CITIZENS PARTICIPATION AND COMMENTS An opportunity for citizens to address the City Council on matters which are on the agenda or are not scheduled for consideration (non-agenda items). The City of Haslet General Election will be held Saturday, May 4, 2024 from 7am - 7pm for the purpose of electing Council Member Place 1, Council Member Place 3 and Council Member Place 5. All terms are for two years. The City of Haslet Special Election will also be held Saturday, May 4, 2024 to determine if the citizens desire to reauthorize the local sales and use tax that is used for maintenance and repair of municipal streets in Haslet. The tax is one-quarter of one percent (0.25%) of sales and use tax. The early voting period for the May 4, 2024, Elections will be Monday, April 22, 2024 – Tuesday, April 30, 2024. As the election approaches, specific polling places will be published in accordance with state law. 5.E. The State of Texas Primary Election is Tuesday, March 5, 2024 from 7am - 7pm. 5.F. Discuss, consider and act on an Ordinance changing the zoning from “AG” Agricultural to “GC” General Commercial for property located at the northwest corner of Harmon Road with Haslet Parkway (750 Harmon Road). 1) Staff Presentation - Planning/EDC Coordinator Maurice Schwanke presented the zoning request submitted on 750 Harmon Road on a 3.42 acre tract for a change from “AG” Agricultural to “GC” General Commercial. The proposed zoning change would accommodate a convenience store with gasoline sales pumps. The “AG” district is consider as a “holding zone” until such time as permanent zoning is assigned. 2) Public Hearing - Mayor Hulsey opened the Public Hearing at 7:57 pm. Bryan Clark, representing QT, thanked city staff for their help in getting to this point in the process. Discuss, consider and act regarding the approval of a site and landscape plan for 750 Harmon Road. 1) Staff Presentation - Planning/EDC Coordinator, Maurice Schwanke presented the site and landscape plan for the proposed site of the QT. 2) Public Hearing - Mayor Hulsey opened the Public Hearing at 8:13 pm. Recognizing that there was no one wishing to speak, Mayor Hulsey closed the Public Hearing at 8:13 pm. 3) Discussion, consideration and action on recommendation - Bryan Clark with QT and City Engineer Mike Anderson answered the Council's questions regarding truck parking at night and traffic projections for Haslet Parkway. Motion to approve the site and landscape plan for 750 Harmon Road. Discuss, consider and act to revise Ordinance Article 6.02 Garbage Regulations. 1) Presentation - Mayor Hulsey explained under the current ordinance regarding garbage regulations, citizens can't take their trash cans out to the road no more than twelve hours in advance. Requesting to revise the ordinance to provide twenty-four hours in advance timeframe instead. 2) Discuss, consider and act - Motion to revise Ordinance Article 6.02 Garbage Regulations. Voting by an alternate member is still restricted to the alternate member fulfilling the need of a quorum. 2) Discuss, consider and act - Motion to revise Ordinance 027-2022 regarding alternate board members participation in open and closed meeting discussions. Council Member Horak expressed he is glad to see this come back to the Council, he was opposed to the original change and thinks this will keep citizens engaged now Page 9 of 29 Agenda Item #7.7.A. The HCEDC desires to execute a separate contract for legal services independent of the City. The contract proposed is with the City's current City Attorney's legal firm, Brown & Hofmeister, LLP. 2) Discuss, consider and act - Motion to approve HCEDC executing a contract for legal services with Brown & Hofmeister, LLP. Discuss, consider, and act on appointment of an Alternate Member to HCEDC Place 6. 1) Presentation - Mayor Hulsey explained there exists a vacancy of HCEDC Place 6 due to a resignation. The new appoint will serve the remainder of the Place 6 position ending October 2024. Discuss, consider, and act regarding the approval of an Ordinance adopting the 2024 Master Thoroughfare Plan. 1) Presentation - City Services & Construction Coordinator David Rogers presented, periodically the Master Thoroughfare Plan is reviewed and recommended for updating to keep it current with the cities other approved Master Plans. The amendments to the Master Thoroughfare Plan are needed to align the plan with the Master Land Use Plan. 2) Discuss, consider and act - Motion to approve an Ordinance adopting the 2024 Master Thoroughfare Plan. ANALYSIS: The construction of this roadway is a coordinated effort with local developers, the City of Haslet, the City of Fort Worth, and Tarrant County. The use of eminent domain to acquire the real properties for Right-Of-Way and Temporary Construction Easement needed for this project is agreed to by the party involved as an appropriate process. FINANCIAL IMPACT: To be determined. The project presently incorporates funds for property acquisition. Should the Special Commissioners award exceed the project budgeted funds, any additional funding source will be addressed at that time. Page 20 of 29 Agenda Item #8.8.A. XXX‐2024 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASLET, TEXAS, DECLARING THE NECESSITY TO ACQUIRE CERTAIN REAL PROPERTIES FOR RIGHT‐ OF‐WAY, AND TEMPORARY CONSTRUCTION EASEMENT FOR THE CONSTRUCTION OF THE KELLER‐HASLET ROAD EXTENSION PROJECT; DETERMINING THE PUBLIC USE AND NECESSITY FOR SUCH ACQUISITIONS; AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS NECESSARY FOR SAID PROJECT; APPOINTING AN APPRAISER AND NEGOTIATOR AS NECESSARY; AUTHORIZING THE MAYOR OF THE CITY OF HASLET, TEXAS, TO ESTABLISH JUST COMPENSATION FOR THE PROPERTY RIGHTS TO BE ACQUIRED; AUTHORIZING THE MAYOR TO TAKE ALL STEPS NECESSARY TO ACQUIRE THE NEEDED PROPERTY RIGHTS IN COMPLIANCE WITH ALL APPLICABLE LAWS AND RESOLUTIONS; AND AUTHORIZING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS TO ACQUIRE THE PROPERTY IF PURCHASE NEGOTIATIONS ARE NOT SUCCESSFUL; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Haslet, Texas (the “City Council”), has determined that there exists a public necessity to acquire certain property interests for the construction of the Keller‐Haslet Road extension project, the location of which is generally set forth in the exhibits attached to this Resolution; and WHEREAS, the City Council desires to acquire the property interests (collectively referred to as the “Property”), as more particularly described in the exhibits attached to this Resolution, for this governmental and public use in conjunction with the City of Haslet’s construction of the Keller‐Haslet Road extension project (“Project”); and WHEREAS, the City Council desires that the Mayor, or his designee, take all necessary steps to acquire the Property for the Project including, but not limited to, the retention of appraisers, engineers, and other consultants and experts, and that the City Attorney, or his designee, negotiate the purchase of the Property for the Project, and if unsuccessful in purchasing the Property for the Project, to institute condemnation proceedings to acquire the Property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASLET, TEXAS, THAT: SECTION 1 All of the above premises are hereby found to be true and correct legislative and factual findings of the City of Haslet, Texas, and they are hereby approved and incorporated into the body of this Resolution as if copied in their entirety. SECTION 2 The City Council hereby finds and determines that a public use and necessity exists for the City of Haslet, Texas, to acquire the following Property for the Project, as more particularly described in the exhibits referenced herein: EXHIBIT DESCRIPTION / INTEREST TO BE ACQUIRED 1. Approximately 2.616 acres of real property for right‐of‐way, situated generally in the G. Overton Survey, Abstract Number 1185, W. Finley Survey, Abstract Number 1902 and C. O’Briant Survey, Abstract Number 1195, located in the City of Haslet, Tarrant County, Texas and being part of the remainder of a called 81.484 acre tract of land described in the Deed to Liberty Bankers Life Insurance Company recorded in Instrument Number D22101033, Official Public Records, Tarrant County, Texas. 2. Approximately 1.371 acres of real property for a temporary construction easement, situated generally in the G. Overton Survey, Abstract Number 1185, W. Finley Survey, Abstract Number 1902 and C. O’Briant Survey, Abstract Number 1195, located in the City of Haslet, Tarrant County, Texas and being part of the remainder of a called 81.484 acre tract of land described in the Deed to Liberty Bankers Life Insurance Company recorded in Instrument Number D22101033, Official Public Records, Tarrant County, Texas. SECTION 3 The Mayor, or his designee, is authorized and directed to negotiate for and to acquire the Property for the Project, for the City of Haslet, Texas, and to acquire said rights in compliance with State and Federal law. The Mayor is specifically authorized and directed to do each and every act necessary to acquire the Property for the Project including, but not limited to, the authority to negotiate, give notices, make written offers to purchase, prepare contracts, to retain and designate a qualified appraiser of the property interests to be acquired, as well as any other experts or consultants that he deems necessary for the acquisition process and, if necessary, to institute proceedings in eminent domain. SECTION 4 The Mayor, or any individual he may so designate, is appointed as negotiator for the acquisition of the Property for the Project, and, as such, the Mayor is authorized and directed to do each and every act and deed hereinabove specified or authorized by reference, subject to the availability of funds appropriated by the Mayor for such purpose. The Mayor is specifically authorized to establish the just compensation for the acquisition of the Property. If the Mayor or his designee determines that an agreement as to damages or compensation cannot be reached, then the City Attorney or his designee is hereby authorized and directed to file or cause to be filed, against the owners and interested parties of the needed property interests, proceedings in eminent domain to acquire the Property for the Project.
