AT A REGULAR MEETING FOR THE BOARD OF ZONING APPEALS OF THE CITY OF HAMPTON, VIRGINIA, HELD IN THE CITY HALL HARDY CASH CONFERENCE ROOM, AUGUST 15, 2011. Chairman Thomas Savage called the meeting to order. Upon roll call the following answered as present: Rodney Gentry, William Hobbs, Burnett Peters, John C. Pope and Thomas Savage. Also present were Clerk to the Board, Steven Shapiro; and Mary Cole (recording secretary). . ____________ . On motion of R. Gentry second by W. Hobbs to approve the minutes of the August 1, 2011 meeting as submitted. A roll call vote on the motion resulted as follows: AYES: Gentry, Hobbs, Peters, Pope, Savage NAYS: None . ___________ . 11‐032 A public hearing was held on the variance application submitted by Pray First Mission Ministries., 2165 Cunningham Drive Unit 2179 LRSN 7001532. Michelle Bebbs, City Architect represented Coliseum Central Design Review Committee. The Church was represented by Edward Henderson. A motion was made by J. Pope moved, and seconded by R. Gentry that the variance be granted which will reduce the required (right) building setback from 30 feet to 9.58 feet; reduce the required front parking setback from 30 feet to 9.58 feet; and reduce the required rear parking setback from 10 feet to zero feet to allow a church in an existing building because: 1. The strict application of the ordinance would produce undue hardship due to the location of the tenant space within the shopping center; and 2. The hardship is not shared generally by other properties in the same zoning district and the same vicinity; and 3. The authorization of the variance is not of substantial detriment to adjacent property and the character of the district will not be changed by the granting of the variance; and 4. The granting of the variance is in harmony with the intended spirit and purpose of the ordinance. The following conditions apply: 1. Pray First Mission Ministries is to limit occupancy to what is allowed by the Building Code. 2. The use of the facility is limited to Sunday 10:00 a.m. to 1:00 p.m. and Wednesdays 5:00 p.m. to 7:00 p.m. 3. There will not be a day care or child care use in the building. 4. Parking is limited to the rear parking lot. 5. If Pray First Mission Ministries request s the use of the existing sign cabinet In the future, Pray First Mission Ministries is to utilize the existing sign cabinet and the size of the sign area must meet the requirements of the zoning ordinance. A roll call vote on the motion resulted as follows: AYES: Gentry, Hobbs, Peters, Pope, Savage NAYS: None . ___________ .
