CITY OF HOBART BOARD OF ZONING APPEALS
MINUTES OF JANUARY 7, 2016
Dan Waldrop called the meeting to order at 6:05 p.m. with the recitation of the Pledge of Allegiance.
Members in attendance: Dan Waldrop, Dennis Zoladz, Ron Jackson, Mark Kopil and Stuart Allen. Also
in attendance: Phil Gralik, City Engineer; Sergio Mendoza, City Planner; Carroll Lewis, Zoning
Administrator and Joy Respecke, Recording Secretary.
Election of Officers: Mr. Jackson made a motion to retain the 2015 officers, seconded by Mr. Kara. All
ayes, motion carried. (5-0) Mr. Waldrop/Chairman; Mr. Zoladz/ Vice-Chairman; and Ron
Jackson/Secretary
Approval of Minutes: Mr. Kopil made a motion to approve the minutes of December 3, 2015 as
presented, seconded by Mr. Zoladz. All ayes, motion carried. (5-0)
Communications/Acceptance of Agenda: Mr. Jackson made a motion to approve the agenda as presented,
seconded by Mr. Allen. All ayes, motion carried. (5-0)
New Business
1. 16-01 Christopher DeRisi (Petitioner/Owner) 3665 Kingsway Drive, Crown
Point regarding 1107 State Street located 60’ from the SE corner of State &
11th Streets, Sec. 154.006(G)(5)(a), zoned R-2, 0.18 acre
Request: Public Hearing: Developmental Standards Variance
Purpose: A proposed 42” high chain link fence located in the front yard
Approved X Denied __ Deferred ___ Vote 5-0
Christopher DeRisi, 3665 Kingsway Drive, Crown Point mentioned he purchased the property in July
2015 as rental property. The house is located on the rear of the property providing no rear yard. He is
requesting to install a chain link fence across the front yard to allow his tenants security for their children
and possibly a dog. So as to not inconvenience the visual aesthetics of the neighbors, he will not install
the fence past the front of the neighboring houses.
Mr. Waldrop opened and closed the public hearing for Petition 16-01 without public comments.
Mr. Lewis noted accessory structures, including dog houses, are not permitted in front yards.
Mr. Allen made a motion that due to the particular circumstances of the property to Approve Petition 16-
01 with the stipulations the fence is installed 5’ back from the front of the neighboring houses to the north
and south and parallel with the public sidewalk including all discussion and findings of fact, seconded by
Mr. Jackson. (5-0)
Staff Consultation/Discussion: Discussion included rectifying the ordinance to include that fences must
be set 2’ from sidewalks into the yard and also complaints received regarding garbage cans being left in
front yards and not returned to the side or rear yards after. Mr. Zoladz commended Mr. Lewis for
contacting View Outdoor Signs to comply with the stipulations regarding the billboard sign approval on
37th Avenue & Maxwell Street.
There being no further comments Mr. Jackson made a motion to adjourn, seconded by Mr. Kopil. All
ayes, motion carried. (5-0)
