OFFICIAL PROCEEDINGS CITY OF HERREID, SOUTH DAKOTA September 7, 2021 The Herreid City Council was called to order by Council President Adrienne Dupper on the above date at 7:30pm at City Hall. The following members were present: A. Dupper, K. Rossow, P. Weisbeck, and Lacy Fuehrer, with K. Haar, R. Rossow, and Mayor Weismantel absent. Also, present were: M. Neeley, Finance Officer; R. Goehring, Maintenance Supervisor; and Orland Geigle; Prairie Pioneer. Moved by K. Rossow, seconded by Fuehrer to approve the agenda. All members present voted aye, motion carried. Moved by Weisbeck, seconded by K. Rossow to approve the minutes from August 2, 2021. All members present voted aye, motion carried. K. Rossow moved, Fuehrer seconded to approve the following regular and additional claims. All members present voted aye, motion carried. Claims for except for the B&B claim. Building Permits Moved by K. Rossow, seconded by Fuehrer, all present voted aye, motion carried to approve the following building permits: Paul Weisbeck, asphalt on alley south of 108 Birch St, Brian & Marcy Nies, asphalt in boulevard at 504 Ash St, Melinda Neeley installing fence at 408 Tower St. Following clarification via telephone, that the structure would not extend any further into the alley than the previous structure, moved by K. Rossow, seconded by Weisbeck to approve a building permit for Bob Schuetzle to place a 26x36 pole barn at 505 Elm. Public Comments Discussed a letter to the editor in the Prairie Pioneer by Curt Kost noting weeds at the Cemetery. Points included: the letter appears to follow a much needed, substantial rainfall near the end of a dry-hot summer; with Willis Van Heukelom’s retirement this year, the city no long has someone assigned primarily to Cemetery care-discussion in Spring of 2022 to include designation of an employee to function as Cemetery caretaker. Discussed complaints received about dogs barking in town. Conversation included prior complaints regarding similar issues in other locations in town, the potential for the City’s Nuisance Ordinance to apply, the need for complainants to provide documentation/evidence of the issue to the City Attorney for any action to be considered, the potential to contact the Humane Society out of Aberdeen if care for the animal(s) appears sub-standard. Heard that compliments were received from out of town visitors who enjoyed the City’s new playground equipment at Deibert Park. Old Business Pool Report-FO Neeley reported 2021 pool operations: costs $35,816.31, revenue $12,265.00, for a net loss of $23,551.31. Discussion involved the cost structure for memberships and lessons, bathroom/changing room conditions, and need to begin planning 2022 pool season earlier in 2022. Pool Project-Dupper reported that he Engineering firm is preparing plans, options, and recommendations for the pool improvement committee. The committee is still fundraising and hopes to have a more concrete budget estimate for the next Council meeting in October. Sewer Project-Final Payment #8-Sewer Claims (B & B, Helms) were not approved for payment due to outstanding issues: curb stop height, rubble site condition, incorrect rock size delivered for Railway Ave. Drainage-Discussed Dick Werner’s complaint from August meeting regarding drainage near new twin homes on Ash St. Weisbeck has worked with property owner to the south of the twin home to create a small drainage channel, which appears to be an effective temporary solution. Weisbeck will follow up with property owner as mud in the area dries to create a wider/channel and locate appropriate rock to use as a fill for a more permanent solution. Master Transportation Plan-Reviewed plan documents, noting thoroughness of the SDDOT in creating the document. Discussed need to review and consider creation of a sub-committee to recommend projects by priority for city to pursue. Discussion tabled till next meeting. Resolution of Necessity-Paving project-Heard that Jensen’s plans to be in town to work on the project near the end of September, the city has sufficient funds in reserve to pay for the project-but could secure a bond with the assistance of legal council, an interest rate and term of the special assessment needs to be established. New Business HEDC-Heard that HEDC is working to secure some commercial locations that may require building demolition. HEDC requested permission to take debris to the city’s rubble site. Discussion involved the need for work to be coordinated with Maintenance Goehring to be sure materials are sorted appropriately, so long as sufficient space remains, council indicated that such debris could be disposed of at the rubble site. Corona Virus Local Fiscal Recovery Funds-Moved by Weisbeck, seconded by K Rossow to approve completion of the Assurance of Compliance with Civil Rights Requirements and the US Dept of the Treasury Corona Virus Local Fiscal Recovery Fund Award Terms and Conditions for submission with the city’s application for CFR funds. All members present voted aye, motion passed. 2022 Voter Districts-Heard that NECOG has provided some information that may result in the need to modify voter districts in 2022. FO Neeley will be attending training sessions in the fall, and will report back regarding district size issues. Annual Conference-Heard the SDML Annual Conference will be held in Spearfish on October 5-8, and reviewed training agenda. Moved by Weisbeck, seconded by K. Rossow to approved F.O. Neeley, Maintenance Goehring, and Mayor Weismantel to attend the conference. All members present voted aye motion passed. CD 509066 renewal $125,000 12mos. Moved by Weisbeck, seconded by K. Rossow to renew the CD with Campbell County Bank, all members present voted aye, motion passed. Annual Appropriation Ordinance-reviewed for 2022 heard that CPI is 1.2 and growth is 3.61 for a maximum tax levy increase of $5,817.46. Moved by Weisbeck, seconded by K. Rossow to accept the first reading of the 2022 Annual Appropriation Ordinance with the maximum tax levy increase. All members present voted aye, motion passed. Maintenance Report-Maintenance Goehring reported that he has been busy with maintenance of city locations, spreading gravel on the shoulders of streets re-paved as part of the sewer project, completing locates for 811 and assisting residents locate water leaks. Regarding the rubble site and posted hours, Maintenance Goehring will investigate game cameras that could be used to leave the location open for extended hours. Finance Report-Fund balances, expenditures, revenue accounts, sales tax receipts, and delinquent utility accounts were reviewed. FO Neeley was directed to forward three inactive account holders that failed to respond to notices over to collections. Additionally, two active accounts will be notified that their payment requests will be accepted, while one active account will receive a final notice regarding service disconnection. Finally one additional active account will receive notice that they must pay their balance within 15 days or make payment arrangements to avoid service disconnection. FO Neeley is to contact he City Attorney to request advice on the city’s Ordinance regarding disconnection of service and collection of past due accounts. The next regularly scheduled Council meeting will be Monday, October 4th at 7:30pm.
