AT A REGULAR MEETING FOR THE BOARD OF ZONING APPEALS OF THE CITY OF HAMPTON, VIRGINIA, HELD IN THE CITY HALL HARDY CASH CONFERENCE ROOM, NOVEMBER 7, 2011. Chairman Thomas Savage called the meeting to order. Upon roll call the following answered as present: Linda Ellis, Rodney Gentry, Burnett Peters, John C. Pope and Thomas Savage. Also present were Clerk to the Board/Zoning Services Manager, Joe Dunford; Lesa Yeatts, Sr. Deputy Attorney and Mary Cole (recording secretary). . ____________ . On motion of B. Peters second by R. Gentry to approve the minutes of the October 17, 2011 meeting as submitted. A roll call vote on the motion resulted as follows: AYES: Ellis, Gentry, Peters, Pope, Savage NAYS: None . ___________ . 11‐043 A public hearing was held on the variance application submitted by Abundant Life Tabernacle, 101 Blackburn Lane, LRSN 5000205, to be considered for a variance to reduce the required side yard building setback from 30 feet to zero feet to allow an 18 feet x 30 feet addition on an existing church. The applicant represented by James Parker appeared before the board. A motion was made by J. Pope and seconded by B. Peters to allow the applicant to submit a current survey showing the existing site conditions and the proposed addition. Request to be continued to next meeting date, December 5, 2011, to allow applicant time to get corrected paperwork. A roll call vote on the motion resulted as follows: AYES: Ellis, Gentry, Peters, Pope, Savage NAYS: None ABSTAIN: None . ___________ . 11‐044 A public hearing was held on the variance application submitted by Earlean Williams, 46 Newby Drive, LRSN 3004506, which will reduce the required rear yard setback from 28.66 feet to 20 feet to allow an (8 feet x 22 feet) addition on the rear of the dwelling; which will reduce the minimum side yard setback from 3 feet to 1.8 feet; and which will reduce the required rear yard setback from 5 feet to 3.9 feet to amend variance # 96‐63. The applicant represented by Kevin Alligood appeared before the board. A motion was made by B. Peters and seconded by L. Ellis the variance be granted because: 1. It is in keeping with the neighborhood. A roll call vote on the motion resulted as follows: AYES: Ellis, Gentry, Peters, Pope, Savage NAYS: None ABSTAIN: None . _____ 11‐045 A public hearing was held on the variance application submitted by Hampton University, 427 East Queen Street, LRSN 12001060 & 519 East Queen Street, LRSN 12001061, to be considered for a variance to reduce the required side yard setback from 30 feet to 14 feet to allow a new Research Center Building. The applicant represented by Arthur Kamp appeared before the board. Check on status boundary line adjustment plat. Site layout plan was not included in the package. A motion was made by J. Pope and second by B. Peters that the variance request to be continued until November 21, 2011 to check on status boundary line adjustment plat because site layout plan was not included in the package . A roll call vote on the motion resulted as follows: AYES: Ellis, Gentry, Peters, Pope, Savage NAYS: None ABSTAIN: None . ___________ . 11‐046 A public hearing was held on the variance application submitted by Todd W. Gensler, 42 Bay Front Place., LRSN 12007770, to be considered for a variance to reduce the required side yard setback from 3 feet to 0.5 (one half inch), to allow a generator to be placed in the side yard. The applicant Mr. Gensler did not attend due to the fact that he is a physician and in surgery that afternoon. A motion was made by J. Pope and second by B. Peters that the variance request be continued November 21, 2011 to allow the applicant to submit a current survey showing the existing site conditions and the proposed addition.
