The proposed development is a 4,900sf Jim n’ Nicks BBQ restaurant. 49 parking spaces are required, and 59 are proposed. Access to the site will be via a rear access drive and a limited access on East Main Street. The Mayfair developer is in the process of constructing the rear access drive across the vacant lot to the east to the existing Alladin driveway, along with the limited access drive and right turn lane on East Main Street. Location: 108 Bonita Parkway, Parcel 159K A 023.00 Lead Planning Staff: Timothy Whitten STAFF REPORT This site is located in Hazelpath Commons off of Bonita Parkway. It is adjacent to Prime Car Wash. It is zoned GC-PD (General Commercial Planned Development). The proposed use is a 16,829sf, single story commercial shopping center. Rio Bravo would occupy 6,840sf of that. In addition to Rio Bravo, there would be 5 other tenant spaces. That master plan show a total of three outlots in front of the Go Store It facility. Prime Car Wash is located on one of those outlots. This shopping center would occupy the remaining two outlots. (8-0-0) 17 HPC Minutes 09/03/2024 STAFF REPORT The Combined Development Plan for Futbol5 was approved by the Planning Commission in February of this year. (A copy of the minutes from that approval is included in the packet.) Now, Futbol5 is requesting an amendment to the CDP to reduce the number of required parking spaces. The approved CDP showed the following parking data, calculated using the required ratios specified in the zoning ordinance: The approved plan showed one 330’ by 210’ outdoor playing field (indicated in the parking data as “Outdoor Recreation.” It also showed a 20,000sf building for Indoor Recreation uses. 18 HPC Minutes 09/03/2024 The owner is requesting to amend the plan to reduce the required parking from 219 spaces to 125 spaces. Please see the applicant’s request included in the packet. The amended plan shows the same size building and outdoor field as the approved plan, but re- oriented to accommodate revised grading. The image below graphically shows that the 20,000sf building would be provided sufficient spaces to meet the required ratio of 4 spaces per thousand square feet (spaces shown in blue). The outdoor field, instead of using the required ratio for Outdoor Recreation of 2 spaces per 1000 square feet of public use area, would be parked at an amended ratio of 0.5 per 1000 square feet (spaces shown in pink). The amended parking ratio for the field accounts for the requested reduction from 219 space to 125 spaces. The amended plan also utilizes for the first time the newly instituted allowance in the Zoning Ordinance for compact spaces and motorcycle spaces. (8-0-0) STAFF REPORT The applicant has submitted a Preliminary Development Plan application for 74.5 acres, located at 155 Caldwell Drive. The request is to rezone the 74.5 acres from Estate Residential (ER) to Single Family Residential Planned Development (SR-1-PD). The east portion of the lot would be developed with a street and 21 new lots ranging from 15,000 square feet to 22,596 square feet. An 18.8 acre open space would be created. The existing home would remain on Lot 22 with 46 acres. The remaining acreage is associated with the homes and roadway. 24 HPC Minutes 09/03/2024 FUTURE LAND USE PLAN ZONING MAP 25 HPC Minutes 09/03/2024 Surrounding property within the City of Hendersonville is all within the Suburban Living Land Use Character Area (above top), and also zoned ER (2nd picture, above), with property to the west and north being in Goodlettsville city limits. The property entrance would be adjacent to Twelve Stones Golf Club, creating an offset intersection. The current land use for the area is Suburban Living, which allows 1-4 dwelling units per acre. This land use is consistent with both ER and SR-1 PD zoning. 26 HPC Minutes 09/03/2024 The majority of the property lies within the floodplain and unbuildable floodway of Mansker Creek. All of the open space created will lie within the floodway, and is inaccessible to the proposed homes as shown. 27 HPC Minutes 09/03/2024 28 HPC Minutes 09/03/2024 The owner of the property (proposed Lot 22) has submitted a letter from an attorney stating that their property has an agricultural exemption by state law, which could potentially allow any number of proposed agricultural uses, with livestock, crops, agritourism, etc.. The proposed front elevations appear to be primarily brick and stone, with some hardie. The applicant has proposed a number of uses for the property. For the CDP consideration for commercial uses, this requires a land use change from the current land use designation of Suburban Living, which has a residential character, to the Suburban Center Land Use Character Area, which allows for a wide variety of commercial uses. (7-0-0) STAFF REPORT Recently, staff considered a potential Site Plan application in a pre-development meeting involving an Indoor Batting Cages Facility. While the uses of Indoor Recreation Facility and Recreational Training School are permitted within the Dockside Neighborhood (DN) zone, there is no specific listing within Table #12 Parking Requirements in the Zoning Ordinance for Batting Cages. Table #12 Parking Requirements does list sub-uses that fall under Indoor Recreation Facility such as Firing Range, Bowling Alley, and Driving Range, but does not list Batting Cages. When calculating the parking requirements for Batting Cages based on the listed uses in Table #12 Parking Requirements for the proposed new building using Indoor Recreation Facility (4 parking spaces per 1,000 SF of public use area) and Office (1 parking space per 400 Sf GFA), the following parking requirement is calculated: 7,350 SF / 250 SF = 29 parking spaces + 1,760 SF / 400 SF = 4 parking spaces 33 Total parking spaces required 60 HPC Minutes 09/03/2024 As can be seen in the image below, most of the proposed building is consumed by the 10 Batting Cages, yet the overall size is resulting in the requirement of 29 parking spaces for this area that can only be utilized by one person at a time using each cage resulting in the need for only 10 parking spaces. The total required parking spaces should more appropriately be 14 spaces (4 for office use and 10 for the 10 batting cages). The Zoning Ordinance allows for the Planning Director to decide about unlisted uses based on findings (7.3). In making such a determination, the Planning Director shall report the determination to the Planning Commission. It is requested that the Planning Commission confirm the following determination from the Planning Director regarding the parking calculation for Indoor Batting Cages: Table #12 Parking Requirements list Indoor recreation Facility sub-uses Firing Range and Driving Range to determine parking calculation. Each of these sub-uses only require 1 parking space per lane or tee. Due to the overwhelming similarity of such sub-uses to Batting Cages, it is determined that a more appropriate calculation for Indoor Batting Cages would be 1 parking space per batting cage. 61 HPC Minutes 09/03/2024 15.
