Your approval of the attached ordinance is requested. c: Dawn Kelsey  ORDINANCE NO. 33-21 ORDINANCE AMENDING CODE OF ORDINANCES CHAPTER 20, STREETS, SIDEWALKS AND OTHER PUBLIC PLACES SUMMARY: ORDINANCE AMENDING CODE OF ORDINANCES CHAPTER 20, STREETS, SIDEWALKS AND OTHER PUBLIC PLACES, ARTICLE I, IN GENERAL, SEC. 20-1, APPROVAL REQUIRED FOR OBSTRUCTION, AND ADDING SEC. 20-1.1, SEC. 20-1.2, SEC. 20-1.3, SEC. 20-1.4 RELATING TO LICENSE AGREEMENTS FOR PERMANENT OR SEMI-PERMANENT OBSTRUCTIONS WITHING THE PUBLIC RIGHT-OF-WAY OF THE CENTRAL BUSINESS DISTRICT WHEREAS, the City of Henderson would like to encourage new residential and commercial development within the Central Business District. NOW, THEREFORE, BE IT ORDAINED by the City of Henderson, Kentucky, that the Code of Ordinances is hereby amended as follows: Chapter 20 STREETS, SIDEWALKS AND OTHER PUBLIC PLACES ARTICLE I. IN GENERAL Sec. 20-1. Approval required for obstruction. No person, firm, or corporation shall erect or maintain any temporary or removeable obstruction across or upon any street, alley, sidewalk, or public rights-of-way of the city without the consent and written approval of the city manager. For the purposes of this section, temporary or removeable obstructions shall include, but not be limited to, any [house,] fence, wall, building, structure of any kind, or any post, rail, or other fixed object that may in any way obstruct, either totally or partially, any street, alley, sidewalk, or public right-of-way. This section shall not prohibit the planting of trees, shrubs, or other plants provided that vision is not totally or partially blocked at intersections as defined in Section 4.09 of the zoning ordinance of the city. This section shall also not prohibit canopies and building overhangs provided that such canopies and overhangs are attached to a principal building and are not freestanding or require an independent support structure and comply with Section 4.09 of the zoning ordinance of the city. Retaining walls may be permitted pursuant to this section if, in the opinion of the city manager or codes administrator, such retaining wall is necessary to either protect the safety of persons or to preserve private property rights provided that the placement or replacement of any retaining wall or structure is carried out in accordance with Section 4.09 of the zoning ordinance of the city. Any person, firm, or corporation found to be in violation of this section shall be given a written notification of the violation that exists and be given fifteen (15) calendar days to correct any and all violations cited. If the violation continues to exist after the expiration of the notification period, the city may remove the obstructions and may charge the property owner for the number of hours involved in eliminating the obstructions at a charge of twenty-five dollars ($25.00) per hour. The city may, at its option, choose not to remove any obstructions and cause a citation to be issued to the property owner for violating this section of the code with these charges to be heard in PUBLICATION DATE: FIRST READ: 09/14/2021 SECOND READ: ORDINANCE NO. 33-21  ORDINANCE NO. 33-21 (CONT.) Henderson district court. Any person, firm, or corporation given notice pursuant to this section of the code by any official of the city may file an appeal within the fifteen-day time period established in this section with the city manager citing the reason or reasons that this section of the code should not be enforced. The city manager shall issued a final determination in writing to the person, firm, or corporation filing such an appeal, and the decision of the city manager shall be final. Sec. 20-1.1 License agreements for permanent or semi-permanent obstructions within the public right-of-way of the Central Business District (CBD). Persons, firms, or corporations seeking to place a permanent or semi-permanent object, structure, or any other installation in the public right-of-way in the Central Business District shall adhere to the following procedures to seek a license agreement. ru. Prior to filing for building permits or site plans, the developer, applicant, petitioner. or property owner, shall attend a pre-conference with the encroachment design committee, to discuss the proposed permanent or semi-permanent obstruction request and reviewprocess . .The meeting is informative in nature .. Comments, representations, or expressions of any nature made at the meeting, shall not be binding. hl A fully completed application, along with all required documents, shall be submitted to the city manager's office.. An official review of the application will be made by the encroachment design committee within twenty-one (21) calendar days of submission of fully completed application with required documents. . . £} The encroachment design committee will review the project and present their findings in a written. report to the city manager and the applicant. ill. The city manager will forward the completed application and written report of the encroachment design committee to the Board of Commissioners within twenty-one (21) calendar days for Consideration. ~ All adjoining property owners shall be notified of the application•andmeeting date when application will be considered by Board of Commissioners ;t) Final approval or disapproval will be made by the Board of Commissioners. g} All proposed permanent or· semi-permanent obstructions within the ·Central Business District must comply with all federal, state, and local building regulations as well as the Americans with Disabilities Act and any other applicable law, regulation, or ordinance. Sec. 20-1.2 Encroachment design committee. The encroachment design committee. shall provide non-binding written recommendations to the Board of Commissioners on each application for license agreement. the encroachment design committee shall consist of the city engineer, city codes administrator, the executive director of the Downtown Henderson Project, and the city manager. Sec. 20- l.3 License agreement provisions License agreements shall be for a term of ten (10) years and shall be reviewed annually. Attachments to the license agreement include but are not limited to: a) Plan of proposed structure/etc. b) Certificate for two million dollars ($2,000,000.00) in general liability insurance for any residential structure, or five million dollars ($5,000,000.00) in general liability insurance ORDINANCE NO. 33-21  ORDINANCE NO. 33-21 (CONT.) for any commercial structure, with the City of Henderson named as an additional insured. This is the minimum requirement, and the City of Henderson reserves the right to require a higher value based on the risk presented. c) A bond, the amount of which is set by the City of Henderson, or in the alternative, licensee may place ten percent (10%) of the cost of the structure in an approved escrow account in the name of the City of Henderson. Every five (5) years, license will add an additional five percent (5%) in the escrow account. The bond, or escrow, shall survive for the life of the structure. d) Licensee will allow code administrator, or designee, to conduct an annual inspection of the licensed obstruction to ensure the structure is in good repair and structurally sound. e) If the structure is found to be deficient, licensee has thirty (30) days to correct any and all deficiencies or remove structure. f) If licensee fails to do so, the. city manager may revoke the license, or in the alternative, direct the code administrator to make any repairs necessary, includingremoval of structure, using the bond fund, or escrow account as payment. Licensee may appeal the city manager's decision to the Board of Commissioners. g) Nothing herein will prevent the code administrator from taking any action necessary when in his/her opinion, there is imminent danger of failure or collapse of the building or structure that endangers life. h) License may also be revoked for failure to follow rules or conditions/restrictions placed on the encroachment if not remedied within thirty (30) days. i) License agreements are generally required to contain provisions that are the responsibility of the licensee that includes, but are not limited to the following: 1. Inclusion of a release and indemnification provision releasing and indemnifying the city from personalinjury and property damage liability resulting from the use of the public right-of-way. 2. Maintaining the encroachment. 3. Removing the encroachment. 4. A copy of any applicable legal documents related to Homeowners or Condominiums Associations. Sec. 20-1.4 Encroachment design standards. a) Encroachment license agreements shall substantially comply with the following supplemental development regulations: 1. Encroachment license agreements shall only be allowed on streets that have allocated on-street parking available. 2. All structural members shall not protrude, disrupt, or alter the existing brick pavers within public right-of-way. 3. Wood structures shall not be allowed. 4. Signs of any type shall not be allowed. 5. Decorative lighting shall be subject to approval of the city manager. 6. the Structure shall meet design guidelines contained in the application. Cox Chief of Police SUBJECT: Public Safety Officer Position During a recent presentation, I discussed the need of my department to go to a 12 hour shift to help maintain law enforcement services. The move to a 12 hour shift will cost around $150,000. We are able to implement this change and stay within our current budget for the remainder of this fiscal year. Also, I discussed the utilization of a Public Safety Officer position to handle certain calls for service. I am recommending the creation of a Public Safety Officer position to provide additional resources to the police department and to serve as a way to recruit qualified individuals into future police officer positions. I am recommending forgoing the filling of an open secretary position in my department to pay for the Public Safety Officer position. Your approval of this ordinance is requested. c: Connie Galloway Robert Gunter  ORDINANCE NO. 35-21 ORDINANCE AMENDING PAY PLAN SUMMARY: ORDINANCE ADOPTING A REVISED JOB CLASSIFICATION AND PAY PLAN FOR THE CITY OF HENDERSON WHICH ADDS ONE (1) PUBLIC SAFETY OFFICER POSITION FOR THE HENDERSON POLICE DEPARTMENT; AND AMENDS POLICE HAZARDOUS DUTY GRADE AND SALARY RANGES WHEREAS, on August 31, 2021, Ordinance No. 29-21 was adopted enacting a new job classification and pay plan for the City of Henderson; and WHEREAS, it is in the best interest of the City of Henderson that its employees be compensated in a manner which allows the City to be competitive with other employers in order to attract and retain qualified personnel; and WHEREAS, the Board of Commissioners has recognized the need to revise the Job Classification and Pay Plan for the employees of the City of Henderson by adding one (1) public safety officer in the Police Department, and amend Police Hazardous Duty Pay Grade and Salary Ranges; and WHEREAS, the City Manager recommends the adoption of the revised Job Classification and Pay Plan and the amended Police Hazardous Duty Pay Grade and Salary Ranges NOW, THEREFORE, BE IT ORDAINED by the City of Henderson, Kentucky as follows: 1. "Buzzy" Newman, Jr., City Manager W?/1,/ SUBJECT: Amended Public COVID-19 Vaccination Incentives The accompanying municipal order authorizes the approval of amending Municipal Order 46-21, voluntary financial incentive program for City of Henderson adult residents who have received full doses of a COVID-19 vaccine. The amended municipal order edits the participating pharmacy list and expands the incentive to qualified citizens who received their first vaccine on or after September 14, 2021, and those who receive the first vaccine between September 22, 2021, and October 22, 2021, and become fully vaccinated within twenty-eight (28) days thereafter. Your approval of the attached municipal order is requested.  MUNICIPAL ORDER - - - - MUNICIPAL ORDER AMENDING MUNICIPAL ORDER 46-21 VOLUNTARY FINANCIAL INCENTIVE PROGRAM FOR CITY OF HENDERSON, KENTUCKY ADULT RESIDENTS WHO HAVE RECEIVE FULL DOSES OF COVID 19 VACCINE WHEREAS, there continues to be an increase of new active cases of Covid-19 within the City of Henderson and Henderson County; and WHEREAS, as of September 1, 2021, the fully vaccination rate of Henderson County is 40.39% which is below both the state (58%) and national averages (52.7%); and WHEREAS, the current surge of COVID-19 cases in Henderson County and the counties surrounding Henderson and the associated increase of hospitalizations have caused local hospital to be at capacity or near capacity; WHEREAS, Kaiser estimates 113,000 unvaccinated Americans who were hospitalized with Covid-19 in June and July would have stayed out of the hospital had they gotten vaccinated, and at an average cost of $20,000 per hospitalization, those unvaccinated Covid victims required about $2.3 billion in unnecessary health care spending, in just two months; and WHEREAS, the City of Henderson would like to provide a financial incentive for its unvaccinated adult citizens to get vaccinated against Covid-19 to assist in stopping the Covid-19 virus outbreak and provide some relief to area hospitals; and WHEREAS, the City of Henderson received funding from the federal government through the American Rescue Plan Act (ARP A) which can be used to pay for vaccine incentive programs; and WHEREAS, the City has worked with T & T Drug Store, Midway Pharmacy, Butler's Apothecary, and the Green River District Health Department [Health First Community Health Center] to develop, promote, and administer an incentive program to get more City residents vaccinated; and WHEREAS, the City desires the first one thousand (1,000) adult City of Henderson residents, age 18 and over, who become fully vaccinated during this thirty (30) day period receive a one (1) time financial incentive of One Hundred Dollars ($100) provided in gift cards with the citizens' understanding that providing false information may result in criminal charges; and WHEREAS, to be eligible for the financial incentive, all eligible residents must [be vaccinated] receive his/her first dose of a Covid-19 vaccine between September 22, 2021 and October 22, 2021, and become fully vaccinated within twenty-eight (28) days thereafter. Those residents who received their first dose of a Covid-19 vaccine, or the one (1) dose of Johnson & Johnson vaccine, on or after September 14, 2021, and receive the second dose of the same vaccine from a participating provider of the Vaccine Incentive Program between September 22, 2021 and October 22, 2021 are also eligible for the one (1) time financial incentive.  NOW, THEREFORE, BE IT ORDERED, by the City of Henderson, Kentucky, will develop a vaccination incentive program for City of Henderson adult residents wherein the first one thousand (1,000) adult residents of the City of Henderson, Kentucky who [become fully vaccinated for Covid 19] receive his/her first Covid-19 shot between September 22, 2021 and October 22, 2021, and become fully vaccinated within twenty-eight (28) days thereafter, at one of the participating pharmacies will receive a $100 gift card, the funds will come from ARP A funds. .
