A. Rezoning Application No. 18-00008. This is a rezoning applicaton by Mary Christian to
rezone .16± acres located at 123 E. Pembroke Avenue, which is a corner lot abutting
Eaton St. [LRSN: 2003496]. The application is to rezone the property from Multiple
Residential (R-M) District with proffered conditions to One Family Residential (R-4) District.
Approval of this application would permit the applicant to apply for Use Permit
Application No. 18-00011 for a community center. The Hampton Community Plan (2006,
as amended) recommends medium density residential for this site. Copies of documents
or information concerning this proposal may be obtained from the Community

B. Use Permit Application No. 18-00011. This is a use permit application by Mary Christian to
permit a community center at 123 E. Pembroke Avenue, which is a corner lot abutting
Eaton St. [LRSN: 2003496]. The property is currently zoned Multiple Residential (R-M)
District with proffered conditions, which does not allow for the community center use.
The applicants are proposing Rezoning Application No. 18-00008 to change the zoning
district to One Family Residential (R-4) which would allow for a community center use
with a use permit. The Hampton Community Plan (2006, as amended) recommends
medium density residential for this site. Copies of documents or information concerning

C. Use Permit Application No. 18-00007. This is a use permit application by Colonial Downs
Group, LLC to permit an amusement center for an indoor off-track betting historical
horse racing facility at 1990 to 1996 Power Plant Parkway [a portion of LRSN: 13001056],
which is within the Power Plant Shopping Center at the corner of Pine Chapel Road and
Power Plant Parkway. The property is currently zoned Limited Commercial (C-2) District
with proffered conditions which allows for an amusement center subject to an approved

use permit. The Hampton Community Plan (2006, as amended) recommends mixed use

D. Zoning Ordinance Amendment No. 18-00015: Ordinance To Amend And Reenact
Chapter 3 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Uses
Permitted” By Amending Section 3-3 Pertaining to Additional Standards On Permitted
Uses As It Relates To Live Entertainment 1 and Live Entertainment 2. This amendment
would redefine Live Entertainment 1 venues as those providing live entertainment only
within the building, without a dance floor or similar open gathering space, and a small
performance area. The amendment also provides standard conditions of operation for
Live Entertainment 1. Live Entertainment 2 applies to venues wishing to provide a dance
floor or similar open gathering space, larger performance area, or wishing to operate
beyond the standard required conditions of Live Entertainment 1. Live Entertainment 2
would continue to require a use permit approved by City Council. This item is proposed in
conjunction with Zoning Ordinance Amendments 18-00016 and 18-00017. Copies of

E. Zoning Ordinance Amendment No. 18-00016: Ordinance To Amend And Reenact
Chapter 9 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Overlay
Districts” By Amending Article 3 – Coliseum Central Overlay To Redefine Live
Entertainment 1 and Live Entertainment 2. This amendment would redefine Live
Entertainment 1 venues as those providing live entertainment only within the building,
without a dance floor or similar open gathering space, and a small performance area.
The amendment also provides standard conditions of operation for Live Entertainment 1.
Live Entertainment 2 applies to venues wishing to provide a dance floor or similar open
gathering space, larger performance area, or wishing to operate beyond the standard
required conditions of Live Entertainment 1. Live Entertainment 2 would continue to
require a use permit approved by City Council. This item is proposed in conjunction with
Zoning Ordinance Amendments 18-00015 and 18-00017. Copies of documents or

F. Zoning Ordinance Amendment No. 18-00017: Ordinance To Amend And Reenact
Chapter 11 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Parking”
By Amending Section 11-2 Pertaining To Parking Spaces Required And Section 11-8
Parking Credits, Exemptions, And Reductions As A Part Of Redefining Operational
Characteristics Of Live Entertainment 1 & 2. Approval of this amendment would (1)
remove the additional parking currently required for live entertainment 1, which is based
upon building capacity, and (2) base any additional parking requirement for live
entertainment 2 on the size of the dance floor or similar open gathering space.
Additional parking is that which is required beyond the minimum for the restaurant or
micro-brewery/distillery/winery. Approval of this amendment would also make additional
areas within the City eligible for on-street parking credits and modify the shared parking
agreement requirements in order to grant additional flexibility. This item is proposed in
conjunction with Zoning Ordinance Amendments 18-00015 and 18-00016. Copies of

G. Use Permit Application No. 18-00012. This is a use permit application by Bowman’s Soul-N-
The Wall to permit live entertainment 2 in conjunction with a restaurant at 1899 N
Armistead Avenue, which is at the corner of N Armistead Avenue and Pine Chapel Road

[LRSN: 7001182]. The property is currently zoned Neighborhood Commercial (C-1) District
which allows for live entertainment in conjunction with a restaurant subject to an
approved use permit. The Hampton Community Plan (2006, as amended) recommends

H. Zoning Ordinance Amendment No. 18-00008: Ordinance To Amend And Reenact
Chapter 1 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “General
Provisions” By Amending Section 1-30 Pertaining To General Green Area Requirements.
Approval of this amendment would include PH-2 (Phoebus Town District) among the
districts that are exempt from the general requirement to set aside ten percent (10%) of
a lot for trees, shrubs, and turf. This item is proposed in conjunction with Zoning Ordinance
Amendments 18-00008, 18-00009, 18-00010, 18-00011, 18-00012, 18-00013, and 18-00014
and Rezoning Applications No. 18-00009 and 18-00010 to establish new mixed-use zoning
districts and development standards for Phoebus in support of the recommendations of
the Phoebus Master Plan (2007, as amended). Copies of documents or information

I. Zoning Ordinance Amendment No. 18-00009: Ordinance To Amend And Reenact
Chapter 3 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Uses
Permitted” By Amending Section 3-2 To Recodify The Use Table by Separating Standard
Base Districts From Special Districts, Adding The New Zoning Districts Entitled Phoebus
Town District (PH-2) And Phoebus Commercial Transition District (PH-3) To the Use Table,
and Amending Section 3-3 Pertaining to Additional Standards On Permitted Uses
Applicable To the PH-2 and PH-3 Districts. Approval of this amendment would: (1) govern
the uses permitted in the new PH-2 and PH-3 districts, which will be the same as currently
permitted in PH-1, (2) remove “bank, accessory, without drive through,” in all districts,
and (3) remove “religious facility, temporary tent revival” in all districts. This item is
proposed in conjunction with Zoning Ordinance Amendments 18-00008, 18-00009, 18-
00010, 18-00011, 18-00012, 18-00013, and 18-00014 and Rezoning Applications No. 18-
00009 and 18-00010 to establish new mixed-use zoning districts and development
standards for Phoebus in support of the recommendations of the Phoebus Master Plan

J. Zoning Ordinance Amendment No. 18-00010: Ordinance To Amend And Reenact
Chapter 8 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Special
Districts” By Amending Article 7 Entitled “Phoebus Districts” By Amending PH-1 – Phoebus
Business District. Approval of this amendment would rename the district to “Phoebus
Urban Core District” and create more appropriate urban form standards for the historic
and commercial core of Phoebus with development regulations that place parking to
the rear of buildings, regulate lot depth, building height, building setbacks, and façade
composition in order to support pedestrian activity and ensure development consistent
with the overall scale of historic Phoebus. Development deviating from certain
dimensional standards will require an approved use permit. This item is proposed in
conjunction with Zoning Ordinance Amendments 18-00008, 18-00009, 18-00010, 18-00011,
18-00012, 18-00013, and 18-00014 and Rezoning Applications No. 18-00009 and 18-00010
to establish new mixed-use zoning districts and development standards for Phoebus in
support of the recommendations of the Phoebus Master Plan (2007, as amended).

K. Zoning Ordinance Amendment No. 18-00011: Ordinance To Amend And Reenact
Chapter 8 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Special
Districts” By Amending Article 7 Entitled “Phoebus Districts” By Adding A New District
Entitled “PH-2 – Phoebus Town District”. Approval of this amendment would adopt
appropriate urban form standards for the areas directly adjacent to the PH-1 Urban Core
District with development regulations that place parking to the rear of buildings, regulate
lot depth, building height, building setbacks, and façade composition in order to support

L. Zoning Ordinance Amendment No. 18-00012: Ordinance To Amend And Reenact
Chapter 8 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Special
Districts” By Amending Article 7 Entitled “Phoebus Districts” By Adding “PH-3 - Phoebus
Commercial Transition District”. Approval of this amendment would adopt form
standards to create a transition from the urban mixed-use center to more suburban
development with regulations that place parking to the rear of the building façade,
regulate lot depth, building height, building setbacks, and façade composition in order
to support pedestrian activity and ensure development consistent with the overall scale
of historic Phoebus. This item is proposed in conjunction with Zoning Ordinance
Amendments 18-00008, 18-00009, 18-00010, 18-00011, 18-00012, 18-00013, and 18-00014
and Rezoning Applications No. 18-00009 and 18-00010 to establish new mixed-use zoning
districts and development standards for Phoebus in support of the recommendations of
the Phoebus Master Plan (2007, as amended). Copies of documents or information

M. Zoning Ordinance Amendment No. 18-00013: Ordinance To Amend And Reenact
Chapter 10 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Signs” By
Amending Article 2, Sections 10-18, 10-31, 10-32, 10-33 To Adopt New Regulations For
Signs In The New PH-2 And PH-3 Zoning Districts. Approval of this amendment would
regulate the types of signs permitted and prohibited in the new PH-2 and PH-3 districts, as
well as dimensional and other features of permitted signs, such requirements are the
same as required in the current PH-1. This item is proposed in conjunction with Zoning
Ordinance Amendments 18-00008, 18-00009, 18-00010, 18-00011, 18-00012, 18-00013, and
18-00014 and Rezoning Applications No. 18-00009 and 18-00010 to establish new mixed-
use zoning districts and development standards for Phoebus in support of the
recommendations of the Phoebus Master Plan (2007, as amended). Copies of

N. Zoning Ordinance Amendment No. 18-00014: Ordinance To Amend And Reenact
Chapter 11 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Parking”
By Amending Section 11-8 Pertaining To Parking Credits, Exemptions And Reductions As
Part Of The Adoption Of New Zoning Districts For The Phoebus Neighborhood. Approval
of this amendment would (1) expand where on-street parking credits are permitted
throughout the city, (2) exempt or reduce parking requirements for certain uses in the PH-

2 and PH-3 districts from the general parking requirements, and (3) modify general
parking requirements for PH-1 as set forth in Chapter 11. This item is proposed in
conjunction with Zoning Ordinance Amendments 18-00008, 18-00009, 18-00010, 18-00011,
18-00012, 18-00013, and 18-00014 and Rezoning Applications No. 18-00009 and 18-00010
to establish new mixed-use zoning districts and development standards for Phoebus in
support of the recommendations of the Phoebus Master Plan (2007, as amended).
