The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday, April 11, 2023 at 8:00 p.m. Mayor Labrosse called the meeting to order and the Deputy City Clerk announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall. Attendance Ms. Saabye called the roll: Mayor Labrosse, Councilman Battaglia, Councilwoman Von Rudenborg and Councilman Carroll were present. Deputy Mayor Canestrino was absent. City Manager Vincent Caruso was present. City Attorney Steve Kleinman was absent. City Clerk Deborah Karlsson was absent. Deputy City Clerk Allison Saabye was present. Flag Salute Proclamations and Presentations – None Approval of Minutes – A motion to approve the Executive, C.O.W., and Regular Meeting Minutes from March 14, 2023 was offered by Councilwoman Von Rudenborg, seconded by Councilman Battaglia and approved by Mayor Labrosse, Councilwoman Von Rudenborg, Councilman Battaglia, and Councilman Carroll. A motion to approve the Executive, C.O.W., and Regular Meeting Minutes from March 28 and March 28, 2023 was offered by Councilwoman Von Rudenborg, seconded by Councilman Battaglia and approved by Mayor Labrosse, Councilman Battaglia, and Councilman Carroll. Councilwoman Von Rudenborg abstained. City Manager’s Report Be advised that as of April 1st, our recycling center has moved to the DPW located at 120 East Broadway. As of May 1st, our recycling collection has been revised to alternate collection. Bottles and cans will be collected one week and cardboards will be the next. Hangtags will be distributed and notifications will be posted on social media. Registration for the Recreation summer program opened on April 10th. Be sure to register your child for a fun-filled summer experience. Slam Dunk the Junk is scheduled for April 29 th from 9AM to 1PM, please register online before April 24th. The City’s 29th annual golf outing is on June 8th. You can follow the link on the website for registration details. The City is holding a shred event which is scheduled for Saturday, June 24 th from 9AM to 1PM at Johnson Park. The City of Hackensack is hosting opening day of baseball this Saturday April 15 th in Foschini Park. The City along with the Shade Tree Committee will host an Arbor Day celebration on April 28th at 10AM at Union Street Park. This year’s tree will be planted in memoriam of Al Chanel Junior, a Hackensack employee of over 35 years and tree supervisor from 2004 to 2017. The City recently launched a cannabis webpage for general information and inquiries. Feel free to check it out at www.hackensack.org/cannabis. The Police Department will be hosting their 22nd annual youth academy from August 21 st to August 25th. Please contact the Police Department for applications or refer to the website. The PBA will be hosting their second annual car show on June 11 th at the Costco parking lot. Please refer to social media for information and details. We now have a City “Safe Exchange Zone” which is located in the City Hall parking lot, there are two spaces which are also used for 15 minute parking spaces however they can be identified by the green lines and signage. This will allow our community to conduct private party transactions at the Hackensack Police Department. These spaces will have 24- hour surveillance but optimal transactions should be scheduled between 8AM and 5PM. CITY OF HACKENSACK ORDINANCE NO. 16-2023 AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, “VEHICLES AND TRAFFIC,” TO REMOVE HANDICAPPED PARKING SPACE IN SECTION 49.2, “PARKING FOR THE HANDICAPPED,” (73 BROADWAY) WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, WHEREAS, the City Council of the City of Hackensack wishes to amend Chapter 170 of the Code of the City of Hackensack, entitled “Vehicles and Traffic,” to remove a handicapped parking space from Section 49.2, entitled “Parking for the Handicapped;” and, WHEREAS, the City Council finds it is in the City’s best interest to take this action. CITY OF HACKENSACK ORDINANCE 17-2023 CALENDAR YEAR 2023 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14) 04/11/2023 3  WHEREAS, the Local Government Cap Law, N.J.S. 40A:4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the City Council of the City of Hackensack in the County of Bergen finds it advisable and necessary to increase its CY 2023 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the City Council hereby determines that a 2.5% increase in the budget for said year, amounting to $2,365,853.63 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap law, is advisable and necessary; and, WHEREAS, the City Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. NOW THEREFORE BE IT ORDAINED, by the City Council of the City of Hackensack, in the County of Bergen, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2023 budget year, the final appropriations of the City of Hackensack shall, in accordance with this ordinance and N.J.S.A. 40A:4-45.14, be increased by 2.5%, amounting to $2,365,853.63 and that the CY 2023 municipal budget for the City of Hackensack be approved and adopted in accordance with this ordinance; and, BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within five (5) days of introduction; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within five (5) days after such adoption. CITY OF HACKENSACK ORDINANCE NO. 18-2023 AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, “VEHICLES AND TRAFFIC,” TO ADD A NEW HANDICAPPED PARKING SPACE IN SECTION 49.2, “PARKING FOR THE HANDICAPPED” (HAYNES STREET) WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, WHEREAS, the City Council of the City of Hackensack wishes to amend Chapter 170 of the Code of the City of Hackensack, entitled “Vehicles and Traffic,” to add one (1) new handicapped parking spaces to Section 49.2, entitled “Parking for the Handicapped;” and, WHEREAS, the Hackensack Police Department and the City Engineer have investigated the matter and have determined that adding such handicapped parking spaces will not significantly impact on-street parking, nor will it affect traffic flow. WHEREAS, the City Council finds it is in the City’s best interest to take this action. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 170, Section 49.2 of the Code of the City of Hackensack is hereby amended as follows [additions by underline] §170-49.2. Parking for the handicapped. E. Designation of parking areas. Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Section 4: Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent 04/11/2023 5 jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part. Section 5: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed. CITY OF HACKENSACK ORDINANCE NO. 20-2023 AN ORDINANCE TO AMEND CHAPTER 34 OF THE CODE OF THE CITY OF HACKENSACK, “PUBLIC WORKS, DEPARTMENT OF” TO CLARIFY RESPONSIBILITY FOR TREE PLANTING, MAINTENANCE AND REMOVALS WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and 04/11/2023 6 welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, WHEREAS, pursuant to N.J.S.A. 40:81-10, the municipal council in a municipality governed by the Municipal Manager form of government law may determine the powers and duties of municipal departments and offices as it may deem necessary for the proper and efficient conduct of the affairs of the municipality; and, WHEREAS, pursuant to the aforesaid authority, the City Council of the City of Hackensack has established a Department of Public Works in Chapter 34 of the Code of the City of Hackensack (“City Code”), which among other duties, oversees trees within the City’s control; and, WHEREAS, the City wishes to clarify Chapter 34 of the City Code so as to more clearly assign authority over public trees and formally establish that the Supervisor of the Tree Division of the Department of Public Works, subject to the direction of the Director of Public Works and the City Manager, is responsible for public tree care and for planting, maintaining and/or removing trees from streets, parks and other public spaces; and, WHEREAS, the Tree Division Supervisor shall further consult with the City’s Shade Tree Advisory Committee as appropriate and necessary to effectively perform his or her duties. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 34 of the Code of the City of Hackensack is hereby amended to add a new Section 34-4, entitled “Tree Division supervisor, duties and responsibilities,” to read as follows: §34-4. Tree Division supervisor, duties and responsibilities. A. The City employee assigned to serve as Supervisor of the Tree Division of the Department of Public Works, subject to the oversight of the Superintendent of Public Works and the City Manager, shall be the City official primarily responsible for the following matters: 1. For those trees on City property that are not the responsibility of the owner of a property adjacent to a public right-of-way or easement as established by Section 162- 2(B) of the City Code, the planting, cultivating, pruning, spraying or removal of any tree or shrub. 2. Determining whether any diseased, decayed or otherwise damaged tree situated on public property or within a public right-of-way presents a public hazard or creates a blight and therefore must be pruned or removed. 3. Promptly addressing any requests by a public utility company for the pruning or removal of trees within a utility right-of-way. 4. Enforcing, along with other applicable City employees and officials, the provisions of Chapter 162 of the City Code, which establishes various rules and regulations governing shade trees located on public property or in the public right-of-way in front of any established lot or parcel in the City. 5. Researching and utilizing the best available practices for planting, maintaining, and/or removing trees located on City property. B. The Supervisor of the Tree Division may consult with the Shade Tree Advisory Committee as necessary and appropriate to effectively perform his or her duties and shall serve as the City’s liaison to the Shade Tree Advisory Committee in all matters for which said is Committee empowered to provide guidance and direction. Under no circumstances shall such consultation delay the removal of any dead, diseased, decaying or otherwise damaged tree that may present a risk to public safety. 04/11/2023 7  C. Nothing in this Ordinance is intended to modify or limit in any way the provisions of Section 162-2(B) of the City Code, which establishes that the maintenance of any Shade Tree, as defined in Chapter 162 of the City Code, shall be the sole responsibility of the owner of the property adjacent to such public right-of-way or easement. Section 2: All other provisions of Chapter 34 of the Code shall remain unchanged. Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Section 4: Severability. ORDINANCE NO. 21-2023 CITY OF HACKENSACK COUNTY OF BERGEN ORDINANCE AUTHORIZING CONVEYANCE OF BLOCK 204, LOT 5 (18-20 BRIDGE STREET) PURSUANT TO REDEVELOPMENT AGREEMENT AND GLOBAL SETTLEMENT AGREEMENT WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq., as amended and supplemented (“LRHL”), provides a process for municipalities to participate in the redevelopment and improvement of areas in need of redevelopment with a designated private redeveloper; and WHEREAS, the governing body serves as an instrumentality and agency of the City of Hackensack (the “City”) pursuant to the LRHL for the purpose of implementing redevelopment plans and carrying out redevelopment projects within the City (the “Redevelopment Entity”); and WHEREAS, N.J.S.A. 40A:12A-8 authorizes the City to enter into contracts or agreements for the planning, construction or undertaking of any development project or redevelopment work in an area in need of redevelopment; and WHEREAS, on or about August 4, 2015, to resolve multiple lawsuits involving the City, the City entered into a Global Settlement Agreement and Release (“Global Settlement Agreement”) with certain owners of real property within the City, pursuant to which the City agreed to take various redevelopment actions under the LRHL in connection with Block 205, Lots 2, 5, 6, and 7 (50 Main Street); Block 204, Lot 5 (18-20 Bridge Street); Block 205, Lots 4 and 8 (59-61 Moore Street and 62-64 Main Street); and WHEREAS, on November 10, 2015, pursuant to Resolution No. 478-15, the City authorized and requested that the Planning Board undertake a preliminary investigation to determine whether Block 205, Lots 2, 5, 6, and 7 (50 Main Street) and Block 204, Lot 5 (18-20 Bridge Street) (the “Area of Investigation”) constitute an area in need of redevelopment in conjunction with the previously designated redevelopment area of Block 205, Lots 4 and 8 (59-61 Moore Street and 62-64 Main Street) according to the criteria set forth in N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and WHEREAS, on December 9, 2015, the Planning Board held a properly noticed public hearing at which the planner presented the findings of his preliminary investigation report for the Area of Investigation resulting in a determination to recommend that Block 204, Lot 5 and Block 205, Lots 2, 4, 5, 6, 7, and 8 (the “Project Site”) be designated as an area in need of redevelopment; and WHEREAS, on February 9, 2016, pursuant to Resolution No. 46-16, the City concurred with the Planning Board’s determination that the Project Site is an area in need of redevelopment for non-condemnation purposes; and WHEREAS, on February 23, 2016, pursuant to Ordinance No. 70-16, the City adopted the 50-52 Main Street Redevelopment Plan (the “Redevelopment Plan”), consisting of the properties within the Project Site; and WHEREAS, on July 13, 2016, the Planning Board adopted a resolution providing preliminary and final site plan approval (“Site Plan Approval”) for the redevelopment of the Project Site into two buildings (one five stories and one two stories) containing a total of 42 rental apartment units, retail space, parking and on-site improvements (the “Project”); and WHEREAS, on February 13, 2018, pursuant to Resolution No. 41-18, the City designated Mansion House Urban Renewal, LLC as the designated redeveloper of the Project Site and authorized entry into a Redevelopment Agreement with Mansion House Urban Renewal, LLC; and WHEREAS, on March 16, 2018, pursuant to Resolution No. 41-18, the City and Mansion House Urban Renewal, LLC entered into a Redevelopment Agreement (the (Redevelopment Agreement”) for the redevelopment of the Project Site in accordance with the Redevelopment Plan and the Site Plan Approval; and 04/11/2023 9  WHEREAS, the City is the owner of a certain parcel of land located within the Project Site, designated as Block 204, Lot 5 (the “Property”) on the Tax Map of the City of Hackensack and commonly known as 18-20 Bridge Street; and WHEREAS, the Redevelopment Agreement, in accordance with the Global Settlement Agreement, requires the City to convey title to the Property to the designated redeveloper for the Project Site to be used as parking in connection with the Project; and WHEREAS, conveyance of the Property to the redeveloper has not yet occurred because the Property has been the subject of remediation activities under the supervision of the New Jersey Department of Environmental Protection (“NJDEP”); and WHEREAS, on August 21, 2018, pursuant to Resolution No. 311-18, the City approved the application of DPB Associates Urban Renewal, LLC to assign the rights and obligations contained in the Redevelopment Agreement from Mansion House Urban Renewal, LLC to DPB Associates Urban Renewal, LLC; and WHEREAS, the City and DPB Associates Urban Renewal, LLC thereafter entered into a First Amendment to the Redevelopment Agreement by which Mansion House Urban Renewal, LLC assigned its rights, obligations, and interests in the Redevelopment Agreement to DPB Associates Urban Renewal, LLC (the “Redeveloper”); and WHEREAS, on November 17, 2022, the NJDEP issued a Remedial Action Permit (“RAP”) for the Property enabling it to be conveyed with proper engineering controls in place to be used as parking for the Project, which the Redeveloper has had access to since such controls were installed. NOW, THEREFORE, BE IT ORDAINED by the governing body of the City of Hackensack in the County of Bergen, State of New Jersey as follows: SECTION 1. CITY OF HACKENSACK ORDINANCE NO. 22-2023 AN ORDINANCE TO AMEND CHAPTER 88 OF THE CODE OF THE CITY OF HACKENSACK, “FIRE PREVENTION,” SECTION 88-6, “AMENDMENTS, MODIFICATIONS, AND SUPPLEMENTS TO STANDARDS” WHEREAS, the City of Hackensack has adopted the "Uniform Fire Safety Act" (N.J.S.A. 52:27D-192 et seq.) to protect life and property from fire and explosion; and, WHEREAS, in furtherance of this effort, the City has adopted Chapter 88 of the Code of the City of Hackensack, “Fire Prevention,” and has further enacted certain additional amendments, modifications and supplements to the State Fire Prevention Code as set forth in Chapter 88, Section 6 of the Code of the City of Hackensack; and, WHEREAS, based upon the recommendation of its fire safety professionals, certain revisions and updates to Chapter 88-6 are necessary in order to most effectively protect life and property within the City. Section 1: Section 88-6 of the Code of the City of Hackensack (“City Code”), “Amendments, modifications, and supplements to standards,” is hereby amended as follows (additions by underline, deletions by strikethrough): § 88-6 Amendments, modifications and supplements to standards. The following amendments, modifications and supplements to the State Fire Prevention Code are hereby enacted: A. Insurance reports (supplement to code Section F-300.1.1) . All owners, lessees or tenants of any building or structure that has been involved in a fire or other damage, resulting in a call to the Fire Department, City of Hackensack, shall report to said Department the name and address of the insurance agent and the amount of insurance carried. This information shall be supplied to the Fire Department within five days of the date of the call for assistance to said Department. B. NO CHANGES 04/11/2023 11 C. Cooking on balconies (supplement to code Section F-307 N.J.A.C. 5:70-3, 308.1.4.1). The use of portable grills and open lighted fuel, such as propane, wood, paper, synthetic material, etc., on balconies or other portions of a building is prohibited. Specifically excluded from the operation of this section is the use of charcoal or electric grills. D. Fire lanes/fire zones (supplement to code Section F-311 N.J.A.C. 5:70-3, 503.1.1). Other than one- and two- family dwellings, where private property is developed with driveways or parking areas, the following provisions shall apply: (1) NO CHANGES (2) Said fire lanes shall be marked on the pavement and with signs as required by the Bureau of Fire Prevention and shall be kept open at all times. Signs and markings shall be installed at the expense of the owner or lessee of the property. Violation of these fire lanes/fire zones by either parking vehicles upon them or storing equipment on them shall be prohibited. Any person who violates this article shall be issued a summons and upon conviction in Municipal Court pay a fine of not less than $82 $96. (3) NO CHANGES (4) NO CHANGES E. Stair designation (supplement to code Section F-504). Every owner of an apartment a building, which building has more than three floors, must provide green and red reflectors. These reflectors must measure at least one inch in diameter with a machine-threaded stud attached. One red reflector is to be mounted on the stairwell side of the door frame on the hinge side at a height between 18 inches and two feet from the floor. This reflector will indicate that the stairwell is a dead end and does not have a door leading to the roof. It is to be mounted by drilling a hole and thread-tapping the same to enable the thread-stud attached to the reflector to be screwed into the hole. One green reflector is to be similarly installed in the same place and manner as the red reflector in those stairwells which lead to a rooftop door. Section 2: All other provisions of Chapter 88 of the City Code shall remain unchanged. Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Section 4: Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part. Section 5: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. In addition to the salary ranges indicated, each eligible employee will receive longevity pay of one percent (1%) for each two (2) years of service, computed on the amount of the base salary of the employee at the time he becomes eligible for such longevity payment. In order to qualify for such longevity pay, the employee must have earned each two (2) years service credit on or before January 4, March 31, June 30 or September 30, in order to receive the added one percent (1%) longevity pay for the ensuing quarters. Whenever an employee receives an increase or new position, the employee will receive longevity increase on the new base at the same percentage as heretofore received on the prior base salary. Additional compensation of any nature, including overtime, will not be considered in computing longevity payments. Longevity payments will be computed from the time the employee was last employed on a full time basis by the City. Leaves of absence without pay with the exception of employees on official leave of absence due to military duty will not be considered in determining the length of service. The above longevity formula is modified from 1% for each two (2) years of service to 2% for each four (4) years of service for all personnel hired subsequent to December 1, 1987, as outlined in the Personnel Ordinance. The City Manager is hereby authorized and directed to determine the salary of each Civil Service employee within each salary range, subject to the provisions of any applicable collective negotiations agreement, such determiniation and salary to be effective January 1, 2022. Clerical personnel assigned the function of recording / corresponding secretary to a specific City board, requiring evening meetings, shall receive a stipend as approved by the City Manager, of $50.00 to $100.00 per meeting in lieu of overtime for all work performed relative to the assignment, unless a higher payment is required by the federal Fair Labor Standards Act or other law, in which case those provisions shall apply. SECTION 6. Health Benefit coverage shall be limited to only those City employees working a minimum of 35 hours per week unless otherwise required by state or federal law. Elected or appointed officials are excluded from coverage. SECTION 7. The City Manager or his / her designee is hereby authorized to approve payment for vacation time due in advance of an employee's scheduled vacation date, as provided under N.J.S. 40A:5-19. SECTION 8. The City Manager is authorized to grant a $750 stipend to any employee who is bilingual. Department of Environmental Protection’s (NJDEP’s) Sewer Overflow and Stormwater Reuse Grant (OSG) through the NJDEP’s Green Infrastructure efforts; and WHEREAS, the City has successfully been awarded Principle Forgiveness in the past and intends to continue to pursue these grant opportunities in the future; and WHEREAS, one such NJDEP grant program requires the City to collect data from a City-wide tree inventory that can best be provided by utilizing a professional Geographic Information Systems (GIS) data collection system; and 04/11/2023 18  WHEREAS, a City-wide tree inventory will be also be useful in the pursuit of other tree-related grant opportunities; and WHEREAS, the City of Hackensack desires a professional GIS data collection City-wide tree inventory and has solicited Requests for Proposals regarding the engineering services required for this next phase of said project; and WHEREAS, it was determined that the proposal received from Suburban Consulting Engineers is the most advantageous to the City based on cost, expertise in this field and prior experience with the City’s combined sewer system. NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack, County of Bergen, as follows: 1. Suburban Consulting Engineers of 96 U.S. Highway 206, Flanders, NJ 07836 is hereby awarded a contract in an amount not to exceed $60,000 for the GIS data collection services to compile a City-wide tree inventory, in accordance with the proposal attached thereof. 2. A Certification of Funds has been prepared and authorized by the Chief Financial Officer for the said contract assuring that there is a sufficient appropriation to fund the purchases authorized in this resolution as an express and mandatory condition of the award of this contract. 3. The budget account to be charged is C-04-22-034-000-100. 4. The Mayor and City Clerk are hereby authorized to sign the contract documents necessary to effectuate the award of this contract. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that the Agreement as between the City of Hackensack and Hackensack School Traffic Guards (Teamsters Local 97 of New Jersey) for the period of July 1, 2022 through June 30, 2026, be and hereby is APPROVED; and 04/11/2023 26  BE IT FURTHER RESOLVED that the City Manager, the City Attorney, and the City Labor Counsel are authorized to take all appropriate actions so as to implement this Resolution. Rich Cerbo – We never do anything about the problem on Spring Valley. There are two rush hours, one in morning and one in evening and busses are going down empty. I am going to get a speed detector, they are flying by over 50 mph. Why are they being used if the busses are empty? Maybe one or two people on the busses and it is causing a disturbance. This redevelopment we have going is great but every time we look up here is another 30-year tax break. Now there is one for Lot D. I don’t think anyone knows and what we get about our taxes is they will be stabilized, not lowered. One last thing I guess is what we talked about over the years what about the buildings that aren’t taxed in town like the hospital, education buddings, County buildings. I am a man of God myself but I don’t see why the churches can’t give a contribution. Nahshon Bolton – I am the new president of Jon-J (Jamaican Organization of NJ). I know a member comes here every now and again. I have a possible big goal of renaming a street after a famous Jamaican since Hackensack has the largest Jamaican population in the whole state. We would like a street in memoriam like “One Love Way” or “Jamaican Avenue.” I don’t know the process. Mayor Labrosse responded - Come up with the idea and call the Manager’s Office who will email us to approve it. No one else wished to speak. Council Comment Councilwoman Von Rudenborg - Saturday is opening day for baseball and softball. We are still looking for coaches. A special thanks to the Recreation Department who have been working hard to get this season running. We had a huge turn out over 200 signed up and we are proud of that. Thank you to volunteers but we are still in need. Please keep Sgt. David Solinas in your prayers. My middle son’s teacher is friends with that family. He was an Eagle Scout. It is devastating and that is why I always talk to my kids about how to be proud in America and how he gave his life for freedom. You need to keep talking to our kids about that impact. Have a good night. Councilman Battaglia – I live a block away from Spring Valley and I have to look both ways that no bus or trucks are coming. Only solution I see is speed bumps you can see them going 45 some times. Coaches we should put on the website and Facebook to get volunteers. The paving program continues. We are working on Clay and Union Streets to bring the water all the way to the river. We are working to build the dome so everyone can use it for all sports. Thank you. Mayor Labrosse – As far as coaching, I challenge any young people out there, seniors, anyone who wants to volunteer as a youth sports coach. All sports year- round volunteers are way down all over and I can tell you as a long-time youth 04/11/2023 27 sports coach it is one of the most rewarding experiences. Sports are the best form of crime prevention. The challenge is out there to start helping the kids out. I am glad the engineers are working on flooding. I can’t wait until fall when it is under the railroad and water has a way down to the river where it belongs. I am happy to see the Green Street camera work and clean out being done. For those not familiar, the sewer projects are well over 40 million dollars now. We made a commitment to fix a problem that no one did anything about for years. Get home safe.
