NOTICE AND AGENDA OF REGULAR CALLED MEETING HEATH CITY COUNCIL 200 LAURENCE DRIVE - HEATH, TX 75032 TUESDAY, JULY 28, 2026 at 6:30 PM 1. Call to Order – Regular Meeting, Invocation and Pledge of Allegiance 2. Public Comment This is an opportunity for the public to address the Council on any matter, except public hearings included on the agenda. Comments related to public hearings will be heard when the specific hearing begins. Public comments are limited to three (3) minutes per speaker, unless the speaker requires the assistance of a translator, in which case the speaker is limited to six (6) minutes, in accordance with applicable law. To address the Council, please sign in prior to the start of the Council Meeting. Each speaker shall approach the podium and state his/her name and street address before speaking. Speakers shall address the governing body with civility that is conducive to appropriate public discussion. Speakers can address only the governing body and not individual city officials or employees. The public cannot speak from the gallery but only from the podium. The Council is not permitted to take action on or discuss any item not listed on the agenda. The Council may: (1) make a statement of fact regarding the item; (2) make a statement concerning the policy regarding the item; or (3) propose the item be placed on a future agenda. (Tex. Govt Code §551.042). 3. Council/City Manager Comments Regarding Items of Community Interest – Pursuant To Texas Government Code Section 551.0415 The Mayor, Council and City Manager May Report On The Following Items: (1) Expression Of Thanks, Congratulations or Condolences; (2) Information Regarding Holiday Schedules; (3) Recognition Of Individuals; (4) Reminders About Upcoming City Council Events; (5) Information Regarding Community Events; (6) Announcements Involving Imminent Threat To Public Health And Safety. 4. Consent Agenda These items consist of non-controversial or "housekeeping" items required by law. Items may be considered individually by any Council member making such request prior to a motion and vote on the Consent Items. 4.a Action regarding the minutes of the July 14, 2026 Regular Meeting. 4.b Discussion and action regarding an Ordinance approving an annual update to the Service and Assessment Plan for the Haciendas Del Lago Public Improvement District. Presentations 5.a Discussion and update on current capital projects, to include, but not limited to, the Hubbard Drive Project, the Water Plan, Towne Center Park Project, Terry Lane Road Rehabilitation, Candlelite Fire Flow, Public Works Facility, Trails, and the Street Maintenance Program. Public Hearings 6.a Conduct a Public Hearing and Act on an Ordinance of the City Council of the City of Heath, Texas, for Case No. ZA-26-2, requesting to change the zoning from (PD-SF-43) Planned Development-Single Family-43 to (SF-43) Single-Family Residential District, and being a 3.03-acre parcel of land identified as Lot 1, Block A, Wanamaker Estates, and addressed as 400 Heathland Crossing, situated in the Edward Teal Survey, Abstract 207, City of Heath, Rockwall County, Texas. King) 6.b Conduct a Public Hearing and Act on an Ordinance of the City Council of the City of Heath, Texas, for Case No. ZA-26-5, requesting to change the zoning from (PD-SF-43) Planned Development-Single Family-43 and (SF-43) Single-Family Residential District to (PD-SF-43) Planned Development-Single Family-43, being a 4.126-acre parcel of land identified as Lot 1, Block A, Wanamaker Estates and Lot 1, Block 1 of the L Hall addition, addressed as 400 Heathland Crossing and 1500 Laurence Drive, situated in the Edward Teal Survey, Abstract 207, City of Heath, Rockwall County, Texas. King) 6.c Conduct a Public Hearing and Act on an Ordinance changing to the 2025 Comprehensive Plan in accordance with Sec. 211.004 of the Texas Local Government Code, to amend the Future Land Use Map from a Medium Density Residential designation to a Rural Estate designation for the properties described as Lot 1, Block A, Wanamaker Estates and Lot 1, Block 1 of the L Hall addition, addressed as 400 Heathland Crossing and 1500 Laurence Drive, situated in the Edward Teal Survey, Abstract 207, City of Heath, Rockwall County, Texas. King) 6.d Conduct a Public Hearing and Act on an Ordinance of the City Council of the City of Heath, Texas, for Case No. ZA-2026-4 requesting to change the zoning from (AG) Agricultural District to (SF-43) Single-Family Residential District, and being a 20.99-acre parcel of land identified as RCAD Property ID 10470, situated in the J. Cantor Survey, Abstract 53, City of Heath, Rockwall County, Texas. (Z. King) 6.e Conduct a Public Hearing and Act on an Ordinance of the City Council of the City of Heath, Texas, for Case No. ZA-2026-3 requesting to change the zoning from (AG) Agricultural District to (SF-43) Single-Family Residential District, and being a 40.00-acre parcel of land identified as 531 Hubbard Drive, situated in the J. Cantor Survey Abstract 53, City of Heath, Rockwall County, Texas. (Z. King) 6.f Conduct a Public Hearing and Discussion regarding the Proposed Fiscal Year 2026-2027 Budget and Plan of Municipal Services. (J. Ayers) 7. Items for Individual Consideration 7.a Discussion and action regarding Case No. FP-26-6, a request by Cameron Slown, PE, for the approval of a Final Plat for Founders Reserve, being a 22.357-acre tract of land situated in the Edward Teal Survey, Abstract No. 207 and zoned for (SF-43) Single-Family Residential District land uses, and generally situated at the northeast quadrant of the intersection of Laurence Drive and FM-549, and situated east of Heath Hawk Drive, City of Heath, Rockwall County, Texas. (Z. King) 7.b Discussion and possible action on a Resolution proposing the Fiscal Year 2026-27 ad valorem property tax rate and setting a public hearing for August 11, 2026. (J. Ayers) 7.c Discussion and action to approve Resolution 260728A, authorizing the City Manager to submit a grant application to the Texas Water Development Board (TWDB) for the Water Supply and Infrastructure Grant (WSIG) (B. Creed) 7.d Discussion and update on the construction of DPS Stations 30 & 31. (Chief Seery/AGCM) Heath City Hall will provide reasonable accommodations for persons attending meetings. Executive Session In accordance with Texas Government Code, Chapter 551, Subchapter D, the City Council will recess in Executive Session (closed meeting) to discuss the following: 8.a Section 551.074: Deliberation regarding the appointment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, regarding: appointments and re- appointments to the Planning and Zoning Commission, HMBC/HEDC, Park Board, Board of Adjustment, Architectural Review Board, Take Area Appeal Panel, and Municipal Court. 9. Reconvene into Open Session In accordance with Texas Government Code, Chapter 551, the City Council will reconvene into Regular Session to consider action, if any, on matters discussed in Executive Session. 10. Additional Items for Individual Consideration 10.a Discussion and action regarding appointments to the Planning and Zoning Commission, HMBC/HEDC, Park Board, Board of Adjustment, Architectural Review Board, Take Area Appeal Panel, and Municipal Court. 11. Adjourn NOTE: The City Council reserves the right to meet in Executive Session closed to the public at any time in the course of this meeting to discuss matters listed on the agenda, as authorized by the Texas Open Meetings Act, Texas Government Code, Chapter 551, including §551.071 (private consultation with the attorney for the City); §551.072 (discussing purchase, exchange, lease or value of real property); §551.074 (discussing personnel or to hear complaints against personnel); and §551.087 (discussing economic development negotiations). Any decision held on such matters will be taken or conducted in Open Session following the conclusion of the Executive Session. Pursuant to Section 551.127, Texas Government Code, one or more members of the City Council may attend this meeting remotely using videoconferencing technology.
