CITY OF HENDERSON REDEVELOPMENT AGENCY ADVISORY COMMISSION MINUTES REGULAR MEETING Tuesday, September 26, 2023 I. CALL TO ORDER Acting Chair Maria Bailey called the Redevelopment Agency Advisory Commission Meeting to order at 4:00 p.m. in the City Hall Annex Conference Room, City Hall Annex, 280 Water Street, Henderson, Nevada, 89015. Note: At the beginning of the meeting, Commissioner Maria Bailey agreed to serve as Acting Chair for the entirety of the meeting. II. CONFIRMATION OF POSTING AND ROLL CALL MaryAnne Cruzado, Administrative Analyst III, confirmed the Redevelopment Agency Advisory Commission meeting had been noticed in compliance with the Nevada Open Meeting Law. ACCEPTANCE OF AGENDA (Motion) Commissioner Chet Opheikens introduced a motion to accept the agenda, as presented. The vote favoring approval was unanimous. NEW BUSINESS 1 MINUTES REDEVELOPMENT AGENCY ADVISORY COMMISSION MEETING MAY 23, 2023 REDEVELOPMENT Redevelopment Agency Advisory Commission meeting minutes of May 23, 2023. (Motion) Commissioner David Edelblute introduced a motion to accept the Redevelopment Agency Advisory Commission meeting minutes of May 23, 2023, as presented. The vote favoring approval was unanimous. Acting Chair Maria Bailey declared the motion carried. 2 RESOLUTION 2022/2023 BUDGET AUGMENTATION REDEVELOPMENT AGENCY A resolution of the City of Henderson Redevelopment Agency, providing for the augmentation of the 2022/2023 Budget with funds in the form of resources anticipated to exceed that budgeted and reciting the appropriations to be augmented. David Vorce, Principal Redevelopment Fiscal Administrator, presented a summary of this item and explained the reasons for the augmentation to the 2022/2023 Budget. Redevelopment Agency Advisory Commission Page 3 of 6 Tuesday, September 26, 2023 – Minutes 3 RESOLUTION DOWNTOWN REDEVELOPMENT GRANT AWARD AGREEMENT OLIVE GARDEN HOLDINGS, LLC REDEVELOPMENT AGENCY A resolution of the City of Henderson Redevelopment Agency, Clark County, Nevada, recommending approval for a Downtown Redevelopment Grant Award agreement between Olive Garden Holdings, LLC, a Nevada Limited Liability Company, and the City of Henderson Redevelopment Agency in an amount not to exceed $50,000.00, for construction costs associated with a 7,700 square foot restaurant on a 0.45 acre parcel identified as Clark County Assessor’s parcel number 179-18-219-005, and generally located at the north-east corner of Lake Mead Parkway and Atlantic Avenue. Sean Robertson, Redevelopment Project Manager, presented a summary of this item and staff’s justification for recommending approval. Anthony Molloy, Manager of Redevelopment, clarified that the applicant has not made a full commitment to build on this site, as they are also considering several other locations; however, the grant is on a reimbursement basis and therefore, the applicant will only receive the funds in the event that they complete construction of the project. Responding to the questions of Commissioners Chet Opheikens and John Dalrymple, Mr. Molloy clarified that this item’s proposed location is within the Target shopping complex along Lake Mead Parkway, and he does not believe this proposal will affect their location on Sunset Road. Acting Chair Maria Bailey declared the motion carried. Redevelopment Agency Advisory Commission Page 4 of 6 Tuesday, September 26, 2023 – Minutes 4 RESOLUTION REDEVELOPMENT AGENCY OF THE CITY OF HENDERSON DOWNTOWN AREA TAX INCREMENT BONDS SERIES 2023, IN THE AMOUNT NOT TO EXCEED $25,500,000.00 REDEVELOPMENT AGENCY A resolution of the City of Henderson Redevelopment Agency, Clark County, Nevada, approving the issuance of the City of Henderson Redevelopment Agency, Nevada, tax increment bonds (Downtown Redevelopment Area), series 2023, and the execution and delivery of documents relating thereto. David Vorce, Principal Redevelopment Fiscal Administrator, presented a summary of this item and the potential projects the bond funding would assist. Following the inquiry of Commissioner Chet Opheikens regarding the difference between the previous bonds approved by the Redevelopment Agency and this item’s bond issuance request, Scott Shaver, bond counsel from Stradling Yocca Carlson & Rauth, provided clarifying details regarding what this bond issuance would entail. Anthony Molloy, Manager of Redevelopment, provided further details regarding how the Redevelopment Agency plans on utilizing the bonds through the payoff date. (Motion) Commissioner Richard Serfas introduced a motion recommending adoption of a resolution of the City of Henderson Redevelopment Agency, Clark County, Nevada, approving the issuance of the City of Henderson Redevelopment Agency, Nevada, tax increment bonds (Downtown Redevelopment Area), series 2023, and the execution and delivery of documents relating thereto. The vote favoring approval was unanimous. Acting Chair Maria Bailey declared the motion carried. 5 RESOLUTION REDEVELOPMENT AGENCY OF THE CITY OF HENDERSON EASTSIDE REDEVELOPMENT AREA TAX INCREMENT BONDS SERIES 2023, IN THE NOT TO EXCEED AMOUNT OF $17,500,000.00 REDEVELOPMENT AGENCY A resolution of the City of Henderson Redevelopment Agency, Clark County, Nevada, approving the issuance of the City of Henderson Redevelopment Agency, Nevada, tax increment bonds (Eastside Redevelopment Area), series 2023, and the execution and delivery of documents relating thereto. Redevelopment Agency Advisory Commission Page 5 of 6 Tuesday, September 26, 2023 – Minutes David Vorce, Principal Redevelopment Fiscal Administrator, presented a summary of this item and the potential projects the bond funding would assist. He clarified that the last item pertained to the Downtown Redevelopment Area whereas this item pertains to the Eastside Redevelopment Area. Anthony Molloy, Manager of Redevelopment, stated one of the projects that would receive funding from this bond issuance is the fire station training center move from College Drive to the former Camping World located on Boulder Highway. He also said part of the funding is being allocated to a planned updates to the City’s Animal Shelter. (Motion) Commissioner Richard Serfas introduced a motion recommending adoption of a resolution of the City of Henderson Redevelopment Agency, Clark County, Nevada, approving the issuance of the City of Henderson Redevelopment Agency, Nevada, tax increment bonds (Eastside Redevelopment Area), series 2023, and the execution and delivery of documents relating thereto. The vote favoring approval was unanimous. Acting Chair Maria Bailey declared the motion carried. 6 DISCUSSION OF ELECTION FOR REDEVELOPMENT ADVISORY COMMISSION CHAIRMAN & VICE-CHAIRMAN REDEVELOPMENT AGENCY Discussion of Election for Redevelopment Advisory Commission Chairman and Vice Chairman. Anthony Molloy, Manager of Redevelopment, presented a summary of this item. After a brief discussion, it was the preference of the Commissioners to wait until the start of 2024 to hold elections for the new Chair and Vice Chair of the Redevelopment Advisory Commission. VI. CHAIRMAN\MEMBER COMMENTS Commissioner Chet Opheikens requested an item be placed on the next agenda to update the Commissioners on the Reimagine Boulder Highway Project. Responding to the question from Commissioner Richard Serfas regarding the status of the Lakemoor Canyon Redevelopment Project (Lakemoor), Bethany Sanchez, Assistant City Attorney III, said the Lakemoor items were originally scheduled to be heard at the October 3, 2023, City Council and Redevelopment Agency meetings; however, the applicant has requested their items be continued since they are still working on some internal matters. She said the items should be heard at a meeting date in November. Redevelopment Agency Advisory Commission Page 6 of 6 Tuesday, September 26, 2023 – Minutes Following the inquiry of Acting Chair Maria Bailey regarding the possibility of staff setting up site visits to allow the Commissioner to view the location of some of the larger planned projects that come before the Commission, Ms. Sanchez said she would investigate the possibility of scheduling site visits for the Commission and said she would follow up with the Commission at a later date. VII. SET NEXT MEETING The next meeting was set for Tuesday, October 24, 2023, at 4:00 p.m. VIII. PUBLIC COMMENT There were no public comments presented. IX.
