SPECIAL TOWN BOARD MEETING
JUNE 5, 2024
The Town Board of the Town of Hempstead, New York, met at the Town Meeting Pavilion,
Hempstead Town Hall, 1 Washington Street, Hempstead, New York, on Wednesday,
June 5, 2024, at 2:30 P.M.

Supervisor Clavin asked Councihnember Muscarella to lead the assemblage in the Pledge of Allegiance to our
flag.
Supervisor Clavin stated that this item was tabled at yesterday's Town Board meeting. He asked John L.
Maccarone, Town Attorney, to clarify the reason for today's Special Meeting.
John L. Maccarone, Town Attorney stated the Town Board previously approved a resolution for a Home Rule
Message with the Board's approval transferring the property that is currently a marina in the Town of
Hempstead, Village of Freeport to the Village of Freeport. We have been under a license with them since last
year to that effect. It was sent to the Senate and Assembly. The Senate approved it. However, the Assembly
wanted some changes. The Town Attorney's office had some concerns with the language, so he requested the
matter be taken off the calendar.
After much negotiation with Village of Freeport Attorney, Howard Colton, they have agreed on the wording that
any transfer documents or any agreement that they have will specifically say that this property can only be used
as a Marina or a Park and that absent the Town ofHempstead's approval of any other change, it could be used
for nothing else.
Mr. Colton responded via email, which he asked to make part of the record, that the Village understood that
those would be the requirements.
Supervisor Clavin stated he appreciated the clarification and Assemblyman Curran in Albany carrying this
Legislation, and questioned where the Senate now stands on this Legislation? Town Attorney Maccarone stated
he was told by Assemblyman Curran that if these changes were made, the Senate will approve it.
Supervisor Clavin asked for clarification that the land transfer is being done, but will prohibit the Village from
utilizing this property for any other development outside of Town of Hempstead authority aside from what it's
being used as a park or marina? Which Town Attorney Maccarone responded, "That is correct Mr. Supervisor."

On motion of Councihnember Carini, seconded by Deputy Supervisor
Goosby, and unanimously voted upon roll call that the public hearing be
closed, and "An Act authorizing the Town of Hempstead to transfer ownership
of certain parkland to the Village of Freeport" ADOPTED, pursuant to
Resolution No. 663-2024.

No further business to come before the Board, it was on motion of Deputy Supervisor Goosby,
seconded by Councihnember Dunne, and unanimously voted upon roll call that the Meeting be
ADJOURNED.
