The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, July 14, 2025 at 8:00 P.M. Mayor Gaines called the meeting to order and the Deputy City Clerk announced, “This meeting is being held in accordance with the “Open Public Meeting Act,” N.J.S.A. 10:4- 6 et seq., notice having been published according to law, with a copy on file in the City Clerk’s Office, and a copy posted on the Bulletin Board in City Hall.” Attendance Ms. Saabye called the roll: Mayor Gaines, Deputy Mayor Toomey, Councilwoman Clark-Collins, Councilman Carroll, and Councilman Diaz were present. City Manager Vincent Caruso was present. City Attorney Richard Malagiere was present. City Clerk Deborah Karlsson was absent. Deputy City Clerk Allison Saabye was present. Flag Salute Proclamations and Presentations – None Approval of Minutes – A motion to approve the Regular Meeting Minutes from June 24, 2025, was offered by Councilman Carroll, seconded by Deputy Mayor Toomey and approved by Mayor Gaines, Deputy Mayor Toomey, Councilwoman Clark-Collins, Councilman Carroll, Councilman Diaz. City Manager’s Report The Veteran banners have been installed on Main Street. There are still spots available. Contact the City Manager’s office to register or register online through rec desk. Summer Concerts are underway. The next concert is Super Trans AM tomorrow on the Green at 7:30PM. The Nerds on July 22nd and Aftershock on July 29. If the weather does not cooperate, these concerts will be held inside at HACPAC. National Night Out will be held at Atlantic Street Park on August 5th where there will also be a concert featuring Steppin’ Out. Please bring your family and join the Police Department, Fire Department, and many community organizations for a night of fun. Thank you to all the departments involved with the 4th of July event. Thank you also to all the sponsors for your support in making it another successful community event. Please check the website and social media for all our summer events including Tuesday night concerts, sunset yoga, Friday night concerts, movies under the stars, and Shakespeare in the park. The City is working on bringing back open swim for residents at the High School pool. More details will be posted soon on the city website and social media. New Jersey is requiring lead safe inspections for rental units. Landlords with pre 1978 rental properties located in Hackensack are required to have inspections completed by July 22. Landlords can use any company of their choosing, as long as compliance is obtained. Please reach out to the Building Department with any questions. CITY OF HACKENSACK ORDINANCE NO. 37-2025 AN ORDINANCE TO AMEND CHAPTER 88 OF THE CODE OF THE CITY OF HACKENSACK, “FIRE PREVENTION,” TO ADD SECTION 88-13 “LITHIUM-ION BATTERIES” PROHIBITING THE SALE AND PRIVATE USE OF SECOND-USE LITHIUM-ION BATTERIES IN NEW OR EXISTING BUISNESSES, IN ADDITION TO GUIDELINES AND REQUIREMENTS FOR SELLERS AND USERS OF LITHIUM-ION BATTERIES, POWERED MOBILITY DEVICES AND PROPER STORAGE WHEREAS, the Hackensack Fire Department, Fire Prevention Bureau and the City Manager have recommended to amend Chapter 88 “Fire Prevention” to add Section 13 “Lithium -Ion Batteries” for the more effective and efficient operations of the City; and, WHEREAS, improper storage and use of lithium-ion batteries, particularly in larger items such as electric scooters, is a significant fire hazard; and, WHEREAS, as of January 2024, there have been 445 fires in the US because of lithium-ion batteries, resulting in 214 injuries and 38 deaths; and, WHEREAS, the City of Hackensack seeks to regulate the use and storage of lithium-ion batteries and chargers in businesses and multi-family dwellings in order to protect the health, safety, and welfare of all residents. WHEREAS, the City Council finds it is in the City’s best interest to take this action. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 88 of the Code of the City of Hackensack is hereby amended to add a new Section 88-13, entitled “Lithium – Ion Batteries” to read as follows: §88-13. Lithium-Ion Batteries 07/14/2025 2 DEFINITIONS: Lithium-ion battery: A storage battery in which an electrical current is generated by lithium ions embedded in a carbon graphite or nickel metal-oxide substrate placed in a high-viscosity carbonate mixture or gelled polymer electrolyte. Powered mobility devices: Motorized bicycles, motorized scooters and other personal mobility devices powered by a lithium-ion or other storage battery. The term does not include motor vehicles or motorcycles or other mobility devices that must be registered with the New Jersey Motor Vehicle Commission or medical devices such as wheelchairs. Second-use lithium-ion battery: A lithium-ion battery that has been assembled or reconditioned using cells removed from used batteries. Storage battery: A secondary battery in which an ion shuttles back and forth between anode and cathode during charge and discharge cycling, without requirement from other reactants. A. Sale or Use of Second Use Lithium-Ion Batteries Prohibited Effective January 1, 2026, no person shall distribute, sell or use: 1. A second-use lithium-ion battery; 2. A lithium-ion battery for a powered mobility device unless it has been listed and labeled by the underwriters’ laboratory or other organizations as may be approved by the Hackensack Fire, or Zoning, such labeling is disclosed on the battery or on packaging for such battery. 3. No person shall assemble or recondition or repair a lithium-ion battery using cells removed from used storage batteries. Enforcement will be conducted during fire inspections, the initial zoning process, and upon inspection following complaints. 4. Each noncompliant battery shall constitute a separate violation. B. Regulation of Charging Areas for Lithium-Ion Batteries In Business and Multiple-Family Dwellings Effective January 1, 2026, it shall be unlawful to charge or store a lithium-ion powered battery for a powered mobility device or to store a lithium-ion battery powered mobility device within the common areas, or basements or attics or below ground garage of any multi-family residential property, containing 3 or more dwelling units; Or any utility room or closet or exit access, egress, or exit or underground garage of any commercial space within any business or vacant property. C. Violations and Penalties 1. A violation of this section shall be punishable by a warning or fine as set forth in the City Code 2. Prior to any violation being issued, a NJ Fire Code notice will be issued by the Hackensack Fire Prevention Bureau. 3. If no compliance is established by the abatement date specified on the NJ Fire Code Notice, a notice of violation will be issued for adjudication in the Hackensack Municipal Court, with the maximum penalty of $2000 per violation. Section 2: All other provisions of Chapter 88 of the Code of the City of Hackensack shall remain unchanged. Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Section 4: 07/14/2025 3  Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part. Section 5: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed. Section 6: This Ordinance shall take effect upon passage, adoption, and publication in the manner prescribed by law. Mayor Gaines – Before we vote on this, I do want to make some remarks. Tonight, the City Council is taking the first step towards rescinding two 30 year and one 15 year tax exemption agreement for the former Sears Site, One Essex Street, and the Sapphire at 132 Main Street, resolution 334-25, 335-25, and 336-25. These are all eleventh hour agreements, rushed through by the previous administration after the May 13th election in direct contradiction with the stated will of the people. The rush to adopt these agreements also left out two important components of any good contract, input from, and transparency to, the City’s main client – the residents. It is our duty to ensure every agreement serves the community’s best interest, especially when these decisions will impact our City for decades to come. These deals were deliberately rushed through as they were leaving office, a move they themselves condemned when they won in 2013 by sending a cease and desist letter to the then outgoing administration warning them against taking any new action. Developer deals were the defining issue in this election that led to our historic overwhelming victory. During the transition period, the previous administration refused to collaborate with us on these important issues despite our repeated voiced concerns and claims that they would work with us as we prepared for office. Tonight, this Council takes agency by doing out due diligence and putting the will of our residents first. Public hearings on these ordinances will be held at our August 11th meeting and you can also share your comments later in the meeting today. (BLOCK 247 LOT 3) APPROVED ON MAY 20, 2025 WHEREAS, on May 20, 2025, the Governing Body passed a resolution authorizing the tax appeal settlement concerning the property known as Cambridge Manor (Block 247 Lot 3) ((2022-2024); and WHEREAS, the refund section of the May 12, 2025 settlement recommendation letter stated, the taxpayer waives any interest payable on any refund to the taxpayer pursuant to N.J.S.A. 54:3-27.2 and/or any other applicable law, provided said refund is paid as follows: One-half (1/2) of the total refund to be paid on or before 8/1/25; and One-half (1/2) of the total refund to be paid on or before 8/1/26 WHEREAS, the refund to be paid under the settlement is the taxpayer waives any interest payable on any refund to the taxpayer, pursuant to N.J.S.A. 54:3-27.2 and/or any other applicable law, provided said refund is paid within ninety (90) days from the date of the Tax Court Judgment. NOW, THEREFORE, BE IT RESOLVED: 1. The above recitals are incorporated herein. 2. The Resolution adopted on May 20, 2025 is hereby amended to reflect that refund payments will be made within ninety (90) days of the date of entry of the Tax Court Judgment. 3. The City’s Tax Appeal Attorneys, the City’s Appraiser and the City’s Tax Assessor are in agreement with the terms of said correction to the settlement and are authorized to take any action necessary to effectuate this resolution and the settlement referenced herein. 4. A statement that Qualifications must be submitted by 2:00 p.m. on August 13, 2025; 3. A statement that the RFQs are being made by the City; 4. Public Comment A motion to open the meeting to the public was offered by Deputy Mayor Toomey and seconded by Councilman Diaz. Michelle Tavaras - Recently I noticed a post on Hackensack social media about garbage pick up and how we only have one a week. I am asking if you can possibly find a way to bring back two a week, especially in the summer. Speaking as a Sunday BBQer, by Tuesday my driveway smells ratchet. I am putting that out there for consideration. Mayor Gaines responded – This is something that we have inquired about, and I want to give thanks to DPW and to our City Manager. Beginning that first week in August we will have two times a week garbage pick up in the summer for August and September. Please do help us spread it. It is new so please spread the word. Rev. Carolyn Davis – I want to say congratulations again and thank you so much. You made a promise to the people of Hackensack, and they voted unanimously for you for that promise that you would be open, you would look at redevelopment and make sure that it works especially for the taxpayers who left here to deal with it. Thank you for that, continue doing what you were voted to do. I trust all of you. Thank you. Kate Coffey from Day Pittney – I am here tonight on behalf of RHR Hackensack Urban Renewal LLC, which is the designated redeveloper and contract purchaser for Block 405, Lot 3. We are here to object to the ordinance which was introduced this evening to rescind our PILOT agreement. We believe it is legal and contrary to law and we wanted to inform you that we intend to vigorously enforce our vested contractual rights. Thank you. Sissy Scariff – I just want to say how elated we are, my community is, with you guys. Mr. Diaz, I had to look up when I heard you speak because I thought you were Leo, you sound so much like Leo. I couldn’t understand him, but I am trying to understand you, you are a little clearer. We appreciate you. I just wanted to say how happy I am with you guys and the community, and we’ve just been talking about you. I want to mention the garbage; we have a few areas where people put their house garbage in public containers. They get filled up. I have called public works, and I forgot his name, but he says he has that problem on First Street, down on Hudson, where there is a large population of people hanging out. I am just asking, and it doesn’t have to be everywhere, if we can have signs saying not for household garbage on the containers to let people know we are watching. A lot of these places have cameras, and I don’t even know how we would enforce that, so maybe a little notation if possible. We have a business on First Street, and we are responsible for trying to keep our area clean. So, people putting garbage in and people coming out of the stores and when they go to put their garbage that should go in there, there isn’t a lot of room, and it overflows. When it is windy, it is all down Stanley, across First Street. That is just a thought that I had. Thank you and congratulations, you even look good up there. Mayor Gaines responded – If you can just communicate with our City Manager about specific locations as to where you want more focus, but hopefully with the extra pickup it will incentivize people to not have to dump their garbage in other places which potentially creates a health issue city-wide. 07/14/2025 24 Ms. Scariff responded – Also, the DPW knows where a lot of these places are too. As I was talking to him, he mentioned one or two other places he has problems in. They can always call and collaborate with the City Manager to do what needs to be done to make Hackensack a better place. Kimberly King – I just had a question about communicating with the Hackensack residents what that schedule for garbage pick up will be. How will that be communicated so that when August rolls around, residents will know what their zone pickups will be? I know it will be on the website. City Manager responded – The schedule for the whole year is out already so what we have to do is explore a tag type of thing when the zones will be for the areas, we will advertise on social media and the website, and any way we can. We have a short window to do so. Ms. King responded – As an individual who was born and raised in Hackensack, I am thrilled that the development plans have been called back for now. I would much prefer that the space that we have available be used for a school or green space or a community center or all three. Hackensack has become very congested, and it is difficult to get around especially when school begins. Before we go and develop and have more residents come in, and we have further overcrowding with our schools and the streets, it would be nice to see some of the space we have available be used for green space, community center for kids, or another school. Council Comments Deputy Mayor Toomey – I would like to begin by thanking everyone for coming out to our first Council meeting tonight and to everyone who came out to our reorganization meeting on July 1. Your continued presence and involvement mean a great deal to us. Over the last couple of weeks, we have had several meaningful events in our community. On July 1st, the Fire Department held their annual memorial ceremony to honor fallen firefighters particularly those who died in the Hackensack Ford fire in 1988. This year marked the 37th anniversary. On July 4th, we celebrated a fantastic Fourth of July with a great turnout and a wonderful band performance by Fillet of Soul. A big thank you to our municipal workers who helped put the event together and did an outstanding job. We would like to congratulate Lt. Levis on his retirement after 29 years of dedicated service to our Police Department and our City. Thank you, Lt., for your commitment and contributions to public safety. We also attended our first ribbon cutting ceremony for a new business on Main Street. Congratulations to Rejuvenate on Main on their grand opening and thank you for inviting us to cut the ribbon. Our summer concerts in the park are well underway and we have a great line up for the rest of the season. We encourage everyone to come out and enjoy the music and connect with your neighbors. I want to thank Russo Development for co-sponsoring the fireworks for us. I want to talk a little for 30 seconds about the PILOT programs. Just because we pulled stuff today does not mean they won’t be revisited. We want to make ourselves sure of what was signed and what was said prior to us and then we can reconvene and meet with you again. As Phil alluded to, we had an amazing turn out at our reorganization meeting, but that isn’t just for us. That is for the community of Hackensack and we recognize that. We know that this community is not going to be rebuilt for our residents by five people. It is going to be rebuilt for our residents by our residents. We are residents just like you, we pay taxes just like you. They’ve been going up just like yours have so we have those concerns. We have that perspective. We have those some sorts of ideas like we have heard come forward about the sanitation. Please continue to bring those to us. We are vessels for the will of the people. That is the way we plan on acting and I think that you can see that we have already taken steps to doing that. 14 days on the job but we are getting to work. We just want to say thank you once again.
