CITY OF HOBART BOARD OF ZONING APPEALS MINUTES OF NOVEMBER 3, 2016 Stuart Allen called the meeting to order at 6:05 p.m. with the recitation of the Pledge of Allegiance. Members in attendance: Scott Gregory, Mark Kopil and Stuart Allen. Members absent: Maria Galka and Ron Jackson. Also in attendance: Phil Gralik, City Engineer; Sergio Mendoza, City Planner; Carroll Lewis, Zoning Administrator and Joy Respecke, Recording Secretary. Approval of Minutes: Mr. Kopil made a motion to approve the minutes of October 6, 2016 as presented, seconded by Mr. Gregory. All ayes, motion carried. (3-0) Communications/Acceptance of Agenda: Mr. Mendoza distributed the schedule for the public community workshop session regarding the Parks Master Plan as well as the survey. Mr. Kopil made a motion to approve the agenda as presented, seconded by Mr. Gregory. All ayes, motion carried. (3-0) New Business 1. 16-11 Nikola Pejnovic (Petitioner/Owner) 1205 S. Decatur Street, located 1/3 mile th south of 10 Street on Decatur Street, Sec. 154.006(F)(7), zoned R-1 1.643 acre Request: Public Hearing: Developmental Standards Variance Purpose: To exceed the permitted 2 accessory structures for a proposed 40’x60’ pole barn Approved X Denied __ Deferred ___ Vote 3-0 Nikoa Pejnovic , 219-880-5867 requested a 40’x60’ pole barn to be used for storage. The height will not exceed 15’ at the peak. Mr. Allen opened the public hearing for Petition 16-11. Lino Maggio, 849 Lake Street: Mr. Maggio spoke in favor of the 3rd accessory structure. He felt it would aesthetically fit on the property since NIPSCO and the woods border the property. Hearing no additional public comments Mr. Allen closed the public hearing. Mr. Mendoza noted this is a variance for a third structure and inquired to the size of an existing detached structure. Mr. Pejnovic stated in addition to his 3-car attached garage he increased the size of the previous owner’s shed to 18’x20’. Mr. Mendoza instructed him to obtain a permit for the existing structure as the City or the Assessor’s Office has record of the shed. Mr. Kopil made a motion to Approve Petition 16-11 including all discussion and findings of fact, seconded by Mr. Gregory. All ayes, motion carried. (3-0) 2. 16-10 Nikola Pejnovic (Petitioner/Owner) 1205 S. Decatur Street, located 1/3 mile south of 10th Street on Decatur Street, Sec. 154.006(F)(5), zoned R-1 1.643 acre Request: Public Hearing: Developmental Standards Variance Purpose: To exceed the permitted 2,097 sq. ft. for accessory structures by 1,407 sq. ft. for a proposed 40’x60’ pole barn Approved X Denied __ Deferred ___ Vote 3-0 Mr. Allen opened the public hearing for Petition 16-10. Lino Maggio, 849 Lake Street: Mr. Maggio spoke in favor of the square foot variance. Hearing no additional public comments Mr. Allen closed the public hearing. Mr. Gregory made a motion to approve Petition 16-10 including all discussion and findings of fact, seconded by Mr. Kopil. All ayes, motion carried. (3-0) 3. 16-12 Fotis Vardaros (Petitioner/Owner) 13900 Limerick Dr. St John for property at 8433 Minnesota St located on the NE corner of Minnesota St. & 84th Pl. Sec. 154.224, zoned M-1, 2 acres. Request: Public Hearing: Developmental Standards Variance Purpose: To encroach into the 30’ building line for a proposed 6’ chain link fence Approved X Denied __ Deferred ___ Vote 3-0 Ms. Vardaros, 13900 Limerick Dr., St. John, 219-558-0507 requested to encroach into the building line with a proposed 6’ chain link fence. Mr. Allen opened and closed the public hearing for Petition 16-12 without public comments. Mr. Kopil made a motion to approve Petition 16-12 including all discussion and findings of fact, seconded by Mr. Gregory. All ayes, motion carried. (3-0) 4. 16-13 Anthony Latta (Petitioner/Owner) 3420 E. 73rd Avenue located approx. 800’ east from the NE corner of 73rd Avenue & Colorado Street, Sec. 154.358(E)(3), zoned R-2, 1.86 acres Request: Public Hearing: Developmental Standards Variance Purpose: A proposed 2nd street cut Approved X Denied __ Deferred ___ Vote 3-0 Anthony Latta, 3420 E. 73rd Avenue mentioned they are proposing to construct an addition consisting of living area over a garage on the east end of the house. He stated they purchased the adjacent lot to the east in order to gain access to the attached garage and requested a second driveway cut. Mr. Allen opened and closed the public hearing for Petition 16-13 without comments. Discussion ensued regarding the proposed addition not conforming to the minimum 8’ side yard setback and would need to combine the two lots for a 1 lot Page 2 BZAmin 11/3/16 subdivision. In addition should the east lot ever be sold separately, they would not have access to the proposed garage. Ms. Latta noted they will not connect the west and proposed east driveways as the submitted site plan indicated. Mr. Gregory made a motion to Approve Petition 16-13 including all discussion and findings of fact, seconded by Mr. Kopil. All ayes, motion carried. (3-0) Staff Consultation/Discussion: Mr. Mendoza mentioned to the residents in the audience that the information for the Parks Master Plan were available in the Council Chambers and on the City’s website. There being no further comments or discussion Mr. Kopil made a motion to adjourn, seconded by Mr. Gregory. All ayes, motion carried.
