The Pledge of Allegiance was led by Mayor Clary. AGENDA The January 10, 2023, BOMA meeting was called to order by Mayor Jamie Clary. The roll was called with the current membership of eleven (11) present. Waters moved; seconded by Skidmore to approve the January 10, 2023, agenda. There was a unanimous vote to approve the motion. Clary declared the motion carried. PRESENTATIONS Michelle Groves and Erin Birch with United Way of Sumner County gave a presentation on Asset 1.imited, In.come Constrained, ~mployed. ALICE. Groves shared many statistics focusing on the children and those with disabilities and Veterans in Sumner County. The ALICE threshold was explained and the percentages of those meeting the threshold and those not meeting the threshold were included. More information can be found at www.unitedwaysumner.orn/Alice PUBLIC HEARING None MINUTES Waters moved; seconded by Garton to approve the December 13, 2022, minutes. There was a unanimous vote to approve the minutes. Clary declared the motion carried. CITIZENS' COMMENTS Clary read the Guidelines for public comments. Takae Miller of 142 Fieldcrest Circle addressed the Board in support of Andy Kaczmarek for Ward 3 Alderman. There was residential representation from Mansker Farms present with Ms. Miller. CONSENT AGENDA None ORDINANCES AND RESOLUTIONS None OTHER AGENDA ITEMS Election of Ward 3 Alderman. Clary moved; (no seconded needed) to nominate Andy Kaczmarek and Jeff Sasse as qualified candidates for the position of Ward 3 Alderman recently vacated by Russ Edwards as he was appointed City Judge. Clary noted that the nomination did not require a second. Without objection the rules were suspended to hear from Kaczmarek and Sasse with an allotted five (5) minutes to address the Board. Each nominee shared their reasons for applying and what qualities they possess for serving the position. MINUTES OF REGULAR MEETING JANUARY 10, 2023 PAGE3 Nominations were closed. There was a majority vote nine to two (9-2) electing Jeff Sasse as Ward 3 Alderman. The voting was as follows: Kaczmarek Votes-Collins, Garza Sasse Votes- Dixon, Garton, Goodwin, Martin, Peterson, Roberson, Skidmore, Waters, Clary Clary declared the motion carried. Goodwin moved; Garton seconded a motion to take a five (5) minute break. After the break, Jeff Sasse was sworn in as Ward 3 Alderman with his wife Susan in attendance. REPORTS Brief Committee Reports General-Peterson • Met January 10, 2023, with all commissioners present. • Discussed Ordinance 2023-01, an ordinance to establish an updated Occupational Safety and Health Program Plan. Passed unanimously. Moving on to BOMA for further discussion. • Discussed Resolution 2023-01, a resolution authorizing the Handmade Market to renew its use of the grounds of City Hall for its market activities. Nine (9) events planned. Passed unanimously. Moves to BOMA. • Discussed establishing a committee for streetlights, Ordinance 2023-02. That will be before BOMA in two (2) weeks. Planning-Martin • At the meeting, Director Free gave a recap of 2022. • The final Westlake plan has been updated and posted to the Planning website. • The plan will be presented to the Planning Commission March 7, 2023. Approved the following Development Plan: • Bellsford Landing - FDP Amendment (Open Space). Approved. • Submitted three (3) changes to three (3) areas of the plan. Approved the following Site Plan: • Southern Nurseries, Soil Shed - Site Plan. Approved. MINUTES OF REGULAR MEETING JANUARY 10, 2023 PAGE4 • Re-elected everyone to the same positions for the new year as follows: • Chairman: Jeff Coker • Vice-Chairman: Tim Altizer • Secretary: Vanessa Silkwood • Assistant Secretary: Charles Hasty Chief of Operations Report-Eckenroth • Congratulations to Alderman Sasse on his appointment as Ward 3 Alderman. • Updated building damages from freezing temperatures-Fire Station #5 sustained damage from burst sprinkler line, Country Hills Golf Course suffered damage from a broken water line as well as a concession stand at Volunteer Park. • No damage at the Police Department or City Hall. • Final estimates are not in, but all the buildings are insured and have a $1,000.00 deductible. • Buildings have been dried out and repairs are expected to begin once the City has gone out to bid. • Traffic collision at New Shackle and Main over the weekend destroyed the traffic control equipment. • Sgt. Josh Morrison was recognized and commended for his above and beyond duties giving attention to the matter and his initiative to get the equipment up and running as soon as possible. There was a great backlog with our vendor to replace the equipment needed. Sgt. Morrison reached out to various sources and discovered the City of Goodlettsville had recently replaced all their traffic control boxes. Goodlettsville was the first to reach out and was able to provide a spare box. The system was up and running the same day due to Sgt. Morrisons efforts and the City of Goodlettsville's willingness to help. • Traffic Engineer position has been open for two (2) years. No applicants. • Interview scheduled for tomorrow for an Assistant City Engineer potential. • Finance Director applications are continuing to be received. Another round of interviews will be scheduled. • Mid-year budget review is upcoming. Finance Committee meeting January 24, 2023, to discuss the mid-year budget. • There will be a BOMA workshop on February 6, 2023, to go over mid-year budget. • The Annual Comprehensive Financial Report is completed and will be given at the next Finance Committee meeting. • Roberson inquired of Code Red outage during the snow. Eckenroth stated he was aware that two (2) Code Reds were issued, with only one ( 1) going through. Eckenroth will provide more information after researching. Waters moved; seconded by Martin to approve the December 13, 2022, agenda. Clary asked the Board to acknowledged that the 2-week rule was being waived for Resolution 2022-48. There was a unanimous vote to approve the motion. Clary declared the motion carried. PRESENTATIONS Presentation of December Beautification Awards by Kathy Paschal with the Beautiful Hendersonville Committee. The Beech Environmental Club was recognized and shown appreciation for organizing a trash pickup. In attendance were Co-Presidents Meagan Linford and Hannah Madrigal, 2 MINUTES OF REGULAR MEETING DECEMBER 13, 2022 PAGE 2 Events Coordinator Vincent Giovanelli, and Club Advisor Stephanie Stephens. Director Gilley spoke giving recognition to Beautiful Hendersonville for providing awards and judges for the Best Christmas lights displays. Ultimate Party Festival of Lights has grown to see 10,000 visitors come through last year to view the lights. Maps have been created by a couple of people in the community outlining where lights can be seen all over the city. The maps are published on the Parks Facebook Page. Sponsors such as Hendersonville Civitan, Ace Hardware, Ultimate Party Store, and HolidayFest have given donations for displays and Mary’s Magical Place. Kathy Paschal distributed certificates to the winners for best Christmas lights in five categories: • Reason for the Season-First Baptist Church-Accepted by Ben Baxley • Neighborhood Harmony- (the most number of homes decorated with lights)- Durham Farms-Accepted by Lifestyle Director Connie Needles, Community Manager Amy Raines, and Senior Marketing Manager Lacey Edwards representing Freehold. • Traditional-Linda Bornt-119 Hillwood Drive • Lights on Luna-Mike and Sandra Grogg • Best Overall-Willie & Becky Cheatham-124 Haven Street Presentation of a proclamation to Mary Jane Campbell for her service on the Beer Board. Couldn’t attend. Presentation of a proclamation to Mike Fussell for his service on the Industrial Development Board. Couldn’t attend. Presentation of a proclamation for gratitude and appreciation honoring Prentice Oldham for his service to the city on the Beer Board. The Beer Board was established in 1994 to regulate sales, storage and manufacturing of beer. Mr. Oldham served on the Beer Board from 1998-2022 with much of that time serving as Chairman. PUBLIC HEARING None MINUTES Waters moved; seconded by Dixon to approve the November 29, 2022, minutes. There was a unanimous vote to approve the minutes. 3 MINUTES OF REGULAR MEETING DECEMBER 13, 2022 PAGE 3 Clary declared the motion carried. Peterson moved; seconded by Waters to approve the December 1, 2022, minutes. There was a majority vote twelve to one (12-1) to approve the minutes with Dixon abstaining. Clary declared the motion carried. CITIZENS’ COMMENTS None CONSENT AGENDA None ORDINANCES AND RESOLUTIONS The caption was read for Resolution 2022-48, a resolution to accept a donation from a city resident for Public Safety and Parks. Clary moved; Waters seconded to approve Resolution 2022-48. Edwards shared Resolution 2022-48 unanimously passed the Public Safety Committee. Clary gave some background regarding the donation sharing that a family wished to anonymously donate $25,000.00 to the city to be used for Public Safety and Parks. He stated he could accept gifts on behalf of the city, but he could not accept liabilities for the city. The designation for the use of the funds creates the liability. The COO will be asked to draw up the ordinance to appropriate the funds when it is determined what they will be spent for. Clary asked the donor how they would feel about the Public Safety portion of the donation going to the two officers for which there was a fundraiser over the weekend to help cover expenses. The donor thought it was a great idea and they wrote a $25,000.00 check directly to the Citizen’s Police Academy Alumni Association which will distribute the funds to the officers. Clary delivered the check to John Isbell who is the President of the Citizen’s Police Academy Alumni Association. Upon receipt of that check, the donor gave Clary another check for $25,000.00 for the Parks. The donor has stated that they would like to do this over the next several years. 4 MINUTES OF REGULAR MEETING DECEMBER 13, 2022 PAGE 4 Clary entertained a motion to amend Resolution 2022-48 to remove the Public Safety portion. Edwards moved; Waters seconded a motion to amend Resolution 2022-48 by removing “Public Safety and” from the caption as well as the first “Whereas” and removing “public safety” from the “Now, Therefore” section. There was a unanimous vote to approve the amendment to the motion. Clary declared the motion carried. Waters inquired on the amount of funds donated over the weekend. Clary stated he had heard approximately $5,500.00. There was a unanimous vote to approve the motion as amended. Clary declared the motion carried. OTHER AGENDA ITEMS Appointment of City Judge Roberson moved; Waters seconded to nominate Russ Edwards as City Judge starting January 1, 2023, and concluding March 2025 which marks the end of the term Curtis Lincoln was elected to. Clary noted that the nomination did not require a second. Clary also noted that Edwards has expressed interest in serving. Peterson moved to nominate Patrick Parker as City Judge. Without objection the rules were suspended to hear from Parker and Edwards. Parker shared his history and relationship to Hendersonville spanning his lifetime and his desire to serve in the capacity of City Judge. He feels he has the qualities to fulfill the role and carry on the same service as provided by Curtis Lincoln. Edwards spoke about his desire to serve as City Judge, balancing fairness and protecting the city as well as the citizens that will come before him. He expressed his love for serving as Alderman and how that will differ from serving in the position of City Judge. Collins relayed to Interim City Attorney Wray a concern from a constituent regarding a potential conflict of interest if Edwards were to be appointed City Judge and remain an alderman. Wray confirmed that would constitute a conflict of interest. 5 MINUTES OF REGULAR MEETING DECEMBER 13, 2022 PAGE 5 Edwards stated if elected City Judge, he would relinquish his seat as alderman and would abstain from the vote on City Judge. Nominations were closed. There was a majority vote ten to two to one (10-2-1) electing Russ Edwards as the City Judge. The voting was as follows: Edwards Votes-Dixon, Garton, Garza, Goodwin, Martin, Roberson, Sitler, Skidmore, Waters, Clary Parker Votes-Collins, Peterson Abstain-Edwards Clary declared the motion carried. Edwards stated he had also withdrawn his name for the position of County Law Director. Clary asked the Board to amend the agenda, needing a two-thirds majority vote, to motion to start the process of filling of Edwards’ vacated seat at the next meeting. Waters moved; Garton seconded a motion to amend the agenda to include this motion. There was a unanimous vote to amend the agenda to consider the motion of filling soon to be vacant Alderman Edwards’ seat. Clary declared the motion carried. Clary moved; Dixon seconded a motion to request the Mayor and Staff to seek applications for the BOMA seat that will become open due to the likely resignation of Alderman Russ Edwards. The process will be similar to the process of previous BOMA vacancies. Staff will publicize the opening and collect applications until January 3, 2023. From among the qualified applicants, the Board of Mayor and Aldermen will appoint a person on January 10, 2023 to fill the seat as long as legally permitted. There is a second part to the motion to seek applications for any BOMA seat that is vacated prior to the January 10, 2023, BOMA meeting. Staff will publicize the opening and collect applications until January 17, 2023. From among the qualified applicants, the Board of Mayor and Aldermen will appoint a person on January 24, 2023, to fill the seat as long as legally permitted. This arises as Alderman Sitler has applied for the position of County Law Director and in the event he is elected to that position, his aldermanic seat will become available. Waters moved to amend the motion to appoint Jeff Sasse as Ward 3 Alderman to replace Edwards instead of taking applications. There was no second. Motion failed. 6 MINUTES OF REGULAR MEETING DECEMBER 13, 2022 PAGE 6 Skidmore commented that he believes the Charter prevents the aforementioned from taking place as there are steps to fulfill the vacancy. There was a unanimous vote to approve the motion. Clary declared the motion carried. REPORTS Public Safety-Edwards • Met December 13, 2022 • Reading of Resolution 2022-48, a resolution to accept a donation from a city resident for Public Safety and Parks-Passed unanimously. • Discussion: Fleet Replacement Policy-Discussed with Fire and Police lead by COO Eckenroth. Encouraged all to watch the meeting as it is a very important issue that will be coming up soon. Planning-Martin Approved the following Site Plan: • Tailgate Brewery, Temporary Patio Cover – Site Plan (Mural Portion was withdrawn by applicant.) The committee requested that Tailgate Brewery complete the exterior package and resubmit it to be considered all together. • Volunteer State Bank withdrew request for the access road due to concerns heard from neighbors. • Westlake District Framework Plan draft will be ready in two (2) weeks and will be presented to the Planning Commission in February 2023. Golf-Roberson • The existing irrigation pump at the golf course was installed in 1989 and is showing signs of deterioration. • Golf Course Commission and the golf management group met with Finance Committee in May of 2022. The Finance Committee felt it was important for the golf management group to move forward with replacement. • The Golf Course Commission unanimously approved to move forward on accepting bids for an irrigation pump. • The pump could range from $300,000.00 to $325,000.00. • The bids will begin next year [2023] with the installation to be near the end of the year. • No funds will come out of the General Fund. • There will be a Capital Projects meeting in January to bring new aldermen and others up to date on city projects. Erica will be polling the standing committee chairs to see what dates are feasible for them to meet. 7 MINUTES OF REGULAR MEETING DECEMBER 13, 2022 PAGE 7 Chief of Operations Report-Eckenroth • Thanks to Judge Edwards • Thanks to Jason Gallo and his team for getting the City Judge job posting put up and turned around so quickly and Alderman Sitler for advising key places to post the job listing. A good applicant pool was received from those postings. • No Parks events this weekend • Thanks to Director Gilley for his assistance on the Golf Course Committee and all he does for the Parks Department. • Pothole Repairs-The city has a three-pronged approach: cold patch, a new machine has just been purchased to be operated by the city crews that fills in potholes with a hot mix providing a more permanent fix than cold patch, and a contractor that cuts out sections and uses a hot mix for repairs. • $135,000.00 put in the budget at the beginning of the year is about half depleted with a list of repairs to extinguish the rest of the funds. • Pothole reports can be done through the city website from the “I Want To” tab, then “Report a Problem”. • The reports go to the Public Works Department. • Assistant Finance Director Tamara Ingersoll has joined the Finance Department. • The ACFR (Annual Comprehensive Financial Report) will be presented to the Board soon Peterson thanked Eckenroth and Public Works for addressing the potholes and fixing those so quickly. Peterson also asked that the Mayor extend thanks to the anonymous donor for the generous donations. Roberson expressed concerns from citizens regarding construction blasting. Eckenroth stated that a fact sheet has been put together to help citizens navigate the complaints. The State sets and regulates the blasting but our Fire Department is here to help. The sheet is located on the city’s website under the Fire Department tab. Upon motion by Edwards and second by Garza, there was a unanimous vote for approval to adjourn. STAFF REPORT REPORT PREPARED BY: Jesse Eckenroth – Chief of Operations BACKGROUND: 1 The City of Hendersonville, for purposes of local governance, is divided into six (6) evenly represented geographical wards. Each city ward is represented by two elected alderman that serve on the Board of Mayor and Alderman and have equal voting rights. Alderman terms are four (4) years, elections and the corresponding appointments are staggered at two (2) year intervals. DISCUSSION: 2 Russ Edwards was elected as a Ward 3 Alderman and has served faithfully. However, Mr. Edwards was appointed to be City Judge, beginning January 2023. As a result of Mr. Edwards appointment as City Judge he has resigned from his position of Ward 3 Alderman, effective January 2023. To fill the currently vacant position of Ward 3 Alderman the city issued a notice for all interested residents. The city has received two applications for the position of Ward 3 Alderman as attached to this staff report. The vacancy appointment would run the full length of Mr. Edwards remaining term, approximately two years. TITLE Alderman – Ward 3 TERM LIMIT From Appointment – November 2026 GENERAL INFORMATION The City of Hendersonville, a municipality incorporated in 1968, governs via a mayoral/aldermanic city charter granted by the Tennessee General Assembly in 1986. The mayor, who functions as the city's Chief Executive Officer, is elected at-large and serves a four-year term of office. The city is apportioned into six wards, or geographical subdivisions based upon population, with each ward encompassing over 10,000 residents. Registered voters in each ward elect two aldermen/alderwomen who serve staggered four-year terms of office. Staggered terms provide continuity of policy, direction, and ordinances. All city legislation is directed by alderman, each alderman and the Mayor have an equal vote on legislative matters. Typically, BOMA meets twice monthly to conduct city business. Meetings are held on the second and fourth Tuesday. at City Hall. All aldermen serve on each of the Board's various committees which typically meet once a month. Committee findings and recommendations are reported to the full Board of Mayor and Aldermen. Citizen volunteers, who are appointed by the Mayor or the Board, serve on several sub-commissions that also meet once a month. The commissions oversee various city activities. Alderman/alderwoman serves as a non- voting liaison for the various city committees.
