AT THE WORK SESSION OF THE HAMPTON PLANNING COMMISSION HELD IN THE LAWSON CONFERENCE ROOM, 8TH FLOOR, CITY HALL, HAMPTON, VIRGINIA, ON THURSDAY, MAY 2 2013, AT 3:00 P.M. Chairman Gregory Williams, Vice Chairman Gaynette LaRue, and Commissioners Carlton Campbell, James Young, Andre McCloud, and Chris Snead were present. Commissioner Mary Bunting was absent. Mr. Terry O’Neill, Secretary to the Commission, opened the floor for questions and or comments regarding the agenda items. Sr. Deputy City Attorney Vanessa Valldejuli stated Zoning Ordinance Amendment items B through S are housekeeping amendments due to the adoption of chapter 35.1 and new stormwater management regulations. She stated she would ask for an amendment to items O and P because of issues between the Department of Conservation and Recreation (DCR) and the Federal Emergency Management Agency (FEMA). In response to a question from Mr. O’Neill, Chairman Williams agreed since Zoning Ordinance Amendments B through S are all related that they should be read together in order to expedite the process. Voting on the amendments will be done in separate motions. Mr. O’Neill stated item A is a separate item and deals with an amendment to the sign ordinance in regards to signage for large institutional uses such as the VA Hospital and Hampton University. This will cover campuses with multiple building locations and will be a limited provision. Zoning Official/Project Coordinator Melissa Sajid stated the big component in this issue is the zoning district in which these uses are located. Hampton University is partially located in a residential district. Ms. Valldejuli stated ZOA 061-2013 pertaining to zoning district SPI-IH (infill housing) is not a substantive change; it is only regarding landscaping. Mr. O’Neill stated in regards to the CIP, the purpose of the Commission is to review it for consistency with the Community Plan but the Commissioners are not responsible for balancing the budget. Budget Director Gloria Washington stated feedback has been received regarding the adoption of the budget for FY 2014 and this feedback will be entertained for discussion with Council. Input was received from different groups and the CIP Committee used this information to rank priorities. She stated the Planning Commission is just to recommend approval as submitted or with guidance and/or recommendations. Mr. O’Neill stated the document could change based on budget revenues. Planning Commission Work Session 20130502 Page 1 In response to a question from Commissioner LaRue, Ms. Washington stated that the VDOT revenue is a 50/50 match. Some revenues are dedicated resources and some are fee based. The CIP is a revolving 5 year process. Ms. Valldejuli stated as a result of the Joint Land Use Study with Langley Air Force Base it was noted that there is no power of eminent domain for clear zone property in the state of Virginia. Acquisition of land is through voluntary sales from property owners. The city matches state funds for the acquisition of properties. In response to a question from Commissioner Young, Mr. O’Neill stated the educational school funding monies are not included in the CIP. Commissioner LaRue gave a brief update on a downtown work group’s plans to repurpose the old courthouse as an art center with artist and dance studios; gift shop; and restaurants as some of the things it might house. The meeting adjourned at 3:29 p.m. Planning Commission Work Session 20130502 Page 2 AT A PUBLIC HEARING AND REGULAR MEETING OF THE HAMPTON PLANNING COMMISSION HELD IN THE COUNCIL CHAMBERS, 8TH FLOOR, CITY HALL, HAMPTON, VIRGINIA, ON THURSDAY, MAY 2, 2013 AT 3:30 P.M. ITEM I. CALL TO ORDER Chairman Gregory Williams called the Planning Commission meeting to order. ITEM II. ROLL CALL A call of the roll noted Commissioner Mary Bunting was absent. Ms. Bunting’s presence was noted at 3:47 p.m. ITEM III. MINUTES A motion was made by Vice-Chairman LaRue, seconded by Commissioner Young, to approve the minutes of the April 4, 2013 work session and Planning Commission meeting. A roll call vote on the motion resulted as follows: AYES: Campbell, Young, McCloud, LaRue, Bunting, Williams NAYS: None ABST: Snead ABSENT: None IV. STAFF REPORTS Terry O’Neill, Secretary to the Commission, stated this meeting would be the last Planning Commission meeting for Senior Youth Planner James Payne as he will be graduating from high school. A. Youth Planner Report James Payne stated this meeting is the last presentation he would be making before the Planning Commission. James stated during the month of April the Youth Commission focused on accomplishing two major goals; recruitment and the Youth Friendly Guidebook Reception held on April 15 at the Hampton Teen Center. The purpose of the event was to inform business and organizations on the critical aspects of hosting a “Youth Friendly” event. Applications for Youth Commission recruitment will be out in the month of May. The applications have been given out to all of the public and private high schools in the area. They can also be found on the Hampton website. James stated prior to working on the Youth Commission he had originally wanted to b a doctor. He now wants to be a politician. Working on the PC Minutes 20130502 Page 1 Commission has helped him plan his career path. All of this started with his recruitment. The Planning Division is also going through a recruitment process for the Junior Youth Planner position. Through the recruitment process, the Planning Division and the Hampton Youth Commission will do everything possible to set up a bright future for Youth civic Engagement. He would like the youth to come back and help make Hampton “the most livable city in Virginia”. In response to a question from Commissioner Young, James stated there will be four seniors leaving the Youth Commission. Upon being congratulated on his work and graduation and in response to a question from Commissioner Campbell, James stated the Youth Friendly Guidebook is now finished and they are looking for partners to distribute it. James stated the Youth Planner interviews will be held on May 21, 2013 and the Youth Commission interviews will be on May 28, 2013. Chyna Matheny will become the Senior Youth Planner. Commissioner LaRue congratulated James and stated she hopes he will go into politics as we need the best and brightest. She stated James is an example of how the City can help its youth. Commissioner McCloud congratulated James and stated James had said at the beginning of his time as a Youth Planner he was nervous. Commissioner McCloud stated that even if James did not have an answer he always came up with something. Public Hearing Procedures Terry O’Neill, Secretary to the Commission, read key points of the Hampton Planning Commission Public Hearing/Comment Rules in order for the affairs of the Commission to be conducted in a courteous and orderly manner. V. PUBLIC HEARING ITEMS A. Zoning Ordinance Amendment No. 054-2013: Ordinance to amend and re- enact chapter 18.1 of the Zoning Ordinance of the City of Hampton, Virginia entitled “Signs” by amending section 18.1-6 pertaining to special situations to add subsection (7) pertaining to signage for large institutional uses. Zoning Official/Project Coordinator Melissa Sajid stated the purpose of the proposed Zoning Ordinance amendment is to create regulations that allow flexibility in design with respect to entrance sign regulations for educational and medical campuses. The proposal intends to create specific regulations for entrance signs for PC Minutes 20130502 Page 2 educational and medical campuses that are 50 acres or more in size. As proposed, campus entrance signs would be allowed up to 110 square feet and 13’ in height. Walls that are integrated into the design of such signs shall be allowed up to 15’ in height provided no more than 25% of the wall is at the maximum height. This need was brought to light when Hampton University proposed new signs in November 2012 and had to apply for variances. The Hampton Community Plan (2006, as amended) includes policies that promote the enhancement of the identity and scenic qualities of city corridors and gateways (LU-CD Policy 17) and that promote cooperation and partnerships with higher educational institutions and health and human service providers (CF Policy 23 and CF Policy 47). This ordinance amendment achieves these policies by partnering with educational and medical institutions to create design flexibility for signage that aesthetically augments and punctuates corridors leading to educational and medical campuses. Staff recommends adoption of the proposed Zoning Ordinance Amendment No. 054-2013. In response to a question from Commissioner Campbell, Mr. Terry O’Neill stated Hampton University is waiting for approval of this ordinance. If the ordinance is approved the variance applications will be a moot point. Vice Chairman LaRue stated this request looks like the increased sizes going from 48 square feet allowed to 110 square feet will be more than other cities in the area. In response Mr. O’Neill stated this request is trying to go along with what other communities have done; more communities are going with the larger entrance signs i.e. Christopher Newport University. Staff has worked closely with Hampton University and this is within the realm of compatibility. Ms. Sajid showed the Commissioners a rendering of Hampton University’s proposed signage. Staff recommended approval of Zoning Ordinance Amendment No. 054-2013. There were no speakers. Zoning Ordinance Amendment No. 055-2013: Ordinance to Amend and Re- enact Chapter 17.3 Special Public Interest, Article XVIII of the Zoning Ordinance of the City of Hampton, Virginia Entitled “SPI-BBD-Buckroe Bayfront District” by Amending Section 17.3-133(C)(2)(a) Pertaining to a Final Design Plan. Sr. Deputy City Attorney Vanessa Valldejuli stated a majority of the proposed amendments are housekeeping issues as landscaping references are now in a separate document of its own. There are also minor changes deleting or changing terms since is no longer a Codes Compliance Department or a Planning Department. PC Minutes 20130502 Page 4 They are now part of the Community Development Department. There are also additional amendments that reference required stormwater management regulation changes. After presentation the Commission approved the following resolution: WHEREAS: the Hampton Planning Commission has before it this day ZOA 055-2013, a proposed Ordinance to Amend and Re-enact Chapter 17.3 Special Public Interest, Article XVIII of the Zoning Ordinance of the City of Hampton, Virginia Entitled “SPI-BBD-Buckroe Bayfront District” by Amending Section 17.3-133(C)(2)(a) Pertaining to a Final Design Plan; WHEREAS: this is a housekeeping amendment which changes the reference to site plan regulations from article IV, chapter 9 of the city code to chapter 35.1, deletes any specific titles, and refers only to the chapter of the city code governing subdivisions; and WHEREAS: there were no speakers. NOW, THEREFORE, on a motion by Commissioner Mary Bunting and seconded by Commissioner Chris Snead, BE IT RESOLVED that the Hampton Planning Commission recommends approval of the ordinance amendment to chapter 17.3, article XVIII, of the Zoning Ordinance. Capital Improvement Plan (CIP) for Fiscal Years 2014-2018: The City of Hampton, Virginia’s proposed five-year capital improvement plan includes additions and improvements to the City’s capital assets. Proposed projects may be included in one of the following expenditure categories: Education; Hampton’s Waterways; Maintenance of Public Properties and Performance Support; Master Plans; Neighborhood Support; New Facilities; Other CIP Projects; Other Economic Development Support; Public Safety and Streets PC Minutes 20130502 Page 20 and Infrastructure. Cost estimates for the projects proposed in the five-year plan total $228,131,966. In response to the continued fiscal challenges experienced by many of the nation’s localities, the proposed Capital Improvement Plan represents a very conservative approach that will further the City’s capital investments while maintaining compliance with the City’s financial policies. Funding sources for the proposed plan may include: General Fund; General Obligation Bond Proceeds; Stormwater Fund and Wastewater Fund. Budget Director Gloria Washington gave a brief presentation on the Capital Improvement Plan (CIP) for Fiscal Years 2014-2018 (FY14-18). She stated Council would vote on the budget for 2014 with the remaining years (2015-2018) as planning years. The CIP is a five year funding plan that covers long-term acquisition of property and equipment; construction of new public facilities; and maintenance and improvement to existing public facilities. Capital improvement projects have a minimum cost of $50,000 and a life expectancy of at least five years. The CIP objectives are continually examined to include review of the Hampton Community Plan. The CIP objectives are: • Continue the City’s overall vision of making Hampton “the most livable City in Virginia.” • Implement the Hampton Community Plan including Master Plan initiatives. • Maintain/protect current bond rating by adherence to Council approved financial policies. • Merge Hampton City Schools’ capital improvement plans with the City’s process. • Prepare capital budget portion of the annual recommended budget. • Balance the City’s economic development needs with existing development and capital renewal plans. The role of the Planning Commission in the budget process is to review the proposed plan for consistency with the Hampton Community Plan. Master Plans and strategic plans are followed as before. The challenges in this process are: • Ability to fund the number of viable projects with limited resources; • Execution of federal/state mandated requirements; and • Maintenance of existing development while planning the completion of on-going projects and implementation of new projects. PC Minutes 20130502 Page 21 A graph was displayed showing the total CIP’s budgeted amounts from FY08-12 through FY4-18, which due to the economy, shows a decline from FY08-12 to present. Due to the economic decline funding is at 50% from prior years. The FY14-18 budget of $228 million is based on the projected figure when the dedicated tax rate is taken into consideration. The FY14-18 CIP revenue resources are as follows: • Federal and State Government - $8.70M • General Obligation Bond Proceeds - $69.34M • Dedicated Sources - $52.19M • Contributions from the General Fund - $97.90M The proposed projects for the FY14-18 CIP expenditure categories are in one of ten expenditure categories with some as follows: • Education - $37.28M • Hampton’s Waterways - $19.02M • Maintenance of Public Properties/Performance Support - $61.7M • Master Plans - $24.01M ($20M is based on the proposed dedicated tax increase) • New Facilities - $550K • Other CIP Projects - $11.97M • Other Economic Development Support - $2.4M • Public Safety - $7.55M • Streets and Infrastructure - $61.89M (Dedicated VDOT funding is located in this line item) The Strategic Investment Initiatives are spread out over the areas based on the various neighborhoods – Phoebus; North King; Kecoughtan; Buckroe; Coliseum Central; Downtown; other City Initiatives; Waterways, and other Community Plan Initiatives. Ms. Washington stated the action requested of the Planning Commission is to receive public comment on the proposed plan and recommend the Plan be forwarded to City Council for approval based on its consistency with the Hampton Community Plan. The next step will be the Council meeting on May 8, 2013 at which time the final budget will be adopted. Prior to adoption Council will have an opportunity to modify the plan with the first year as the only portion being adopted. Incorporated into the Manager’s budget as the Capital Budget component is the amount of $39.6 million. Chairman Williams reminded the Commission that this is the opportunity for the Commissioners to add something or question the proposed budget. In response to a question from Commissioner McCloud, Commissioner Bunting stated the $4 million dollars, as it is now in the Master Plans, will be funded with a dedicated tax increase and could either be scaled down or remain the same depending on Council’s decision. The total amount will not be known until Council adopts the new real estate tax rate. The additional four cents would be used to invest in an even faster acceleration of Master Plans and Strategic Plans than would PC Minutes 20130502 Page 22 otherwise be supportable by the CIP. The idea behind it was to accelerate the impact on the economic base in the neighborhoods through the additional investment funding. In response to a question from Commissioner LaRue, Ms. Washington responded that what looks like an increase in what can be spent is the part of the $228M which includes funding dedicated to Stormwater and Wastewater Initiatives based of TMDL and EPA requirements. Part of the increase is dedicated revenue to those activities. As stated by the City Manager, the other amount is the $4 million each year over the next five years from dedicated tax for the Master Plan initiative and that could fluctuate based on Council’s approval on May 8. In response to a question from Commissioner LaRue, Commissioner Bunting stated property values went down because of the impact on real estate values. Values went down each of those years because of the recession and the impact on property values. When real estate values went down and other revenues were not growing there was less money to spend. The City could not borrow as much because of financial policies that govern outstanding debt that is looked at as a part of assessed valuation. When assessed valuation goes down as it did because of the housing market crash, the city had less money it could borrow and maintain its strong AA credit rating. Both of those caused the downward decline. A slight increase is shown over the next 5 year period because the economy seems to be improving, but $20 million is tied to the dedicated tax increase. The $20 million is based on receiving $4 million over the next five years. If the tax increase is not approved by Council or it is scaled downward, that number would come down. Part is driven by the dedicated tax revenue and part is due to better revenue projections in out years. As the economy improves things go up slightly. In response to questions from Commissioner Campbell, Commissioner Bunting stated when the new Regional Animal Shelter was first proposed it was thought the City’s entire share of $3 million for the project needed to be funded in full. When the four localities decided to build the project, Newport News took the lead in the facility and rolled the construction cost into a bond issue. Payments or debt service are now made on an annual basis instead of one lump sum and which resulted in Hampton not having to borrow the $3 million. The non-departmental component of the budget before Council shows the contribution to the Regional Animal Shelter that includes the debt service and the operating expenses. In response to Commissioner Campbell’s question about Ft. Monroe, Commissioner Bunting stated the City is not responsible for its improvements; that falls to the Fort Monroe Authority which receives its funding via the State. In response to a question from Commissioner McCloud, Commissioner Bunting stated the policy under consideration is a guideline because future councils cannot be obligated to a particular action as it relates to the budget or taxes. A guideline was already in place so as property values rise the tax rate would go down. When Council adopted that policy in prior years, the decline in housing values was not anticipated. PC Minutes 20130502 Page 23 Commissioner Bunting stated in conversations with those members of the community who attended the community meetings regarding the budget that she, Dr. Shiflett (School Board), School Board members, and Council members, it was suggested if the rate adjustments had been done incrementally there would not have been a big jump as is now being considered. Tax rates should be adjusted up and down every year. Housing values are not to remain stagnant, and in the last five years homeowners have paid less. The rate adjustment will take most homeowners back to what they paid in taxes in 2008 before the decline started. When housing values go up the tax rate will go down. As one last caution, Commissioner Bunting stated if the community wants new things (i.e. new library branch or new ball field), then money is needed. Policies are guidelines. A rate increase was budgeted when two new schools were proposed. In response to Commissioner LaRue and Chairman Williams, Commissioner Bunting stated it was good to see residents come out to the Community meetings. Everyone was encouraged to come to the forums and do the online surveys. A random scientific phone survey was also done. Commissioner Campbell stated it was good to be able to respond to a recent survey on Planning Department organizational changes and he looks forward to partnership with the Planning staff. Commissioner McCloud stated it is his opinion that the roll of the Planning Commission on the CIP process has changed for the better and thanked the City for what it has done. WHEREAS: the Planning Commission has before it this day the proposed Fiscal Years 2014-2018 Capital Improvement Plan; WHEREAS: the Planning Commission reviewed the proposed Capital Improvement Plan for consistency with and in support of the City of Hampton’s adopted Community Plan and Master Plans initiatives; WHEREAS: the proposed Fiscal Years 2014-2018 Capital Improvement Plan is considered a five-year funding plan and is intended to be one of the guides utilized to develop the Manager’s Recommended Budget which will be approved on May 8, 2013; WHEREAS: expenditure categories included in the proposed Fiscal Years 2014-2018 Capital Improvement Plan are: Education; Hampton’s Waterways; Maintenance of Public Properties and Performance Support; Master Plans; PC Minutes 20130502 Page 24 Neighborhood Support; New Facilities; Other CIP Projects; Other Economic Development Support; Public Safety and Streets and Infrastructure; WHEREAS: the estimated cost for the projects included in the proposed Fiscal Years 2014-2018 Capital Improvement Plan total $228,131,966; WHEREAS: the final adoption of the proposed Fiscal Years 2014-2018 Capital Improvement Plan will occur at a City Council public hearing to be held on May 8, 2013, the first year of which has been incorporated as the Capital Budget component in the Fiscal Year 2014 Manager’s Recommended Budget; WHEREAS: there was no one present to speak during the public hearing. NOW, THEREFORE, on a motion by Commissioner James Young and seconded by Commissioner Carlton Campbell, BE IT RESOLVED that the Hampton Planning Commission respectfully recommends the Honorable City Council of the City of Hampton, Virginia approve the proposed Fiscal Years 2014-2018 Capital Improvement Plan as presented. Cost estimates for the projects proposed in the five-year plan total $228,131,966. In response to the continued fiscal challenges experienced by many of the nation’s localities, the proposed Capital Improvement Plan represents a very conservative approach that will further the City’s capital investments while maintaining compliance with the City’s financial policies.
