CITIZENS PARTICIPATION AND COMMENTS An opportunity for citizens to address the Zoning Board of Adjustment on matters which are on the agenda or are not scheduled for consideration (non‐agenda items). The Texas Open Meetings Act prohibits deliberation by the Board of any subject which is not on the posted agenda, therefore the Board will not be able to discuss or take action on items not listed on this agenda, other than to make statements of specific factual information or to recite existing policy in response to the inquiry. NOTE: In order to address the Board during this time, or later in the meeting for any item that is scheduled on the agenda, please complete, and submit a speaker card to the City Secretary prior to the start of the meeting. The presiding officer may ask the speaker to hold comments on agenda items until that agenda item is reached. No Citizen Presentations were made. 3. CONSENT AGENDA Consent items are deemed to need little Council deliberation and will be acted upon as one business item. The deck increases the impervious surface on the lot to 50.5%. The maximum lot coverage for this property is 35% as established in Zoning 3.2.4(E) A variance granted by the ZBA is the only avenue of relief from the strict provisions of the zoning ordinance. Time is of the essence due to family related health issues. In addition, our daughter is getting married in September and is hoping to have a bridal shower in June. I have asked Mark Linenberger, a decades long friend from Church, to explain how we got into thisjam. We absolutely love living in Haslet and hope this will improve the ambiance of the backyard overlooking the lake and block the sound and visual aesthetics via the machinery on our back fence. GREMMELS FROM: MARK LINENBERGER DATE: MAY 1, 2023 RE: PATIO AND FIREPLACE — 1517 PRIMROSE PLACE First and foremost, my sincere apologies for the situation I have put you in with the City of Haslet and the need to submit for a variance to the Zoning Board of Adjustments. I am writing this memo at your request to state the facts leading up to the encroachment of the fireplace into the rear setback (building line) at your resident. From the onset, I simply wanted to help you and Sandy attain a more usablebackyard with your amazing ‘lake view‘ home property. We started the discussion with a much grander concept with a covered patio and then scaled back to creating a much less expensiveconcrete patio with limestone coating surrounded in the future with nice landscaping. When we laid out the initial idea of a covered patio, we identi?ed the 20’ set back (building line in the rear yard). We proceeded developing the larger more expensive covered concept with the criteria in mind. Once you decided to scale back to align with your budget, we simplified to a nice 20’x 20’ concrete patio that would possibly accommodate a cover and enhanced backyard landscaping in the future. I inquired, as your friend, with the City of l-Iasletif we needed to pull a permit for a 20’x 20’ concrete patio. I was informed that a permitwas not requiredif it did not include a vertical snucture (I made the unfornrnateleap to thinking ‘covered’ patio structure for vertical structure). We moved into implementation. I failed to maintain the control of the building line with the concrete crew that set the fonnwork. I did not ever go back and check rear build line control (my error attempting to facilitate a projectfor my friends in my spare time). As we continued to discuss the future enjoyment of your ‘lake view’ patio. you and Sandy continued to mention the need to dampenthe continuous lake fountain pump noise. We decided that a fireplace would he the best way to block the ‘sound’ from the lake fountain pump. At that point we exchanged ideas on shape and location of the proposed ?replace. We ultimately moved outboard of the 20’x 20’ patio unknowingly impending on the rear yard building line set back (my third error focused on achieving — the identi?ed goal without considering the set-back criteria). I was contacted by the mason and I called Mr. Thetford, on your behalf.who informed me that the fireplace needed to be permittedand he also expressed concern regarding the rear yard setback. I conveyed to Mr. Thetford that we were aware of the 20’ building line and I was pretty sure that the as-built honored the set back. I promptly ?led for a building permitfor the next day (Friday). That week end I was reflecting on Mr. Thetfondquestioning compliance with the rear yard building line. I came out to your property to confu-rnwe were okay and found that we had in fact not honored the build line and the ?replace actually has a slight encroachment to the 20’ build line. See attached photos and drawing. On Monday, April 17"‘,I contacted Mr. Thetford reporting the encroachment followed up with a memo and sketches showing that the corner of the ?replace encroaches the build line. I am sincerely regretful, as a friend for three decades, to put you and Sandy in this difficult situation. I acknowledge the frustration that I have caused you, your wife and the officials of the city of I-laslet,Texas.
