CALL TO ORDER/ROLL CALL
Molly Joseph Ward presided
Present: W. H. "Billy" Hobbs, Jr., Will Moffett, Chris Snead, Christopher G. Stuart,
Donnie R. Tuck, George E. Wallace
Mayor Ward called the meeting to order at 8:04 a.m. All members of City Council
were present.
Mayor Ward shared that the National Park Service Advisory Board and the Director
of the National Park Service, John Jarvis, with his senior staff are meeting at Fort
Monroe over the next few days. She plans to leave the meeting briefly to welcome
them to Hampton and then will return.
The following staff members were present: Mary Bunting, City Manager; Cynthia
Hudson, City Attorney; Katherine Glass, Clerk of Council; James A. Pete" Peterson
and James Gray, Assistant City Managers; Tommy Townsend, Acting Police Chief;
Diane Bohlman, Director of Human Resources; Robin McCormick, Communications
Strategist; and Steven Bond, Senior Assistant City Attorney.
Karen Michael, Esquire and Robert Brauchle of the Daily Press were also present.
Mr. Brauchle left when the closed session convened.

1. 12-0426 Closed session pursuant to Virginia Code Sections 2.2-3711.A.1 and .7 to
discuss personnel matters involving the Police Division and to consult with legal counsel
regarding specific legal matters pertaining to the Police Division and requiring such
consultation.

At 9:05 a.m. Mayor Ward left the meeting to welcome the National Park Advisory Board
to Hampton.
At 9:40 a.m. Vice Mayor Wallace took a 10 minute recess. The meeting reconvened at
9:54 a.m. Karen Michael departed during the recess. Shortly after the meeting
reconvened Major Jean Troutman joined the session.
Mayor Ward returned at 10:16 a.m.
There were recesses from 11:01 a.m. until 11:08 a.m. and from 12:16 p.m. until 12:30
p.m.
Certification
2. 12-0427 Resolution Certifying Closed Session
WHEREAS, the City Council of the City of Hampton, Virginia, has convened a
closed session on this date pursuant to an affirmative recorded vote made in accordance
with the provisions of the Virginia Freedom of Information Act; and
WHEREAS, Section 2.2-3712D of the Code of Virginia requires a certification by
the City Council of the City of Hampton, Virginia, that such closed meeting was
conducted in conformity with Virginia Law;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Hampton, Virginia, hereby certifies that, to the best of each member’s knowledge, (i)
only public business matters lawfully exempted from open meeting requirements by
Virginia law were discussed in the closed session to which this certification resolution
applies, and (ii) only such public business matters as were identified in the motion
convening the closed meeting were heard, discussed, or considered by the city council
of the city of Hampton, Virginia.
Following the closed session certification at 12:57 p.m., the meeting reconvened in open
session.
Mayor Ward read the following statement:
We had two closed session items that we discussed today.
1) We had the opportunity today to ask Karen Michael additional questions, and
2) We received a briefing regarding the investigation of the undercover cigarette
operation.

Council understands that a comprehensive evaluation of the undercover cigarette
operation will only be possible after the financial and external audits are complete.
However, the City Manager will be releasing a summary of the investigation thus far
within the next 24 hours.
Based on the briefings and the presentation we received, we believe the investigation is
proceeding in a credible manner and we have confidence in our City Manager, City
Attorney and the Acting Chief in this regard.
