1. Accept Petition for Annexation of the Ersted Property (Tract 8439) into the Existing Hayward
GHAD; Accept Draft Ersted Property Plan of Control (December 24, 2018); Adopt Hayward
GHAD Resolution No. 19-01 to Direct a Public Hearing be Held after Providing no less than
20 days Notice to the Landowners in the Annexation Area to Consider the Proposed
Annexation of Territory into the Existing Hayward GHAD, and Hear any Written Objection
Thereto; and Direct the Hayward GHAD Manager, or their Designee, to Mail, by First Class
Mail, a Written Notice of the Hearing to Consider the Proposed Annexation and the Proposed
Plan of Control to Each Owner of Real Property as Required by GHAD Law (Report from
GHAD Manager Harrell)
A motion was made by Council Member Lamnin, seconded by Council Member Mendall, to approve per staff's
recommendation. The motion carried by the following vote:

CITY COUNCIL MEETING
CLOSED SESSION ANNOUNCEMENT
City Attorney Lawson reported the City Council convened in closed session at 5:30 p.m.,
concerning three items: 1) conference with property negotiators pursuant to Government Code
54956.8, regarding State owned parcels along the Route 238 Bypass Alignment; 2) conference
with property negotiators pursuant to Government Code 54956.8, regarding 175 Fairway
Street; APN 78G-2704-2-1; and 3) conference with legal counsel pursuant to Government Code
54956.9(d)(4), regarding three anticipated cases; and noted there was no reportable action
related to Items 1 and 3. Related to Item 2, City Attorney Lawson added that the City Council
did not have time to discuss the item and would reconvene after the regular meeting.

Funding from the State of California Office of Traffic Safety for the Hayward Police
Department

3. Amendments to the Water Supply Agreement with the City and County of San Francisco and
Wholesale Customers - Approval of Resolution Authorizing the City Manager to Execute the
Amended and Restated Agreement
A motion was made by Council Member Mendall, seconded by Council Member Zermeño, to approve staff's
recommendation. The motion carried by the following vote:

Finance Agency to Allow the Existing Leisure Terrace Apartment Complex Located at 1638 E
Street to Apply for Four Percent Low Income Housing Tax Credits to Convert All Units to
Deed Restricted Affordable Housing Units
Consent item approved.
5. South Hayward Youth and Family Center - Authorization to Negotiate and Execute 1) an
Agreement with Alameda County to Accept $500,000, and 2) a Professional Services
Agreement with RossDrulisCusenbery, Inc. (RDC) for Building Program and Design Services
Consent item approved.
LEGISLATIVE BUSINESS
6. Review and Approve Recommended Garbage and Recycling Rates Adjustment for 2019-2020
(Report from Director of Utilities and Environmental Services Ameri)
A motion was made by Council Member Zermeno, seconded by Council Member Mendall, to approve the
garbage and recycling rate adjustment for 2019-2020. The motion carried by the following vote:
Aye: 7- Council Member Zermeno, Council Member Marquez, Council Member Mendall, Council Member
Lamnin, Council Member Wahab, Council Member Salinas, and Mayor Halliday
A motion was made by Council Member Zermeño, seconded by Council Member Mendall, to approve the
landfilling of “unders". The motion carried by the following vote:
Aye: 6- Council Member Zermeno, Council Member Marquez, Council Member Mendall, Council Member
Lamnin, Council Member Salinas, and Mayor Halliday

agenda or Information Items. The Council welcomes your comments and requests that speakers present
their remarks in a respectful manner, within established time limits, and focus on issues which directly
affect the City or are within the jurisdiction of the City. As the Council is prohibited by State law from
discussing items not listed on the agenda, your item will be taken under consideration and may be referred
to staff.
ACTION ITEMS
The Council will permit comment as each item is called for the Consent Calendar, Public Hearings, and
Legislative Business. In the case of the Consent Calendar, a specific item will need to be pulled by a Council
Member in order for the Council to discuss the item or to permit public comment on the item. Please notify
the City Clerk any time before the Consent Calendar is voted on by Council if you wish to speak on a Consent
Item.

Any member of the public desiring to address the Council shall limit her/his address to three (3) minutes
unless less or further time has been granted by the Presiding Officer or in accordance with the section under
Public Hearings. The Presiding Officer has the discretion to shorten or lengthen the maximum time
members may speak. Speakers will be asked for their name before speaking and are expected to honor the
allotted time. Speaker Cards are available from the City Clerk at the meeting.
