CITY OF HOBART BOARD OF ZONING APPEALS MINUTES OF JANUARY 4, 2018 Stuart Allen called the meeting to order at 6:00 p.m. with the recitation of the Pledge of Allegiance followed by a moment of silence. Members in attendance: Stuart Allen, Mark Kopil, Ron Jackson, Jason Spain and Scott Gregory. Also in attendance: Phil Gralik, City Engineer, Carroll Lewis, Zoning Administrator and Joy Respecke, Recording Secretary. Absent: Sergio Mendoza, City Planner Election of Officers: Mr. Kopil motioned to retain Stuart Allen, Chairman; Mark Kopil, Vice-Chairman and Ron Jackson, Secretary, seconded by Mr. Jackson. All ayes, motion carried. (5-0) Approval of Minutes: Mr. Gregory motioned to approve the minutes of November 2, 2017 as presented, seconded by Mr. Jackson. All ayes, motion carried. (5-0) Communications/Acceptance of Agenda: Mr. Jackson motioned to approve the agenda as presented, seconded by Mr. Spain. All ayes, motion carried. (5-0) New Business 1. 18-01 Outdoor One LLC/Lou O’Donnell (Petitioner/Agent) for 4681 W. 61st Ave. located 200’ west from the SW corner of 61st Ave. & Marcella Blvd. Sec. 154.173(B)(1), zoned B-3, 1.299 acres Request: Public Hearing: Conditional Use Purpose: Proposed 10’x30’ billboard sign Approved ___ Denied X Deferred ___ Vote 5-0 Mr. O’Donnell proposed to construct a 300 sq. ft. billboard 35’ in height on property owned by Taco Bell. He noted that he received one letter in support and two opposing the proposed billboard. The opposing letters were from the adjacent Arbys restaurant. He mentioned that he spoke with the landowner and addressed his concerns that the proposed billboard would interfere with the existing Arby’s sign, building and with competitive content. Mr. O’Donnell felt that it would not impede the Arby’s property. Mr. Lewis noted that although billboards are permitted with conditional use approval in a B-3 District but sited Sec. 154.382 that states billboards offering products sold off-site are prohibited and must indicate a hardship should the Board deny the request. Mr. Allen opened and closed the public hearing for Petition 18-01 without public comments. Mr. Spain felt the proposed billboard would be injurious to the adjacent property owners and additional billboards along the 61st Avenue corridor is unwanted. Mr. Spain motioned to Deny Petition 18-01 including all discussion and Findings of Fact, seconded by Mr. Kopil. All ayes, motion carried. (5-0) Staff Consultation/Discussion: None There being no further comments or discussion Mr. Allen motioned to adjourn, seconded by Mr. Jackson. All ayes, motion carried.
