEREAS, pursuant to the foregoing statutory authority, the City Council of the City of Hackensack has promulgated regulations regarding “residents only on-street parking” areas, which are codified at Chapter 170, Section 71 of the Code of the City of Hackensack (“Code”); and, WHEREAS, the City Council has received recommendations from its parking and public safety professionals to formally establish requirements that an applicant’s driver’s license matches the address for which the residents-only on-street parking permit is sought, and further that vehicles eligible for a residents-only on- street parking permit must be registered in New Jersey; and, WHEREAS, the foregoing will further ensure that a vehicle receiving a residents-only on-street parking permit is being used by a bona fide resident of the City, except for college students eligible for a permit who live in another state when not attending school within the City of Hackensack; and, WHEREAS, the City Council has determined, after consulting with said professionals, to implement the aforementioned change as proposed herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 170, Section 71, Subsection B of the Code of the City of Hackensack is hereby amended as follows [additions by underline]: §170-71 Residents only on-street parking. B. Application for parking permits under this section shall be made in writing to the Police Department on forms provided for that purpose. Permits shall be granted only under the following terms and conditions: (1) The applicant must be a bona fide resident within the enumerated streets or parts of streets constituting the applicable resident-only parking area as set forth in Subsection E. The applicant must provide appropriate documentation of such residency such as a deed or lease or utility bill or other verifiable information at the time of the application. The applicant’s New Jersey driver’s license and vehicle registration must match the address for which the residents-only on street parking permit is sought, except for permits issued to college students as set forth in (4), below. (2) The applicant shall submit either as proof of his or her ownership of the vehicle a copy of the lease agreement pertaining to his or her possession or such other verifiable information establishing that the vehicle is used by the resident on a regular and continuing basis. Except for permits issued to college students as set forth in (4), below, the vehicle shall be registered in the state of New Jersey. (3) UNCHANGED (4) UNCHANGED Section 2: All other provisions of Chapter 170 of the Code shall remain unchanged. Section 3: Repeal of Inconsistent Provisions. Council Intr Secon Abstai Absen Recuse Member o d Yes No n t d Von Rudenborg X X Deputy Mayor Canestrino X Battaglia X X Carroll X Mayor Labrosse X CITY OF HACKENSACK RESOLUTION NO. 402-21 RESOLUTION AUTHORIZING AN AMENDMENT TO A REDEVELOPMENT AGREEMENT WITH THE HACKENSACK UNIVERSITY MEDICAL CENTER, A 10/12/2021 7  MEMBER OF THE HACKENSACK MERIDIAN HEALTH NETWORK, RELATING TO THE SECOND STREET REDEVELOPMENT PLAN WHEREAS, pursuant to Resolution No. 133-20, the City Council approved a Redevelopment Agreement with the Hackensack University Medical Center (“HUMC”), a Member of The Hackensack Meridian Health Network, which was executed by the parties on March 13, 2020; and, WHEREAS, the Redevelopment Agreement addressed the construction of a building addition and other site related improvements, all in accordance with the Second Street Redevelopment Plan; and, WHEREAS, under and pursuant to the Redevelopment Agreement, the HUMC agreed to certain improvements to the City stormwater and sewer infrastructure systems in accordance with the Second Street Redevelopment Plan; and, WHEREAS, the City has agreed to accept from HUMC a Payment In Lieu of the aforementioned infrastructure improvements which were to be undertaken by the HUMC under the Agreement; and, WHEREAS, the HUMC and City wish to amend the Agreement with respect to the modification of the HUMC’s obligation to carry out the aforementioned infrastructure improvements. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Hackensack, in the County of Bergen, State of New Jersey as follows: 1. The above recitals are hereby incorporated as if restated herein in full. 2. An amendment to the Redevelopment Agreement between the Hackensack University Medical Center, a Member of the Hackensack Meridian Health Network, and the City of Hackensack, in the form as attached hereto and incorporated herein, is hereby approved. Deputy Mayor Canestrino is authorized to execute the amendment to the Redevelopment Agreement in lieu of Mayor John Labrosse, who has recused himself from this matter. 3. All other terms of the Redevelopment Agreement between the parties that are not a subject of the amendment referenced in this Resolution shall remain valid and fully enforceable by the parties. 4. Deputy Mayor Canestrino, the City Manager, the City Attorney and the City Clerk are authorized and directed to take all necessary and appropriate action to effectuate the intent and purpose of this Resolution. 5. Council Intr Secon Abstai Absen Recuse Member o d Yes No n t d Von Rudenborg X Deputy Mayor Canestrino X X Battaglia X X Carroll X Mayor Labrosse X CITY OF HACKENSACK RESOLUTION NO. 403-21 10/12/2021 8  RESOLUTION AWARDING CONTRACT TO SUBURBAN ENGINEERING FOR ENGINEERING SERVICES – JOHNSON PARK SPORTS FACILITY FINAL DESIGN, ENVIRONMENTAL PERMITTING & BID PHASE SERVICES WHEREAS, the City of Hackensack has committed to a comprehensive renovation of Johnson Park, including the construction of a sports facility, and requires engineering services for the final design, environmental coordination, production of construction documents, and assistance with all phases of the public bidding process; and WHEREAS, the City solicited Requests for Proposals regarding the engineering services required for said project; and WHEREAS, it was determined that the proposal received from Suburban Consulting Engineers is the most advantageous to the City based on cost, expertise in this field and prior experience with this particular location and project. NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack, County of Bergen, as follows: 1. Suburban Consulting Engineers of 96 U.S. Highway 206, Flanders, NJ 07836 is hereby awarded a contract in an amount not to exceed $222,150 for the engineering services related to the Johnson Park Sports Facility Final Design, Environmental Permitting and Bid Phase Services, in accordance with the proposal attached thereof. 2. A Certification of Funds has been prepared and authorized by the Chief Financial Officer for the said contract assuring that there is a sufficient appropriation to fund the purchases authorized in this resolution as an express and mandatory condition of the award of this contract. 3. The budget account to be charged is C-04-21-025-000-100. 4. The Mayor and City Clerk are hereby authorized to sign the contract documents necessary to effectuate the award of this contract. The City Attorney shall review any and all contractual documents prepared in furtherance of this award. FOR IMPLEMENTATION AND ADMINISTRATION OF THE CITY OF HACKENSACK COVID 19 MINI-GRANT RENTAL ASSISTANCE PROGRAM WHEREAS, the City of Hackensack wishes to retain the services of a qualified organization to provide the assistance necessary for the implementation and administration of the City’s Covid 19 Mini-Grant Program for Low-to-Middle Income Renters’ Assistance; and 10/12/2021 9  WHEREAS, Greater Bergen Community Action Inc., a not-for-profit organization, offered to provide said services to the City of Hackensack and is qualified to render same; and WHEREAS, the City of Hackensack has a need to acquire these services without a “fair and open process” as defined by P.L. 2004, c.19, the “Local Unit Pay-to-Play Law”; and WHEREAS, prior to the execution of the contract, Greater Bergen Community Action Inc. will have completed and submitted a Business Entity Disclosure Certification, which certifies that they have not made any reportable contributions to a political or candidate committee for a candidate for, or holder of, the office of City Council of the City of Hackensack (the “City”) in the previous year, and that the contract will prohibit Greater Bergen Community Action Inc. from making any reportable contributions through the term of the contract. NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack, County of Bergen, as follows: 1. Greater Bergen Community Action Inc. of 392 Main St., Hackensack, NJ 07601 is hereby awarded a contract in an amount not to exceed $25,000 for the implementation and administration of the City of Hackensack Covid 19 Mini-Grant Low-to-Middle Income Renters’ Assistance Program, in accordance with the proposal attached thereof. 2. A Certification of Funds has been prepared and authorized by the Chief Financial Officer for the said contract assuring that there is a sufficient appropriation to fund the purchases authorized in this resolution as an express and mandatory condition of the award of this contract. 3. Coming up this weekend is the Community Bike Run with the Police Department. I went last year and it was a great event. There are some drive-in movies coming up, the Police Department is presenting how to recognize and avoid scams Saturday October 23 at 4PM. Deputy Mayor Canestrino – With the FEMA update, one resident mentioned how to get the information to the public. If we could put that video up on the website. I 10/12/2021 17 think that FEMA had other talking points too to post as well. The application process is almost over so we need to get the word out. I saw someone walking door to door today. If you had damages from Ida, make sure you get that application in. From the COW meeting, the City with Greater Bergen received the NPP award to restore the Anderson Street area. It runs over multiple years and working together will help some local businesses. It will be a way to help those who are there adapt to the new clientele. We can use trash cans and planting over there. The pocket parks are being worked on and moving forward to receive estimates to get them put in place. Wonderful use of areas that are not being utilized. One major thing to talk about on the docket is the agreement with the medical center to obtain infrastructure improvements to alleviate some stormwater issues. We have developed a great public private partnership with the hospital over the years. Thank you to the engineering for presenting about the sewer updates. I think Ms. Davis said she wanted something broken down simpler for the residents to understand and going forward we want to make these reports easy to understand. We are trying to give as much information as we can but in a way we can all understand. Maybe can get pictures or a visual something easy to understand and keeps people aware of the work going on. Thank you to Gary and the Commission for the pocket parks. I hope they come to fruition in the next few years. The paving continues. The Manager is looking to implement safety devises on some of the intersections. It won’t be done overnight but we are working on a safer environment around the city. Councilman Carroll – I would like to thank FEMA for their presentation. It was well presented and gave a lot of information for residents to file if necessary. The sewer update was fantastic to keep everyone informed about what is going on. I would like to thank fire, police and DPW for this past weekend. The events were well attended.
