Hayward City Hall CITY OF HAYWARD 777 B Street Hayward, CA 94541 www.Hayward-CA.gov Action Minutes Planning Commission Thursday, October 24, 2019 7:00 PM Council Chambers ROLL CALL Present 6- Mariellen Faria, Angela Andrews, Gary Patton, Ray Bonilla Jr., Julie Roche, and Robert Stevens Absent 1- Daniel Goldstein Commissioner Goldstein arrived in the Council Chambers at 7:02 p.m. Chair Faria announced that the Election of Officers would be moved to after the Public Hearings, Item #2 would be heard before Item #1, and Item #3 would be continued until the next Planning Commission meeting on November 14, 2019. ELECTION OF OFFICERS A motion was made by Commissioner Bonilla, seconded by Commissioner Patton, to move this item until after the Public Hearings. The motion carried with the following votes: Aye: 7- Faria, Goldstein, Andrews, Patton, Bonilla, Roche, and Stevens PUBLIC COMMENTS There were none. PUBLIC HEARING 1. Proposal to Subdivide a 1.21-Acre Site into 18 Parcels to Allow the Construction of 14 Townhomes with Common Open Space Areas and Related Site Improvements at 28538 Huntwood Avenue (APN 465-0025-005-03) Requiring Approval of a Vesting Tentative Tract Map and Site Plan Review. Application No. 201705535 by James Chao (Applicant) on behalf of Zhong Yin Liu (Owner) A motion was made by Commissioner Patton, seconded by Commissioner Roche, to approve Option #1: Deny the Vesting Tentative Tract Map No. 8456 and Site Plan Review Application 201705535, based on the Findings for Denial. Planning Commission Action Minutes October 24, 2019 After the vote, Chair Faria asked for clarification regarding the staff recommendation Option #1, Deny the Tentative Tract Map and Site Plan Review After hearing from staff, Chair Faria stated that she would have voted aye for the denial of the project. 2. Route 238 Corridor Land Development - Parcel Group 6: Carlos Bee Quarry: Review and Recommendation to the City Council to Approve Draft Master Development Plan and Addendum to the 2014 General Plan Environmental Impact Report A motion was made by Commissioner Patton, seconded by Commissioner Goldstein, to approve the staff recommendation. The motion carried by the following vote: Aye: 7- Faria, Goldstein, Andrews, Patton, Bonilla, Roche, and Stevens 3. Proposed Development of a Fuel Facility with Related Site Improvements at the Costco Business Center Located at 22330 Hathaway Avenue, Assessor Parcel No. 429-0082-003-00. Barghausen Engineering on Behalf of Costco Wholesale Corporation (Applicant/Owner), Requiring Approval of a Major Modification to an Existing Planned Development Zoning District (Application No. 201706217) and Adoption of a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program. A motion was made by Commissioner Bonilla, seconded by Commissioner Patton, to continue this item until the next Planning Commission meeting of November 14, 2019. The motion carried by the following vote: Aye: 7- Faria, Goldstein, Andrews, Patton, Bonilla, Roche, and Stevens ELECTION OF OFFICERS Commissioner Patton nominated Commissioner Bonilla to the office of Chair. The nomination carried with all Commissioners voting aye. Commission Patton nominated Commission Andrews to the office of Vice-Chair. The nomination carried with all Commissioners voting aye. Commissioner Bonilla nominated Commissioner Roche to the office of Secretary. The nomination carried with all Commissioners voting aye. APPROVAL OF MINUTES Commissioner Roche had a correction to the minutes. Secretary Chan stated that she would confirm the correction and amend the minutes if necessary. 4. Minutes of the Planning Commission Meeting of October 10, 2019 A motion was made by Commissioner Andrews, seconded by Commissioner Patton, to approve the Planning Commission Meeting Minutes of October 10, 2019. The Secretary will give the card to the Commission Chair who will call on you when the item in which you are interested is being considered. When your name is called, walk to the rostrum, state your name and address for the record and proceed with your comments. The Chair may, at the beginning of the hearing, limit testimony to three (3) minutes per individual and five (5) minutes per an individual representing a group of citizens for organization. Speakers are expected to honor the allotted time. CALL TO ORDER Pledge of Allegiance ROLL CALL ELECTION OF OFFICERS PUBLIC COMMENTS The PUBLIC COMMENTS section provides an opportunity to address the Planning Commission on items not listed on the agenda. The Commission welcomes your comments and requests that speakers present their remarks in a respectful manner, within established time limits and focus on issues which directly affect the City or are within the jurisdiction of the City. As the Commission is prohibited by State law from discussing items not listed on the agenda, your item will be taken under consideration and may be referred to staff for further action. ACTION ITEMS The Commission will permit comment as each item is called for Public Hearing. Please submit a speaker card to the Secretary if you wish to speak on a public hearing item. PUBLIC HEARING For agenda item No. 1, the decision of the Planning Commission is final unless appealed. The appeal period is 10 days from the date of the decision. If appealed, a public hearing will be scheduled before the City Council for final decision. For agenda item No. 2 the Planning Commission may make a recommendation to the City Council. For agenda item No. 3, the Planning Commission may continue the item to the next regular Planning Commission meeting, scheduled for November 14, 2019.
