The four points to be considered under the Cable Act are: 1. Whether Mediacom has substantially complied with the material terms of the franchise and applicable law; 2. Whether the quality of Mediacom’s service, including signal quality, response to consumer complaints, and billing practices, but without regard to the mix or quality of cable services or other services provided over the system has been reasonable in light of community needs; 3. Whether Mediacom has the financial, legal and technical ability to provide the services, facilities and equipment in its proposal; and 4. Whether Mediacom’s proposal is reasonable to meet the future cable-related community needs and interests, taking into account the cost of meeting such needs and interests. Additionally, please note that the Cable Act provides that final decision not to renew a cable franchise must be based on an adverse finding with respect to one of these four  109 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A regular Meeting on June 13, 2017 factors. The proceedings were declared to remain open while the City gathers the information necessary to make its decision regarding renewal. PRESENTATION: “20-Year Service Award” MAYOR AUSTIN expressed appreciation to Recreation Program Manager Mark Simmons for his 20 years of service and dedication to the City. MARK SIMMONS, Recreation Program Manager, thanked everyone for their support and especially former Parks and Recreation Director Emily Gilliam for giving a 25-year old right out of college a chance. ________________________ PRESENTATION: Eagle Scout Project – Canoe Creek Nature Trail Outdoor Classroom RAY NIX, Code Inspector and Canoe Creek Nature Trail Project Manager, announced that during the design and construction phases of the Canoe Creek Nature Trail a special feature was envisioned that could be incorporated into that trail system. It was envisioned that the project would be built by interested community groups and or would make a great Eagle Scout project. He then introduced Eagle Scout Candidate Jacob Goldie to describe the special project. JACOB GOLDIE, Eagle Scout Candidate, explained that he would like to propose as his Eagle Scout Project the construction of the Canoe Creek Nature Trail Outdoor Classroom. The outdoor classroom is designed to be an immersive wooded experience. It will have a 10’ x 12’ wooden platform with a bench seat and back railing along the back side, and eight benches in front of that. It will be built with an amphitheater feel due to the natural terrain with the platform on a lower section and then the seats will be going upwards. He indicated that this would be really good for the City of Henderson because there really aren’t any other outdoor classrooms anywhere except Audubon State Park. MAYOR AUSTIN thanked Mr. Goldie for his willingness to work on this project and indicated that some of the schools had already expressed interest in the possibility of using the outdoor classroom. ________________________ APPROVAL OF CONSENT AGENDA: MAYOR AUSTIN asked the City Clerk to read the Consent Agenda. COMMISSIONER BUGG stated that the reason that she was in favor of that was because most of us up here are really working hard to try to run the city and when you have to take out two or three months in the spring and two or three months again in the fall sometimes it is more difficult to do that. ORDINANCE NO. 35-17: FIRST READ ORDINANCE AMENDING EMPLOYEE MANUAL AN ORDINANCE AMENDING ARTICLE 212-ENTRANCE RATE OF PAY, AND ARTICLE 220-RATE OF PAY UPON JOB CLASSIFICATION CHANGE, OF THE EMPLOYEE MANUAL OR THE CITY OF HENDERSON TO DEFINE RATE OF PAY UPON PROMOTION AND TEMPORARY APPOINTMENT TO A HIGHER CLASSIFIED POSITION WITHIN THE NON-HAZARDOUS DUTY PAY PLAN MOTION by Commissioner Staton, seconded by Commissioner Pruitt, that the ordinance be adopted. TOM WILLIAMS, Henderson Water Utility General Manager, explained that he had asked Mr. Sights for a slight modification from the ordinance as originally proposed from grade 26 or above to grade 18 or above because HWU has had problems at times with people not wanting to promote internally due to taking on so much more responsibility with only a 5% increase in pay. Currently a new hire from outside City employment could be offered up to the midpoint of the grade as a beginning salary. He indicated that in his opinion that puts our internal promotions at a disadvantage as opposed to someone being hired from outside. He further explained that this would not be automatic and would be on a case by case basis. 114 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A Regular Meeting on June 13, 2017 DAWN KELSEY, City Attorney, added that it would only apply to positions that require a state or federal certification. She indicated that not only with the water department but in the City there are times that people don’t move up into these positions because of the pay and we need them because they have these certifications. ROBERT GUNTER, Acting City Manager, indicated that the City Manager asked that his email sent to the Board be read into the record. The following email from City Manager Russell R. Sights to the Board of Commissioners was read into the record: Board Members: For the past few years, the Mayor and Commissioners here in Henderson have not increased their salaries to reflect the Cost of Living Adjustment (COLA). This year I would encourage you to do so for the following reasons: 1. The Commonwealth of Kentucky, by law, allows elected officials to annually increase their individual salaries by a defined amount based on the Department of  115 CITY OF HENDERSON – RECORD BOOK Record of Minutes of A regular Meeting on June 13, 2017 Labor Consumer Price Index (CPI). This is the only increase that can be made by officials during their term of office. This is a perfectly legal procedure to follow. 2. Please consider that your decision, even though it affects you personally to a very small degree, also has a cumulative effect on every elected official that succeeds you in future years. By not taking the CPI amount this year, it reduces the annual amount received by elected officials in future years-from-now on. 3. It is possible that if salaries do not progress periodically, that the compensation may get so low that good people are discouraged about seeking public office. Who knows- and everyone has their own opinion on this question. I know that many times the comment is made that elected officials don’t run for the money anyway, and I believe that to be true. However, elected officials do deserve to be compensated for their time and attending official functions. For these reasons, I would encourage you to approve the resolution on the agenda authorizing the COLA. Russell The vote was called. ROBERT GUNTER, Acting City Manager, explained that this proposal would decrease the fee for online and phone credit/debit card payments from the current $4.95 per $300.00 to $1.95 per $300.00, a minimum savings to the customer of $3.00 per transaction. The City does not charge customers for debit card payments when made in person at the Municipal Center. However, when the City began accepting online and phone payments the utilities determined they did not want to absorb those fees as they can run into the tens of thousands of dollars per year. He continued that references had been checked with one of those being the University of Kentucky and they are very pleased with the services provided. The vote was called. COMMISSIONER STATON indicated that about six months ago he had requested that distribution of the agenda packets be moved from Friday to Wednesday to give people more time to review them. However, that seems to have presented quite a bit of hardship, especially when there are back to back meetings and after discussing it with several people over the past week he is suggesting that starting in July distribution of the agenda packets return to the Friday prior to the Tuesday meetings. There were no objections to making the change. ________________________ COMMISSIONERS REPORT: COMMISSIONER PRUITT thanked the police and fire departments for participating in the Stop the Gun Violence benefit basketball game. He indicated that everyone had a great time at the John F. Kennedy Center, and that Parks and Recreation Director Trace Stevens and his team did a fabulous job. He commended all involved on an awesome job! ________________________ COMMISSIONER BUGG reminded everyone that the J-Town Angel Program would be discussed at the July 18th work session and that she would like to invite the public to come learn about this program that deals with the drug addiction problem by referring people to rehab instead of straight to jail. She indicated that Henderson is trying to become proactive instead of reactive in this area. MAYOR AUSTIN thanked Commissioner Bugg for her work on this initiative and indicated that the Jeffersontown Angel Program has been very successful. ________________________ COMMISSIONER VOWELS thanked Commissioners Pruitt and Bugg for taking the lead and working on the benefit basketball game and the Angel Program. ________________________ COMMISSIONER STATON echoed the sentiments of Commissioner Vowels and that he believes the Angel Program is going to be fantastic for Henderson. He indicated that he really appreciated Commissioner Bugg’s efforts in getting them to come down and share a little bit more about what they are doing up there because it is exciting to see the results that they have had. ________________________ MAYOR AUSTIN reminded everybody that the Handy Festival starts tomorrow and runs through Saturday.
