CITY OF HASLET, TEXAS RESOLUTION NO. ___-2023 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASLET, TEXAS, REQUESTING ANNEXATION OF A PORTION OF THE JOHN DAY ROAD RIGHT-OF- WAY IDENTIFIED HEREIN, AND DIRECTING CITY STAFF TO PREPARE A SERVICE PLAN PROVIDING FOR THE EXTENSION OF FULL MUNICIPAL SERVICES TO SAID AREA LOCATED IN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF HASLET, TARRANT COUNTY, TEXAS WHEREAS, the annexation of property into the corporate limits of a city such as the City of Haslet, Texas is authorized and regulated by Chapter 43 of the Texas Local Government Code; and WHEREAS, Subchapter E of Chapter 43 of the Texas Local Government Code allows for the annexation by a city of certain areas, including reservoirs, airports, and streets; and WHEREAS, Section 43.1055(a)(1) of the Texas Local Government Code permits a city to annex a road right-of-way on request of the owner of the right-of-way or the governing body of the political subdivision that maintains the right-of-way; and WHEREAS, Section 43.1055(c)(1) of the Texas Local Government Code requires that the owner of the right-of-way or the governing body of the political subdivision that maintains the right-of-way request the annexation of the right-of-way in writing before a city may annex a road right-of-way under Subchapter C-1; and WHEREAS, Section 43.065 requires that before the publication of the notice of the first required annexation hearing, the governing body of the municipality proposing the annexation shall direct its planning department or other appropriate municipal department to prepare a service plan that provides for the extension of full municipal services to the area to be annexed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASLET, TEXAS, THAT: Section 1. The City of Haslet, Texas (“City”), as the owner of that portion of John Day Road right-of-way, being a 4.961-acre tract out of the M.E.P. & P. RR. Co. Survey, Abstract No. 1130, Tarrant County, Texas, as deeded to the City in Instrument No. D220197294, Official Property Records of Tarrant County, Texas, and as further described in Exhibit A, hereby requests annexation of said right-of-way pursuant to Section 43.1055 of the Texas Local Government Code. Section 2. City staff is hereby directed to prepare a service plan relating to the provision of municipal services to the John Day Road right-of-way identified herein prior to Page 4 of 7  Agenda Item #4.4.A. publication of the notice of the first annexation as required under Section 43.065 of the Texas Local Government Code. Section 3.
