A. Use Permit Application No. 20-00008 : This is a use permit application by Mr. William Felt,
PE, on behalf of American Legion to construct a new building for the American Legion Post
48, located at 115 S. Mallory Street [LRSN: 12001405] and 117 S. Mallory Street [LRSN:
12001406] . The property is zoned Phoebus Urban Core (PH-1) District. The proposed
building design does not meet the required development standards within the base zoning
district resulting in the request for a use permit which allows the Planning Commission and
City Council to consider alternative forms of development in relation to the adopted policies
within the Hampton Community Plan (2006, as amended) and the Phoebus Master Plan
(2007, as amended). The Hampton Community Plan recommends mixed-use uses for this
site and the Phoebus Master Plan recommends pedestrian-oriented “main street” character
buildings.
B. Use Permit Application No. 21-00002: This is a request by Mr. Azad Haji to operate a
restaurant without a drive-through, with an alcoholic beverage license at 1405 E. Pembroke
Avenue [LRSN: 12003335] in the Woodland Park neighborhood of the City. The property is
zoned Limited Commercial (C-2), Neighborhood Commercial (C-1), and One Family
Residential (R-9) with the restaurant and associated parking located within the C-2 and C-1
districts. The Hampton Community Plan (2006, as amended) recommends commercial land
use in this area. The use is currently permitted to operate only between the hours of 6:00 AM
and 10:00 PM; this request would expand those hours of operation.
