1 CITY OF HAMPTON BOARD OF ZONING APPEALS 2 WORK SESSION SUMMARY 3 4 February 4, 2019 5 The City of Hampton Board of Zoning Appeals held a work session on Monday, February 4, 2019 6 at 4:30 p.m. in the Hardy Cash Conference Room, City Hall, 22 Lincoln Street, Hampton, 7 Virginia. 8 9 In attendance were: Chairman John C. “Jack” Pope, Vice-Chair Linda Ellis, and Board 10 Members Dr. Arne Hasselquist, Richard Rudnicki, and Thomas Savage. Also present were Zoning 11 Administrator/Community Development Department (CDD) Deputy Director Steve Shapiro, 12 Deputy City Attorney Bonnie Brown, Development Services Center Manager Hannah Sabo, 13 Zoning Official Angela Leflett, Zoning Official Melvion Knight, and Senior Administrative 14 Assistant/Recording Secretary Ann Crist. 15 Chairman Pope called the work session to order at 4:30 p.m. 16 17 Regarding AZ18-00001, Zoning Administrator/Community Development Department (CDD) 18 Deputy Director Steve Shapiro advised the Board that the applicant has withdrawn his 19 application for appeal. Zoning Official Angela Leflett provided the Board with a copy of the 20 withdraw request. A copy of the withdraw request is attached to these minutes. 21 22 Regarding AZ19-00001, Zoning Administrator/Community Development Department (CDD) 23 Deputy Director Steve Shapiro advised the Board that the appellant was evicted from the 24 residence and the violation is closed; the application for appeal is withdrawn. In response to questions from Vice-Chair Ellis, Zoning Administrator/Community Development Department 25 (CDD) Deputy Director Steve Shapiro stated there is no limit to the number of animals a person 26 can own listed in the zoning ordinance, and the definition of a kennel in the zoning ordinance 27 is two (2) or more dogs older than 4 months. Mr. Shapiro stated that based on his interpretation 28 of the zoning ordinance Ms. Quinn is operating a kennel, which is not a permitted use in this 29 residential district. ROLL CALL 5 6 Chairman Pope called the meeting to order at 5:00 p.m. 7 8 A call of the roll noted those present: Chairman John C. “Jack” Pope, Vice-Chair Linda Ellis, 9 and Board Members Dr. Arne Hasselquist, Richard Rudnicki, and Thomas Savage. 10 Also present were Zoning Administrator/Community Development Department (CDD) Deputy 11 Director Steve Shapiro, Deputy City Attorney Bonnie Brown, Development Services Center 12 Manager Hannah Sabo, Zoning Official Angela Leflett, Zoning Official Melvion Knight, and 13 Senior Administrative Assistant/Recording Secretary Ann Crist. 14 15 ITEM II. MINUTES – January 7, 2019 16 17 A motion was made by Board Member Savage and seconded by Vice-Chair Ellis to approve 18 the January 7, 2019 Board of Zoning Appeals work session and public hearing meeting minutes. 19 A roll call vote on the motion resulted as follows: 20 21 AYES: Rudnicki, Savage, Ellis, Pope 22 NAYS: None 23 ABSTAIN: Hasselquist 24 ABSENT: None 25 ITEM IV. PUBLIC HEARING ITEMS: 26 27 A. AZ18-00001: North 37 Management LLC, 11 Ivory Full Crescent, LRSN 13002547, an 28 appeal of a notice of violation issued on October 25, 2018, for violating Use Permit 29 635 condition #5, that no boats at the marina be used a permanent living quarters. 30 Applicant deferral request granted during the January 7th Board of Zoning Appeals 31 hearing. 32 33 Zoning Administrator/Community Development Department (CDD) Deputy Director Steve Shapiro advised the Board that the applicant has withdrawn his application for appeal. 34 35 Vice-Chair Ellis made a motion to approve the applicant’s request to withdraw his application 36 for appeal. Board Member Savage seconded the motion. 37 38 A roll call vote on the motion resulted as follows: 39 40 AYES: Hasselquist, Rudnicki, Savage, Ellis, Pope NAYS: None 41 ABSTAIN: None 42 ABSENT: None 43 44 45 B.
