Borough of Ho-Ho-Kus County of Bergen Mayor and Council Combined Work/Public Meeting Minutes February 26, 2019 7:30 p.m. The Combined Work/Regular Public Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus, NJ on February 26, 2019. The meeting was called to order at 7:30 p.m. by Mayor Randall asked the Municipal Clerk to read the open public meeting statement: The Combined Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”, adequate notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. APPROVAL OF MINUTES A motion was offered by Councilman Iannelli, seconded by Councilman Policastro to approve the Minutes of the January 22, 2019 – Combined Meeting. Motion carried on a roll call vote – all present voting “Ayes, with the exception of Council President Troast & Councilman Shell who abstained. DEPARTMENT REPORTS Reports on file in the Clerk’s Office Police Report Court Report  Board of Health – Annual Report for 2018 PUBLIC COMMENTS Mayor opened the meeting to the public. He stated if anyone desired to be heard, please raise your hand to be recognized, come forward to the microphone and state your name and address for the record. Stanley Kober, 191 Washington Avenue Mr. Kober submitted a copy to the administrator and Mayor a manual from his perspective a compilation of Ho-Ho-Kus Historical facts. Resident also asked the Mayor and Council to consider approving the resolution (against NJ Senate Bill S-119) which he submitted to them via email last week. Mayor & Council will review. Mayor closed the meeting to the public. ADMINISTRATOR REPORT Administrator Jones reported the town was given a book about the Revolutionary War in Ho-Ho-Kus (part two) from a former resident to put in our case along with (part one). The resolution on for tonight 19-43 Brandywine/Valley Forge drainage improvement is for Phase 3, back in October there was a grant with the NJDOT where we received over $300,000 for phase 1 & 2. We are looking to extend that further, which would alleviate some other issues with the storm water. The Annual Richard Run’s is scheduled for October 13th. The 2016 paving project is scheduled to commence sometime in June 2019, which entails Franklin Turnpike from the Ho-Ho-Kus border all the way down to Race Track Rd/Route 17. In preparation for this project we will be replacing many of the water valves. The number one problem street is Jacqueline Avenue, which will be done under a separate County paving project. This has been expedited and is scheduled for the end of March or early April. A pre-construction meeting for this project is scheduled for March 18th. Regarding the Girl Scout Troop 95845 requesting to install a Pet Waste Station at two possible locations in town, after talking to the Animal Control Office and DPW Supervisor they determined distributing dog waste bags would not be a problem as long as a sign is posted on the bag dispenser reminding people to bring the dog waste back to their home receptacle as mandated by Borough Code. He attended a meeting yesterday on the Mayor’s behalf with Congressman Gottheimer where they discussed storm preparedness, government surplus equipment and federal grants that are available to potentially hire police and firefighters in the future. For next month he will have a resolution to take advantage of the government surplus equipment. Representative from FEMA assured him the flood maps will be available February 28th, 2019 and will go into effect August 28, 2019 which would grant our residents relief for flood insurance. Lastly, the administrator stated we paid off our 5.4 million dollar short term borrowing. We were renewed at 2.34% over the next 10 years. Will be introducing the budget next month. Section 80-11. Intent is amended to read: In recognition of the time and effort donated to the Borough and its citizens, it is the intent of this article to exempt certain volunteers defined in Section 80-12 from certain fees imposed by the Borough. Section II. Section 80-12. Definitions is amended to read as follows: As used in this article, the following terms shall have the meanings indicated: ACTIVE MEMBER – A resident of the Borough of Ho-Ho-Kus who is an active member in good standing in the Ho-Ho-Kus Volunteer Fire Department, the Ho-Ho-Kus Volunteer Ambulance Corps, the Office of Emergency Management, the Recreation Commission, the Shade Tree Commission, the Zoning Board of Adjustment, the Planning Board, the Library Board or the Board of Health. “Good standing” shall also include current compliance with all municipal, federal and safety mandated programs as may be applicable. FAMILY – No change. FEES – No change. VOLUNTEERS – Includes all active members of the Ho-Ho-Kus Fire Department, the Ho-Ho-Kus Volunteer Ambulance Corps, the Office of Emergency Management, the Recreation Commission, the Shade Tree Commission, the Zoning Board of Adjustment, the Planning Board, the Library Board and the Board of Health who have satisfactorily completed their probationary period, if applicable, and are in good standing either within their respective organizations or their board or commission memberships and whose property taxes or any receivables due to the Borough of Ho-Ho-Kus are not in arrears. Section III. Section 80-13. Establishment of fee exemptions - No change. Section IV. Section 80-14. Administration. A. Not later than January 10 of each calendar year, the Fire Chief of the Ho-Ho-Kus Volunteer Fire Department, the Captain of the Ho-Ho-Kus Volunteer Ambulance Corps, the Emergency Management Director, the Chairpersons of the Zoning and Planning Boards, the Chairpersons of the Recreation and Shade Tree Commissions, the Chairpersons of the Library Board and Board of Health shall submit to the Borough Clerk a list of all residents who meet the definition of an “active member in good standing” and whose property taxes or any receivables due to the Borough of Ho-Ho-Kus are not in arrears. Such list shall be updated on a periodic basis by the volunteer organization or boards to add those individuals who have completed their probationary status, as applicable, or to delete individuals who have been removed from membership or who no longer meet the criteria for active member status. B. - C. – No change. Section V. Section 80-15. Exclusions - No change. Section VI. Section 80-16. Interpretation - No change. Section 80-17. Severability. If any portion of this ordinance is adjudged unconstitutional or invalid by the Court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered. Section 80-18. Repealer. -3-  All other ordinances or parts of ordinances of the Borough which are inconsistent with this ordinance are hereby repealed but only to the extent of such inconsistencies. Section 80-19. Effective Date. This ordinance shall take effect upon passage and publication as required by law. PUBLIC HEARING Mayor opened the meeting to the public. He stated this is the time and place for the public hearing on Ordinance #2019-20 and all persons who wishes to be heard, please state your name and address before making your statement. Seeing none, the Mayor closed the meeting to the public. A motion was offered by Councilman Rorty and seconded by Councilman Iannelli to adopt Ordinance #2019- 20. INTRODUCTION OF ORDINANCES ORDINANCE #2018-21 AN ORDINANCE TO AMEND CHAPTER 85 (ZONING) OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HO-HO-KUS SO AS TO AMEND CERTAIN PROVISIONS RELATING TO BUSINESS AWNING SIGNS. BE IT ORDAINED, by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen and State of New Jersey, as follows: SECTION 1. Chapter 85, “Zoning”, shall be amended to amend certain provisions relating to business awning signs as follows: Section 85-37.2. Awnings, canopies and marquees. *** B. Prohibitions. *** (4) No lettering, logo or symbol identifying the business shall exceed eight (8) inches in height. The address numbers shall not exceed six (6) inches in height and shall be located within the bottom one- third (1/3) of the front of the awning, canopy or marquee on both sides. SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. SECTION 3. If any parts, sections, provisions, or the total of any of the above-mentioned publications are held to be invalid or unenforceable in any court, the findings or judgments of which court are applicable to the State of New Jersey, the balance and remainder of such publication shall remain in full force and effect. SECTION 4. This Ordinance shall become effective upon adoption and publication according to law. A motion was offered by Councilman Rorty and seconded by Council President Troast to approve Introduction of Ordinance #2019-21. Motion carried on a roll call vote – All present voting “Aye”. ORDINANCE #2018-22 AN ORDINANCE TO AMEND CHAPTER 85 (ZONING) OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HO-HO-KUS SO AS TO AMEND CERTAIN PROVISIONS RELATING TO DRIVEWAYS. BE IT ORDAINED, by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen, and State of New Jersey, as follows: SECTION I. Chapter 85, “Zoning”, shall be amended to amend certain provisions relating to residential driveways as follows: Section 85-32.3. Driveways. In all residential zones, all driveways accessory to residential dwellings shall comply with the following requirements: *** -4- B. The width of the driveway shall be at least eight (8) feet, and shall not exceed 20 feet within 16 feet of the curb line, including any adjacent parking areas or turning areas. The driveway may be widened to no more than 35 feet thereafter. Notwithstanding the foregoing, the width of circular or curved driveways shall not exceed 12 feet. The driveway shall be measured perpendicular to the normal direction of travel. If a residence has a three-car garage, a driveway width of not more than 32 feet shall be permitted from the entrance of the garage to 20 feet past the garage entrance, then transition to 25 feet wide (or 20 feet wide within 16 feet of the curb line) over the next five (5) feet of length. *** K. A parking space or parking area which is separate from the driveway shall not be permitted in front, side or rear yard required setbacks. SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. SECTION 3. If any parts, sections, provisions, or the total of any of the above-mentioned publications are held to be invalid or unenforceable in any court, the findings or judgments of which court are applicable to the State of New Jersey, the balance and remainder of such publication shall remain in full force and effect as an Ordinance of the Borough of Ho-Ho-Kus. SECTION 4. This Ordinance shall become effective upon adoption and publication according to law. ORDINANCE #2018-23 AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 75 OF THE HO-HO-KUS BOROUGH CODE ENTITLED “TOWING SERVICES” BE IT ORDAINED, by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen and State of New Jersey that Chapter 75 of the Code is amended as follows: Section I. Section 75-1 Definitions is amended, in part, as follows: STORAGE CHARGES FOR TWENTY-FOUR HOUR PERIOD - The maximum allowable amount to be charged by a storage facility for a calendar day or fraction thereof. A new 24 hour period begins at 12:01 a.m. TOW VEHICLES BASE OF SERVICE – The towing operator’s principal places of business where the tow vehicle is stationed when not in use. Section II. Section 75-4 Application Process is amended to read: A. (1) The name, residence and business addresses and telephone number of the owner of the towing company. If the owner is a corporation, the application shall contain the name, residence and business address and telephone number of every stockholder owning more than 10% of the issued stock. Section 75-4 C. (4) is amended to read: Neither the applicant nor the applicant’s personnel have been convicted of a criminal offense within the past year. Section III. The following subsections of Section 75-6 Minimum standards of performance are amended to read: A. (1)(c) One medium duty wrecker. (1)(d) One heavy-duty hydraulic wrecker one with at least 30 ton capacity and 3 stages under reach. A. (4) is amended to read: All equipment shall comply with all state and federal regulations and all vehicle operators shall possess a CDL license for over 26,000 pounds. B. Minimum equipment requirements: (5)(a) Towing operators’ vehicles shall display New Jersey commercial license plates and registrations issued to the licensed towing service. C. (1)(f) Not have been convicted of a crime within the past year. -5-  D. (1)(d) The storage area shall be in an area legally zoned for such use and shall have video surveillance. A certificate of occupancy for towing and storage use is required. (1)(e) The storage facility shall be available 24 hours a day, 365 days per year and shall be open to the public on weekdays during normal business hours and for four hours on Saturdays. The applicant shall specify the hours on which the facility will be open on Saturdays. The applicant is not required to be open on Sundays or Federal/State holidays. (1)(g) The hours of release for any impounded vehicles are Monday-Friday from 8:00 A.M. to 4:30 P.M. If the owner of the vehicle is requesting that the vehicle be released after hours, there will be a $75.00 fee for after-hours release when the tower is available to do so. Section IV. Section 75-10 Towing and storage fee schedule is amended to read: A. Fees for towing and storage of private passenger vehicles, damaged in an accident or recovered after being stolen, may not exceed the fees established by the New Jersey Department of Insurance. B. The following is a fee schedule for basic automobiles, motorcycles, motorized bikes, towing services and heavy-duty recovery. (1)(a) to (e) repealed. (2)(a), (b) repealed. (3) repealed. (1) Is amended to read as follows: To provide heavy vehicle recovery, the Borough of Ho-Ho-Kus requires that the licensee have on scene a recovery supervisor with Level 3 certification from the Towing and Recovery Association of America (TRAA) or another nationally recognized certification such as Wreck master. Section 75-10 G. is amended to add a new subsection (5): (5) Acceptance of credit/debit cards are at towing company’s discretion. A maximum of 4% service fee may be added to offset expenses. Credit/debit cards do not have to be accepted for any impounded vehicles. Section V. Severability. If any portion of this ordinance is adjudged unconstitutional or invalid by the Court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered. Section VI. Repealer. All other ordinances or parts of ordinances of the Borough which are inconsistent with this ordinance are hereby repealed but only to the extent of such inconsistencies. Section VII. Effective Date. This ordinance shall take effect upon passage and publication as required by law. CONSENT AGENDA RESOLUTIONS (19-40 thru 19-43) Resolution #19-40- Introduced by Council President Troast A Resolution – Payment of Bills WHEREAS, claims have been submitted to the Borough of Ho-Ho-Kus in the amount of $8,737,975.35; and WHEREAS, such claims have been listed according to Department and account number with corresponding vouchers to be reviewed and approved by the Mayor and Council; and, WHEREAS, the CFO has determined that the funds have been properly appropriated for such purposes and are available, in the Borough of Ho-Ho-Kus and that the claims specified on the schedule attached hereto, following examination and approval by the Mayor and Council, be paid and checks issued accordingly; and, NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Ho-Ho-Kus that the claims totaling $8,737,975.35 be approved and ratified respectively Resolution #19-41- Introduced by Council President Troast A Resolution – Interlocal Mutual Aid Agreement with Paramus WHEREAS, the borough of Ho-Ho-Kus and the Borough of Paramus seek to enter into an inter-local agreement with the Fire Departments for Mutual Aid; and -8- WHEREAS, the departments may on occasion need to call upon each other to provide service to each other in times of need; and, WHEREAS, the departments agree to provide each other with mutual aid when called upon to do so; and, NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the borough of Ho-Ho-Kus that it is hereby authorized to execute an agreement between the Borough of Paramus and the Borough of Ho-Ho-Kus Volunteer Fire Department. Resolution #19-42- Introduced by Council President Troast A Resolution – Grant Permission – Richard’s Run 2019 WHEREAS, the Borough of Ho Ho-Kus has received a request from Maggie Lilijegren of Ho-Ho-Kus requesting permission to hold the annual Richard’s Run/HHK 5K event in town on Sunday, October 13, 2019. WHEREAS, this incredible community and government support for this annual town-wide event is thrilled be celebrating the 16th running of Richard’s Run. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Ho-Ho-Kus, that permission is hereby granted to hold the Annual Richard’s Run of 2019. Resolution #19-43- Introduced by Council President Troast A Resolution – Approval to submit a grant application and execute a grant contract with the New Jersey Department of Transportation for the Brandywine/Valley Forge Drainage Improvement, Phase 3 project. NOW, THEREFORE, BE IT RESOLVED that the Council of the Borough of Ho-Ho-Kus formally approves the grant application for the above stated project. BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as MA-2019- Brandywine/Valley Forge Drainage I-00697 to the New Jersey Department of Transportation on behalf of the Borough of Ho-Ho-Kus. BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of Ho-Ho-Kus and that their signature constitutes acceptance of the terms and conditions of the grand agreement and approves the execution of the grant agreement. A motion was offered by Council President Troast and seconded by Councilman Crossley to approve Resolutions 19-40 through 19-43. Motion carried on a roll call vote – All present voting “Aye”. OLD BUSINESS - None LIAISON REPORTS Recreation – Councilman Iannelli reported the girls’ softball league is looking to change from fast pitch to slow pitch, reason being the registration numbers have gone down. The recreation travel baseball league is now merging with the “Bulldogs” which is a Highlands Team made up of Upper Saddle River & Allendale. School fields are still in major disrepair over at Lloyd Field. We are looking to replace or refurbish the baseball & football sheds around the track. Wrestling had a great season, had a 120 kids join. There is a special needs basketball team underway. There was a lot of talk at the meeting discussing our town is in desperate need of a Recreation Center. Cheerleading has a new president; they have 60 girls who cheer from flag all the way up to the 8th grade. Soccer & Lacrosse the numbers are very low. Numbers are down in all sports with the exception of the 7th grade boys. Board of Education – Councilman Policastro reported the meeting for the BOE is tonight, he has requested from the Board Secretary a copy of the agenda and minutes. -9- Ambulance Corp. – Councilman Crossley reported the Ambulance Corp had their meeting last night where (17) volunteers attended. They are still looking for members. Councilman questioned if we have call out of town one in particular Montvale if a driver goes through ez-pass how does the town account for that. Chief Minchin stated the police cars do have ez-pass and when they go on the parkway & turnpike we are not charged. Administrator will follow up getting the ex-pass. Councilman Crossley spoke of certificates and recertification that members are required to take and stated we are very fortunate to have a talented and well trained group of volunteers. Fire Department – Councilman Rorty explained they are updating their by-laws. Library – Councilman Policastro stated February meeting was cancelled, next meeting is scheduled for March 18th which he will be attending. Chamber of Commerce – Councilman Shell reported they elected their officers for 2019. They are planning a joint meeting with Waldwick Chamber of Commerce on March 19th. Taste of Ho-Ho-Kus is scheduled for June 5, 2019. Police – Chief Minchin report they are going through reaccreditation. Everything looks good, on-site inspection of the building is scheduled for March 11, 2019.
