Borough of Ho-Ho-Kus County of Bergen Mayor and Council Special Meeting November 8, 2018 7:30 p.m. The Special Meeting of the Municipal Council of the Borough of Ho-Ho-Kus was held in the Municipal Building at 333 Warren Avenue, Ho-Ho-Kus, NJ on November 8, 2018. The meeting was called to order at 7:30p.m. by Mayor Randall who asked the Municipal Clerk to read the open public meeting statement: The Special Meeting of the Mayor and Council of the Borough of Ho-Ho-Kus is now in session in accordance with the provisions of Section 5 of the “Open Public Meetings Act”, adequate notice of this meeting has been posted in the front lobby entrance to the Borough Hall and Council Chambers, a copy has been filed with the Borough Clerk, and copies of the Annual Notice of Meetings, of which this is a part, have been heretofore sent to the Ridgewood News. CONSENT RESOLUTIONS (18-121 thru 18-123) Resolution #18-121- Introduced by Council President Troast A Resolution – Liquor License Person-to-Person Transfer WHEREAS, an application has been filed for a Person-to-Person Transfer of Plenary Retail Distribution License Number 0228-44-004-005, heretofore issued to Russack Inc. for premises located at 626 North Maple Avenue, Ho-Ho-Kus, New Jersey; WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term; WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statues, regulations promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33; WHEREAS, the applicant has disclosed and the issuing authority reviewed the source of all funds used in the purchase of the license and the licensed business and all additional financing obtained in connection with the license business; NOW, THERFORE BE IT RESOLVED that the Borough of Ho-Ho-Kus Governing Body does hereby approve, effective November 13, 2018, the transfer of the aforesaid Plenary Retail Distribution License to Hohokus High Spirits Inc., and does hereby direct the Borough Clerk/A.B.C. Board Secretary to endorse the license certificate to the new ownership as follows: “This license, subject to all its terms and conditions, is hereby transferred to Hohokus High Spirits Inc., effective November 13, 2018”. Resolution #18-122- Introduced by Council President Troast A Resolution – CDBG Agreement-Stone Ridge Lane Roadway Improvements BE IT RESOLOVED, that the Mayor and Council of the Borough Ho-Ho-Kus wishes to enter into a grant agreement with the County of Bergen for the purpose of using $36,000 in 2019 Community Development Block Grant Funds for Stone Ridge Lane Roadway Improvements located at Stone Ridge Lane, Ho-Ho- 1 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Special Meeting November 8, 2018 7:30 p.m. Kus, NJ 07423. BE IT FURTHER RESOLVED, that the Mayor and Council hereby authorizes the Mayor, Administrator, Borough Clerk to be a signatory for the aforesaid grant agreement; and BE IT FURTHER RESOLVED, that the Mayor and Council hereby authorizes the Mayor, Administrator, Borough Clerk to sign all County Vouchers submitted in connection with the aforesaid project; and BE IT FURTHER RESOLVED, that the Mayor and Council recognizes that the Borough of Ho-Ho-Kus is liable for any funds not spent in accordance with the Grant Agreement; and that liability of the Mayor and Council is in accordance with HUD requirements. Resolution #18-123- Introduced by Council President Troast A Resolution – Grant Permission-Holiday Sleigh Ride WHEREAS, the Borough of Ho Ho-Kus has received a request from Contemporary Club of Ho-Ho-Kus requesting permission to hold a Holiday Sleigh Ride with a Horse Drawn Wagon Ride. The Community event and fundraiser hosted by the Contemporary Club of Ho-Ho-Kus is scheduled for Sunday, December 30th, 2018 from the times of 2:00pm – 6:00pm. with a pre-determined rain date TBD. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Ho-Ho-Kus, that permission is hereby granted to hold a Holiday Sleigh Ride event. A motion was offered by Council President Troast and seconded by Councilman Iannelli to approve Resolutions 18-121 through 18-123. Motion carried on a roll call vote – All present voting “Aye”. PUBLIC DISCUSSION Mayor opened the meeting to the public. He stated if anyone desired to be heard, please raise your and to be recognized, come forward to the microphone and state your name and address for the record. Seeing none, The Mayor closed the meeting to the public. INTRODUCTION OF ORDINANCES: ORDINANCE #2018-13 ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 79 OF THE CODE ENTITLED “VEHICLES AND TRAFFIC” BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen and State of New Jersey, that Section 79-18 of the Code Permits is hereby amended as follows: Section I A. No change. B. The fee to be charged by the Borough Clerk for the resident permits shall be $375.00 and businessman permits shall be $100.00. No fee shall be required for permits issued to Borough employees for parking during the regular course of business in Municipal Lot B. C.-F. No change. Section II Repealer All other provisions of this Ordinance which are not affected by this amendatory Ordinance are hereby ratified and confirmed and shall remain in full force and effect. However, all ordinances or parts of ordinances, which are inconsistent with the provisions of this amendatory Ordinance, are hereby repealed to the extent of such inconsistency. Section III Severability 2 Borough of Ho-Ho-Kus County of Bergen Mayor and Council Special Meeting November 8, 2018 7:30 p.m. If any portion of this Ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this Ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered. Section IV Effective Date This ordinance shall take effect after final passage and publication as required by law. A motion was offered by Council President Troast and seconded by Councilman Iannelli to approve Introduction of Ordinance #2018-13. Motion carried on a roll call vote – All present voting “Aye”. ORDINANCE #2018-14 ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 13 OF THE CODE ENTITLED “CATS” BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen and State of New Jersey, that Section 13-3 G. of the Code License Fee Schedule is hereby amended as follows: Section I 13-3 G. License Fee Schedule. The cat license annual fee shall be $20.00 for each non-altered or altered cat. There will be a $5.00 renewal fee for each additional cat after three (3). The cat license shall expire on the last day of January in each year. Persons, who fail to obtain a license and registration tag, as required, prior to February 28 in each year, will be subject to a late fee based upon the following schedule: Late Fee Schedule (after 2/28): 3/1 - 3/31 $10.00 + License Fee 4/1 - 4/30 $15.00 + License Fee 5/1 - 5/31 $20.00 + License Fee 6/1 - 6/30 $25.00 + License Fee 7/1 - 7/31 $30.00 + License Fee 8/1 - 8/31 $35.00 + License Fee 9/1 – 9/30 $40.00 + License Fee 10/1 – 10/31 $45.00 + License Fee 11/1 – 11/30 $50.00 + License Fee 12/1 – 12/31 $55.00 + License Fee No license fee shall be prorated for any portion of the licensing year. Volunteers serving the Borough shall be exempt from the foregoing fees. Section II Repealer All other provisions of this Ordinance which are not affected by this amendatory Ordinance are hereby ratified and confirmed and shall remain in full force and effect. However, all ordinances or parts of ordinances, which are inconsistent with the provisions of this amendatory Ordinance, are hereby repealed to the extent of such inconsistency. Motion carried on a roll call vote – All present voting “Aye”. ORDINANCE #2018-15 ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 18 OF THE CODE ENTITLED “DOGS” BE IT ORDAINED by the Mayor and Council of the Borough of Ho-Ho-Kus, County of Bergen and State of New Jersey, that Section 18-3 A. of the Code Fees; expiration of tags. is hereby amended as follows: Section I 18-3 A. The person applying for the license and registration tag of a dog shall pay the annual fee for such license of $20.00 whether or not the dog is neutered/spayed. For each annual renewal, the fee for the license and registration tag shall be the same as for the original license and tag, and said licenses, registration tags and renewals thereof shall expire on the last day of January in each year.
