All present. 2. Invocation - Pastor Rev. Dr. John Duncan of the Church at Horseshoe Bay provided the invocation. 3. Pledges to the Flags - Mayor Clinesmith led the pledges of allegiance to the United States flag and the Texas flag. 4. Announcements and Staff Recognition A. City wins TAMIO Communications Award for the Oak Wilt Prevention Campaign – City Manager Jeff Koska announced the award and recognized Communications Director Dan Herron. B. November 7, 2023 City Council General Election – Legislative Services Director Kerri Craig announced the details of the upcoming election. 5. Public Comment – Carrie Pickering from Linebarger presented checks from excess proceeds from tax sales. Bill Gaylord spoke regarding FM 2147 traffic and lot clearing. 6. Presentations Informational only; no action to be taken. A. Fiscal Year 2023 Third Quarter Financial Report – Finance Director Chris Thomas provided a report, which is on file. No action taken. 7. Public Hearing Items Public Hearing and possible action regarding: A. Ordinance 2023-31: Amending Ordinance 2017-18, Which Established Land Use Assumptions, Capital Improvements Plans and Impact Fees to be Assessed by the City of Horseshoe Bay, Texas; Updating the Land Use Assumptions, Capital Improvements Plan and Impact Fees for Water and Wastewater Utilities; Providing for a Penalty for the Violation of this Ordinance; Providing for Repealing, Savings and Severability Clauses; Providing for an Effective Date of this Ordinance; and Providing for the Publication of the Caption Hereof – Utilities Director Rick Williams and Grady Reed from HDR Engineering provided a report, which is on file. Mayor Clinesmith opened a public hearing at 3:22pm. No one spoke. Mayor Clinesmith closed the public hearing at 3:53pm. Council Member King motioned to approve Ordinance 2023-31 and set the impact fee of $3,913.00 for water service and $2,633 for wastewater service. Council Member Hosea seconded. 1  VOTE: 5-0 in favor, motion passed. B. Ordinance 2023-34: Voluntarily Annexing Approximately 99.237 Acres (Silver Rock) of Land Adjacent and Contiguous Territory Into the Incorporated Municipal Boundaries of the City of Horseshoe Bay, Texas Including the Following: Findings of Fact; Effective Date; Repealer; Severability; and Proper Notice and Meeting Clause – City Manager Koska provided a report, which is on file. Mayor Clinesmith opened a public hearing at 3:55pm. No one spoke. Mayor Clinesmith closed the public hearing at 4:01pm. Council Member Hosea motioned to approve Ordinance 2023-34 and the request for voluntary annexation of the 99.237 acres of land as described in the boundary survey. Council Member Waddill seconded. VOTE: 5-0 in favor, motion passed. C. Ordinance 2023-32: Rezoning 99.237 Acres out of the E. Mercer Survey No. 4 Abstract 563, Also Known As 24435 E. Hwy 71 (Silver Rock) From A-1 Recreational to GH Garden Home, R-6 Apartment, Townhouse, Cottage, C-2 General Commercial; Amending the Zoning Map for Zone 3 Horseshoe Bay West; and Providing for Findings of Fact, Repealer, Severability, Effective Date, and Public Notice and Meeting – City Manager Koska provided a report, which is on file. Mayor Clinesmith opened a public hearing at 4:02pm. No one spoke. Mayor Clinesmith closed the public hearing at 4:05pm. Council Member Hosea motioned to approve Ordinance 2023-32 with a written amendment to remove the apartments zoning. Mayor Pro Tem Thurman seconded. VOTE: 5-0 in favor, motion passed. 8. Business Discuss, Consider, and Possibly Take Action Regarding: A. Propose the 2023 Tax Rate – Finance Director Thomas provided a report, which is on file. Council Member Jones motioned to propose the maximum tax rate of $.27000 per $100 taxable valuation be used in the preparation of the fiscal year 2024 budget. Council Member Hosea seconded. VOTE: 5-0 in favor, motion passed. B. Request for a 7th Building Permit Extension for the Property Located at 100 Lighthouse Drive, Randy Cate, Applicant – Development Plans Examiner Christina Reinhardt provided a report, which is on file. Council Member Waddill motioned to approve the request from Randy Cate for a 7th building permit extension for 100 Lighthouse Drive for a period of 75 days for a fee of $22,500. Council Member King seconded. VOTE: 5-0 in favor, motion passed. C. Merit Compensation Adjustments – Human Resources Director Rachel Hearne provided a report, which is on file. Mayor Pro Tem Thurman motioned to approve the staff recommended total merit adjustment of $230,226 or 3%. Council Member Jones seconded. VOTE: 5-0 in favor, motion passed. 9.
