Invocation Council Member Byrd offered the invocation. 3. Pledge of Allegiance Mayor Reed led the Pledge of Allegiance. 5. Consent Agenda (any item placed on the consent agenda shall be removed and taken up as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion) A motion was made by Council Member Byrd, seconded by Vice Mayor Baugh, to approve the consent agenda as presented. Minutes from September 11, 2018 City Council meeting These minutes were approved on the Consent Agenda. 5.b. Consider a request from TSU Holdings LLC with representative Steven Urglavitch to rezone a parcel zoned B-1C, Central Business District, by amending regulating proffers at 245 East Water Street. Rodriguez to close a total of 3,420 +/- square feet of two portions of undeveloped public alleys, which are located on the eastern and southern perimeters of 211 East Washington Street Council Member Byrd requested clarification for Item 5c and asked if the public hearing had already been held. Chris Brown, city attorney, stated the public hearing had been previously held, staff was waiting for the adjoining property owners to decide if they wanted to purchase the other half, which they did not. This ordinance was approved on second reading. 6. Public Hearings 7. Regular Items 7.a. Consider enacting Section 7-2-20 - Fluoridation of city water supply to the Harrisonburg City Code Chris Brown, city attorney, stated this is the second reading of Section 7-2-20 of the city code, providing for fluoridation of the city water supply. He stated technically this could have gone on the consent agenda, however, he thought a brief explanation was in order. He stated in July 2016 staff informed council that the fluoridation system was not working properly and needed to be evaluated and most likely replaced. He stated in October 2017 Mr. Collins, director of Public Utilities, presented to council a recommendation along with cost estimates for the repair/replacement of the system as well as notified council of a $45,000 grant that was secured from the State. He stated at that time staff felt fluoridation should be approved by council prior to going forward with the repairs and didn’t think it was fair to accept the grant funds without a fluoride ordinance approved by council. He stated a public hearing on the ordinance was held in October 2017 and approved on first reading by council. He stated the new fluoride system improvements have been completed and staff is requesting the second reading and approval by council to proceed with fluoridation. A motion was made by Council Member Byrd, seconded by Council Member Hirschmann, to approve the ordinance enactment as presented. Reallocations 8.a. Consider a budget reallocation/adjustment to the city’s appropriation to the School Board in the amount of $193,317 for additional state revenue that was allocated to the City of Harrisonburg Page 2 Printed on 10/23/2018 City Council Meeting Minutes - Final September 25, 2018 Harrisonburg City Public Schools (HCPS) by the Commonwealth of Virginia Larry Propst, finance director, presented a budget adjustment request as it was agreed at the time the city’s budget was approved that when the state passed their budget any additional school funding would reduce the city ’s appropriation to the schools. He stated the amount of the budget adjustment requested is $193,317. A motion was made by Council Member Byrd, seconded by Vice Mayor Baugh, to approve the budget reallocation and adjustment as presented. The motion carried with a recorded roll call vote taken as follows: Yes: 5- Mayor Reed, Vice-Mayor Baugh, Council Member Byrd, Council Member Jones and Council Member Hirschmann No: 0 9. Other Matters 9.a. Comments from the public, limited to five minutes, on matters not on the regular agenda. (Name and address are required) None 9.b. City Council and Staff Council Member Jones stated the Community Criminal Justice Board will be meeting on October 15, 2018, at Memorial Hall, beginning at 7:00 pm and hopes that all 500 seats will be filled. He stated discussions on a justice planner, ways and means we can move forward as a community, ways to reform and re-educate people about the justice system, and a review of the Drug Court’s progress. 9.c. Consider a VML Conference Voting Delegate and an Alternate Voting Delegate for the upcoming VML Conference Council Member Byrd stated most council members will be attending the upcoming VML Conference and suggested appointing Mayor Reed as voting delegate and Vice Mayor Baugh as alternate voting delegate for the Urban Section. The motion carried with a unanimous voice vote. 9.d. City Council and Staff (continued) Ande Banks, deputy city manager, provided samples of additional city seals per the request of council during the September 11, 2018 meeting. Some discussion took place regarding the samples provided and additional changes recommended. Mr. Banks stated he will have the changes made and will present to council once completed. 9.e. Consider appointing Wesley Russ, assistant city attorney, as the Freedom of Information Act (FOIA) officer for the city of Harrisonburg Chris Brown, city attorney, stated the city is in need of appointing a new FOIA Officer as required by State law and until a new Public Information Officer is hired the City of Harrisonburg Page 3 Printed on 10/23/2018 City Council Meeting Minutes - Final September 25, 2018 assistant city attorney Wesley Russ has agreed to serve in the interim. A motion was made by Council Member Jones, seconded by Vice Mayor Baugh, to appoint Wesley Russ as the city’s FOIA Officer. The motion carried with a unanimous voice vote. 9.f. City Council and Staff (continued) Mayor Reed stated the 21st annual Harrisonburg International Festival will be held this weekend September 29th from 12:00 pm to 6:00 pm and will be at the Turner Pavilion and Park. This is a very special event that celebrates this area's rich cultural and language diversity and draws more than 9,000 people; the Alpine Loop Grand Fondo will also be held this weekend September 30th, and the event requires the full closure of Warren St. and the rolling temporary closure of Main Street, Court Square and W . Market St. during the start of the race. The finish line and events for the participants will be held at the Turner Pavilion; the Parks and Recreation Commission has one vacancy for someone residing in the East District of the city. Applications can be obtained and submitted on the city’s website; absentee voting for the November 6th General Election started statewide Friday September 21st, the last day to submit an absentee ballot by mail is November 6, 2018 and the last day to vote absentee in person is November 3, 2018. In Person Absentee Voting will be available Monday thru Friday from 9:00am - 5:00pm on the 2nd floor of the City Hall Building and will additionally be available Saturday, October 27, 2018 and Saturday, November 3, 2018 from 8:00am - 4:00pm. For more information please visit the city’s website; and Fire Prevention Week is from October 8 through October 12th, 2018, the Harrisonburg Fire Department will have interactive displays at the Valley Mall from 9am - 9pm each day. 10. Boards and Commissions 10.a. Harrisonburg Electric Commission A motion was made by Council Member Jones, seconded by Vice Mayor Baugh, to appoint Dr. Alexander L. Gabbin to the Harrisonburg Electric Commission. The motion carried with a unanimous voice vote. 12.
