Rezoning Application No. 21-00010: This is a rezoning application by Delorean Power LLC, to amend the proffered conditions of Rezoning No.1315 to permit the proposed use: power plant (battery energy storage system) as well as other uses permitted in both Heavy Manufacturing (M-3) and Langley Business Park (LBP) Districts. The +32.83 acres parcel is located at 3201 Commander Shepard Blvd [LRSN: 6001003] and currently zoned M-3 District with conditions. The Hampton Community Plan (2006, as amended) recommends business/industrial use for this site. Lead Staff: Donald Whipple, Chief Planner B. Rezoning Application No. 23-00001: This is a rezoning application by Hampton Roads Community Action Program (HRCAP) to amend the proffered conditions of Rezoning No. 14-00007 to allow for Day Care 1, Commercial as well as other uses permitted in the Neighborhood Commercial (C-1) district. The ±2.66 acres parcel is located at 91 E Mercury Boulevard [LRSN: 8001553] and is currently zoned C-1 District with conditions. The Hampton Community Plan (2006, as amended) recommends commercial use for this site. Lead Staff: Davis Pemberton, City Planner C. Rezoning Application No. 23-00003: The applicant, City of Hampton, has requested deferral of this application in order to allow time for community engagement. The application is asked to be deferred to the June 15th Planning Commission meeting. This is a rezoning request by the City of Hampton to rezone two parcels totaling +0.86 acre from Multiple Residential (RM) District to the Public Open Space (PO-1) District. Page 1 of 4 The two parcels are located at 200 N First Street and 372 N First Street A [LRSN: 12006702 & 12007400, respectively]. The rezoning would place these publicly controlled properties into the same zoning district as the rest of Buckroe Park and Beach. The Hampton Community Plan (2006, as amended) recommends public/semipublic use for the property. The parcels also fall within the boundaries of the Buckroe Master Plan (2005, as amended), which recognizes the value of the parcels as access to the beach and operations in support of the park and beach. Use Permit Application No. 23-00001: This is a use permit application by Kevin & Yong Westby to permit a short-term rental (STR) at 826 N First Street [LRSN: 12007581]. The property is currently zoned One-Family Residential (R-11) which permits a short-term rental subject to an approved use permit. The Hampton Community Plan (2006, as amended) recommends low-density residential for this site. The property is also within the Buckroe Master Plan (2005, as amended) area, which supports North First Street north of Buckroe Park as a primarily residential neighborhood. Lead Staff: Urvi Patel, City Planner E. Use Permit Application No. 23-00003: This is a use permit application by RNFV1 LLC to permit a short-term rental (STR) at 230 N Fifth Street [LRSN: 12006999]. The property is currently zoned One-Family Residential (R-9) which permits a short-term rental subject to an approved use permit. The Hampton Community Plan (2006, as amended) recommends medium-density residential for this site. The property is also within the Buckroe Master Plan (2005, as amended) area, which supports North First Street north of Buckroe Park as a primarily residential neighborhood. Use Permit Application No. 23-00004: This is a use permit application by David & Erin Scott to permit a short-term rental (STR) at 8 Findley Street [LRSN: 7000091]. The property is currently zoned One-Family Residential (R-13) which permits a short-term rental subject to an approved use permit. The Hampton Community Plan (2006, as amended) recommends low-density residential for this site. The property is also within the Coliseum Central Master Plan (2015, as amended) area, which supports maintaining the residential neighborhood. Lead Staff: Urvi Patel, City Planner G. Zoning Ordinance Amendment No. 23-00001: This is a proposal by the City of Hampton to amend and re-enact the Zoning Ordinance of the City of Hampton, Virginia by amending Chapter 1, entitled “General Provisions” to add new regulations applicable to many or all zoning districts regarding food trucks. The provisions will clarify how food trucks may be parked or stored within Hampton. This amendment is in conjunction with Zoning Ordinance Amendments 23-00002, 23- 00003, 23-00004, 23-00005, 23-00006, and 23-00007. Lead Staff: Allison Jackura, Zoning Administrator H. Zoning Ordinance Amendment No. 23-00002: This is a proposal by the City of Hampton to amend and re-enact the Zoning Ordinance of the City of Hampton, Virginia by amending Chapter 2, Section 2-2 entitled “Definitions” to add a definition of “Food truck” and other related definitions. This amendment is in conjunction with Zoning Ordinance Amendments 23-00001, 23-00003, 23-00004, 23-00005, 23-00006, and 23-00007. Lead Staff: Allison Jackura, Zoning Administrator I. Zoning Ordinance Amendment No. 23-00003: This is a proposal by the City of Hampton to amend and re-enact the Zoning Ordinance of the City of Hampton, Virginia by amending Chapter 3, Section 3-2 entitled “Table of Uses Permitted”, and Section 3-3 entitled, “Additional Standards On Uses,” to update additional standards related to “Home Occupations” to allow food truck parking in conjunction with Page 2 of 4 home occupations, and to add “Food truck host site” as a permitted use, subject to approval of a zoning administrator permit, within the Residential (R-LL, R-43, R-R, R-33, R-22, R-15, R-13, R-11, R-9, R-8, and R-4), the Multifamily (MD-1, MD-2, MD-3, MD-4, and R-M), the Commercial (C-1, C-2, And C-3), the Manufacturing (M-1, M-2, And M-3), the Langley Flight Approach (LFA-1, LFA-2, LFA-3, LFA-4, And LFA-5), the Buckroe Bayfront (BB-3, BB-4, And BB-5), the Hampton Roads Center (HRC-1, HRC-2, And HRC- 3), the Langley Business Park (LBP), the Downtown (DT-1, DT-2, And DT-3), the Phoebus (PH-1, PH-2, And PH-3), the Fort Monroe (FM-1, FM-2, FM-3, And FM-4), and the Parks (PO-1 And PO-2) Zoning Districts. The additional standards will clarify how and where food trucks are permitted to operate on a site. This amendment is in conjunction with Zoning Ordinance Amendments 23-00001, 23-00002, 23-00004, 23-00005, 23-00006, and 23-00007. Staff Lead: Allison Jackura, Zoning Administrator J. Zoning Ordinance Amendment No. 23-00004: This is a proposal by the City of Hampton to amend and re-enact the Zoning Ordinance of the City of Hampton, Virginia by amending Chapter 6, Article 1, entitled “C-1 District – Neighborhood Commercial” to exempt the use “food truck host site” from being required to be indoors which would otherwise prohibit the use within the C-1 zoning district. This amendment is in conjunction with Zoning Ordinance Amendments 23-00001, 23- 00002, 23-00003, 23-00005, 23-00006, and 23-00007. Staff Lead: Allison Jackura, Zoning Administrator K. Zoning Ordinance Amendment No. 23-00005: This is a proposal by the City of Hampton to amend and re-enact the Zoning Ordinance of the City of Hampton, Virginia by amending Chapter 7, Article 1, entitled “M-1 District – Limited Manufacturing” to exempt the use “food truck host site” from being required to be indoors which would otherwise prohibit the use within the M-1 zoning district. This amendment is in conjunction with Zoning Ordinance Amendments 23-00001, 23- 00002, 23-00003, 23-00004, 23-00006, and 23-00007. Staff Lead: Allison Jackura, Zoning Administrator L. Zoning Ordinance Amendment No. 23-00006: This is a proposal by the City of Hampton to amend and re-enact the Zoning Ordinance of the City of Hampton, Virginia by amending Chapter 8, entitled “Special Districts” to exempt the use “food truck host site” from being required to be indoors which would otherwise prohibit the use within the LFA-3, HRC-1, DT-1, DT-2, and LBP zoning districts. This amendment is in conjunction with Zoning Ordinance Amendments 23-00001, 23-00002, 23-00003, 23- 00004, 23-00005, and 23-00007. Staff Lead: Allison Jackura, Zoning Administrator M. Zoning Ordinance Amendment No. 23-00007: This is a proposal by the City of Hampton to amend and re-enact the Zoning Ordinance of the City of Hampton, Virginia by amending Chapter 9, Article III, Section 9-23, entitled “O-CC District- Coliseum Central Overlay to exempt the use “food truck host site” from being required to be indoors which would otherwise prohibit the use within the overlay district. This amendment is in conjunction with Zoning Ordinance Amendments 23- 00001, 23-00002, 23-00003, 23-00004, 23-00005, and 23-00006. Staff Lead: Allison Jackura, Zoning Administrator VI.
