The rear of the site backs up to a residential lot in the Dockside Neighborhood (DN). The existing Care-A-Lot Daycare Center will be demolished. The existing site has two ingress/egress driveways, but new development will be reduced to one driveway on northwest corner of the lot onto Walton Ferry Road. The proposed development is a 9,050 square foot indoor batting cages. Batting cages require one parking space per batting cage. There are 10 batting cages within the proposed development. The office space requires four additional spaces as 1 parking space per 400 square feet. The total spaces required based on prior information is 14 parking spaces and 16 parking spaces have been provided. 9 HPC Minutes 11/04/2024 The front elevation inset part of the proposed building, closest to the street, is all brick with brick watertable. The larger portion where the batting cages would be located in the building has a brick watertable with hardie board and batten above. The design review for this building includes consideration for the overall architectural design and mix of materials (brick and hardie board and batten) and surrounding buildings. The adjacent buildings partially obscure the rear section of the building. (7-1-0) 26 HPC Minutes 11/04/2024 STAFF REPORT This is a request for approval of a comprehensive development plan (CDP) for Willowbrooke Phase 2. BRIEF HISTORY The subdivision currently known as Millstone was originally called Willowbrooke when it began going through approvals in 2006. In addition to single family homes and a small commercial area, the Willowbrooke master plan showed an assisted living and nursing home facility sited on 15.66 acres in the middle of the subdivision. This area was Phase 2 of Willowbrooke. The overall subdivision failed to take off after the economic downturn in 2007-2008. Around 2012, the subdivision was re-visioned as Millstone and received approvals from the Planning Commission and BOMA. The 15.88 acres was at that time under separate ownership and not included in the new Millstone master plan. Millstone then developed around 27 HPC Minutes 11/04/2024 the vacant Willowbrooke property. The original Willowbrooke master plan is still in effect for the Phase 2 vacant property. CURRENT WILLOWBROOKE PRELIMINARY/FINAL MASTER PLAN The current master plan for Willowbrooke Phase 2 allows Assisted Living and Nursing Home as allowed uses. No other uses are allowed. The plan shows one large, centralized facility, with 180 skilled nursing beds and 85 assisted living units. Parking for the facility is arranged around the west, north and east sides of the facility. A large detention pond is located on the east side. A wide-open space is shown between the facility and the south and south-east property lines. The pattern book that accompanied the plan shows a photo of a 2-story all-brick structure (see image at left). CURRENT WILLOWBROOKE PHASE 2 MASTER PLAN 28 HPC Minutes 11/04/2024 The current Millstone master plan shown at left, shows the residential development as it relates to the Willowbrooke parcel. The areas highlighted in green are shown as open spaces within Millstone to remain undeveloped. CURRENT MILLSTONE MASTER PLAN 29 HPC Minutes 11/04/2024 PROPOSED COMBINED DEVELOPMENT PLAN Thrive Senior Living is proposing a new comprehensive development plan to replace the current Willowbrooke master plan. The current zoning of MXR (Mixed Residential) will remain unchanged, but Independent Living is proposed to be added to the list of allowed uses, and significant changes are proposed in the layout of the site and the type of development. Independent Living is a residential complex where occupancy is limited to persons 55 years of age or older. Highlights of some of the proposed changes include: • Instead of Assisted Living and Nursing Home uses, the sole use will be Independent Living. Assisted Living and Nursing Home are still proposed to remain listed as allowable uses, however. • Instead of 180 skilled nursing beds and 85 assisted living units, there will be 169 Independent Living units. Those units are broken down as follows: O Building 1 (two-story stacked flats fronting Carriage House Lane): 10 units O Building 2 (two-story stacked flats fronting on Carriage House Lane): 13 units O Building 3 (two-story stacked flats fronting on Carriage House Lane): 11 units O Building 4 (large three-story stacked flats central building): 86 units O Buildings 5-19 (attached and detached cottage units: 49 units • Instead of one large centralized two-story building, there will be a three-story building (building 4), 3 smaller two-story stacked flats buildings (buildings 1-3), and 49 cottage units (buildings 5A-19D); 30 HPC Minutes 11/04/2024 • Instead of a large amount of surface parking arranged around a central building, there will be a few, small surface parking lots, with the remainder of the parking located in garages and driveways. • The current master plan does not call out any landscape buffers per se, but shows a wide open space on the south and south-east sides of the property. Parking fields are located between the streets and the building. Along the east property line, a large detention pond is located between the building and the adjacent residential development. Under the proposed plan, 20-foot-wide landscaped buffers are proposed along the south, east, north, and west property lines, and a 60 foot stream buffer along the south-east property line. In addition, along the north side, a water quality pond will be located between the proposed 20’ landscape buffer and the facility, providing additional separation on that side. • Instead of multiple street connections to the west (to Carriage House Lane) and the north, there will be one divided entry to Carriage House Lane, and one street connection to Bluebell Lane to the south. The current Lingering Way Street stubout on the north side of the development will not connect to the site; however, at the request of staff, the existing sidewalk there will connect into the development. Independent Living has a maximum allowed density of 15 units per acre. The density being proposed is 10.6 units per acre. The required number of parking spaces is 348; 367 spaces are proposed, to be provided through some smaller surface parking bays mostly located around the larger central building, and through spaces located in driveways and garages. The large central building will have tuck-under garages. The 3 smaller stacked- flats buildings will also have tuck under garages at the rear of the buildings, facing the interior of the development. The proposed amenities include a pool, an outdoor gaming area, a golf/putting green, two dog parks, pickle ball courts, and a garden area. REQUESTED WAIVER FOR BUILDING HEIGHT The allowed building height under the current MXR zoning is 35 feet. In addition, the pattern book that accompanied the Willowbrook master plan indicated that the facility would be two stories (see building image on page 1). Thrive Senior Living initially proposed all four of the stacked-flats buildings (buildings 1-4) to be three-stories. They have since reduced buildings 1-3 (along Carriage House Lane) to two stories, but are requesting that the larger building 4 (see image above) be allowed to have 3 floors, with a total height of 39 feet. BOMA General Committee Meeting (November 12, 2024 estimated) 2. BOMA Regular Meeting – 1st Reading (November 26 2024 estimated. BOMA will need to make a motion to extend the deadline for the 2nd reading approval to Jan. 14, 2025). 3. BOMA Regular Meeting – 2nd Reading (January 14, 2025 estimated.). 8.8.3.2 | PROCEDURAL REQUIREMENTS FOR PRELIMINARY DEVELOPMENT PLAN B. The Planning Commission shall determine if the planned development is or is not in the public interest based on the following: 1. Is the site or zoning lot upon which the planned development is to be located adaptable to the unified development proposed? 2. Will the proposed planned development be detrimental to or endanger the public health, safety, comfort, or general welfare of any portion of the community? 3. Will the proposed planned development be injurious to the use and enjoyment of other property in the vicinity for the purposes already permitted? 4. Will the proposed planned development impede the normal and orderly development and improvement of surrounding property for uses permitted in the zoning district? 5. Is there provision for adequate utilities, drainage, off street parking and loading, pedestrian access and all other necessary facilities? 6. Is there provision for adequate vehicular ingress and egress designed to minimize traffic congestion upon public streets? 7. Are the location and arrangement of structures, parking areas, walks, lighting and appurtenant facilities, compatible with the surrounding neighborhood and adjacent land uses? 8. Is there suitable landscaping for the portions of the proposed planned development which are not to be used for structures, parking and loading areas, or access ways? 9. Is the planned development, in the specific location proposed consistent with the spirit and intent of this Ordinance and the Land Use and Transportation Plan? The Planning Commission in its review and recommendation and the Board of Mayor and Aldermen in its deliberations shall make specific findings with regard to the following grounds for a Zoning Map amendment: A. The amendment is in agreement with the Land Use Plan. B. Staff was not comfortable approving the extensive amount of bright blue they were proposing, so Walmart appealed to the Planning Commission for approval. Planning Commission denied the request. 36 HPC Minutes 11/04/2024 Now Walmart is proposing a similar color scheme, but with more bright blue than the request that was denied. Staff explained to the applicant that the request had already been denied, but they wish to proceed with their request. Walmart (204 Anderson Lane) has submitted a request to build a 3,840sf addition to their building. The application is eligible for staff-level review. As part of the application, they are also requesting to make some changes to the paint color on the front and sides of the building. The proposed changes exceed what staff is comfortable approving. Section 12.3.6.3.D states “Use muted earth tone tints of colors such as reds, browns, tans, grays, and greens. In addition to single family homes and a small commercial area, the Willowbrooke master plan showed an assisted living and nursing home facility sited on 15.66 acres in the middle of the subdivision. This area was Phase 2 of Willowbrooke. The overall subdivision failed to take off after the economic downturn in 2007-2008. Around 2012, the subdivision was re-visioned as Millstone and received approvals from the Planning Commission and BOMA. The 15.88 acres was at that time under separate ownership and not included in the new Millstone master plan. Millstone then developed around the vacant Willowbrooke property. The original Willowbrooke master plan is still in effect for the Phase 2 vacant property. CURRENT WILLOWBROOKE PRELIMINARY/FINAL MASTER PLAN The current master plan for Willowbrooke Phase 2 allows Assisted Living and Nursing Home as allowed uses. No other uses are allowed. The plan shows one large centralized facility, with 180 skilled nursing beds and 85 assisted living units. Parking for the facility is arranged around the west, north and east sides of the facility. A large detention pond is located on the east side. A wide open space is shown between the facility and the south and south-east property lines. The pattern book that accompanied the plan shows a photo of a 2-story all-brick structure (see image at left). 3 CURRENT WILLOWBROOKE PHASE 2 MASTER PLAN The current Millstone master plan shown at left, shows the residential development as it relates to the Willowbrooke parcel. The areas highlighted in green are shown as open spaces within Millstone to remain undeveloped. CURRENT MILLSTONE MASTER PLAN 4 PROPOSED COMBINED DEVELOPMENT PLAN Thrive Senior Living is proposing a new comprehensive development plan to replace the current Willowbrooke master plan. The current zoning of MXR (Mixed Residential) will remain unchanged, but Independent Living is proposed to be added to the list of allowed uses, and significant changes are proposed in the layout of the site and the type of development. Independent Living is a residential complex where occupancy is limited to persons 55 years of age or older. Highlights of some of the proposed changes include: • Instead of Assisted Living and Nursing Home uses, the sole use will be Independent Living. Assisted Living and Nursing Home are still proposed to remain listed as allowable uses, however. • Instead of 180 skilled nursing beds and 85 assisted living units, there will be 169 Independent Living units. Those units are broken down as follows: o Building 1 (two-story stacked flats fronting Carriage House Lane): 10 units o Building 2 (two-story stacked flats fronting on Carriage House Lane): 13 units o Building 3 (two-story stacked flats fronting on Carriage House Lane): 11 units o Building 4 (large three-story stacked flats central building): 86 units o Buildings 5-19 (attached and detached cottage units: 49 units 5 • Instead of one large centralized two-story building, there will be a three-story building (building 4), 3 smaller two-story stacked flats buildings (buildings 1-3), and 49 cottage units (buildings 5A-19D); • Instead of a large amount of surface parking arranged around a central building, there will be a few, small surface parking lots, with the remainder of the parking located in garages and driveways. • The current master plan does not call out any landscape buffers per se, but shows a wide open space on the south and south-east sides of the property. Parking fields are located between the streets and the building. Along the east property line, a large detention pond is located between the building and the adjacent residential development. Under the proposed plan, 20 foot wide landscaped buffers are proposed along the south, east, north, and west property lines, and a 60 foot stream buffer along the south-east property line. In addition, along the north side, a water quality pond will be located between the proposed 20’ landscape buffer and the facility, providing additional separation on that side. • Instead of multiple street connections to the west (to Carriage House Lane) and the north, there will be one divided entry to Carriage House Lane, and one street connection to Bluebell Lane to the south. The current Lingering Way street stubout on the north side of the development will not connect to the site; however, at the request of staff, the existing sidewalk there will connect into the development. Independent Living has a maximum allowed density of 15 units per acre. The density being proposed is 10.6 units per acre. The required number of parking spaces is 348; 367 spaces are proposed, to be provided through some smaller surface parking bays mostly located around the larger central building, and through spaces located in driveways and garages. The large central building will have tuck-under garages. The 3 smaller stacked-flats buildings will also have tuck under garages at the rear of the buildings, facing the interior of the development. The proposed amenities include a pool, an outdoor gaming area, a golf/putting green, two dog parks, pickle ball courts, and a garden area. REQUESTED WAIVER FOR BUILDING HEIGHT The allowed building height under the current MXR zoning is 35 feet. In addition, the pattern book that accompanied the Willowbrook master plan indicated that the facility would be two stories (see 6 building image on page 1). Thrive Senior Living initially proposed all four of the stacked-flats buildings (buildings 1-4) to be three-stories. They have since reduced buildings 1-3 (along Carriage House Lane) to two stories, but are requesting that the larger building 4 (see image above) be allowed to have 3 floors, with a total height of 39 feet. The rear of the site backs up to a residential lot in the Dockside Neighborhood (DN). The existing Care-A-Lot Daycare Center will be demolished. The existing site has two ingress/egress driveways, but new development will be reduced to one driveway on northwest corner of the lot onto Walton Ferry Road. 2 The proposed development is a 9,050 square foot indoor batting cages. Batting cages require one parking space per batting cage. There are 10 batting cages within the proposed development. The office space requires four additional spaces as 1 parking space per 400 square feet. The total spaces required based on prior information is 14 parking spaces and 16 parking spaces have been provided. 3 The front elevation inset part of the proposed building, closest to the street, is all brick with brick watertable. The larger portion where the batting cages would be located in the building has a brick watertable with hardie board and batten above. The design review for this building includes consideration for the overall architectural design and mix of materials (brick and hardie board and batten) and surrounding buildings. The adjacent buildings partially obscure the rear section of the building. The Dockside Neighborhood (DN) utilizes a little more flexibility in valuation of percentage of amount of brick and hardie board and batten. 4 STAFF COMMENTS – PLANNING DEPARTMENT: 2 1. Provide details as to how trash will be removed as the business not eligible for City Trash collection. 2. Show location of pad where trash receptacles will be placed along with brick enclosure. 3. Staff was not comfortable approving the extensive amount of bright blue they were proposing, so Walmart appealed to the Planning Commission for approval. Planning Commission denied the request. Now Walmart is proposing a similar color scheme, but with more bright blue than the request that was denied. Staff explained to the applicant that the request had already been denied, but they wish to proceed with their request. Since more than a year has elapsed since their previous request, the waiver request may be renewed. A copy of the October 2022 staff report is attached at the end of this report. Walmart (204 Anderson Lane) has submitted a request to build a 3,840sf addition to their building. The application is eligible for staff-level review. As part of the application, they are also requesting to make some changes to the paint color on the front and sides of the building. Such changes are typically made at the staff level as long as the changes conform to the City’s building design standards and any planned development design standards. The proposed changes exceed what staff is comfortable approving. Section 12.3.6.3.D states “Use muted earth tone tints of colors such as reds, browns, tans, grays, and greens. Avoid primary colors or bright accent colors and stark contrast colors.” Staff previously approved a limited amount of bright blue in select locations with lesser visibility. Now, Walmart wants to expand the same color to more wall sections and with greater visibility. The existing approved paint scheme is shown below. The rust-colored areas are actually the existing, unpainted brick. The proposed paint scheme is shown below. The compressed image makes it look like the brick areas are also to be painted, but that is not the case. The same rust-colored areas shown in the image above would remain un-painted brick in the image below.
