Minutes of the meeting of the Board of Trustees of the Incorporated Village of Hewlett Bay Park held on Monday, April 18, 2022 at 6:00 PM. at Village Hall, 30 Piermont Avenue, Hewlett NY 11557. Members of the public also were permitted to observe and participate via Zoom videoconference. The public had a right to speak at this meeting. 1. Calling the Meeting to Order: Mayor Salomon called the meeting to order at 6:03 PM 2. Mayor Appointments A. Deputy Mayor- Mayor Salomon appointed Trustee Oliviero as Deputy Mayor for the remainder of the official year. Deputy Mayor Oliviero signed his oath of office. B. Trustee Mayor Salomon appointed Renee Zylberberg to the position of Trustee for the remainder of the official year. Deputy Mayor Oliviero moved to approve the appointment, which motion was seconded by Trustee Levy, and unanimously approved 3. Notice of Meeting – Nassau Herald: The Clerk reported that notice of the public meeting was emailed to the Nassau Herald, posted on the bulletin board outside of Village Hall and in the lobby of Village Hall and posted on the Village website. 4. Minutes –March 3, 2022 On motion by Mayor Salomon, seconded by Deputy Mayor Oliviero, and approved unanimously, the Board dispensed with the reading of the March 3, 2022 minutes as the Clerk had previously mailed such minutes and they are hereby approved. 5. Appointments Mayor Salomon’s appointments; Member Board of Appeals Stella Gershfeld - Remainder of term 2022 Alt Member – Board of Appeals Neil Soskel - Remainder of official year 2022 Chair/Member Design Review Board Andrea Soskel –Remainder of official year 2022 Member Design Review Board Karen Katz - Remainder of term 2023 On motion by Deputy Mayor Oliviero, seconded by Trustee Levy and unanimously carried the above appointments were approved 7. Additional Speed Bumps and Allocation of Village Funds to Purchase The Board discussed. 8. Proposed Bill HBP 2201- A local law to adopt a new Chapter 133A of the Code of the Village of Hewlett Bay Park, entitled “Telecommunications Licenses and Franchises”, providing for the regulation of telecommunications within public ways On motion by Mayor Salomon, seconded by Trustee Levy and unanimously approved, the Board voted to hold a Public Hearing on May 23, 2022 at 6:30 pm, with respect to Proposed Bill HBP 2201-, and directed the publication of the required legal notice. 9. Resolution Establishing Residency Requirements for the Village Justice On motion by Mayor Salomon, seconded by Deputy Mayor Oliviero, and unanimously approved, the following resolution was adopted; WHEREAS, with certain specified exceptions, the New York State Public Officers Law and the New York State Village Law require that Village officers, including the Village Justice, be residents of the Village of Hewlett Bay Park (“Village”), and WHEREAS, Village Law §3-300(2)(b) permits the Board of Trustees of a village with a population of less than 3,000 people to provide, in lieu of any other residency requirement imposed by law, that the Village Justice may reside within a county in which the Village is situate, and WHEREAS the Village is situated in Nassau County and has a population of less than 500 people, and WHEREAS, to assure that the Village Justice Court has a Village Justice and will be able to function and operate continuously, the Board of Trustees deems it in the best interests of the Village to provide that the Village Justice need not reside in the Village, so long as the Village Justice is a resident of Nassau County, New York,  NOW, THEREFORE, BE IT RESOLVED, effective immediately, that notwithstanding the provisions of the Public Officers Law and the Village Law, and in accordance with Village Law §3- 300(2)(b), a new Village Code Chapter, Chapter 39 be, and hereby is, adopted, to read as follows: “Chapter 39. Village Justice Residency Requirements. § 39-1. Residency requirements for Village Justice Notwithstanding the provisions of the Public Officers Law and the Village Law, and in accordance with Village Law §3-300(2)(b), the Village Justice may reside within the Village of Hewlett Bay Park or the County of Nassau.” and it is further RESOLVED, that the Village Clerk shall notify General Code Publishers Corp. of the adoption of this resolution, for inclusion in the Village Code publicly made available by such company 10. Schedule Public Hearing for Storm Water Annual Report: On motion by Mayor Salomon, seconded by Deputy Mayor Oliviero and unanimously approved, the Board voted to hold a Public Hearing on May 23, 2022 at 6:30 pm, with respect to the Storm Water Annual Report, and directed the publication of the required legal notice. 11. Lynbrook Street Sweeping Intermunicipal Agreement The Board discussed. 12. Everit Avenue Road Program Update On motion by Trustee Zylberberg, seconded by Mayor Salomon and unanimously carried, the Board approved the Everit Avenue Road program from the Village Boundary line at Willow Pond to the Village Boundary line at Broadway and instructed the Clerk to have the Engineer to have specs and bids produced for public bid. 13. June 2022 Election Update and Resolutions A. Appoint Election Inspectors and Compensation On motion by Deputy Mayor Oliviero and seconded by Mayor Salomon, the following resolution was unanimously adopted. WHEREAS, pursuant to the Election Law, the Board of Trustees is required to appoint an even number of inspectors of election, and fix their compensation, and designate one of them as Chair,  NOW, THEREFORE, BE IT RESOLVED, that the following persons are hereby designated and appointed inspectors of election, and they shall meet on June 21, 2022 at the place designated for such Village Election, between the hours of 12 Noon and 9:00 p.m., inclusive, for the purpose of the Village Election: NAME ADDRESS PARTY Elaine Levy 510 DUBOIS AVE VALLEY STREAM, NEW YORK 11581 Democrat Francine Kornweiss 250 Central Ave DEMOCRAT LAWRENCE, NY 11559 Jay Anderson 1367 BROADWAY REPUBLICAN HEWLETT, NEW YORK 11557 Rachel Anderson 1367 BROADWAY REPUBLICAN HEWLETT, NY 11598 AND IT IS FURTHER RESOLVED, that Francine Kornweiss, hereby is, designated to act as Chair of said inspectors of election, and it is further RESOLVED, that the compensation for each of the aforesaid inspectors of election shall be $135.00 for each of said days that said inspectors of election may be required to serve. B. Designate polling place and hours for Village Election to be held on Tuesday, June 21, 2022. On motion by Mayor Salomon, and seconded by Trustee Rubel, the following resolution was unanimously adopted. WHEREAS, pursuant to the Election Law, the Board of Trustees is required to designate the polling place for the Village election to be held on June 21, 2022, and the hours of election, NOW, THEREFORE, BE IT RESOLVED, that the polling place for the Village Election to be held on June 21, 2022 shall be the Village Hall, 30 Piermont Avenue, Hewlett, New York. BE IT FURTHER RESOLVED, that the hours of the said Village Election shall be from 12:00 noon to 9:00 p.m., inclusive. 14. Proposed Bill HBP 22-02 A local law to amend Chapter 146 of the Code of the Village of Hewlett Bay Park, to provide for a new section to regulate piers in a front yard. On motion by Mayor Salomon, seconded by Trustee Levy and unanimously approved, the Board voted to hold a Public Hearing on May 23, 2022 at 6:30 pm, with  respect to proposed Bill HBP 2202, and directed the publication of the required legal notice. 15. Building Department Correspondence A. RSM Building Corp seeking a Demo Bond for property located at 162 Cedar Avenue to Demo House On motion by Mayor Salomon, seconded by Deputy Mayor Oliviero, and unanimously approved, the Board approved the Demo bond issued to RSM Builders in the amount of $50,000 for the demolition of property known as 162 Cedar Avenue. B. Letter received 4/4/2022 from Joshua and Candice Feiler owners of 229 Woodside Drive requesting a First extension on Permit HBP 2021007 to construct a second story addition over existing first story, construct a one-story addition and widen driveway approved by BZA 3-9-2021. No Fee On motion by Deputy Mayor Oliviero, seconded by Mayor Salomon and unanimously approved Board granted a 1st extension for permit # HBP 2021007 to construct a second story addition over existing first story, construct a one-story addition and widen driveway approved by BZA 3-9-2021. Permit will run from 3/10/2022 – 9/10/22—No Fee Motion by Mayor Salomon, seconded by Deputy Mayor Oliviero and unanimously Carried, the Board authorized Village Attorney Brian Stolar to draft a law granting permission to the Building Inspector to renew permits without having to come to the Board. 16. Village Hall Beautification On motion by Deputy Mayor Oliviero, seconded by Trustee Levy and unanimously approved, the Board approved the beautification of the front premises known as Village Hall at 30 Piermont Avenue, Hewlett, for a price not to exceed $3600 to be 1/3 split between the Village of Hewlett Neck and Village of Woodsburgh. 18. Willow Pond Motion by Mayor Salomon, seconded by Deputy Mayor Oliviero and unanimously carried, the Board authorized the modification of the Willow Pond agreement between the Village of Hewlett Harbor and the Village of Hewlett Bay Park, to provide for a revision of the payment responsibility for work to increase the base amount from $4,000 to $7,500 and modify the split for additional expenses to a  75/25% split, with the Village of Hewlett Bay Park being responsible for one half of the base amount and 25% of additional agreed upon expenses, and authorized the Village Attorney to work with the Hewlett Harbor Village Attorney to prepare an amendment to the Willow Pond agreement in accordance with these modifications, 19. Audit of Claims The Board discussed the claims. Upon confirmation from the Deputy Mayor Oliviero that the items in such abstract represented the purchase of goods and services actually received and/or performed and that each item contained in the abstract was for a proper Village purpose, on motion duly made by Mayor Salomon, seconded by Trustee Rubel, and adopted unanimously, the Board authorized and directed the Village Treasurer pay the general fund claims in the total sum of $192,220.90 set forth in abstract #712 (copy of the abstract is on file in the Village office). 21.
