Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes February 25, 2020 7:30 p.m. The Public Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus, NJ on February 25, 2020. The meeting was called to order at 7:30 p.m. by Mayor Randall who asked the Municipal Clerk to read the open a public meeting statement: The Public Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”. Notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Record and the Ridgewood News. FLAG SALUTE: Mayor Randall led those present in the salute to the American Flag. OFF-CONSENT RESOLUTION Resolution #20-44 – Introduced and read by Council President Troast A Resolution – An Appointment of a Councilmember to fill a vacancy WHEREAS, there presently exists a vacancy in the membership of the Governing Body by reason of the retirement of Councilman Philip Rorty, effective February 3, 2020; and WHEREAS, the Ho-Ho-Kus Republican County Committee has submitted three (3) nominees for the selection of a successor to fill the vacancy; and WHEREAS, the Governing Body has considered the matter; NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Ho-Ho-Kus that it hereby appoints Kathleen Moran as the councilperson to serve until the next general election in November, 2020, at which time the vacancy shall be filled for its unexpired term. A motion was offered by Council President Troast and seconded by Councilman Crossley to approve Resolution 20-44 through 20-44. Motion carried on a roll call vote – All present voting “Aye”. OATH OF OFFICE ADMINISTERED TO: Mayor Randall administered the Oath to newly appointed Councilwoman Kathleen Moran. APPROVAL OF MINUTES A motion was offered by Councilman Crossley, seconded by Councilman Shell to approve the minutes of January 28, 2020 Closed &Combined Meeting of the Mayor and Council. Motion carried on a roll call vote – all present voting “Ayes, with the exception of Councilman Policastro and Councilwoman Moran who abstained. PUBLIC DISCUSSION Mayor opened the meeting to the public. He stated if anyone desired to be heard, please raise your and to be recognized, come forward to the microphone and state your name and address for the record. 1  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes February 25, 2020 7:30 p.m. Mr. Van Orden, 61 Lloyd Road Mr. Van Orden explained he installed stanchions during the last phase of his new home construction. When the zoning officer came to do his inspection, he noticed the stanchions and told him it was not permitted. While it is relatively common throughout the borough, it appears that the ordinance does not specifically regulate them and he was advised to appear before the Mayor and Council to request the ordinance to be changed to allow stanchions/light posts. The Mayor and Council will take this matter under advisement. Monica Ludwig Ms. Ludwig updated the Mayor and Council regarding establishing an Environmental Commission/Green Team. She met with various Boards and Commission to discuss interest and involvement. Administrator Jones will inquire in more detail what is in involved by the municipality to establish this Commission. More information to follow. The Mayor closed the meeting to the public. ADMINISTRATOR’S REPORT Administrator reported on the following; Old Business Library – Borough closed out 2019 financial year. The 2020 new payment agreement with them has started. 1-9 East Franklin Turnpike Issues – This matter is due back in court next week. DOT Train Station – A meeting was held on February 19 th . It was not attended to be a public meeting as NJDOT and NJ Transit were on-site to review plans for the conversion of Warren Avenue (Brookside Avenue) from a two-way to one-way. However, the Village of Ridgewood had some concerns and invited the public, where there were approximately 40 concerned residents on the tracks. Since there were so many of the public that showed up NJDOT offered to come back to Ho-Ho-Kus Municipality to address the resident’s concerns. The end result of that meeting the Village of Ridgewood committed to a substantial improvement to the hill to widen the road. However, the NJDOT will still continue moving forward with their plans and will change back to two-way once that improvement is completed. Recycling – Last week the phone calls declined as he feels the residents are getting to understand the new schedule. He is still working on educational materials to be distributed sometime in March. Domestic Violence Policy – No update POS Ordinance – Mark Berninger the Zoning Official is reviewing, will have for introduction at the next Mayor and Council Public Meeting scheduled for March 24th, 2020. Water Meter replacements – In January 27, 2020 the borough started with (902) old meters to change and as of February 28,2020 (185) meters have been changed, (717) left. CORRESPONDENCE a) Village of Ridgewood – Notice of Public Hearing on Tuesday, March 3, 2020 regarding their Master Plan. b) Village of Ridgewood - Notice of demolition of the existing building and structures (565 North Maple Avenue ) Block 2904 – Lots 21,22,23,24,25,26 c) Letter from HHK Planning Board Attorney authorizing Burgis Associates to conduct a preliminary investigation for the project known as “Ho-Ho-Kus Crossing” proposed redevelopment area. 2  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes February 25, 2020 7:30 p.m. INTRODUCTION OF ORDINANCES ORDINANCE 2020-32 AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 85 OF THE BOROUGH CODE ENTITLED “Zoning” (Permit Fee for a real estate “For Sale Sign”) BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen and State of New Jersey as follows: Section I. Chapter 85-37K(4)(a) is amended and supplemented as follows: (a)(1) - (6) - No change. (a)(7) – The Permit Fee for a real estate “For Sale” sign is $50.00. All such fees heretofore collected are authorized and ratified. Section II. Severability If any portion of this ordinance is adjudged unconstitutional or invalid by the Court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered. Section III. Repealer All other ordinances of the Borough, or parts thereof, which are in conflict with this ordinance are hereby repealed to the extent of such conflict. Section IV. – Effective Date. This ordinance shall take effect upon passage and publication as required by law. A motion was offered by Councilman Shell and seconded by Councilman Crossley to approve the introduction of Ordinance #2020-32. Motion carried on a roll call vote – All present voting “Aye”. ORDINANCE 2020-33 AN ORDINANCE TO AMEND AND SUPPLEMTN CHAPTER 81 OF THE BOROUGH CODE ENTITLED (“Water and Water Rates) BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen and State of New Jersey as follows: Section I. Chapter 81-5(A) is amended to read: § 81-5. Application for water and service connections. A. Application for water supply or connections to existing mains shall be made to the Building Department by the customer or his duly authorized agent on blanks provided for the purpose, accompanied by remittance in the amount estimated to cover all costs incident to said connections, including the cost of the Borough street opening permit. The minimum charges shall be: three-fourths-inch service line: $1,000; and the one- inch service line: $2,500. If, however, the cost exceeds the estimated amount, the customer shall be liable for the additional amount. If the cost is less than the estimated amount, a refund shall be made for the difference up to the minimum charge. [Amended 1-23-1990 by Ord. No. 651; 12-21-1993 by Ord. No. 726; 3-25-2003 by Ord. No. 865] Section II. Chapter 81-6(C) is amended to read: § 81-6. Property on customer's premises. [Amended 1-23-1990 by Ord. No. 651] C. When a customer requires the service of the Department's employee after regularly scheduled working hours and the service required was not deemed to have been the Department's responsibility, the customer shall be charged at cost. [Amended 12-21-1993 by Ord. No. 726; 3-25-2003 by Ord. No. 865] Section III. Chapter 81-8(C)(1) and (2) are amended to read: § 81-8. Meters. C. (1) Five-eighths-inch and three-fourths-inch meter: at cost. C. (2) One-inch meter: at cost. Section IV. Chapter 81-11(A) is amended to read: § 81-11. Meter Tests & Adjustments. A. The Department will make a test of the accuracy of a meter upon request of a customer, once within a calendar year. If additional tests are requested, they will be at the expense of the customer at the rate of $100 per test. Section V. Chapter 81-27(A) and (B) Building Construction are hereby repealed. Section VI. Chapter 81-28 is amended to read: § 81-28. General construction and contracting. [Amended 12-21-1993 by Ord. No. 726; 3-25-2003 by Ord. No. 865] Unmetered service shall be charged at the rate of $100 per quarter or portion thereof. Section VII. Chapter 81-29(A) is amended to read: § 81-29. Charges not involving use of water. A. Resumption of service after discontinuance due to nonpayment of bills or violation of Article I of this chapter or for calls to premises served as provided under § 81-7B of Article I of this chapter: $250. [Amended 1-23-1990 by Ord. No. 651; 3-25-2003 by Ord. No. 865] Section VIII. Chapter 81-29(G) is amended to read: G. Missed appointments. Where a customer or his duly authorized agent makes an appointment for reading the water meter and fails to keep the appointment, a fee of $ 2 5 shall be charged. [Added 3-25-2003 by Ord. No. 865] Section IX. Chapter 81-29 is further amended by adding thereto new sub sections H and I to read as follows: H. The Water Department will perform a data log of the water meter upon the request of a customer, once within a calendar year. If additional data logs are requested, they will be at the expense of the customer at the rate of $ 25 per data log. A report giving the result of such recording will be made available to the customer, and a record of such recording will be kept. I . Minimum water service charged per quarter for properties that have well service and meter on premise and a water connection service. Section X. All other provisions of Chapter 81 not amended herein remain in effect. Section XI. LIAISON REPORTS Recreation – Councilman Iannelli reported; the Football/Cheer Association merged with Allendale and Upper Saddle River which will name go under a newly created organization call the Northern Highlands Jr. Football Team Football Leader Association. Councilman will be attending their meeting in March to discuss the new budget, by-laws and the use of the facilities and will report back to the Council. Library – Last month the Mayor & Council passed an endorsing resolution giving Worth Pinkham Memorial Library the green light to apply to the first round of grant solicitations through the Library Construction Bond Act. The Act 8  Borough of Ho-Ho-Kus County of Bergen Mayor and Council Public Meeting Minutes February 25, 2020 7:30 p.m. provides state bond grants for construction and renovation projects to Libraries throughout the state of NJ who are seeking capital improvements. The M&C supports this Grant application process. If the Library is successful in receiving a state grant the municipality is required to match funds 1 to 1. This governing body has made no commitment to underwrite capital improvements to the Library. No decision will be made until such time Grant funds are awarded - If they are awarded. We will then fully review the project at that time. The Grant application is non- binding, if it should come through it can be declined if Borough funds cannot be raised. We have encouraged the Library Board of Trustees to pursue all funding opportunities by working with the Friends of the Library for private funding to support its match. They may also solicit and receive other grants and funds from any private source to support its required share of the project. Board of Education – No report Ambulance Corp. – Councilman Crossley reported they had their monthly meeting last night. Discussed was updating the members on the VIP (Volunteer Incentive Program) as we have a lot of new volunteers coming through the system. They wanted to make the new members aware on what the program is all about and the benefits which included waving fees for pet licensing, fence permits, some construct permits and any other fees the borough can waive. Some of the volunteers have been attending seminars regarding the Coronavirus in order to be prepared going forward. Fire Department – No Report Chamber of Commerce - Councilman Shell reported the date for the Taste of Ho-Ho-Kus in scheduled for Wednesday, June 3rd, 2020. Funds raised from this event will be going into buying decorations to dress up the downtown business district around Christmas time. They elected the officers for 2020. MAYOR'S REMARKS NEW BUSINESS Budget – Administrator Jones along with CFO, Joe Citro gave an overview of the 2020 proposed Budget. The budget increased 5% over the 2019 level. This primarily reflects increases in police salaries, capital project, debt service and pension cost. The proposed tax rate reflects a three-point increase from 2019. This would result in a $223.00 increase in taxes on an average home valued at $746,779. The current debt level is $6.49 million with an interest rate of 2.3% and will be paid back in annual installments ending in 2029. There was a budget surplus balance of $3.5 million at the end of 2019, of which $1,000,000 is being used to partially offset the tax rate increase. The 2020 Budget revenues and appropriations were also discussed. Budget introduction is scheduled for March 24th, 2020 at the Public Meeting of the Mayor and Council.
