1 PUBLIC HEARING AND REGULAR MEETING 2 MINUTES 3 City of Hampton Wetlands Board 4 City Council Chambers, 8th Floor, City Hall 5 January 26, 2010 6 Call to Order 7 The meeting was called to order at 5:00 p.m. by Chairman Woods. 8 Roll Call 9 All Board members and alternates were present. Also present were Lesa 10 Yeatts, from the City Attorney’s Office. David Imburgia, Environmental 11 Planner and Wetlands Board Staff Coordinator, Greg Goetz, Land Development 12 Services Manager, Gayle Hicks, Senior City Engineer, Elizabeth Murphy, VMRC, 13 Alan Kyker, Enforcement Officer and Veronica Shepard who was introduced to 14 the board as the new representative from the City Attorney’s Office. 15 16 Election of Chair 17 The floor was opened for nomination of the Chairman Of the Wetland Board for 18 the calendar year 2010. Billy Woods was nominated for Chairman with a second 19 by Gayle Cozzens. Aye votes were cast by Vice Chair Cozzens, Board Member 20 Betts, Board Member Hasselquist, Board Member Chapman, Board Member 21 Bruckheimer, Board Member Morris and Chairman Woods. No one voted Nay or 22 Abstained 23 24 Election of Vice Chair 25 The floor was opened for nomination of the Vice Chairman of the Wetland Board for the calendar year 2010. Gayle Cozzens was nominated for Vice Chairman August 25, 2009 Minutes - 17  1 with a second by Board Member Bruckheimer. Aye votes were cast by Board 2 Member Betts, Board Member Hasselquist, Board Member Chapman, Board Member 3 Bruckheimer, Board Member Morris and Chairman Woods. No one voted Nay or 4 abstained. 5 6 Consideration of Minutes 7 8 The minutes for the August 25, 2009 meeting were accepted as written with 3 9 small changes. 10 11 Public Hearings 12 13 No public hearing items for consideration. 14 Matters by Staff 15 16 Gayle Hicks, Public Works Senior Civil Engineer gave a presentation on 17 Hampton Shoreline Projects 18 Hampton River Dredging is awaiting City Council’s decision on dredging of 19 side channels 20 The Indian Creek and Salt Ponds projects as well as the Pilot Avenue 21 Breakwater are not funded. The Factory Point Restoration project is underway 22 and has made some progress. The Buckroe Beach breakwater at Point Comfort is 23 awaiting a VMRC permit, and the Buckroe Beach Renourishment – 2011 which will 24 be managed by the Corp of Engineers on a cost sharing basis will begin ACOE 25 design in early summer. August 25, 2009 Minutes - 18  1 Some potential projects include, Planning Assistance States/Localities (PAS) 2 non structural flood hazard mitigation, Public Law 84-99 – Rehabilitation 3 assistance for flood damaged flood control projects and Water Resources 4 Development Act 2010 – design and construction funding for 1996 study by VIMS 5 for 12 breakwaters from Fort Monroe north to Grandview Nature Preserve at a 6 cost of $350,000 per breakwater. 7 8 David Imburgia, Wetlands Board Staff Coordinator gave an update on a wetlands 9 violation for 461 Windmill Point Rd. A letter and a Notice to Comply were 10 sent out outlining the components needed on the plan for restoration for 11 the staff to review. 12 13 David also gave a briefing on the barge that floated from Factory Point all 14 the way over to Dandy Point in the Nor’easter. Off loading some dredged 15 material and a few lifts by a crane were needed to re-float it. Restoration 16 began as soon as the barge was moved and will be monitored for 3 years by a 17 subcontractor in vegetation restoration to make sure the vegetation is 18 correct and being planted at the correct time. An “after the fact” permit 19 was issued by the Corp of Engineers. 20 Items from previous Board meeting. 21 1. Refuse along Harris Creek Road was cleaned up by Public Works. They 22 put in sand and installed a No Dumping sign. 23 2. Elizabeth Murphy, VMRC gave an update on unauthorized land disturbance 24 along Bridge St. A contractor built a new bulkhead but there was no 25 evidence of a Wetland violation August 25, 2009 Minutes - 19  1 3. The subject of whether the use of timber mats, when putting in a pier 2 and using heavy equipment, constitutes a Wetlands violation is still being 3 determined. David Imburgia has consulted the VMRC, VIMS and the Corp of 4 Engineers and together they are working on a way to regulate such 5 activities. 6 7 4. The Board will be reimbursed for attending seminars. They must apply to Codes Compliance for re-imbursement. 8 9 5. Report Violations by calling the 311 Call Center. 10 11 Matters by the Board 12 Member A. Hasselquist brought up the question of sand being dumped on the 13 Driveway at 109 Grandview Dr and then being dumped over the seawall onto the 14 Rip Rap. Alan Kyker, enforcement Officer, was asked to look at it. 15 16 Member D. Bruckheimer asked that an accounting be made of the money received 17 and spent. David Imburgia handed out a sheet with information on a fee that 18 was collected the previous day. 19 Member D. Morris asked that the Board be briefed sometime down the road on 20 items such as Storm Water Regulations as related to outfalls and how it would 21 impact the Wetlands Board. City Attorney Lesa Yeates stated that Veronica 22 Shepard has been assigned to the Wetlands Board and should be able to address 23 the issue 24 25 Permit for 335 Dandy Point Rd, applied for in 2008, has been issued and the homeowner is aware that it expires at the end of March, 2010 August 25, 2009 Minutes - 20  1 MATTERS BY THE PUBLIC 2 3 Mr. Gene Cohen of 1341 Carr Pl asked when dredging of the Hampton River and it Tributaries would be done.
