The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday, September 9, 2025 at 8:10 P.M. Mayor Gaines called the meeting to order and the City Clerk announced, “This meeting is being held in accordance with the “Open Public Meeting Act,” N.J.S.A. 10:4-6 et seq., notice having been published according to law, with a copy on file in the City Clerk’s Office, and a copy posted on the Bulletin Board in City Hall.” Attendance Ms. Karlsson called the roll: Mayor Gaines, Deputy Mayor Toomey, Councilwoman Clark-Collins, Councilman Carroll, and Councilman Diaz were present. City Manager Thomas Freeman was present. City Attorney Richard Malagiere was present. City Clerk Deborah Karlsson was present. Deputy City Clerk Allison Saabye was present. Flag Salute Proclamations and Presentations – None Approval of Minutes – A motion to approve the COW, Executive and Regular Meeting Minutes from August 11, 2025, was offered by Councilman Carroll, seconded by Deputy Mayor Toomey and approved by Mayor Gaines, Deputy Mayor Toomey, Councilwoman Clark-Collins, Councilman Carroll, Councilman Diaz. City Manager’s Report The veteran banner program, spots are still available for the next round of banners going on Main Street. They will not be installed until next year but there are still spots available. Visit the City of Hackensack website to sign up for the free newsletter. It is emailed out every Friday and provides important updates, event information, exclusive content and community news. On August 15, the City of Hackensack held a street renaming ceremony for James JT Taylor Way, a Hackensack native and Rock and Roll Hall of Fame inductee, and lead singer of Kool and the Gang. It was well attended and it was wonderful to see so many people come out to honor Hackensack’s own. Check our website and social media for upcoming events in September. Some of our events include the 9/11 Memorial Service scheduled on September 11th 10AM in front of Fire Headquarters. Town wide garage sale will be held September 14 and 15th from 9AM to 4PM. The registration deadline for the garage sale is September 10th. Contact the City Manager’s Office for application information. HACPAC has a couple of events going on this month Hope and Freedom Gallery Reception and Exhibit on September 11th at 6 PM. We have Howdy Stranger Improv Comedy Show on September 13th at 8PM. CITY OF HACKENSACK ORDINANCE NO. 41-2025 AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, “VEHICLES AND TRAFFIC,” TO ADD A NEW HANDICAPPED PARKING SPACE IN SECTION 49.2, “PARKING FOR THE HANDICAPPED” (PINE STREET) WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and, WHEREAS, the City Council of the City of Hackensack wishes to amend Chapter 170 of the Code of the City of Hackensack, entitled “Vehicles and Traffic,” to add one (1) new handicapped parking spaces to Section 49.2, entitled “Parking for the Handicapped” and, WHEREAS, the Hackensack Police Department and the City Engineer have investigated the matter and have determined that adding such handicapped parking spaces will not significantly impact on-street parking, nor will it affect traffic flow. WHEREAS, the City Council finds it is in the City’s best interest to take this action. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: 09/09/2025 2 Section 1: Chapter 170, Section 49.2 of the Code of the City of Hackensack is hereby amended as follows [additions by underline] §170-49.2. Parking for the handicapped. E. Designation of parking areas. In accordance with this chapter, the following location(s) shall provide parking for the physically handicapped: Parking Lot or Street Side Location/Number of Handicapped Space Pine Street West From a point 85 feet north of the north westerly curb line apex of Pine Street and Martin Terrace to a point 22 north thereof. Section 2: All other provisions of Chapter 170, Section 49.2 of the Code of the City of Hackensack shall remain unchanged. Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Section 4: Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part. Section 5: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed. Section 6: This Ordinance shall take effect upon passage, adoption, and publication in the manner prescribed by law. CITY OF HACKENSACK ORDINANCE NO. 42-2025 AN ORDINANCE TO AMEND CHAPTER 170 “VEHICLES AND TRAFFIC” TO CLARIFY ZONES IN WHICH COMMERCIAL VEHCILES CAN PARK WHEREAS, the City Council, consistent with the recommendation of the City’s professionals, finds and declares that a clarification and revision to certain sections of the Chapter 170 “Vehicles and Traffic” is necessary in order to promote the orderly development of the City as well as its general welfare with respect to commercial parking rules; and, WHEREAS, the Council further has determined that these revisions be made to ensure that commercial motor vehicles are not being parked on City streets in a manner that is detrimental to the health, safety and welfare of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Section 170-12, “Parking of commercial vehicles in certain areas” of the Code of the City of Hackensack (“City Code”) is hereby amended as follows (additions by underline, deletions by strikethrough): A. No person shall park a commercial motor vehicle, as that term is defined in the Zoning Ordinance of the City of Hackensack, at any time upon any of the streets contained within any and all zones in the City of Hackensack the districts designated as O (Office) Zones, B (Business) Zones, HRO (High Rise Office) Zones, UN (University Office) Zones, HCS (Health Care Services) Zones and any Special Improvement District, as described in said Zoning Ordinance and the Zoning Map attached to and made a part thereof, unless that commercial motor vehicle is owned or operated by the owner or occupant of legally zoned commercial property located in the particular zone where the vehicle is parked, or the vehicle's operator is actively and directly engaged in the transaction or performance of business with the owner or occupant of legally zoned commercial property located in the particular zone where the vehicle is parked, or the vehicle's operator is actively and directly engaged in the installation, maintenance or performance of public utility services in that zone. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. CITY OF HACKENSACK ORDINANCE NO. 44-2025 AN ORDINANCE AMENDING CHAPTER 90 OF THE CODE OF THE CITY OF HACKENSACK, “FOOD AND DRINK,” TO UPDATE CERTAIN FEES AND REGULATIONS IN ARTICLE I “RETAIL FOOD ESTABLISHMENTS” WHEREAS, Chapter 90 of the Code of the City of Hackensack (“City Code”) establishes regulations governing retail food establishments within the City of Hackensack; and, WHEREAS, the Health Department has reviewed the current “Retail Food Establishment” portion of Chapter 90 “Food and Drink” to make amendments to comply with the State Sanitary Code in regards to retractable doors; and WHEREAS, the Health Department and City Manager, in consultation with the City Council also feel it is appropriate to update the fee for temporary food permits for special events to charge a comparable rate to other municipalities ; and, WHEREAS, the City Council agrees that such regulations are necessary to protect the health, safety and welfare of City residents and visitors, and to ensure that food retail establishments operate in a safe and sanitary manner at all times and in compliance with state regulations as set forth in Chapter 24 of the New Jersey State Sanitary Code. 09/09/2025 7  NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows: Section 1: Chapter 90, Article 1, Section 2, 3, and 4 of the Code of the City of Hackensack are hereby amended as follows [additions by underline, deletions by strikethrough] §90-2 License required. It shall be unlawful for any person or any body corporate to conduct a retail food establishment, as defined in and governed by said Chapter 24 of the State Sanitary Code, without first having procured a license from the Health Department in accordance with Chapter 107, Licenses and Permits, and without complying with any and all of the provisions concerning operation and maintenance of such establishments as contained in the aforementioned chapter of the State Sanitary Code. A. Suspension, revocation or reinstatement of licenses: Licenses issued under authority of this Article as well as any issued under Chapter 90, Food and Drink, may be suspended, revoked or reinstated by the City of Hackensack Health Department. §90-3 Application requirements. In addition to the information required to be contained in the application by §107-6B of Chapter 107, each application for a license issued under this Article shall include a detailed description of any premises, structures and vehicles to be used in the operation of such business, and such premises, structures and vehicles shall be subject to inspection as to their compliance with all applicable provisions of the Code of the City of Hackensack. A. It shall be unlawful to install garage-type retractable doors or any other mechanical device that would permit outdoor air into the food preparation area of a retail food establishment in the City of Hackensack. This includes the dining area if food preparation and service areas cannot be separated by solid walls and doors. Any pre- existing food establishments prior to October 1, 2025 shall follow the Hackensack Health Department policy dated October 27, 2017. §90-4 License fees; expiration A. The annual fee for licensure of retail food establishments is hereby fixed as follows: Temporary retail food establishments for special events $25 $75 [ALL OTHER FEES REMAIN UNCHANGED] Section 3: All other provisions of Chapter 90 of the City Code shall remain unchanged. Section 4: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the legislative intent that all ordinances or part of ordinances now existing or in effect unless the same being conflict or inconsistent with any provision of this Ordinance shall remain in effect. Public Comment A motion to open the meeting to the public was offered by Councilman Carroll and seconded by Councilman Diaz. Mr. Tolstoy – I want to thank Ryan Westra for his work in Hackensack since I’ve been here in 2013. The work done on Hobart Street which is a life manufacturing zone in a residential area. In terms of paving, I would like to see the animosity go away in terms of the past and previous administration. When you ride down from Kansas from River to Green Street you find only one side of the street is paved especially for the senior citizens federally funded housing. Then when you get to the Hispanic section, there was no paving done. Whatever animosity, I feel that should be put all in a basket and thrown away because whatever your enemy was, was not a good friend. Number two, when it comes to walking out of this building into the parking lot, given that we are the County seat of Bergen County, I look at the parking lot and I see what is going on here. It has been going on too long. As the County seat, as the new administration to unite the people, you need to have a home that looks like it is taken care of. This parking lot area behind the civic center needs to look like it’s a real town hall place of meetings. Thank you. Kevin Boswell – I personally want to thank you for your confidence in allowing us to serve the interest of you and the residents of the City. The projects that you just approved this evening, two for Foschini Park and two for Johnson Park relate to the construction inspection as well as LSRP work previously being done by another consultant that we are taking over those roles. The last project is the master plan for Johnson Park and the old master plan was developed before you had the two parking lots, Sears lot and the overflow lot from the University office complex, so now you effectively have three separate parking areas with three separate access points, with no relationship on site, circulation between those three. In addition, you cancelled the contract on the building, which presents some challenges but also it presents a very nice opportunity from current contract which is still continuing with the new parking lot. We now have unobstructed access to the river, so we are working on several different concepts for you to consider. We will have it within the next 10 days, and we 09/09/2025 22 are doing a thorough review of the NJ DEP permitting for the projects as originally envisioned and how new stormwater regulations and flood hazard regulations may affect it and protect the interest of the city because the new regulations are more restrictive. We are very cognizant of this, and I want you to know we are very committed. Thank you and we are very committed to protecting the interests of the residents. Thank you. Rich Cerbo – I wanted to mention that roads need to be started up. When are you going to start paving roads? There are shabby roads and shabby areas, and the roads are not great. I have been reading the, I know you have been in a few weeks, but there have been articles. I have read about rescinding things from past deals that the previous council made. Maybe we can ask Mr. Malagiere about this but that sounds like retaliation to me. I think that is tolerated in politics, if you trash something that went before and say we aren’t doing that. That’s illegal in some areas of the law, retaliation, but in politics it’s tolerated. I am wondering how far you are going to go with that. I thought some of the deals they had were pretty good. That is my second point, but the roads are important, the weather was perfect, I thought that I would see the roads being paved but nothing. That’s it. Thank you. Rev. Carolyn Davis – I just want to say congratulations to this board to what you are doing. As far as I can see the city voted for this Council because they did want to see the changes going on and the things that you are rescinded are the things that the community said they wanted you to look at. Personally, I thank you for what I have seen you doing and getting out into the community and meeting with the community and talking to the people. I think there is a great sense of relief in the community, so congratulations. Dora Mae Davis – I want to say once again congratulations to you all. You are for the people, and I am so proud of you, and I look forward to working with you. Darling Bode – I have a question; do you have anything planned for a dog park? As a childless 37-year-old woman, I have gathered a huge group of my friends here in the City in the new multi-dwellings. We would like to know if you have anything in place for dog park because we are in need of one or at least some stations for doggy bags so people can collect the feces. I live on Clinton Place and I have to clean up a lot which I don’t mind doing but as a health inspector that is not okay. Thank you. Erica Solice – Congratulations because you are here to help us. One of the big concerns I have is the Hackensack High School, Middle School, and Elementary school. We have seen so many buildings but not enough schools. I had to put my kids in a charter school because they were complaining, the food was not right. When I was in school it was fresh and healthy like it was when I went. It is to make the kids overweight and that is not healthy. We need to pay attention and put more budget into the kid’s meals. You need to expand the schools, even though my kids are now in the charter it took me 2 years to get them in the charter school. What about the other residents? There is so many kids in one classroom. The teachers should get a little more salary because the teachers are not doing well. They are retiring. As a mom, it is a big concern. Council Comments Deputy Mayor Toomey – Hello everyone and thank you to everyone who came out tonight to attend our Council meeting and a special thanks to our presenters for sharing their time and expertise. We look forward to the development of the comprehensive bicycle plan. I know a lot of people have asked about that. We look forward to working with that and seeing how it all pans out. Having dealt with legal 09/09/2025 23 services in the past when I worked for the Human Services Department, I know they are highly effective in supporting low-income individuals who need legal assistance and guidance. That is a good group to refer people to. Thank you to everyone for bringing various issues to our attention. We welcome that because we will look into things and try our best to do the right thing and fix it. Miss Solice, especially to what you said about doing things the right way, I hear you and we take it seriously and we will look into that. There was a gentleman who said and I appreciate that he said we have only been in 10 weeks, and we appreciate that you want to give us the time to get our feet wet and get things squared away. There was someone who came up and said something about rooming houses. They are popping up everywhere. That is a concern, and I would like to look to look into that because rooming houses really is something that needs to be approved by the town. I know from past experience having dealt with rooming houses, there are a lot more in town way back when but not so many anymore, but I don’t think there can be any new ones. If there are rooming houses popping up, we need to find out more. I know there have been people saying Airbnb’s popping up, so we need to look into that because I don’t know what the code is for Hackensack. If there are people renting out rooms in their homes, there are codes for everything. We will look into that. Thank you and have a good evening. Councilwoman Clark-Collins – Good evening. I attended two events last week. The first was a health fair given by the India Cristian Assembly Church on State Street. I had my blood pressure, blood sugar, and body mass index checked by Hackensack University Medical Center. Lunch was provided, things to do for the kids, and it was all free. I hope those who came out for that enjoyed that as much as I did. I want to give a special thank you to Pastor Finney for hosting the event. He said they had a turn out of over 300 people so that was great. I supported the soccer car wash fund raiser at the High School. The kids did a great job of washing the cars under the supervision of Coach Shawn. Thank you for the fundraiser and I think a lot of people came out to supporting that. Please continue to come out and support these events. The more you show support for the events, the more events you will see in the future. As Tom said, the next big event is the city wide garage sale this Saturday and Sunday. This is the first time we are doing it so hopefully it will be success and we can continue to do it as well. I want to thank Darling for bringing that state bill to our attention. That is very important and we will look into that. I agree they should be held responsible, PSEG as well as the water company, for what they are doing to the streets. Finally, I wanted to mention that I lost my cell phone on Prospect Ave last Friday. Thankfully I have the find me app and I traced it back to an apartment on Passaic Street. I called the police and it was found by a woman who was walking the same path. She returned it to me. So, if you are watching, I want to say thank you to Jendiyan. Thank you so much for retuning my phone. I also want to give special thanks to Officer Miller, Srojka, Baddalian, for their assistance. Thank you all for coming out and get home safe. Councilman Carroll – Good evening. I know Mr. Glover left but he did say please bear with us. It has been since July 1. I think someone else did mention it. We are trying to do the best for our residents, our employees, and the community. Bear with us, we are getting there. Mr. Boswell, great presentation. I hope in 10 days we have renderings of Johnson Park so we can take the eye sore that was going to be there out of our heads and see a new rendering of something nice for the community for everyone to enjoy. The young lady with PSEG and re-paving. I have dealt with them a lot. It is hard. I hate to see a block that was just paved and then they suddenly decide to do a waterline on it. They are supposed to keep it like you said but it is never the same. They are not going to pave the whole block, just the section they take out and section to your house. I wish there was something different where they paved half the block but then sometimes, someone else said it before, half looks beautiful and half doesn’t and that is not because of us, it is because they did something. Last Friday I attended with Congressman Josh Gottheimer, a press conference at the High School, and someone brought up e-bikes which was the topic of conversation and e bike safety, storage, and things that we can make out children safer. The DOT tells us what we can and can’t do with e bikes. The ages 13 and 17 that should wear a helmet, anyone else is 09/09/2025 24 supposed to but they don’t. 7 miles to 18 mph is supposed to be the top speed but they don’t. We are trying. It is crazy out there. It is a cheaper form of transportation and more and more people are doing it. When we talk about the bicycle lanes, maybe it is a possibility we need to combine that but that is another issue we will bring up. Thank you for your support and thank you for coming out tonight. Councilman Diaz – Thank you Mayor. Excuse me if my comments tonight are general because rather than present a report of the first 100 days, tonight I want to make a reflection on our first 70 days today. When I woke up this morning, the first thought was what a summer we have been having in Hackensack. It has been different. It has been very positive. Since July 1, we shared some great moments together like the 4th of July celebration that drew such a massive crowd, followed by so many shows and events that brought our community together. We are getting back that community sense. None of it would be possible without the hard and smart work of our city employees and volunteers and above all, the collaboration and positive energy of our residents. On the other hand, and I am talking on behalf of the Council in general, my City Manager and Attorney, the decisions we have made so far have been guided and supported by most of you and your constant presence at these meetings sharing your opinions and ideas makes all the difference. Now, let’s continue doing it one day at a time, one season at a time. Let’s get ready for the fall season with new ideas and new commitments but always thinking of the best interest of the residents of Hackensack. Let’s make sure we put in the same enthusiasm and commitment we have shown so far. Hackensack is on the rise and the best is still ahead of us. Mayor Gaines – So many great things have been said so I am not going to repeat it. I want to thank everyone again for coming out and I really hope from these meetings, you gain insight into things happening in Hackensack. We try to best communicate. Someone made a comment before, I get emails from Teaneck, and I think we can probably step that up as well. We speak a lot about how new we are but I am incredibly proud of what we have done in 70 days, and while we are not there yet, wait till we get there. I want to point out two things. One thing we had the opportunity to go to was the Police youth academy graduation which was an amazing program sponsored by our Police Department which our Fire Department supported. It was 90 kids who participated, kids of all races, backgrounds, from all neighborhoods in Hackensack and also from our receiving districts. It was fantastic. To watch these kids not just go through a week long experience, that maybe for some of them see it as a camp, but they are learning about public service, about responsibility, about how to listen and respond to people. I popped in a couple days and to see them graduate was fantastic. We are looking to provide better service in a way that is fiscally responsible. I don’t want there to be any misconception about the way we are approaching it. A comment was made about road paving. If you look at the roads being paved, we are looking at South Newman, DeWolf, Union, Lookout, Coolidge, Davis, Kennedy to Hudson. That’s the entire city and it is across all 5 wards. We are cognizant of that. There have been changes from the previous administration. One I want to highlight tonight. There was a change order that we were able to take $80,000 off of a contract by moving it from one vendor to another for less that will provide the same service, maybe better service. I want to be very clear. What we won’t do is rubber stamp things because we inherited them. We are going to look at things and make decisions, the best we can in our judgement. No one is looking here to be spiteful. Everyone is looking to figure out how we can do a little better. We ran because we could do better.
