CITY OF HOBART BOARD OF ZONING APPEALS MINUTES OF JANAURY 3, 2013 Mr. Dan Waldrop called the meeting to order at 6:05 p.m. with the recitation of the Pledge of Allegiance. Members in attendance: Mr. Dennis Zoladz, Mr. Ron Jackson, Mr. Dan Waldrop and Mr. Stuart Allen. Member absent: Mr. Greg Lollis Also in attendance: Mr. Jake Dammarell, Assistant City Engineer; Mr. Aj Bytnar, City Planner/Zoning Administrator and Ms. Joy Respecke, Recording Secretary. Election of Officers: Mr. Allen made a motion to retain Mr. Waldrop as Chairman, seconded by Mr. Jackson. All ayes, motion carried. (4-0) Mr. Jackson made a motion to nominate Mr. Zoladz for Vice- Chairman, seconded by Mr. Waldrop. All ayes, motion carried. (4-0) Mr. Allen made a motion to retain Mr. Jackson for Secretary, seconded by Mr. Zoladz. All ayes, motion carried. (4-0) Approval of Minutes: Mr. Allen made a motion to approve the minutes of December 6, 2012 as presented, seconded by Mr. Jackson. All ayes, motion carried. (4-0) Communications/Acceptance of Agenda: Mr. Bytnar requested to Table Petitions 12-18 & 12-19. Mr. Jackson made a motion to approve the agenda as amended, seconded by Mr. Zoladz. All ayes, motion carried. (4-0) New Business 1. 12-18 All About Storage/Caroline Yanovic (Petitioner/Owner) 2300 E. State Rd. 130 located 200’ east of the NE corner of St. Rd. 130 & Sullivan St., zoned M-1, 15.44 acres. Request: Tabled; Public Hearing: A petition for a Developmental Standards Variance, Sec. 154.006 (G(5)(a) Purpose: To allow existing barbed wire on top of 6’ chain link fence Approved ___ Denied __ Deferred X Vote ___ Tabled at acceptance of agenda. 2. 12-19 All about Storage/Caroline Yanovic (Petitioner/Owner) 2300 E. State Rd. 130 located 200’ east of the NE corner of St. Rd. 130 & Sullivan St., zoned M-1, 15.44 acres. Request: Tabled; Public Hearing: A petition for Developmental Standards Variance, Sec. 154.358 (G)(2) Purpose: To allow existing gravel in outdoor storage parking area Approved ___ Denied __ Deferred X Vote ___ Tabled at acceptance of agenda. 3. 13-01 View Outdoor Advertising, LLC (Petitioner) 3198 E. 81st Ave., located on the NW corner of Colorado Street & 81st Avenue, zoned B-1, 0.0690 acre. Request: Public Hearing: Conditional Use, Sec. 154.713 (B)(1) Purpose: To allow a 65’ high 14’x48’ tri-fold digital &/or static offsite billboard sign. Approved X Denied __ Deferred __ Vote 4-0 Representing View Outdoor Advertising was Attorney Richard Anderson, 9211 Broadway, Merrillville. He noted the property had recently been approved by the Common Council to rezone from B-1 to B-3 to allow the off-site billboard sign. He also noted the sign will not obstruct existing signs in the area. Mr. Waldrop opened and closed the Public Hearing for Petition 13-01 without public comments. Mr. Bytnar reminded the Board that their decision is contingent upon the determination of the Plan Commission. Mr. Jackson made a motion to Approve Petition 13-01 contingent upon the Plan Commission’s determination including all discussion and findings of fact, seconded by Mr. Zoladz. All ayes, motion carried. (4-0) Staff Consultation/Discussion: Mr. Bytnar noted revisions are being made to the Rules of Procedure. Mr. Waldrop acknowledged Mr. Bytnar’s last meeting and applauded his accomplishments during his time as City Planner. Mayor Snedecor also thanked Mr. Bytnar for his accomplishments and noted Mr. Carroll Lewis will be acting as City Planner/Zoning Administrator until a replacement is hired. Hearing no further comments or discussion Mr. Jackson made a motion to adjourn, seconded by Mr. Allen. All ayes, motion carried.
